HEARINGS Mayor Paul opened the public hearing on LIGHTING MAINTENANCE DISTRICT A.D. 121, 1991 -92 ASSESSMENT LEVY. Ms. McDonnell affirmed the proof of publication. It was moved by Council Member Hayden and so ordered to receive and file. Mr. Redmayne summarized the Engineer's report, noting the increase and decrease in some zones, depending on the fund balances remaining from last year. Council Minutes 6/25/91 -1- 9274 It was moved by Council Member Boggs, seconded by Council Member Brazelton, and so ordered to approve the Engineer's Report. No correspondence was received on this matter. There being no one present wishing to speak, it was moved by Council Member Hayden, seconded by Council Member Brazelton, and so ordered to close the public hearing. RESOLUTION NO. 5448 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE 1991 -92 FISCAL YEAR ASSESSMENT FOR LIGHTING MAINTENANCE DISTRICT A.D. 121 The Resolution was read by title only. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried to waive further reading and adopt. Mayor Paul opened the public hearing on UNIFORM SCHEDULE OF FEES, ESTABLISHING CITY AND BUILDING FEES. Ms. McDonnell affirmed the proof of publication. It was moved by Council Member Hayden and so ordered to receive and file. Mr. Powell summarized the staff report, noting there are two Resolutions recommended for adoption regarding City Fees and Building Fees. No correspondence was received on this matter. There being no one present wishing to speak, it was moved by Council Member Cormack, seconded by Council Member Hayden, and so ordered to close the public hearing. RESOLUTION NO. 5449 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING A UNIFORM SCHEDULE OF FEES The Resolution was read b y title only. It was moved by Council Member Cormack, seconded by Council Member Boggs and unanimously carried to waive further reading and adopt. Prior to the foregoing vote, Council Member Boggs thanked staff for including the previous four year budget history in the report for her information. She questioned the coverage of the non- residential paramedic fee. Chief Irwin advised the fee would cover any resident of the household. However, a visitor to a house would have to pay for paramedic services. Mr. Powell noted this type of payment is related to traffic accidents from -people travelling through our City; it is not an often occurrence. Council Member Boggs asked if the theatre use fee would be charged for rehearsals and was informed the fee would only be charged for a full performance since this is the actual cost charged for the cleaning service. Council Minutes 6/25/91 -2- 4 9273 Mayor Paul discussed the increase in fees for lost adult and children paperback books. Mr. Jarrett replied the proposed fee is the average cost of replacing a children's or adult paperback book. RESOLUTION NO. 5450 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING FEE SCHEDULES FOR BUILDING REGULATIONS The Resolution was read by title only. It was moved by Council Member Brazelton, seconded by Council Member Boggs, and unanimously carried to waive further reading and adopt. Mayor Paul opened the public hearing on FISCAL YEAR 1991 -92 CITY BUDGET WITH IMPLEMENTING DOCUMENTS. Ms. McDonnell affirmed the proof of publication. It was moved by Council Member Hayden, and so ordered to receive and file. Mr. Caton summarized the staff report, recommending adoption of the 1991- 92 budget with implementing documents. He noted the changes made from the previous year's budget. Council Member Hayden expressed concern that the Downtown Improvement Project would be abandoned and was informed staff could not start this project for at least six months, at which time funds will be requested to begin development. Council Member Boggs concurred with Council Member Hayden's comments regarding the needs in the Downtown Area and was assured there would be a midyear budget review based on economic changes. Council Member Hayden questioned the set -aside money for the sound wall project and was informed that $150,000 w i l l be in the Capital Improvement Budget which will be reviewed in August. Ms. McDonnell noted correspondence had been received from Sgt. Mike Hadley, President of the Downey Police Officers' Association, opposing reduc- tion of the motorcycle detail from twelve to ei9 ht officers. There being no one present wishing to speak, it was moved by Council Member Hayden, seconded by Council Member Brazelton and so ordered to close the public hearing. RESOLUTION NO. 5451 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWN E Y ADOPTING THE FISCAL YEAR 1991 BUDGET WITH IMPLEMENTING DOCUMENTS The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Hayden, and unanimously carried to waive further reading and adopt. Council Minutes 6/25/91 -3- ____________________ 927 Prior to the foregoing vote, Council Member Boggs clarified that adoption of this Resolution w i l l result in a reduction from twelve to eight motorcycle officers. He noted the joint public hearing on this matter between the City Council and Community Development Commission was held on June 11, 1991 and closed on that date. Although the hearing has been closed, members of the public will have an opportunity to comment on the proposed resolution and ordinance prior to the Council taking action. Council Minutes 6/25/91 - Mr. Thorson advised under Section 2105 of the Downey Municipal Code, the Council can accept public comments on agenda items and individuals wishing to address the Council on these it items may do so; however, the Mayor does have the opportunity to allocate the time for public comment. , Mr. Farfsing summarized the staff report, recommending the Resolution P mmend ng a responding to written protests received at the meeting on June 11, 1991 be adopted, and the Ordinance approving and adopting Amendment 5A to the Redevelopment Plan be introduced. He also received a fax letter on June 24, 1991 from Mr. Sutton representing the Murata Family Trust 9 a Fame y ust opposing Amendment 5A although no reasons were given; the Murata Family Trust does not own land in this area. He noted the Project Area Committee is in concurrence with Amendment 5A. Mayor Paul asked if anyone in the audience wished to speak regarding Redevelopment Amendment 5A. Mr. Lennie Whittington, 8542 Manatee, spoke regarding the response from Gunn, Russell, and Copenhaver to a petition he submitted at the meeting of June 11, 1991. His petition endorsed the project, but he expressed dismay at the inappropriateness of the responses he received. Mayor Paul asked if the Council Members had any questions regarding Amendment 5A. Council Member Boggs clarified that a traffic study would have to be done if there is any future development in the area of Margaret Street, since this seems to be the concern of the residents. RESOLUTION NO. 5461 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY RESPONDING TO THE WRITTEN OBJECTIONS OF VARIOUS PERSONS TO THE PROPOSED AMENDMENT NO. 5A TO THE DOWNEY REDEVELOPMENT PLAN (BROOKSHIRE AND MARGARET) The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Hayden, and unanimously carried to waive further reading and adopt. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING AND ADOPTING AMENDMENT 5A TO THE REDEVELOPMENT PLAN FOR THE DOWNEY REDEVELOPMENT PROJECT AS THE OFFICIAL REDEVELOPMENT PLAN FOR SAID PROJECT (BROOKSHIRE AND MARGARET) The Ordinance was read by title only. It was moved by Council Member Cormack, seconded by Council Member Hayden, and unanimously carried to waive further reading and introduce. - Mayor Paul noted this concludes the actions of the City Council on Amendment 5A for this evening. The Council will consider the second reading and adoption of the Ordinance to approve Plan Amendment 5A at its meeting of July 9, 1991. Council Minutes 6/25/91 -6- 9219 Mayor Paul announced the Council's consideration of proposed AMENDMENT 5B TO THE DOWNEY REDEVELOPMENT PLAN AND SPECIFIC PLAN 90 - 1 (1 - 5 FREEWAY /FLORENCE AVENUE, which includes approximately 39 acres generally bordered by the 1-5 Freeway, I -605 Freeway and Dollison Drive. He noted the joint public hearing on this matter between the City Council and Community Development Commission was held on June 11, 1991, and closed on that date. Although the hearing has been closed, members of the public will have an opportunity to comment on the proposed Resolution and Ordinance prior to the Council taking action. I t was moved by Council Member Cormack, seconded by Council Member Hayden, and unanimously carried to continue the proposed Resolution responding to protests and Ordinance approving and adopting Redevelopment Plan Amendment 5B p to 7 :30 p.m., July 23, 1991 at the Downey City Council Chamber. Prior to the foregoing vote, Mr. Thorson noted there are no time constraints and Council may defer action if that is its desire. I t was the consensus of Council to establish a subcommittee consisting of Council Members Cormack and Brazelton to further review Amendment 5B with the Murata family. ORDINANCE NO. 929 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING SPECIFIC PLAN 90 -1 Mr. Rangel summarized the staff report, recommending adoption of the proposed Ordinance which serves as the zoning and development regulations for approximately 39 acres of commercial property near the interchange of the I -5 and I -605 Freeways. There was no one in the audience wishing to speak regarding Specific Plan 90 -1. Mayor Paul asked if the Council had any comments regarding the Specific Plan 90 -1. Council Member Boggs requested this item be voted on when the other items regarding Amendment 5B are voted upon. Council Member Hayden stated the Specific Plan tool is critical to this project and should be adopted for the protection of the neighborhood. The Ordinance was read by title only. It was moved by Council Member Hayden, seconded by Council Member Cormack, and carried by the following vote to waive further reading and adopt: AYES: COUNCIL MEMBERS: Hayden, Brazelton, Cormack, Paul ABSTAIN: COUNCIL MEMBERS: Boggs Mayor Paul announced the City Council's consideration of proposed AMENDMENT 5C TO THE DOWNEY REDEVELOPMENT PLAN (LAKEWOOD BL. /GALLATIN RD.) , which relates to approximately 15.4 acres located northwest, southwest, and southeast of the intersection of Lakewood Boulevard and Gallatin Road. He noted the joint hearing of the City Council /Community Development Commission was held on June 11, 1991 and closed on that date. Even though the hearing has Council Minutes 6/25/91 -7- 9280 been closed, the public will have an opportunity to comment on the proposed Resolution and Ordinance prior to Council action. Council Member Brazelton advised he will be abstaining from this item due to a potential conflict of interest .and vacated his seat accordingly. Mr. Farfsing summarized the staff report, noting staff has prepared responses to oppositions raised at the meeting of June 11, 1991 and has reviewed different applications of eminent domain. He noted the following correspondence in opposition: Mr. Lennie Whittington, requesting the hearing be re- opened; Mr. Sutton, representing the Murata Family Trust; the Murata Family Trust does not own land in this area; The following correspondence was received in support of Amendment 5C: Pacific Lincoln Mercury, supporting Redevelopment Amendment 5C; Downey Ford, supporting Redevelopment and eminent domain. This correspondence was received into the record. Mr. Farfsing noted that the boundaries have been modified as suggested by the Project Area Committee, but staff recommends eminent domain remain in the plan to be used in a judicious manner. Mr. Thorson advised on the uses and limitations of eminent domain, noting it can be used selectively on properties. Council Member Boggs clarified the owners of the auto dealerships are requesting eminent domain; the rest of the properties that do not want eminent domain have not been included. Mr. Caton explained that Downey Ford's owner desires eminent domain; the Lincoln Mercury site is owned by Ford Motor Company in Michigan, and the operator of the site is requesting eminent domain. The Ford Motor Company was notified of these Redevelopment Plans and hearings. There was no one in the audience wishing to speak on Amendment 5C. RESOLUTION NO. 5462 .. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY RESPONDING TO THE WRITTEN OBJECTIONS OF VARIOUS PERSONS TO THE PROPOSED AMENDMENT 5C TO THE DOWNEY REDEVELOPMENT PLAN (LAKEWOOD AND GALLATIN) ORDINANCE N0. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING AND ADOPTING AMENDMENT 5C TO THE REDEVELOPMENT PLAN FOR THE DOWNEY REDEVELOPMENT PROJECT AS THE OFFICIAL REDEVELOPMENT PLAN FOR SAID PROJECT (LAKEWOOD AND GALLATIN) Council Minutes 6/25/91 -8- 9 28 1 The Resolution and Ordinance were read by title only. I t was moved by Council Member Cormack, seconded by Council Member Hayden, and unanimously carried by the Members present to waive further reading of the Resolution and adopt; and waive further reading of the Ordinance and jntroduce. Council Member Boggs stated for the record that her vote is continent fact that contingent the fac at the only properties having eminent domain attached to them have been duly notified and are in favor. Council Member Brazelton resumed his seat. ADMINISTRATIVE REPORTS SECTION 108 LOAN FROM U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT 1 Mr. Powell summarized the staff report, recommending approval of the Housing and Urban Development Loan which will be used to reimburse the City for costs of purchasing property near the corner of Lakewood and Firestone Boulevards. Discussion ensued regarding sale of the property, generating interest, and prepayment of the loan. Council Member Brazelton questioned whether the plan was to originally use the money for this purpose and was informed this was the initial idea. I t was moved by Council Member Cormack, seconded by Council Member Brazelton, and unanimously carried to approve the Promissory Notes, the Series 1991 -A Fiscal Agency Agreement and the Master Fiscal Agency Agreement among the Borrowers and Chemical Bank, and a contract for Loan Guarantee Assistance; and authorize the City Manager to execute these documents. ORAL COMyUNI CATIONS : None OTHER BUSINESS - COUNCIL COMMENTS: Council Member Boggs discussed the safety of fireworks in the City. Chief Irwin noted the reason fireworks are allowed in Downey is that several organizations in the community use this as a fundraiser. He stated his recommendation that fireworks be illegal in the City. Discussion ensued regarding alternative sources to raise funds, such as curb painting. Council Member Boggs noted vacant properties fenced off in her District, specifically one site on Alameda Street across from the Alameda Elementary School, and one site on Patton Road, south of the Hospital. She requested staff review these properties and their status. Council Member Hayden congratulated Mayor Paul on his year as Mayor. Council Member Cormack noted the good job done by Mayor Paul this past year. Council Minutes 6/25/91 -9- fL Mayor Paul congratulated the Council on the way it has handled many diffi- cult issues, i.e. redevelopment, the budget, etc. He expressed his pleasure in working with Council Members that stand up for their own views, yet work in unison. Mayor Paul referenced a letter received from the Downey Police Officer's Association regarding "hiding" their motorcycles in bushes, etc. to enforce speed laws, and requested this item be placed on a future agenda.
