ADJOURNED REGULAR MEETING
DECEMBER 1, 2008
The Community Development Commission of the City of Downey held an Adjoumed Regular
Meeting at 7:38 p.m., December 1, 2008, in the Council Chamber of the Downey City Hall, 11111
Brookshire Avenue, Downey, California, Chairperson David R. Gafin presiding.

1. APPROVE AND AUTHORIZE THE CHAIRPERSON TO EXECUTE AN OWNER
PARTICIPATION AGREEMENT (OPA) FOR PROPERTY LOCATED AT 8233 FIRESTONE
BOULEVARD, WITH PORTO'S BAKERY OF DOWNEY, INCORPORATED FOR THE
PURCHASE OF BAKERY OPERATING COVENANTS : Community Development.
Deputy City Manager Livas gave a Power Point presentation indicating that over the last
several months City staff has been negotiating with Raul Porto, President of Porto's Bakery of
Downey, Inc., which has resulted in the proposed Owner Participation Agreement before the
Commission tonight. There are two other Porto's Bakeries in Burbank and Glendale which are family
owned and operated for thirty -five years and are assets to those communities. The OPA requires
that there be forty full -time jobs and that the bakery stays in business for a minimum of five years.
The Commission provides $750,000 in economic development incentives.
Mr. Livas continued that this project is expected to bring in about 2,000 people on a daily
basis to the downtown Downey area and represents an important step towards the goal of making
the downtown a viable and active gathering place of the community. The return on investment has
been conservatively estimated over ten years to be $808,509 in new sales and property tax income
to the City. He responded to questions of the Commissioners.
Chairperson Gafin asked if anyone from the public wished to comment on this item and no
one came forward.
Vice - Chairperson Guerra gave suggestions on the insurance forms including the additionally
insured /endorsement that was used. He indicated that this is a good investment for the City which
he supports and thanked the staff for presenting the item.

Chairperson Gafin agreed that this will be good for the downtown area, but indicated
concerns with the redevelopment funds reserve and putting almost all of the funds only into one
project. He stated he could support $500,000; but not $750,000.
Commission Bayer expressed that while the bakery would be good partner for downtown, she
is also concerned with using all of the funds and is not ready to spend the $750,000.
Commissioner Trejo apologized for his lateness to the meeting. He mentioned hating served
on the City Council downtown subcommittee for nearly eight years and that this project will be a
catalyst and will have future dividends.
It was moved by Vice - Chairperson Guerra, seconded by Commission Trejo and failed, noting
the dissentions of Commissioner Bayer and Chairperson Gafin, to approve staff recommendation.
NON - AGENDA PUBLIC COMMENT:
The following persons spoke in support of the adoption of the Downey Safety Auxiliary
Association and the Downey City Employee Association - Maintenance Unit Memorandums of
Understanding (MOU's) that are pending with the City:
