The City Council of the City of Downey held a regular meeting at 7:30 p.m.,
October 23, 1990, in the Council Chamber of the Downey City Hall, Mayor

Mayor Paul presented a Certificate of Recognition to Scott Shelley on his
attainment of First Class Boy Scout, Troop 406.

HEARINGS:
Mayor Paul opened the Public Hearing on STREET VACATION NO. 160, PORTION OF
TRUE AVENUE SOUTH OF METRO STREET.
Ms. McDonnell affirmed the affidavit of posting of notice. It was moved by
Council Member Cormack, seconded by Council Member Brazelton, and so ordered to
receive and file.
Mr. Ralph summarized the staff report, recommending approval of the
proposed street vacation.
Ms. McDonnell advised no correspondence has been received on this matter.
Mayor Paul asked if there was anyone present who wished to speak in favor
or opposition to the proposed street vacation.
Ken Miller, 7336 Cleargrove Dr., questioned ownership of the property to be
vacated, and was informed quitclaim deeds signed by owners on the west side of
the street allow for ownership to revert to property owners on the east side of
the street. He then expressed support of the proposed vacation.
It was moved by Council Member Cormack, seconded by Council Member Boggs,
and so ordered to close the hearing.
RESOLUTION NO. 5355
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF A PORTION OF TRUE AVENUE. THIS IS
APPROXIMATELY 110 FEET SOUTHERLY OF THE INTERSECTION OF
TRUE AVENUE AND METRO STREET AND LYING EASTERLY OF A LINE
THAT IS PARALLEL WITH AND THIRTY FEET EASTERLY OF
THE CENTERLINE OF TRUE AVENUE.
The Resolution was read by title only. It was moved by Council Member
Boggs, seconded by Council Member Cormack, and unanimously carried by the
Members present to waive further reading and adopt.
Mayor Paul opened the Public Hearing on APPEAL, ZONE VARIANCE NO. 90 -59 FOR
PROPERTY LOCATED AT 8137 THIRD STREET.
Ms. McDonnell affirmed the proof of publication. It was moved by Council
Member Cormack, seconded by Council Member Boggs, and so ordered to receive and
file.
Mr. Rangel summarized the staff report, recommending denial of the
Appeal. He narrated a brief slide presentation of the subject and surrounding
properties.
Ms. McDonnell advised no correspondence has been received on this matter.

Mayor Paul asked the applicant to come forward and present her case.
Maria Larkin, 9139 Raviller Dr., discussed her experience in constructing
her building over the last two years. She noted the high cost of current
signage and requested permission to retain the signs already on the property.
Mayor Paul asked if there was anyone present who wished to speak in favor
of the Appeal.
George Poppoff, 9064 Gainford Ave., explained he is involved with
developing properties west of the subject building and is concerned with
stringent requirements the City is imposing on developers.
Doris Patterson, 10524 Lesterford Ave., encouraged approval of the Appeal,
noting the applicant's property is an improvement to the area.
Mayor Paul asked if there was anyone present who wished to speak in
opposition. There was no response.

and so ordered to close the hearing.
RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DENYING ZONE VARIANCE NO. 90 -59 FOR PROPERTY LOCATED AT
8137 THIRD STREET
The Resolution was read by title only. (See later motion approving the
Appeal).
Council Member Boggs stated the signage on the property coincides with her
interpretation of the Sign Ordinance, eliminating sign clutter yet allowing for
small business recognition throughout the City.
Mayor Paul agreed the signage on the building meets the intent of the Sign
Ordinance.
Council Member Brazelton commented it would be difficult to establish
findings under the Code to approve the Variance without setting a precedent.
It was moved by Council Member Boggs, seconded by Council Member Cormack,
and carried by the following vote to approve the Appeal:

Prior to the foregoing vote, further discussion ensued regarding the amount
of signage allowed under the Code and the options available to the applicant.
Mayor Paul directed the City Attorney to return with the appropriate
findings for approval of the Zone Variance.

Mr. Caton summarized the staff report, recommending introduction of this
Ordinance as a means of funding additional police positions.

Mr. Powell discussed comparable statistics between twelve cities with
regard to police staffing. He noted provisions for hardship cases which are
exempt from utility users tax are already in the existing rules and regulations.
Chief Mayes commented on the staffing levels in the Police Department and
the rising crime statistics.
Joel Lubin, 7820 Al l engrove St., recommended holding a special election to
create a positive atmosphere in the community with regard to the utility users
tax.
Robert Shand, 10806 Pico Vista Lane, expressed support of the proposed
Ordinance as a method to collect monies for combatting the rising crime element
in Downey.
Roger Lawrence, 9627 Cheddar St., commented on the use of statistics to
serve a specific purpose and suggested the City follow a more frugal policy when
establishing management positions. He cautioned overreacting to recent criminal
activities and expressed support of a special election to discern the will of
the people.
Lennie Whittington, 8542 Manatee St., spoke against the proposed Ordinance,
noting the proposed tax of 3% would probably be raised in the future. He
recommended the implementation of a direct assessment on property taxes to
insure the monies collected would be used for police staffing and suggested
moderate spending among City Departments.
Ken Miller, 7336 Cleargrove Dr., expressed opposition to reimposing the
utility users tax to fund the increase in . police staffing. He referred to
Section 96D of Assembly Bill 8 (AB8) which increased the amount of Downey's tax
revenue by approximatley fifty percent. The utility users tax w i l l erode the
underlying issue of equity that justified Section 96D in AB8, thereby losing the
benefit of the added property tax. He advocated funding the police positions by
utilizing a special benefit assessment on property taxes to be collected
specifically for that purpose.
Guy Sterner, 10303 Downey Ave., expressed dismay that monies received from
the utility users tax would be deposited into the General Fund which could be
used for any purpose. He also commented on the lack of relationship between
the utility users tax amount and the police protection received, and suggested a
benefit assessment be imposed which would guarantee the monies collected would
be used for a specified purpose.
Michael Sullivan, 11116 Rives Ave., stated the tax was unfair specifically
to seniors and homeowners, and encouraged prudent spending within the City.
Mike Hadley, President of the Downey Police Officers Association, discussed
the necessity of increased staffing levels in the Police Department to maintain
a safe community.
It was moved by Council Member Cormack, seconded by Council Member Boggs,
and so ordered to close the public comment portion of the meeting.

Council Member Cormack expressed support of reimposing the utility users
tax as a means of financing needed police positions, noting hardship cases will
be exempt from this tax.
Discussion ensued regarding the procedure and time frame involved in

specifically for the hiring of police staff.
Council l Member Brazelton commented on the urgent need to increase police
staffing and supported the utility users tax as the most efficient source of
funding.
Council Member Boggs expressed support for increasing Police Department
staffing to contend with the rising crime rate. Her preference ference wool d be a
benefit assessment district depending on the time frame involved. She
questioned the existence of any case law reimposing the utility users tax and its effect on property tax allocation.
Mr. Thorson advised there have been no specific cases heard regarding this
matter; however, in his opinion based on the Tax and Revenue Code and related
case law, property tax allocation would not be affected.
Mr. Caton stated a report regarding the option of a benefit assessment
district could be returned for Council's review at the second reading of the
Ordinance.
Mayor Paul read a letter from Council Member Barbara Hayden expressing
support of the utility users tax as a funding source to increase police
staffing.
The Ordinance was read by title only. Mr. Thorson advised at the end of
the first l i n e on page 2 of the proposed Ordinance, the number "384" should be
replaced with the number "533 ".
It was moved by Council Member Brazelton, seconded by Council Member
Cormack, and unanimously carried by the Members present to waive further reading
and introduce.
Prior to the foregoing vote, Council Member Boggs was assured that
information relative to a Benefit Assessment District as an alternative funding
source will be returned for Council's review at the time of the second reading
of the Ordinance.
ORAL CONWNICATIONS
Joel Lubin, 7820 Al l engrove St., supported the reappointment of John
Kenned y to the Downey Civic Center Corporation. He requested Council review the
adequacy of the proposed water rate increases.
Lennie Whittington, 8542 Manatee St., spoke regarding his recent property
tax bill which included an assessment for street safety lighting. He expressed
concern with the procedure that provides an annual allowance for Public Works
employees to purchase work shoes.

Mike Doyle, 8561 Alameda St., commented on. 'USA Overseas Cruise Night" to
be held at Frisco Burger on November 17, 1990, proceeds of which will be used to
purchase videos, magazines and articles to be sent to the U.S. Military in the
Persian Gulf. He requested closure of a portion of Washburn Road for the event
and was referred to Chief Mayes for information.
Soozie V i l l a , 12618 Lakewood Blvd., spoke regarding the need for a handicap
ramp at Woodruff Avenue and Imperial Highway, and was referred to Mr. Ralph for
an update on the matter.
Doris Patterson, 10524 Lesterford Ave., complimented Laura Wilson and City
staff on their efforts involving the recently successful city -wide clean -up
project. •"■
Chief Mayes read a letter from injured Police Officer Randy Ewing to the
Council in which he expressed appreciation for their support during his recovery
period.
The meeting recessed at 9:35 p.m. and reconvened at 9:46 p.m.
ADMINISTRATIVE REPORTS
POLICE BUDGET AND MANPOWER LEVELS: REQUEST TO INCREASE APPROVED MANPOWER
LEVEL OF THE POLICE DEPARTMENT
Mr. Powell summarized the staff report, explaining this is a companion
measure to the proposed reimposition of the utility users tax and its subsequent
funding of increased police positions.
It was moved by Council Member Cormack, seconded by Council Member
Brazel ton , and unanimously carried by the Members present to approve.
Prior to the foregoing vote, Council Member Boggs clarified this approval
was contingent on identification of an appropriate funding source.
DOWNTOWN PARKING ASSESSMENT DISTRICT N0. 66
Mr. Rangel summarized the staff report, recommending establishment of a fee
for waiving two parking spaces on property at 10921 Downey Avenue and directing
staff to establish a Code Amendment addressing financial alternatives for
additional parking in the downtown area.

IN ACCORDANCE WITH SECTION 9150.24 OF THE DOWNEY MUNICIPAL
CODE ESTABLISHING THE FEE FOR THE WAIVER OF TWO PARKING SPACES
FOR THE PROPERTY LOCATED AT 10921 DOWNEY AVENUE, AS PART OF THE DOWNTOWN
ASSESSMENT DISTRICT N0. 66
The Resolution was read by title only. It was moved by Council Member
Cormack, seconded by Council Member Boggs and unanimously carried by the Members
present to waive further reading and adopt said Resolution establishing a waiver
fee of $2500 per space.

It was moved by Council Member Boggs, seconded by Council Member Cormack,
and unanimously carried by the Members present to approve a Minute Action
directing staff to revise the Downey Municipal Code regarding establishing financial alternatives for additional parking in the downtown area and
incorporating ratio these alternatives into the plan being developed by the Blue
Ribbon Committee for revitalizing the downtown area.

Council Member Boggs requested uested that her comments on pag# 6 referring to the

authorization to hire a consultant to do a feasibility, _implementation and
evaluation study of a Helicopter Program reflect her support for studying the
feasibility of an aerial surveillance program.
It was moved by Council Member Boggs, seconded by Council Member Cormack,
and unanimously carried by the Members present to approve the 'Minutes as
amended.
WARRANTS ISSUED: #28554 - 129005, $1,443,475.19
Lennie Whittington, 8542 Manatee St., expressed dismay at the high cost of
printing services for the "Communicator" reflected on Warrant No. 28714 and
suggested the City print the community newsletter in -house to lower expenses.
He also referred to expensive gift certificates for Stonewood Shopping Center
shown on Warrant No. 28980, that are given for employee longevity.
It was moved by Council Member Cormack, seconded by Council Member

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING PROCEDURES FOR THE EXPANSION OF THE PROJECT AREA COMMITTEE
FOR THE DOWNEY REDEVELOPMENT PROJECT
Council Member Brazelton advised he will be abstaining from voting on this
matter due to a conflict of interest.
It was moved by Council Member Boggs, seconded by Council Member Cormack,
and carried by the following vote to waive further reading and adopt:
AYES: 3 COUNCIL MEMBERS: Boggs, Cormack, Paul
NOES: 0 COUNCIL MEMBERS: None
ABSENT: 1 COUNCIL MEMBERS: Hayden
ABSTAIN: 1 COUNCIL MEMBERS: Brazelton
OTHER BUSINESS - City Council Members:
Council Member Boggs noted a letter from a constituent regarding address
painting on curbs and the excessive fee and demanding demeanor of the painter
who approached the resident. She requested staff review this matter.
