Mayor Paul presented a Certificate of Appreciation to Nathan Nelton in recognition of his Eagle Scout attainment. Council Minutes 10/9/90 -1- HEARINGS: Mayor Paul opened the Public Hearing on ADOPTION OF FOUR ORDINANCES GRANTING PETROLEUM PRODUCT PIPELINE FRANCHISES TO: MOBIL OIL CORPORATION GOLDEN WEST REFINING CORPORATION, ATLANTIC RICHFIELD COMPANY, AND FOUR CORNERS PIPELINE COMPANY. Ms. McDonnell affirmed the proof of publication. Received and filed. Mr. Ralph summarized the staff report, addressing concerns regarding safety of the pipelines. Ms. McDonnell advised no correspondence had been received other than letters contained in the packet material (from oil companies) . . - ` Mayor Paul asked if the oil company representatives wished to address the Council. There was no response. Mayor Paul asked if there was anyone present who wished to speak in favor or opposition to granting the franchises. There was no response. ORDINANCE NO. 915 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING A FRANCHISE TO MOBIL OIL COMPANY The Ordinance was read by title only. It was moved by Council Member Cormack, seconded by Council Member Hayden, and unanimously carried to waive further reading and adopt. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY, STATE OF CALIFORNIA A P S 0 CAL OitNI ADOPTING HISTORIC PRESERVATION STANDARDS FOR CERTAIN CULTURAL RESOURCES ELIGIBLE FOR THE NATIONAL REGISTER OF HISTORIC PLACES AND APPROVING OF A NEGATIVE DECLARATION The Ordinance was read by title only. It was moved by Council Member Boggs and seconded by Council Member Hayden to adopt (see motion to table, page 6) . Council Member Cormack expressed concern with the time restraints involved, encouraging some type of financial protection for the property owner who must abide by the Conditional Use Permit process which can take up to six months. Council Member supported historical Cou c ember Bo s su o ted this Ordinance as a beginning nni n for h� Boggs PP 9 9 preservation efforts and requested staff return with a report addressing possible financial loss for the property owner as a result of time p p p y e Mayor Paul noted, however, the Conditional Use Permit process could take a maximum time of 3 months if the application is expedited. He advised his vote against the introduction of the Ordinance was a result of the amendment which omitted the word "residential" throughout the preservation standards. Council Member Hayden questioned the funding source available for City purchases of historical properties and was informed the General Fund would be available for use. It was moved by Council Member Cormack, seconded by Mayor Paul, and unanimously carried to amend Section 9145.10 to include 'wl thi n 90 days of the filing of the completed application' Mr. Thorson advised the Ordinance will need to be re- introduced per the City Charter since this amendment changes the Ordinance as first introduced. Council Member Hayden noted all changes should be made before re- introducing the Ordinance to prevent a possible need to repeat this procedure. ORDINANCE NO. 919 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY RESCINDING ORDINANCE NO. 895 IMPOSING A MORATORIUM ON THE ' ISSUANCE OF DEMOLITION PERMITS FOR ALL RESIDENCES BUILT PRIOR TO 1939 AND CAPABLE OF FURTHER DEVELOPMENT The Ordinance was read by title only. It was moved by Council Member Brazelton, seconded by Council Member Cormack, and unanimously carried to waive further reading. It was moved by Council Member Brazelton, seconded by Council Member Hayden, and unanimously carried to adopt. ADMINISTRATIVE REPORTS AUTHORIZE PRICE DEPARTMENT TO HIRE CONSULTANT TO DO FEASIBILITY, IMPLEMENTATION, AND EVALUATION STUDY OF HELICOPTER PROGRAM Chief Mayes summarized the staff report, noting his recommendation for authorization to contract with Mr. George Tawes at a cost of $30,000 to conduct a f e a s i b i l i t y study and evaluation of a law enforcement helicopter program. Mr. Caton advised he is not opposed to a helicopter program; however, priorities should be established within the Police Department before considering this option. )6X . v Council Member Boggs recommended adding a prioritized list of current and future Department needs to the proposed study. She voiced support of an aerial AO& surveillance program, requesting further information during the budget review process. Mayor Paul encouraged soliciting requests for proposals for this study, since a large amount of money is involved. Council Member Hayden concurred with the need for reviewing priorities in the Department, specifically staffing levels. It was moved by Council Member Boggs and seconded by Council Member Hayden to add a prioritized list of present and future needs of the Police Department to the proposed study. The proposal now under consideration solely addresses the helicopter program. Council Member Hayden withdrew her second; the motion therefore died. It was moved by Mayor Paul, seconded by Council Member Hayden, and carried by the fol 1 ow ng vote to solicit requests for proposals for the Police Helicopter Program, with the understanding that a prioritized l i s t of Department needs will be returned to Council during the budget review process. OTHER BUSINESS - Items Removed from the Consent Calendar: CONSENT TO ASSIGNMENT FOR STONEWOOD CENTER Mr. Thorson explained the approval will be for two Agreements: one involves Hughes /Lyon Downey and Wells Fargo & Company for a loan amount of $80,000,000; the second agreement is between Hughes /Lyon Downey and Wells Fargo Bank, National Association for a loan amount of $46,650,000. Also, the City is required to sign for both Assignment Agreements. It was -moved by Council Member Hayden, seconded by Council Member Brazelton, and unanimously carried to approve the Consent to Assignment for financing of Stonewood Shopping Center as clarified. ADMINISTRATIVE REPORTS: (Continued) USC STUDY OF ECONOMIC IMPACT OF FEMA REGULATIONS Mr. Messinger discussed staff's recommendation for authorization of an agreement with the University of Southern California School of Urban and Regional Planning for the preparation of a study of economic impacts of FEMA flood plain regulations at a cost of $55,000. Council Member Brazelton commented all cities involved should be committed to this program to insure the equal distribution of costs. It was moved by Council Member Bratel ton, seconded by Council Member Boggs, and unanimously carried to approve this Agreement provided that costs are equally distributed among participating cities. CONTRACT FOR MILE DATA COMMUNICATIONS SYSTEM AND APPROPRIATION Lt. Baptista summarized the staff report, recommending approval of a contract with Motorola/Mobile Digital International in the amount of $744,220 plus a 6.5% contingency to install a Mobile Data Communications System for local fire and police agencies; and appropriate $170,000 for this project. Mr. Caton suggested partial funding be considered from the Drug Asset Seizure Account to free up monies from the General Fund. Council Member Brazelton inquired as to enforcement of the Smoking 9 Ordinance in the City. Council Member Boggs suggested mailing a refresher letter to citizens as a reminder of the statutes contained in the Ordinance. Mr. Caton was directed to review this matter and take necessary steps to enforce the Ordinance. Council Member Brazelton questioned the status of the Sign Ordinance as it pertains to the Kentucky Fried Chicken restaurant on Florence Avenue, noting their Zone Variance had been denied by the Planning Commission. Mr. Rangel advised this company will be r e - f i l i n g a Zone Variance applica- tion, as their Appeal was not acted upon in a timely manner. OTHER BUSINESS - Staff Members: Mr. Caton commended the Police Department, particularly Captain Nathan, for their efforts in handling the robbery incident at PACE Warehouse. Mayor Paul asked for a moment of silence in honor of the police officers injured at the scene of the attempted robbery. Mayor Paul announced the Council is recessing to closed session (8:50 p.m.) to complete discussion of items previously announced on the Closed Session Statement. The meeting reconvened in open sesion at 9:40 p.m. with all Council Members present. There were no closed session actions to report.
