CITY COUNCIL OF THE CITY OF DOWNEY
REGULAR MEETING
DECEMBER 11, 2012
The City Council of the City of Downey held a Regular Meeting at 6:30 p.m., December 11, 2012, in
the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California, Mayor
Brossmer presiding.

The Invocation was delivered by Father Mark Warnstedt, Our Lady of Perpetual Help Church. The
Flag Salute was led by Lieutenant Colonel Peterson, of the U.S. Army.
WELCOME AND FINAL ADDRESS
Mayor Brossmer recognized previous Mayors: Perkins, Kartozian, Gafin, and Representatives from
local Legislative Offices and the community that were in the audience. He presented a Power Point
Presentation highlighting events and accomplishments from the past year: balancing of the 2012/2013
City budget; the relocating of the space shuttle mock -up, "Inspiration "; the Space Shuttle Endeavourfly-
over; the many traveling exhibits hosted at the Columbia Memorial Space Center. He reported on a few
improvement projects: the fencing at the Columbia Memorial Space Center and the Lakewood
Boulevard and Florence Avenue street improvements. He mentioned the Grand Opening of the Downey
Art Vibe Stay Gallery; the re- dedication of the Downey Skate Park to the Meredith H. Perkins Skate
Park; the ground breaking event at Treasure Island Park. He mentioned that the City was able to secure
$1.5 million in grant funds; the success of the Military Banner Program; and, the unveiling and
dedication of the Veterans Memorial Eternal Flame Monument. He stated he looked forward to a bright
future with the much anticipated Tierra Luna Project and thanked the citizens for the honor of allowing
him to be their Mayor. He thanked his family for all of their support and welcomed incoming Mayor Dn.

SPECIAL PRESENTATIONS TO OUTGOING MAYOR BROSSMER

The following guest presented Mayor Brossmer a Certificate of Recognition: Field Representative
Kimberlee Tachiki of Assembly Member Roybal- Allard's office; City of Bellflower Mayor Koops; City of
Commerce Council Member Robles; Downey Unified School District Board President LaPlante, Board
Member Gutierrez, and Superintendent Dr. Doty; California Contract Cities Association Representative
Guerra; Downey Rose Float Association Representative DeRemer; Relay for Life Representative
McGee; and, Downey Rotary Club Representative Andazola. Los Angeles County Supervisor Knabe
presented a scroll in honor of many years of service to the City; Downey Chamber of Commerce Vice
President Trombley presented a plaque in honor of the Mayor's work with the Business Community;
and, Stay Gallery Representative Flores presented a special photograph in honor of Mayor Brossmer
and all of his hard work and dedication.
The following were unable to attend but sent Mayor Brossmer plaques in recognition of his service
to the City of Downey: City of Cerritos, City of Lynwood, and City of Lakewood.
ADMINISTRATION OF OATH OF OFFICE TO MAYOR MARIO A. GUERRA
Los Angeles County Supervisor Don Knabe administered the Oath of Office to Mayor Guerra.
PRESENTATION
Mayor Guerra recognized his business partners Neumann, Lorch, and Roth who were in the
audience and thanked them for their support. He stated being honored of having Los Angeles County
Supervisor Knabe perform the swearing in. He recognized past Mayors Kartozian, Perkins, Gafin, and
Brossmer. He thanked all of his friends and especially his family for all of their support. He presented a
PowerPoint Presentation highlighting some of his future goals: the Healthy Downey Campaign and
introduced Matthew Ware as his mentor for a healthier lifestyle; the commencing of "Mayor's Walking
Wednesdays" to encourage the community to exercise; a voluntary weighing in prior to City Council
Meetings. He thanked local sponsors for joining the City in the Healthy Downey Program: Kaiser
Permanente, Downey YMCA, Applecare Medical who donated the scale, and the Coca Cola Company.
He thanked the Downey Unified School District and Superintendent Dr. Doty for partnering with the City
and adopting the six pillars of Character. He stated that the City will have more walking paths for the
community to enjoy. He thanked the Police Department and recognized Police Chief Charles; he
thanked the Fire Department and recognized Fire Chief Croom; he recognized U.S. Army Lt. Peterson.
He reported on future projects: The Tierra Luna Project, the Downey Gateway Project, Rancho Los
Amigos, The View Project and other projects on Firestone Boulevard. He mentioned the relocating of
the space shuttle mock -up, "Inspiration "; the Diakonia Award he and his wife started that encourages
high school students to participate in Community Service; the successful Military Banner Program; the
Fallen Officer Memorial; and, the unveiling and dedication of the Veterans Memorial Eternal Flame
Monument. He recognized his wife and family that was in the audience and thanked them for all of their
love and great support and stated he was honored and proud of being the next Mayor.
ADDITIONAL PRESENTATIONS
Mayor Guerra presented former Mayor Brossmer a City of Downey Former -Mayor Pin; a plaque in
honor of his service to the City, and a scrap book highlighting his accomplishments as Mayor.

RECESSED /RECONVENED
Mayor Guerra recessed the Adjourned Regular City Council Meeting at 8:17 p.m. to hold the
Successor Agency to the Former Community Development Commission Meeting.
Mayor Guerra reconvened the Adjourned Regular City Council Meeting at 8:54 p.m. with all Council
Members present.
COUNCIL MEMBER ANNOUNCEMENTS; REQUESTS FOR FUTURE AGENDA ITEMS; AND
CONFERENCE /MEETING REPORTS
Council Member Saab stated he looked forward to working with Mayor Guerra and the rest of the
City Council.
Council Member Marquez congratulated in- coming Mayor Guerra.

PUBLIC HEARING: None.
NON - AGENDA PUBLIC COMMENT
Lars Clutterham, resident, spoke about the Heal the Cities Campaign and requested the City
continue their support and stated it was in line with the City's Healthy Downey Program. He requested
the City continue looking into adding more bike paths.
CONSENT CALENDAR ITEMS REMOVED
9. DOWNEY REGIONAL WATER RECLAMATION AND GROUNDWATER PROJECT UPDATE
REPORT: Public Works. This item was removed at the request of City Attorney Abich- Garcia and is
listed under Other Business.
1. RECEIVE AND FILE THE DOWNEY REGIONAL WATER RECLAMATION AND
GROUNDWATER PROJECT UPDATE REPORT;
2. AUTHORIZE STAFF TO APPLY FOR FUNDING THROUGH AVAILABLE STATE AND

4. APPROVED WARRANTS ISSUED: Warrant Nos. 272769 — 273017; Wire Nos. 30002792 &
30002799, 30002802 — 30002810 (omitting 30002805 & 30002808), 995 — 1003, and Cashier
Check Nos. 17 -18, in the total amount of $2,782,461.50: Finance.
5. CASH CONTRACT NO. 690 - FIRE STATION EMERGENCY VEHICLE EMISSION EVACUATION
SYSTEMS PROJECT: ACCEPTED THE IMPROVEMENTS CONSTRUCTED, APPROVED THE
FINAL CONSTRUCTION CONTRACT AMOUNT OF $141,675, AND DIRECTED THE PUBLIC
WORKS DIRECTOR TO FILE THE NOTICE OF COMPLETION: Public Works.
6. APPROVED AGREEMENT WITH THE FAIR HOUSING FOUNDATION TO PROVIDE FAIR
HOUSING SERVICES DURING FISCAL YEAR 2012 -13 IN THE AMOUNT OF $9,000: Community
Development.
7. APPROVED AN AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH CIR
INCORPORATED FOR PROFESSIONAL PLAN REVIEW, BUILDING INSPECTION, AND
STAFFING SERVICES: Community Development.
8. AUTHORIZED THE MAYOR TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH
TTG ENGINEERS FOR THE PREPARATION OF A FUNDING GRANT APPLICATION THROUGH
THE 2013 LOS ANGELES COUNTY METROPOLITAN TRANSPORTATION AUTHORITY
(METRO) CALL FOR PROJECTS FOR THE FLORENCE AVENUE AT THE
SAN GABRIEL RIVER BRIDGE REPLACEMENT PROJECT IN AN AMOUNT NOT TO EXCEED
$32,000: Public Works.
It was moved by Council Member Brossmer, seconded by Mayor Pro Tem Vasquez, with Council
Member Saab abstaining from Item No. 3, to approve the remainder of the Consent Calendar.
OTHER BUSINESS
9. DOWNEY REGIONAL WATER RECLAMATION AND GROUNDWATER PROJECT UPDATE
REPORT: Public Works.
1. RECEIVED AND FILED THE DOWNEY REGIONAL WATER RECLAMATION AND
GROUNDWATER PROJECT UPDATE REPORT;
2. AUTHORIZED STAFF TO APPLY FOR FUNDING THROUGH AVAILABLE STATE AND
FEDERAL PROGRAMS; AND,
3. ADOPT RESOLUTION NO. 12-7386, A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY DECLARING ITS SUPPORT FOR IMPLEMENTATION OF THE DOWNEY
REGIONAL WATER RECLAMATION AND GROUNDWATER PROJECT AND AUTHORIZING
THE CITY MANAGER, OR DESIGNEE, AS AGENT OF THE CITY OF DOWNEY TO APPLY
FOR STATE AND FEDERAL FUNDING THROUGH AVAILABLE PROGRAMS AND GRANTS.
City Attorney Abich- Garcia stated that the Resolution requires some changes. On the first page, the
third line down the fourth "Whereas" should read, "current Utilities Yard located at 9252 Stewart & Grey
Road." Also, on the first page, second line down the fifth "Whereas" should read, "Stewart & Grey Road
and a portion of the property located at 11921 thru 12007 Woodruff Avenue which are adjacent to the
City's Utilities Yard." --�
It was moved by Council Member Brossmer, seconded by Mayor Pro Tem Vasquez, and
unanimously carried to adopt the Resolution as amended.

ADMINISTRATIVE REPORTS: None.
STAFF MEMBER COMMENTS
City Manager Livas thanked outgoing Mayor Brossmer for all of his hard work and congratulated
Mayor Guerra and stated he looked forward to working with him.
APPROVE CLOSED SESSION MINUTES: November 27, 2012: City Clerk.
It was moved by Council Member Brossmer, seconded by Mayor Pro Tem Vasquez, with Council
Member Saab abstaining, to approve the Closed Session Minutes of November 27, 2012.
RECESS TO CLOSED SESSION
Mayor Guerra recessed the meeting to Closed Session at 9:08 p.m. under the following authorities:
1. Government Code Section 54956.9(c) — Initiation of Litigation: One (1) Potential Case.
2. Government Code Section 54957.6 - Conference With Labor Negotiator; City Negotiators:
Mayor & Council; Unrepresented Employee: City Manager.
3. Government Code Section 54956.8 — Conference with real property negotiators Gilbert
Livas /John Oskoui re: property at 7966 Firestone Boulevard; negotiating parties: Salomon
Investment Co.; under negotiations: price and terms of payment.
RECONVENE AND ANNOUNCE CLOSED SESSION ACTION
The meeting reconvened in open session at 9:15 p.m. and City Attorney Abich Garcia announced
that Council gave direction but took no formal action.
