PRESENTATIONS
Mayor Paul read a Proclamation honoring Caesar Mattel for his service to
the community. Council Members Cormack and Boggs commented on Mr. Mattel's
achievements and dedication to the City throughout the years.
Mayor Paul read a Proclamation declaring April as National Child Abuse
Prevention Month.
Mayor Paul presented a Proclamation declaring April 14-20, 1991 a

National Library Week to Jo Miller, Chairperson, Library Advisory Board and
Joan Lingrey, President, Friends of the Library.
Mayor Paul presented a Proclamation declarin 9 April 14-21, 1991 as
American Home Week to Norine Pinizzotto, President, Downey Board of Realtors.

Police Lieutenant Mike Miller recognized Officers Phil Rego, Scott Hoeman,
Dan Murray and Steve Garza, advisors for the Downey Police Law Enforcement
Explorer Program, and thanked the public and Council for their continued
support. Officer Hoeman introduced the Explorers in the audience.

Mayor Paul presented Certificates of Appreciation to Downey High School

Keywanettes, Downey High School Key Club, and members of Downey Kiwanis Club
for their involvement in the Teens Against Graffiti Program.
HEARINGS
Mayor r Paul opened the public hearing on APPEAL, TENTATIVE PARCEL MAP

NO. 22194 FOR PROPERTY LOCATED AT 10935 LITTLE LAKE ROAD which was continued
from the meeting of March 26, 1991.
Mr. Ranged summarized the staff report, recommending denial of the
proposed Parcel Map. He narrated a brief slide presentation depicting the
subject and surrounding area.
Mayor Paul advised he is in receipt of correspondence dated April 3, 1991
from Mr. lee Cook regarding the subject Appeal. It was moved by Council Member
Boggs and so ordered to receive and file the correspondence.
Mayor Paul asked the applicant /appellant to come forward and present his
case.
Mr. Lee Cook, 10935 Little Lake Road, distributed material to Council
Members including maps and photographs of the subject and surrounding area, and
signatures of neighborhood residents in favor of the project. He discussed the
history of his case, noting he has modified his plans as requested by staff.
All Code requirements have been met and a Zone Variance is not required for his
intended development. He narrated a slide presentation of the subject and
surrounding properties.
Mr. George Mirena, 8516 Quinn St., trustee of the pension trust which is
part owner of this property, addressed concerns expressed by the Planning
Commission. He stated that project approval will result in an economically
sound development that will aesthetically improve the neighborhood.
There was no one to speak in opposition.
Mr. Cook commented on the large amount of irregularly shaped lots in the
surrounding area.
It was moved by Council Member Cormack, seconded by Council Member Hayden,
and so ordered to close the public hearing. -
Council Member Boggs questioned the square footage of lots at 10924 and
10930 Little Lake Road and the .grading. of the subject property. She was
informed the two lots specified are . 4,834 square feet and 4,020 square feet,
respectively; the grading is a gradual flow down angle at approximately a four
foot slope. She then expressed support of the proposed Parcel Map, commenting
on the irregularly shaped and small sized lots in the area and the lack of
building potential on the site as it is currently divided.

Council Member Hayden voiced support of the project, noting that most
corner and cul -de -sac lots are irregularly shaped by virtue of their location.
Council Member Brazelton mentioned the square footage is adequate for the
proposed development and the uniqueness of this location warrants a positive
determination on the Appeal.
Council Member Cormack expressed support of the project since the Parcel
Map and future development plans comply with all Code requirements. He
questioned the negative vote of the Planning Commission and was informed that
one Commission concern involved the estabishment of findings for future Zone
Variances on the site if approval is granted.
It was noted that materials presented to Council were not available for
review by the Planning Commission prior to their decision on this case.
Mayor Paul voiced approval of the Parcel Map, considering the signatures
of area residents in support of the project, compliance with all Code
requirements, and the fact that a Zone Variance is not required for future
development.
It was moved by Council Member Cormack, seconded by Council Member Hayden,
and unanimously carried to direct staff to prepare a Resolution approving the
Appeal on Parcel Map No. 22194 for adoption at the next meeting.
ORAL COMMUNICATIONS
Mayor Paul recognized Downey School Board Member Mary Tesoriero in the
audience.
Mr. Lennie Whittington, 8542 Manatee St., expressed concern with the
continued illegal parking of a trailer on property owned by Target Enterprises
at 12739 Lakewood Boulevard.

Mayor Paul opened the public hearing on ONE YEAR EXTENSION OF MORATORIUM
PROHIBITING ISSUANCE OF LAND USE ENTITLEMENTS FOR CERTAIN COiMERCIAL PROPERTIES
ON FIRESTONE AND LAKEWOOD BOULEVARDS.
Ms. McDonnell affirmed the proof of publication. It was moved by Council
Member Hayden and so ordered to receive and file.
Mr. Rangel summarized the staff report, requesting adoption of. this
Urgency Ordinance to extend the moratorium.
There was no one present to speak in favor or opposition.
It was moved by Council Member Cormack, seconded by Council Member Hayden,
and so ordered to close the public hearing.

ORDINANCE NO. 927
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
EXTENDING A MORATORIUM PROHIBITING THE ISSUANCE OF LAND USE ENTITLEMENTS
FOR CERTAIN COMMERCIAL AND MANUFACTURING PROPERTIES ON FIRESTONE AND
LAKEWOOD BOULEVARDS WITHIN THE CITY OF DOWNEY
The Urgency Ordinance was read in its entirety.
It was moved by Council Member Hayden, seconded by Council Member
Brazelton, and unanimously carried to adopt.
Mayor Paul opened the public hearing on APPEAL OF ADMINISTRATIVE CODE
INTERPRETATION REGARDING REAL ESTATE SIGNS.
Ms. McDonnell affirmed the proof of publication. It was moved by Council
Member Hayden and so ordered to receive and file.
Mayor Paul advised a letter has been received from the applicant
requesting continuance of this matter until the meeting of May 28, 1991.
It was moved by Council Member Cormack, seconded by Council Member Boggs,
and unanimously carried to continue the hearing on Appeal of Administrative
Code Interpretation regarding Real Estate Signs to 7:30 p.m., May 28, 1991 in
the Downey City Council Chambers.
ITEMS REMOVED FROM THE CONSENT CALENDAR
Agenda Item VI -E -5, RENTAL AGREEMENT WITH EXCHANGE CLUB FOR CHILD ABUSE
PREVENTION PROGRAM, and Agenda Item VI -E -6, CITY REGULATION OF NEWSRACKS, were
removed by Council Member Cormack.
CONSENT CALENDAR
It was moved by Council Member Cormack, seconded by Council Member Boggs,
and unanimously carried to approve the remainder of the Consent Calendar as
recommended:
MINUTES: ADJOURNED AND REGULAR MEETINGS, MARCH 26, 1991: Approve.
CASH CONTRACT NO. 579 - CITYWIDE TREE TRINMMING - accept work performed by
California Western Arborists, Inc. at a cost of $77,354.00: Approve.
WARRANTS ISSUED: #33851- 34668, $1,268,188.62: Approve.
YELLOW CAB RATE INCREASE authorization per Section 6513 of the Downey
Municipal Code: Approve.
AUTHORIZE LAND EXCHANGE WITH STATE OF CALIFORNIA DEPARTMENT OF
TRANSPORTATION (CALTRANS) by delivering a Grant Deed to Caltrans in exchange
for a Director's Deed and payment of $45,400 to the City (City property located
at Clark Avenue and the I -105 Freeway; County property located at Pangborn
Avenue and Firestone Boulevard): Approve.

DOWNEY IMPROVEMENT PROJECT NO. 730 - WEST SIDE OF TWEEDY LANE BETWEEN
BLANDWOOD /BROOKPARK ROADS; accept contract work and authorize staff to file
Notice of Completion at a total cost of $10,295.80: Approve.
AMENDMENT TO ASSEMBLY BILL 939 (WASTE MANAGEMENT BILL) CONTRACT WITH EMCON
ASSOCIATES for preparation of California Environmental Quality Act document by
Michael Brandman Associates at a total additional cost of $1,200: Approve.

RENTAL AGREEMENT WITH EXCHANGE CLUB FOR CHILD ABUSE PREVENTION PROGRAM
0"."1 Mr. Thorson advised that Council Member Cormack should abstain from
participation on this matter per Government Code Section 1091.5 as he is a
Board Member of the Child Abuse Prevention Committee.
Council Member Cormack vacated his seat accordingly.
It was moved by Council Member Boggs, seconded by Council Member Hayden,
and carried by the following vote to authorise the execution of a standard
rental agreement with the Exchange Club Child Abuse Prevention Center for
office space at the Apollo Neighborhood Center:

Council Member Cormack resumed his seat.
CITY REGULATION OF NEWSRACKS
Council Member Cormack requested support of Assembly Bill 184 regarding
regulation of newsrack materials.
Mayor Paul noted the Public Safety Committee w i l l be meeting in Sacramento
on April 16, 1991 to consider this legislation and suggested Council Member
Cormack attend the meeting to address the issue.
Council Member Hayden questioned whether the City's lobbyist is working on
this matter and was informed that he is aware of the Bill and is also attending
the Public Safety Committee meeting on behalf of the City.
Mayor Paul directed staff to facilitate the attendance of Council Member
Cormack at the Public Safety Committee meeting in Sacramento on April 16, 1991.

DISCUSSION REGARDING DEVELOPMENT IN THE DOWNTOWN AREA
Council Member Brazelton advised he will be abstaining from discussion on
this matter due to a possible conflict based on his interest in the Bank of
America building. He vacated his seat accordingly.
Council Member Hayden questioned whether a moratorium on further downtown
development should be established while the Specific Plan and other studies are
being completed in this area.

Mr. Caton advised that current development proposals in the area do not
warrant a moratorium at this time.
Council Member Brazelton resumed his seat.
Council Member Boggs invited the public to attend an open house at Downey

Retirement Center located at 11500 Dolan Avenue on April 14, 1991.
Council Member Hayden expressed support of the Police Chief and PP a City
Manager, encouraging teamwork among police officers and management. She
mentioned her availability to meet with anyone to help resolve this issue.
Council Member Brazelton voiced support of the Police Chief, commenting he
has not heard any specific complaints other than a general feeling of
unhappiness among the officers. He offered to discuss this matter with anyone
concerned.
Council Member Cormack stated support of the Cit Y Manager and his
appointment of the Police Chief.
Council Member Boggs encouraged the expedient resolution of differences

between Management and the Downey Police Officers Association. She commented
on the importance of Department morale and recommended the City Manager again

attempt to mediate between the parties involved in working toward an amiable
solution.
Mayor Paul expressed dismay with the "no confidence vote" procedure, as it
does not provide a forum in which to consider definite areas of concern. He
advocated the use of problem - solving techniques when specific issues are
addressed and indicated strong support of the Police Chief.
OTHER BUSINESS - Staff:
Mr. Caton requested Council schedule a Study Session on the City of Downey
Budget for 1991 -92 to give staff direction in the area of budget reductions.
It was the consensus of Council to schedule a budget study session at

4:30 p.m., April 19, 1991 in the Downey City Council Chamber.
Mayor Paul announced the Council is recessin (9:40 p.m.) to Closed
Session to complete discussion of items previously announced on the Closed
Session Statement.
The meeting reconvened at 10:30 p.m. with all Council Members P resent.
There were no closed session actions to report.
ADJOURNMENT: 91-3& p.m.
The meeting was adjourned to 4 :30 p.m., April 19, 1991 in the Council
Chamber of the Downey City Hall.
