PRESENTATIONS
Mayor Paul presented a Plaque to Jim Slater, President of East Downey
Little League and Certificates of Appreciation to Roger Johnson, Joe Johnson,
Jim Prentice and Bill Schutz for their contributions to the community and to
children representing East Downey Little League.
Mayor Paul presented a Proclamation declaring April as "California
Earthquake Preparedness Month" to Warren Heer, Vice - Chairman of the Emergency
Preparedness Committee.
Mayor Paul presented a Proclamation declaring April as 'Keep America and
Keep Downey Beautiful Month to Laura Wilson, Coordinator of Keep Downey
Beautiful Committee. Other Committee Members present in the audience were
recognized for their efforts.

Mayor Paul presented a Proclamation declaring March 25 -29, 1991 as "Lung

Cancer Awareness Week to Marguerite Hodge, Project Manager of the American
Lung Association of Los Angeles County.
Mayor Paul presented a Proclamation recognizing the 30th Anniversary of
United States Peace Corps to Mike Squires, U.S. Peace Corps.
HEARINGS:
Mayor Paul opened the public hearing on PROPOSED CODE AMENDMENT REGARDING
FAMILY DAY CARE HOMES AND CHILD CARE STANDARDS.
Ms. McDonnell affirmed the proof of publication. It was moved by Council

Member Hayden and so ordered to receive and file.
Mr. Rangel summarized the staff report, recommending introduction of an
Ordinance regulating family day care homes.
Ms. McDonnell advised correspondence had been received prior to the
meeting from Ms. Elisabeth Bouldin addressing her concerns regarding this
matter.
It was moved by Council Member Hayden, seconded by Council Member Boggs
and so ordered to receive and file the correspondence.
Mayor Paul called for those present in the audience who wished to speak in
favor or opposition to the proposed Code Amendment.
Mr. Chuck Choi, 9038 Dorington Ave., Los Angeles, representing the
Southern California Women's Law Center, questioned the validity of certain
portions of the proposed Ordinance that conflict with the Child Day Care
Facilities Act adopted in 1984 by the State of California. He cited specific
areas of concern, including limiting family day care centers to single family
residential neighborhoods, the number of assistants a provider can employ,
loading and unloading areas for children, and the placement of play
equipment. The use of alternative language proposed in Ms. Bouldin's written
statement was suggested.
Ms. Abby Leibman, 11852 Santa Monica Blvd., Los Angeles, expressed concern
with the placement limitation of family day care centers in single family
residential neighborhoods. Speaking to the density issue, she noted the City's
Noise Ordinance regulates any noise problem that might result from day care
centers and the spacing concern is addressed by the 300 foot requirement
between centers. Therefore, the confinement of family day care centers to
single family residential neighborhoods is unnecessarily restrictive and limits
available options to parents needing quality centers.
Council Member Boggs expressed concern with the safety of children in day
care facilities located within multi- tenant neighborhoods, citing possible
inadequate play space, equipment areas and open space. She questioned the
State requirements with regard to these issues and was informed the State does
not distinguish between single family and multi - tenant areas, but assumes there
is ample open space in residential environments.

It was moved by Council Member Cormack, seconded by Council Member
Brazelton, and so ordered to close the public hearing.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTIONS 9104.76, 9110.08(C), 9114.08(D), 9122.06(D),
9124.06(I) AND 9150.06(I) OF THE DOWNEY MUNICIPAL CODE PERTAINING TO
FAMILY DAY CARE HOMES AND CHILD CARE STANDARDS
The Ordinance was read by title only.
Council Member Hayden voiced concern with inadequate parking and h

distance required between centers in multi- tenant buildings. She suggested
returning the Ordinance to the Planning Commission for further stud y on the
concerns and suggestions expressed tonight.
Council Member Boggs concurred with returning the Ordinance to the
Planning Commission, suggesting perhaps the issue be addressed on a case -by-
case basis with regard to safety. She requested copies of State Law
regulations and recommended instigating legislation in areas lacking safety
requirements.
Council Member Cormack discussed safety problems related to increased
traffic flow resulting from inadequate spacing between facilities in multi -
tenant neighborhoods.
Council Member Brazelton noted local control is somewhat curtailed by
State law but agreed the Planning Commission should address the concerns
expressed. He requested a summary of the licensing requirements for child care
centers.
Mayor Paul stated the concensus of Council is to return the Ordinance to
the Planning Commission, and requested the issue of limiting assistants
employed by day care providers be redressed at that time.
It was moved by Council Member Cormack, seconded by Council Member Hayden,
and unanimously carried to return the proposed Ordinance to the Planning
with
Commission for further study in accordance with concerns expressed.
Mayor Paul opened the public hearing on APPEAL, TENTATIVE PARCEL MAP
NO. 22194 FOR PROPERTY LOCATED AT 10935 LITTLE LAKE ROAD.
Ms. McDonnell affirmed the proof of publication. It was moved by Council
Member Cormack, seconded by Council Member Brazelton and so ordered to receive
and file.
Ms. McDonnell advised correspondence had been received from the applicant,
Mr. Lee Cook, requesting a continuance of this matter to the next meeting in
April.
It was moved by Council Member Cormack, seconded by Council Member
Brazelton, and unanimously carried to continue the public hearing on Appeal,
Tentative Parcel Map No. 22194 to 7:30 p.m., April 9, 1991 in the Downey City
Council Chamber.

ORAL COMMUNICATIONS
Mr. Gordon Strahan, 12359 Gneiss, volunteered his services in establishing
a citizen-friendly network to address municipal concerns, including code
enforcement problems.
ITEMS REMOVED FROM THE CONSENT CALENDAR
Agenda Item VI-E-6, PURCHASE OF FLAG POLES FOR FIRE STATIONS 2, 3, AND 4,
was removed by Council Member Cormack.
Agenda Item VI -F -4, TRACT MAP NO. 48168 - 11701 RIVES AVENUE was removed
{ by Mr. Paul DeTilla.
Agenda Item VI -E -7, RIO HONDO GOLF COURSE FEE RESOLUTION, was removed by
Council Member Hayden.

THE ZONING CLASSIFICATION OF THE EVEN NUMBERED PROPERTIES LOCATED AT
11400 -11432 PARAMOUNT BOULEVARD TO C -2 (GENERAL COMMERCIAL) AND
AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF DOWNEY TO REFLECT
SUCH CHANGE OF ZONE (ZONE CHANGE NO. 90 -104)
The Ordinance was read by title only. It was moved by Council Member
Boggs, seconded by Council Member Hayden, and unanimously carried to waive
further reading and adopt.
ADMINISTRATIVE REPORTS
GATEWAY BEAUTIFICATION PROJECT
Mr. Rangel summarized the staff report, noting the recommendations made by
staff and the subcommittee composed of Council Members Boggs and Hayden. He
referenced a slide map of the subject area.
Council Member Cormack suggested the use of drought - resistant landscaping
to conserve water in this area.
Discussion ensued regarding the development potential of this parcel,
retaining future selling rights, and clarification of the maintenance costs
involved.
It was moved by Council Member Boggs, seconded by Council Member Hayden,
and unanimously carried to retain ownership of Parcel 16265- 002 -903 for
inclusion in the Gateway Improvement project; authorize purchase of 30 square

foot Parcel 16265 -002 -049 contiguous to Parcel 16265- 002 -903 in the amount of
$500; provide Mr. Qualls, property owner adjacent to Parcel #6265- 002 -903, an
easement of City -owned Parcel 16265- 002 -904; provide Mr. Qualls with a driveway
approach off Kl ondyke Avenue; appropriate $58,273 from the Community
Development Block Grant Fund reserve; utilize drought - resistant landscaping
materials and retain the right for future sale of the parcel.
OTHER BUSINESS - Items Removed from the Consent Calendar:
UNSCHEDULED EQUIPMENT PURCHASE OF FLAG POLES FOR FIRE STATIONS 2, 3, & 4
Council Member Cormack expressed concern with the high cost of materials
for this project.
After further discussion, Mr. Caton advised staff will obtain three bids
for materials prior to installation.
It was moved by Council Member Brazelton, seconded by Council Member
Hayden, and unanimously carried to authorize the purchase of three 30' flag
poles and materials for installation, subject to obtaining three bids on
materials for this project.
RIO HONDO GOLF COURSE FEE RESOLUTION
Council Member Hayden suggested deferring consideration of this matter
until the budget study session at which time other fees will be evaluated.
It was moved by Council Member Hayden, seconded by Cormack, and
unanimously carried to defer consideration of the Rio Hondo Golf Course Fee
Resolution until the budget study session.
RESOLUTION NO. 5417
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE FINAL SUBDIVISION NAP OF TRACT MAP NO. 48168
( 11701 RIVES AVENUE AT BROOKMI LL ROAD) , APPROVING AN AGREEMENT
WITH THE SUBDIVIDER AND ACCEPTANCE OF A TINE CERTIFICATE OF ,--■
DEPOSIT IN LIEU OF SURETY BONDS
The Resolution was read by title only.
Mr. Paul Detilla, 10829 Downey Ave., discussed a discrepancy in the
property boundaries of this Map and requested the matter be returned to staff
for further study.
Mr. Thorson advised that since all conditions imposed on the tentative map
have been met and the title company has informed staff of its intent to issue a
Subdivision Guarantee to Los Angeles County, Council is obligated to approve
the Final Map. He noted this approval will not preclude the property owners
from resolving any differences between them by agreement or litigation.
Council Member Cormack questioned when the procedure will be modified to
require Council consideration of tentative maps and was informed staff will
return with an ordinance changing the current process in approximately 60 days.

Mr. Caton advised that tentative maps w i l l be placed in the Council's
mailboxes for their comments until this Ordinance is adopted.
Further discussion ensued regarding the Council's responsibility to
approve the map, the dispute over the property lines and adequacy of the
assurance letter from the title company.
Mayor Paul noted the property boundary discrepancy is a matter for civil
litigation between the property owners.
Council Member Brazelton clarified with staff that conditions imposed on
the tentative map have been met and Final Map approval will not preclude the
property owners from resolving their boundary dispute.
It was moved by Council Member Hayden, seconded by Council Member
Brazelton, and carried by the following vote to waive further reading and
adopt:

NOES: 1 COUNCIL MEMBERS: Cormack
OTHER BUSINESS - Council Members:
Council Member Cormack requested the issue of unsavory material in
newsracks be placed on the next agenda for discussion.
Council Member Boggs recalled past performances of the Downey City Youth
Band under the direction of Caesar Mattei during the Vietnam era and requested
special recognition be given to Mr. Mattei for his contributions to the
community.
Mayor Paul requested special recognition be given to returning Downey
servicemen serving in the Persian Gulf.
ADJOURNMENT: 9:25 p.m.
The meeting was adjourned in memory of Mr. John Boyd, former City Editor
of Southeast Daily News to 6:30 p.m., April 9, 1991 in the Council Chamber of
the Downey City Hall.
