JANUARY 8, 1991
The City Council of the City of Downey held a regular meeting at 7:55 p.m.,
January 8, 1991, in the Council Chamber of the Downey City Hall, Mayor
Roy L. Paul presiding.

Mayor Paul opened the public hearing on GENERAL PLAN AMENDMENTS 90 =2 -
CONSERVATION ELEMENT; 90 -3 - NOISE ELEMENT; AND 90 -4 - SAFETY ELEMENT.
Mrs. McDonnell affirmed the proof of publication. It was moved by Council
Member Hayden and so ordered to receive and file.
Mr. Rangel summarized the staff report, recommending approval of the
proposed chapters of the General Plan and corresponding Negative Declarations of
Environmental Impact.
.Mayor Paul recognized those members present in the audience who serve on
the General Plan Steering Committee.
There was no correspondence received on this matter.

• . . Mayor Paul called for those present in the audience who wished to speak in
favor or opposition to the proposed General Plan Amendments. There was no
response.
I t was moved by Council Member Cormack, seconded by Council Member Hayden,
and so ordered to close the public hearing.
Council Member Boggs requested a study session be scheduled to further
analyze these important amendments to the General Plan. She also encouraged
consideration of the mid -year budget review at the same time as the General Plan
Amendments are studied.
It was the consensus of Council to set the study session for 4:30 p.m.,
January 18, 1991 in the Council Chamber of the Downey City Hall.
Mayor Paul opened the public hearing on LIGHTING DISTRICT ANNEXATION 91/01 -
LAURELDALE AVENUE FROM GOLDEN AVENUE TO 490 FEET NORTHERLY.
Ms. McDonnell affirmed the affidavit of posting of notice and proof of
publication. It was moved by Council Member Boggs and so ordered to receive and
file.
There were no written protests or objections received.
Mr. Ralph summarized the staff report, recommending approval of the subject
annexation.
Mayor Paul called for those present in the audience who wished to speak in
favor of the proposed annexation.
Ms. Lupe Rodriguez, 13243 Laurel dale Ave., stated she initiated the
petition to request lighting; however, she is concerned about the location of
the proposed lights.
Mr. Ralph suggested continuing the hearing to allow time for staff to
distribute maps showing the exact placement of lights to residents on the
affected block.
It was moved by Council Member Boggs, seconded by Council Member Hayden and
unanimously carried to continue the public hearing to 7:30 p.m., January 29, -
1991 in the Downey City Council Chamber.
ITEMS REMOVED FROM THE CONSENT CALENDAR
Agenda Item VI -C -1, CASH CONTRACT NO. S.S. 430 - LAKEWOOD BOULEVARD MEDIAN
LANDSCAPING - PHASE II: AWARD CONSTRUCTION CONTRACT, and Agenda Item VI -E -2,
IMPERIAL SCHOOL CHILD CARE /CHARGES FOR CUSTODIAL SERVICE were removed by Mayor
Paul.
Agenda Item VI -E -7, CONTRACT WITH SOURISSEAU SUPPORT SERVICES TO CONDUCT
EMPLOYEE BACKGROUND INVESTIGATIONS was removed by Council Member Boggs.

It was moved by Council Member Cormack, seconded by Council Member Hayden,
and unanimously carried to waive further reading of the Resolutions and approve
the remainder of the Consent Calendar as recommended:

AMENDING SECTIONS 7330, 7330.1, AND 7330.2 OF THE DOWNEY
MUNICIPAL CODE AND ADDING SECTIONS 7330.3, 7330.4, 7330.5 AND
7330.6 TO THE DOWNEY MUNICIPAL CODE RELATING TO THE CROSS -
CONNECTION CONTROL PROGRAM TO PROTECT THE PUBLIC WATER SYSTEM
The Ordinance was read by title only. It was moved by Council Member
Cormack, seconded y '
conded by Council Member Boggs, and unanimously carried to waive
further reading and adopt.
ADMINISTRATIVE REPORTS
RECOMMEND CITY COUNCIL MEET WITH LOCAL AND STATE REPRESENTATIVES CONCERNING
SENATE BILL 2557 AND ALSO AIR QUALITY MANAGEMENT DISTRICT ON TRIP REDUCTION
REQUIREMENTS
Mr. Caton discussed concerns with the State's 1990 -91 budget and the City's
desire to obtain legislative relief.
It was moved by Council Member Boggs to approve the City Manager's
recommendation. (Motion later withdrawn).
Council Members Hayden and Boggs volunteered to meet with representatives
to discuss budget policies affecting the City.
Mayor Paul requested continual updates on this matter from the City's
lobbyist, Joe Gonsalves.
Council Member Hayden noted options suggested by y the League of California

Cities, such as meeting with local school board representatives, area Mayors and
City Managers, and the Board of Supervisors to further discuss this subject.
Council Member Boggs withdrew her previous motion.
SCHEDULE MID -YEAR BUDGET REVIEW DATE - -�
Mayor Paul advised the budget review date has been set for 4 :30 P .m.
January 18, 1991 in the Downey City Council Chamber, to coincide with the study
session scheduled for the General Plan Amendments.
OTHER BUSINESS - Items Removed from the Consent Calendar:
CASH CONTRACT NO. S.S. 430 - LAKEWOOD BOULEVARD MEDIAN LANDSCAPING - PHASE II
Mayor Paul expressed concern that funds used for this roject were not
designated within p
s gnatedfor priority needs within the City, such as safety and maintenance
considerations.

Council Member Cormack voiced support of aesthetically improving the
appearance of the City.
Council Member Hayden noted the actual bid was less than the estimated cost
of the project.
It was moved by Council Member Brazelton, seconded by Council Member
Cormack, and carried by the following vote to award a unit price contract in the
amount of $171,590.60 to Artistic Landscaping and Engineering for median
landscaping on Lakewood Boulevard under Cash Contract No. S.S. 430:

IMPERIAL SCHOOL CHILD CARE CUSTODIAL CHARGES
Mayor Paul expressed concern with the City being charged for custodial
services at the Imperial School Child Care facility, as this action may set a
precedent for charging fees between the City and School District. He
recommended postponing this matter until a meeting could be arranged between the
City and School District to discuss the situation.

Boggs noted the charges would not be disbursed from the
City's budget, but would derive through Child Care registration fees paid by
participants of the program.
It was moved by Council Member Boggs and seconded by Council Member Cormack
to approve payment of the charges. (Modified by later motion).
Council Member Cormack encouraged maintaining a close working relationship
with the School District.
Council Member Hayden agreed with Mayor Paul, prefering to continue this
matter until after the joint meeting between the City and School District.
Mr. Caton advised he will contact the District Superintendent and return
with a proposed meeting date. He suggested this matter be carefully considered,
as future charges from the School District are a real possibility.
It was moved by Council Member Cormack, seconded by Council Member Hayden,
and carried by the following vote to delay action on the above motion until
after the joint meeting between the City and School District:

CONTRACT TO CONDUCT EMPLOYEE BACKGROUND INVESTIGATIONS
Council Member Boggs questioned whether bids should have been received on
this contract and requested further information on the proposed firm.
Chief Mayes discussed the high qualifications of Sourisseau Support
Services in conducting background investigations.

Mr. Caton advised the bidding procedure does not legally apply to this type
of contract.
It was moved by Council Member Boggs, seconded by Council Member Cormack,
and unanimously carried to approve a contract with Sourisseau Support Services
for purposes of conducting Personnel Background Investigations for city
applicants at a cost of $35 per hour.

OTHER BUSINESS - Staff Members:
Mr. Caton discussed recent ubl ici t about dissension
p y ssens� on � n the Downey Police

Department, and mentioned he has offered his services as mediator between the
Association and the Chief of Police in an attempt to internally resolve h
p y s ve t o
differences that exist. He requested the support of Council in this matter.
Council Member Boggs expressed concern regarding the ublicit dissension
and low morale g p publicity, •
within the Police Department, and hoped this mediation effort
will resolve the problems that exist between all parties.
Council Member Cormack voiced support of the City Manager's attempt to

mediate and resolve this issue.
Council Member Brazelton advised he has met with the head of the Police
Officers Association on several occasions and can determine no substantive basis
for dissatisfaction. He expressed support for Mr. Caton's efforts and the hope
that any further action would be delayed until the City Manager can mediate
between the parties involved.
Council Member Hayden expressed dismay at the problems occurring between
the Association and management staff of the Police Department, and voiced
support of the City Manager's mediation efforts and the Police Chief.
Mayor Paul encouraged resolution of problems through addressing issues as
opposed to any other form of action, and noted support of the City Manager's
attempt and the Police Chief.
OTHER BUSINESS: Council Members:
Council Member Boggs questioned the status of the wall around the Park and
Ride lot adjacent to Ward Elementary School and was informed that state and
federal transportation officials have guaranteed funding for the project which
w i l l begin soon.
Council Member Boggs inquired about the traffic signal at Barl i n Avenue and
Gardendale Street and was informed that a temporary facility is being installed
at the location unti l the permanent signal is established.
Council Member Boggs spoke regarding a mobile police station used in the
City of Norwalk to combat criminal activity. It was agreed that a demonstration
of this mobile station will be scheduled for 6:00 p.m., January 29, 1991.
Council Member Hayden asked if the Blue Ribbon Committee report would be
available at the meeting of January 29, 1991 and was informed the information
will be given to Council on this date.

his suggestion.
