The City Council of the City of Downey held a regular meeting at 7 :48 p.m.,
November 13, 1990, in the Council Chamber of the Downey City Hall, Mayor

Mayor Paul presented a Commendation to Anthony Gauthier for his efforts in

City of Downey.
Mayor Paul read a Proclamation recognizing the week of November 18 -24, 1990
as 'National Family Week.'

Mayor Paul opened the Public Hearing on APPEAL, ZONE VARIANCE NO. 90 -48 FOR
PROPERTY LOCATED AT 8423 PRISCILLA STREET. He advised that staff and the
applicant's representative have requested this hearing be continued to the
regular meeting of December 11, 1990.
It was moved by Council Member Hayden, seconded by Council Member Boggs,
and so ordered to continue the public hearing to 7:30 p.m., December 11, 1990 in
the Downey City Council Chambers.

Brazelton, and unanimously carried to waive further reading of the Resolutions
and approve the remainder of the Consent Calendar as recommended (Council

RESOLUTION NO. 5379
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ESTABLISHING WATER RATES FOR THE CITY OF DOWNEY AND
RESCINDING RESOLUTION NO. 5097
Mr. Ralph summarized the staff report, recommending adjustment of the
current water rates to fund capital improvements to the City's water system and
consideration of a modified water rate structure that would encourage
conservation.
Council Member Hayden questioned whether it would be more appropriate
to
consider this rate adjustment when the new structure is proposed and was advised
the revenue is needed at this time to maintain the current level of service.
In response to questions from Council Member . Boggs regarding the success of
voluntary conservation, Mr.
y Ralph noted a reduction in water use of 8 -12% had
occurred in the last six months except -Se September which is '
P p still being
reviewed.
Council Member Hayden recommended modification of the rate structure to
allow a more equitable cost distribution among large and small water consumers.
Mayor Paul questioned status of the new well and was informed the necessary
housing is under construction with final completion expected in two to three
months.
Mr. Thorson advised of additional language necessary after Section 3 in the
Resolution, stating "Resolution No. 5097 is hereby repealed."
The Resolution was read by title only. It was moved by Council Member

RESIDENTIAL REFUSE RATE
Mr. Ralph summarized the staff report, recommending approval of the new
refuse collection rates to offset hauler expenses.
Mayor Paul noted correspondence had been received from Mr. Ken Krogstad
requesting this matter be continued to allow his client an opportunity to
present a lower bid.
Mr. Thorson advised since a contract currently exists and will not expire
for another year, new bids will not be considered until such time as ,the current
---* contract terminates.
Mayor Paul commented on various options being studied by the Sanitation
District to address this problem.
It was moved by Council Member Cormack, seconded by Council Member
Brazelton, and unanimously carried to approve the new refuse collection rates of
$8.48 per month for single- family residences and $7.32 per unit per month for
multiple -unit residents.
AB939 SURCHARGE (WASTE MANAGEMENT BILL)
Mr. Ralph summarized the staff report, recommending costs incurred through
compliance with AB939 be included on refuse disposal bills sent to residents
under a separate identification of "Surcharge for Compliance to State AB939".
The expense amount would be $0.95 per month for a single family residence and
$0.90 per month for a multiple family residence.
Discussion ensued regarding the effectiveness of voluntary vs. mandatory
recycling, and the success of the Green Waste Program.
Mayor Paul expressed concern with the effect that increased rates will have
on people living on a low or fixed income and requested a report be returned
addressing this problem.

Brazelton, and unanimously carried to approve the inclusion of costs associated
with compliance of AB939 to the refuse disposal bill sent to residents.

OTHER BUSINESS - Items Removed from the Consent Calendar:
CASH CONTRACT NO. S.S.430, LAKEWOOD BOULEVARD MEDIAN LANDSCAPING - PHASE II
Council Member Boggs expressed concern with unfinished medians on Lakewood
Boulevard south of Firestone Boulevard and was informed a report would be
returned examining this situation.
Mayor Paul also voiced concern with the high cost of the project, noting
higher priorities exist throughout the City which could have been addressed
using these funds.

grant authority to advertise for bids on Phase II of the Lakewood Boulevard
Median Landscaping Project at a cost of $264,000, contingent on return u n of a
report focusing on the unfinished medians south of Firestone Boulevard.

INTRA -CITY TRANSIT STUDY
Council Member Brazelton requested this study be halted if the results
appear too costly.
It was moved by Council Member Brazelton, seconded onded by Council Member Boggs,
and unanimously carried to authorize the hiring of the firm A.M.M.A. to
undertake the intra -city transportation needs assessment for the Cit of Downey
at a cost of $19,927 funded by Proposition City y
y roposi ti on A monies, with the understanding the
study will be halted when the results appear to be economically impractical.
Prior to the foregoing vote, Council Member Boggs noted the importance of

It was moved by Council Member Hayden, seconded by Council Member
Brazelton, and unanimously carried to authorize approval of the proposal
submitted by EMCON Associates to, provide integrated waste management services
for the cities of the Southeast Area Integrated Waste Management Working Group,
and to appropriate $20,500 from unappropriated reserves to Account No. 10 -3105.
RESOLUTION NO. 5374
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONSENTING TO ESTABLISHMENT OF FLORENCE AVENUE WITHIN
SAID CITY AS A PART OF THE SYSTEM OF HIGHWAYS OF THE
COUNTY OF LOS ANGELES
Council Member Cormack questioned what control exists to deal with traffic
problems resulting from the synchronization and was informed the Resolution
could be rescinded to terminate this relationship if problems occur.
It was moved by Council Member Brazelton, seconded by Council Member Boggs,
and unanimously carried to waive further reading and adopt.
RESOLUTION NO. 5375
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE CITY ENGINEER TO EXECUTE RIGHT -OF -WAY
CERTIFICATIONS FOR FEDERAL AID PROJECTS
Council Member Cormack requested an explanation on the right -of -ways
involved and was informed all projects require certification, whether or not
right -of -ways exist and this Resolution will authorize the City Engineer to sign
the certifications.

It was moved by Council Member Cormack, seconded by Council Member Boggs,
and unanimously carried to waive further reading and adopt.
RESOLUTION NO. 5376
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ACKNOWLEDGING THE DESIGNATION OF THE LOS ANGELES COUNTY
TRANSPORTATION COMMISSION AS THE LOS ANGELES CONGESTION
MANAGEMENT PROGRAM (CNP) AGENCY FOR LOS ANGELES COUNTY
Council Member Cormack questioned the City's representation on this
Commission and was informed that Downey is not represented as a separate City,
but that all the cities in general are represented.
Mr. Caton commented this plan could have adverse impacts on the City. For
example, the Agency could get involved with land use decisions in the future.
By joining this effort, there is a possibility of future involvement through a
technical advisory committee comprised of staff members from affected Cities and
a greater possibility that monies from increased gas taxes would be received by
the City of Downey.
Council Member Hayden encouraged Council Member Cormack's membership on the
Los Angeles County Transportation Commission with his consent.

and unanimously carried to waive further reading and adopt.
Mayor Paul directed staff to return with a Resolution recommending that
Council Member Cormack serve on the Los Angeles County Transportation
Commission.
RESOLUTION NO. 5378
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
GRANTING THE APPEAL AND APPROVING ZONE VARIANCE NO. 90 -59
FOR PROPERTY LOCATED AT 8137 THIRD STREET
Council Member Brazelton advised he will be voting against this Appeal as
he has concerns with the findings for approval.
It was moved by Council Member Cormack, seconded by Council Member Boggs,
and carried by the foliowing vote to waive further reading and adopt.

ABSTAINED: 1 COUNCIL MEMBERS: Hayden
Prior to the foregoing vote, Council Member Hayden advised she will be
abstaining from voting on this matter as she was not present at the meeting
during which the Appeal was heard, noting, however, she would have encouraged a
compromise with regard to the number of signs allowed on the building.
OTHER BUSINESS - City Council Members:
Council Member Cormack questioned the time frame involved in reviewing the
changes proposed by the Charter Review Committee and was informed the City
Attorney is examining the changes at this time and they should be returned to
Council in December.
In response to uestions regarding n the recognition ceremony honoring the

Charter Review Committee for their efforts on this project, Mr. Caton advised he
w i l l return with a proposal setting a date for this event.
Council Member Hayden questioned the funding for PTA HELPS Program and the
Senior Citizen Trash Rebates and was informed these programs are financed
through a separate budgeting process other than Community Grant Funding.
Council Member Hayden requested review of the criteria for granting funding
requests and recommended they be limited to Downey - based, volunteer
organizations.
Mr. Jarrett advised that a subcommittee of the Recreation and Community
Services Commission was established to study this issue and w i l l be returning to
Council with their recommendation on this matter.

Council Member Boggs requested an update on the traffic signal installation
at the intersection of Barlin Avenue and Gardendale Street, and the block wall
near the Park - and -Ride Lot and Ward Elementary School. She questioned the
existence of special awards for police officers who perform beyond the call of
duty and was advised the Police Department is currently considering such a
program.
Council Member Hayden requested this meeting be adjourned in honor of the
police and fire personnel involved in the PACE Warehouse incident.
Mayor Paul requested City -wide notification on information regarding
utility user tax exemptions for low income and low fixed income residents. It
was agreed that staff would look into advertising this fact.

Mr. Caton noted establishment of the Downey Police and Fire Memorial Trust
Fund and reciept of a $4,000 donation from PACE Warehouse. He commented on the
consistent number of supervisors in Police Department for the past few years.
Mayor Paul advised the Council is recessing to closed session (9 :03 p.m.)
to continue discussion of items previously announced on the Closed Session
Statement.
The meeting reconvened at 10:15 p.m. with all Council Members present.
There were no closed session actions to report.

Dispatcher Terry Felix to 6 :30 p.m., November 27, 1990 in the Council Chamber of
the Downey City Hall.
