Director of Community Dev. /City Planner Robert Messinger, Assistant to the City Manager June Yotsuya, Assistant to the City Manager Cindi Apidgian, Executive Secretary PRESENTATIONS Mayor Hayden presented a Proclamation declaring the week of July 8 -12, 1991 as 'Therapeutic Recreation Week' to Mr. Chester Land, Director of the Recreation Therapy Department of Rancho Los Amigos Medical Center. Mayor Hayden recognized members of the Downey Chapter of DeMol a and their P y Mastor Councilor Chris Turner in the audience. HEARINGS Mayor Hayden opened the public hearing on GENERAL PLAN AMENDMENT 91 - 51, OPEN SPACE AND RECREATION CHAPTER. Council Member Boggs stated she recently attended a Planning Commission hearing on this item as a spectator only and did not participate in any way. Ms. McDonnell affirmed the proof of publication. It was moved by Council Member Brazelton, seconded by Council Member Paul, and so ordered to receive and file. Input was received from the Recreation and Community Commission and the public meetings Services Co General Plan Steering Committee and publ i Were h The only issue contested at the Planning Commission was a requirement that the City exercise its right under the Naylor Act which provides the City with the ability to first purchase school property for open space purposes should the district decide to either sell or lease school property. The City can purchase up to 30% of the site at 25% of the land cost.. Staff recommends approval of the Negative Declaration and the Open Space Chapter to the General Plan. Council Member Boggs expressed concern for Open Space requirements in senior housing and was informed an ordinance addressing senior housing w i l l be brought before the Planning Commission in August prior to Council review. Discussion ensued regarding the Naylor Act, wherein Mr. McOsker advised c that the Nayor Act actually reads 25% of fair market value at the time of acquisition, and it can go higher if the cost of acquisition is greater than 25% of fair market value. A city would have 60 days in which to respond to the offer. It was noted the Unsworth School site was offered to the City some time ago, but the City was not interested. Mr. McOsker referenced Government Code Section 54222 which controls all surplus properties by any jurisdiction, and suggested possibly the Unsworth site was offered under this Code Section. Mr. Caton advised staff will review the matter and return with the facts regarding the sale of Unsworth School. No correspondence was received on this matter. Mayor Hayden asked if there was anyone present in the audience to speak in favor of the General Plan Amendment. Ms. Joyce Lawrence, 9627 Cheddar St., mentioned she is very pleased there are some goals, issues and programs in this Element that protect historical resources, noting it is important to address archaeological issues in this Plan. Mr. Roger Lawrence, 9627 Cheddar St., expressed concern regarding the Naylor Act being included in the Open Space Element and recommended exercising this right when the opportunity presents itself. He mentioned displacement hardship would result if schools were not available for community use, specifically citing the sports events that take place at Columbus High School. Mr. John Vincent, 10710 Wiley Burke Ave., President of the Downey Historical Society, stated particular interest in the historical homes and archaeological section of the Element. Ms. Neva Byram, 9813 Guatemala, questioned staff about proposed development behind the residences on Guatemala Avenue from Suva Street to Firestone Boulevard, and was informed most of the property was sold to the adjoining. property owners and the remainder was returned to the Department of Water and Power. The property is no longer listed as a potential park site, nor are there plans to pursue this matter. RESOLUTION NO. 5463 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE NEGATIVE DECLARATION AND AMENDING A CHAPTER OF THE DOWNEY GENERAL PLAN RELATED TO OPEN SPACE AND RECREATION It was moved by Council Member Boggs, seconded b y Council Member Brazelton, and unanimously carried to waive further reading and adopt. ITEMS REMOVED FROM THE CONSENT CALENDAR Agenda Benda Item VI -F -4, MINUTES OF REGULAR MEETING, JUNE 25, 1991 was removed by Mr. Lennie Whittington. Agenda Item VI -F -1, MEMORANDUM OF UNDERSTANDING TO PARTICIPATE IN THE L.A. IMPACT PROGRAM, and Agenda Item VI -F -2, CALIFORNIA ENERGY COMMISSION - ENERGY PARTNERSHIP PROGRAM were removed by Council Member Boggs. CONSENT CALENDAR It was moved by Council Member Cormack, seconded by Council Member Brazelton, and unanimously carried to waive further reading of the Resolutions and adopt the remainder of the Consent Calendar. Council Minutes 7/9/91 -3- r--, ORDINANCES NOT SET FORTH ABOVE 92f6 ORDINANCE NO. 930 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING AND ADOPTING AMENDMENT 5A TO THE REDEVELOPMENT PLAN FOR THE DOWNEY REDEVELOPMENT PROJECT AS THE OFFICIAL REDEVELOPMENT PLAN FOR SAID PROJECT (BROOKSHIRE AND MARGARET) The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Paul, and unanimously carried to waive further reading and adopt. REDEVELOPMENT PLAN AMENDMENT 58 (I -5 /FLORENCE AVENUE) -‘ Council Member Cormack stated that at the previous meeting, he had requested continuance of Redevelopment Plan Amendment 58 to the meeting of July 23, 1991. He mentioned that additional time is needed to review and discuss this matter with the Murata family. Mr. Caton advised this matter will not be placed on the next agenda at the request of Council Member Cormack. ORDINANCE NO. 931 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING AND ADOPTING AMENDMENT 5C TO THE REDEVELOPMENT PLAN FOR THE DOWNEY REDEVELOPMENT PROJECT AS THE OFFICIAL REDEVELOPMENT PLAN FOR SAID PROJECT (LAKEWOOD AND GALLATIN) Council Member Brazelton advised he is abstaining from voting on the Ordinance due to a possible conflict of interest. The Ordinance was read by title only. It was moved by Council Member Cormack, seconded by Council Member Paul, and carried by the following vote to waive further reading and adopt: AYES: 4 COUNCIL MEMBERS: Cormack, Boggs, Paul, Hayden ABSTAIN: 1 COUNCIL MEMBERS: Brazelton OTHER BUSINESS: ITEMS REMOVED FROM COMSENT CALENDAR MINUTES, REGULAR MEETING, JUNE 25, 1991 Mr. Lennie Whittington, 8542 Manatee St., referenced Page 8 of the Minutes where his letter was noted as requesting the re- opening of the public hearing on Amendment 5C. He stated that his letter requests the re- opening of the public hearing on Amendment 5B also and requested this information be added to the Minutes. Mayor Hayden advised Mr. Whittington that his request will be taken under consideration, the tape w i l l be reviewed, and the Minutes returned at the next Council meeting. Council Minutes 7/9/91 - Mr. Whittington distributed copies of his letter 9290 P etter dated June 20, 1991 via the City Clerk. Ms. McDonnell stated Mr. Whittington's letter was mentioned during discussion on Amendment 5C. There was no discussion on Amendment 5B. The Minutes reflect what actually happened at the June 25th meeting. Mr. Farfsing stated he did not give a staff report on Amendment 5B since Council Member Cormack requested a delay on this matter to allow time to meet with the Murata family. Therefore, there would have been no mention of Mr. Whittington's letter at that time. ,..� Mayor Hayden reiterated that Mr. Whittington's request w i l l be taken under advisement and the Minutes returned at the next Council Meeting for consideration. RESOLUTION NO. 5464 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROVIDING FOR THE PARTICIPATION OF THE CITY IN THE LOS ANGELES COUNTY INTER - AGENCY TASK FORCE Chief Mayes summarized the staff report, requesting authorization for the Police Department to participate in the Los Angeles Inter-Agency Metropolitan Police Apprehension Crime Task Force (L.A. IMPACT). The Resolution was read by title only. It was moved by Council Member Boggs, seconded by Council Member Paul, and unanimously carried to waive further reading and adopt. RESOLUTION NO. 5465 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING APPLICATION WITH THE CALIFORNIA ENERGY COMMISSION FOR PARTICIPATION IN ITS ENERGY PARTNERSHIP PROGRAM Mr. Redmayne summarized the staff report, explaining state funds ,�--, are available for a variety of energy assistance programs. Staff recommends authorization of the Public Works Department to apply to the California Energy Commission for participation in its Energy Partnership Program. The Resolution was read by title only. It was moved. by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried to waive further reading and adopt. OTHER BUSINESS - CITY COUNCIL MEMBERS: Council Member Brazelton questioned why the pedestrian gate located at Gallatin Elementary School has recently been locked when it has been used by the community for the past 34 years. He requested staff contact the Downey School District to ascertain this information. Council Minutes 7/9/91 -5- Council Member Brazelton expressed concern with an abundant number of families living in R -1 Single Family Residential dwellings, thus 921 producing additional school -age children that attend the already crowded P al remedies H e requested staff review the restrictions and legal 9 q to correct this situation. Council Member Paul discussed his recent comments regarding motor officer visibility for traffic enforcement and suggested monitoring the citations received. Mr. Caton explained his office is responsible for the Police Department and he will work with. the Chief on monitoring citations. Should efficiency become a problem, his office will deal directly with - the situation. Council Member Boggs suggested the possibility of less citations being issued from visible motor officers as opposed to officers not as noticeable be taken into account during the monitoring process. She suggested all factors be considered when compiling the statistics. Council Member Boggs mentioned she recently spoke to Jackie Backerack and Judith Hathaway Francis regarding the lack of restroom facilities at the Lakewood Boulevard train depot, and only Ms. Francis was interested in the problem. She suggested a continued aggressive approach to seek restroom facilities for the rail station. Council Member Boggs noted fewer citations are being written in conjunction with street sweeping and requested staff review this matter. Mayor Hayden noted the joint meeting between the City Council and Recreation and Community Services Commission scheduled for July 16, 1991 will not be convenient for at least two Council Members. It was the consensus of Council to reschedule this meeting for 4 :30 p.m., Monday, August 26, 1991. ORAL COMMUNICATIONS Mr. Lennie Whittington, 8542 Manatee St., distributed copies of an Agenda Memo regarding Traffic and Zone Exceptions from the Planning Division to the Planning Commission wherein the City Attorney, from the City of Cerritos noted his opinion that restricting test drives in residential neighborhoods cannot be legally enforced. Mr. Carlos Rios, 11009 Fairford Ave., discussed his concern /beguiling whether the City is setting aside funds for the I -5 Freeway sound wall on Dollison Drive, south of Florence Avenue.
