John Delgatto, representing the Pasadena Tournament of Roses Committee presented a Portrait of Downey's 1991 Rose Float to Mayor Paul. Members of the Rose Float Committee in the audience were recognized. Mayor Paul presented a Proclamation recognizing February as "American History Month" to Martha Sodentani representing the . Council Minutes 2/12/91 -1- nt HEARINGS: Mayor Paul opened the public hearing on DOWNEY MUNICIPAL CODE AMENDMENT REGARDING WATER CONSERVATION REGULATIONS AND RESTRICTIONS. Ms. McDonnell affirmed the proof of publication. It was moved by Council Member Boggs and so ordered to receive and file. Mr. Ralph summarized the staff report, recommending adoption of an urgency ordinance and introduction of a regular ordinance pertaining to the conservation of water. correspondence had been received. ''� No corres P Mayor Paul called for those present in the audience who wished to speak in favor of the proposed Code Amendment. Mr. Jim Derry, 7845 4th St., representing the Department of Water and Power in Los Angeles, spoke regarding the severe water shortage in California and the need for conservation measures. He discussed the process of desalinization, including the high costs involved. Replying to Council Member Hayden's question regarding flooding liability resulting from cloud seeding, Mr. Derry stated that lawsuits had been filed in the past on this issue and remarked on the absence of clouds to seed. Mr. Lennie Whittington, 8542 Manatee, favored the process of adopting the regular ordinance as opposed to the urgency ordinance. He discussed various ways to save water, including median and golf course irrigation and rationing plans. Mayor Paul called for those present in the audience who wished to speak in opposition. Mr. David Cobb, 8556 Farm St., spoke against rationing water by reducing a percentage or basing allocation on previous water bills. It was moved by Council Member Cormack, seconded by Council Member Hayden, and so ordered to close the hearing. ORDINANCE NO. 923 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING A WATER SHORTAGE EMERGENCY AND ADDING SECTIONS 7350 THROUGH 7356 TO THE DOWNEY MUNICIPAL CODE RELATING TO ADOPTING WATER CONSERVATION REGULATIONS AND RESTRICTIONS The Ordinance was read in its entirety. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried to adopt. Prior to the foregoing vote, Council Member Boggs offered assurance that an equitable program would be implemented should rationing be required. Council Member Hayden questioned how the Ordinance would be enforced. Council Minutes 2/12/91 -2- i 0 • ')100 Mr. Caton discussed the ' process by which the Public Works Department will enforce the Ordinance, noting a proactive approach will be taken. en, Staff will notify residents of the new Ordinance through various media sources. Council Member Hayden expressed concern regarding low ' 9 9 ow income residents who cannot afford to comply, specifically citing the requirement to repair leaks within 48 hours. Mr. Caton mentioned the Block Grant Program could assist these residents assuming they qualify for aid. 9 y q y a Council Member Brazel ton noted that most • people could comply with this very mild Ordinance, and hopefully tonight's action will be the most severe needed to address water conservation. Council Member Cormack questioned necessity q e the necessi of the odd /even day watering schedule based on residential addresses. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING A WATER SHORTAGE EMERGENCY AND ADDING SECTIONS 7350 THROUGH 7356 TO THE DOWNEY MUNICIPAL CODE RELATING TO ADOPTING WATER CONSERVATION REGULATIONS AND RESTRICTIONS The Ordinance was read by title only. It was moved by Council y y c Member Boggs, seconded by Council Member Cormack, and unanimously carried to waive further reading and introduce. ORAL COMMUNICATIONS Mr. Gary McCaughan, 7918 8th St., read a statement regarding the potential closure of the Anesthesia Department at Downey Community Hospital, and requested the City investigate this matter, Mr. Norman Horney, 9102 Angell St., questioned whether water bills will be changed to show gallons used and was informed this modification will be made on future water bills. ITEMS REMOVED FROM THE CONSENT CALENDAR Agenda Item VI -E -4, ELECTRONIC MAPPING SYSTEM FOR EMERGENCY RESPONSE, and Agenda Item VI -E -5, REVIEW OF THE CITY'S SIGNING REQUIREMENT REGARDING MULTIPLE TENANT OFFICE BUILDINGS, were removed by Council Amber Boggs. RESOLUTION NO. 5404 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF TRACT MAP NO. 49805 (13028 -40 PARAMOUNT BOULEVARD AT GARDENDALE STREET), APPROVING AN AGREEMENT WITH THE SUBDIVISION AND ACCEPTANCE OF AN IRREVOCABLE LETTER OF CREDIT IN LIEU OF SURETY BONDS ORDINANCES NOT SET FORTH ABOVE ORDINANCE NO. 924 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY CHANGING THE ZONING CLASSIFICATION OF THE PROPERTY AT 7051 -7199 FIRESTONE BOULEVARD TO GENERAL COMMERCIAL (C -2) AND AMENDING THE OFFICIAL ZONING NAP OF THE CITY OF DOWNEY TO REFLECT SUCH CHANGE OF ZONE (ZONE CHANGE NO. 90 -62) The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Hayden, and unanimously carried to waive further reading and adopt. ADMINISTRATIVE REPORTS SEWER MAINTENANCE Mr. Ralph summarized the staff report, recommending authorization to receive bids for sewer maintenance to compare outside contract and in -house costs. It was moved by Council Member Boggs, seconded by Council Member Hayden, and carried by the following vote to authorize the Department of Public Works to go to bid for sewer maintenance: AYES: 4 COUNCIL MEMBERS: Boggs, Hayden, Brazelton, Cormack NOES: 1 COUNCIL MEMBERS: Paul Prior to the foregoing vote, Mayor Paul expressed support of using in- PP g house services for sewer maintenance to limit future costs and maintain home control. Council Minutes 2/12/91 -4- • REDUCTION OF STREET SWEEPING SCHEDULE TO BI- WEEKLY 1 3 Mr. Powell summarized the staff report, recommending modification of the street sweeping schedule from weekly to bi-weekly to conserve funds. Mr. Norman Horney, 9102 Angell St., expressed concern with maintaining living conditions in the area affected by the Century Freeway construction. He requested continued weekly street sweeping for the area two streets north and south of the Century Freeway and all north -south bridges and streets in the vicinity. Council Member Hayden concurred, noting this problem area should be addressed separately. She expressed support of the b t weekl y sw epi ng s in n all other areas of the City through the end of the fiscal year to increase budget savings. Council Member Boggs expressed concern that public confusion will result if this new schedule is implemented, specifically citing the change in street parking. Council Member Cormack agreed the Century Freeway area should be swept weekly in addition to the main thoroughfares throughout the City. However, weekly sweeping is sufficient in other areas through the end of the fiscal year. Council Member Brazelton expressed concern with maintaining the aesthetics of the City. He questioned the flexibility of the contract with the street sweeping company and was informed the new arrangement will have to be negotiated. Mayor Paul stated his opinion that the confusion for the public created by this change and the negative aesthetic effects warrant weekly sweeping throughout the City. It was moved by Council Member Hayden, seconded by Council Member Cormack, and failed by the following vote to reduce the street sweeping schedule from weekly to bi- weekly for the remainder of the fiscal year in all areas of the City except the Century Freeway area: AYES: 2 COUNCIL MEMBERS: Hayden, Cormack NOES: 3 COUNCIL MEMBERS: Boggs, Brazelton, Paul Motion FAILED. OTHER BUSINESS - Items Removed from the Consent Calendar: ELECTRONIC NAPPING SYSTEM FOR EMERGENCY RESPONSE Chief Irwin summarized the staff report, recommending authorization to develop an electronic mapping system to be used by the Fire and Police Departments. It was moved by Council Member Hayden, seconded by Council Member Brazelton, and unanimously carried to authorize the Fire Department to enter Pa into a contract with BSI Consultants to develop a scaled, electronically automated map of the City of Downey to be used by the - Fire and Police Departments in emergencies at a proposed contract price of $25,000 Council Minutes 2/12/91 -5- 4-- 1 (I j k) Prior to the foregoing vote, Council Member • Boggs expressed concern with considering this project during a time of financial restraint and ' the System had questioned why y a not been implemented during the past three years when funds were appropriated.
