HEARINGS: Mayor Paul opened the PUBLIC HEARING ON DOWNEY IMPROVEMENT PROJECT NO. 730, WEST SIDE OF TWEEDY LANE BETWEEN BLANDWO0D ROAD AND BROOKPARK ROAD. Mrs. McDonnell affirmed the affidavit of posting of notice and mailing. It was moved by Council Member Hayden, seconded by Council Member Brazelton, and so ordered to receive and file. Mr. Redmayne summarized the staff report, recommending granting authorization to proceed and advertise for bids, and also appropriate $10,000 for construction of the improvements. There were no written protests or objections received on this matter. Council Minutes 9/11/90 -1- . 9 o or Mayor Paul called for those present in the audience who wished to speak in favor or protest to the proposed Improvement Project. There was no response. It was moved by Council Member Cormack, seconded by Council Member Hayden, and so ordered to close the hearing. I t was moved by Council Member Hayden, seconded by Council Member Boggs, and unanimously carried to approve Downey Improvement Project No. 730, granting authorization to proceed under Chapter 27 of Streets and Highways Code and advertise for bids, and also appropriate $10,000 from Fund 40 (Unbudgeted Fund Balance) for construction of the improvements. Mayor Paul opened the PUBLIC HEARING ON APPEAL, ZONE VARIANCE NO. 90 -31 FOR PROPERTY LOCATED AT 9325 CORD AVENUE. Mrs. McDonnell affirmed the proof of publication. It was moved by Council . y. Member Boggs, seconded by Council Member Hayden, and so ordered to receive and file. Mayor Paul advised the applicant has requested continuance of this hearing to the next Council meeting, and staff concurs with this request. It was moved by Council Member Cormack, seconded by Council Member Boggs, and unanimously carried to continue the public hearing on Zone Variance No. 90- 31 for property located at 9325 Cord Avenue to 7:30 p.m., September 25, 1990 in the Downey City Council Chamber, 11111 Brookshire Avenue, Downey, California. ITEMS REMOVED FROM THE CONSENT CALENDAR Agenda Item VI -E -1, MINUTES: ADJOURNED REGULAR MEETING, AUGUST 21, 1990 was removed by Council Member Boggs. PETROLEUM PRODUCT PIPELINE FRANCHISES RESOLUTION NO. 5337 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO GRANT PETROLEUM PIPELINE FRANCHISES TO ATLANTIC RICHFIELD COMPANY, FOUR CORNERS PIPELINE COMPANY, MOBIL OIL COMPANY AND GOLDEN WEST OIL COMPANY AND SETTING A PUBLIC HEARING TO CONSIDER SUCH FRANCHISES FOR OCTOBER 9, 1990 Council Minutes 9/11/90 -3- 9O7 The Resolution was read by title only. I t was moved by Council Member Cormack, seconded by Council Member Hayden, and unanimously carried . to waive further reading and adopt. Prior to the foregoing vote, Council Member Cormack expressed concern with the safety of underground pipelines, and was informed the pipelines are pressure tested periodically - an oil spill reported has never been reported. He requested a report be returned to Council outlining further information on the safety features of the pipelines. Mr. Thorson noted the franchise specifically calls for the City to receive copies of any reports filed with the State authorities that regulate the operation of the pipelines; thus, the City would be informed of any problems reported to the State. INTRODUCTION OF FOUR ORDINANCES GRANTING PETROLEUM PRODUCT PIPELINE FRANCHISES Mr. Thorson then discussed four Ordinances presented for introduction that are identical except the Ordinance for Four Corners Pipeline Company which is a Public Utility and will have a slightly different rate structure. He also noted the following correction on each of the four Ordinances, page 5, second paragraph, second line: the word "bond" should be replaced with the word "grantee ". Mr. David Dragt, representing Golden West Refining Company, Santa Fe Springs, advised he has submitted a letter to the City Clerk recommending changes to the proposed ordinance and will reserve his testimony for the public hearing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING A FRANCHISE TO GOLDEN WEST REFINING COMPANY The Ordinance was read by title only. ADOPTION FOUR URGENCY ORDINANCES GRANTING INTERIM FRANCHISES TO OPERATE PETROLEUM PRODUCT PIPELINES eyis ORDINANCE NO. 910 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING TO GOLDEN WEST REFINING COMPANY AN INTERIM FRANCHISE • TO OPERATE A PETROLEUM PRODUCTS PIPELINE IN THE CITY OF DOWNEY Mr. Thorson read this Ordinance in full as required by the City Charter, noting it is identical to the other three proposed Urgency Ordinances for adoption. It was moved by Council Member Boggs, seconded by Council Member Hayden, and unanimously carried to adopt. ORDINANCE.NO. 911 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING TO MOBIL OIL CORPORATION AN INTERIM FRANCHISE TO OPERATE A PETROLEUM PRODUCTS PIPELINE IN THE CITY OF DOWNEY Mr. Thorson read the title of this Ordinance, noting it is identical to the Ordinance read in full, except the name is changed in Sections 1, 2 and 10 to Mobil Oil Corporation. ORDINANCE NO. 912 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING TO ATLANTIC RICHFIELD COMPANY AN INTERIM FRANCHISE TO OPERATE A PETROLEUM PRODUCTS PIPELINE IN THE CITY OF DOWNEY Mr. Thorson read the title of this Ordinance, noting it is identical to the Ordinance read in full, except the name is changed in Sections 1, 2 and 10 to Atlantic Richfield Company. It was moved by Council Member Boggs, seconded by Council Member Hay den, and unanimously carried to adopt. ORDINANCE NO. 913 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY GRANTING TO FOUR CORNERS PIPELINE COMPANY AN INTERIM FRANCHISE TO OPERATE A PETROLEUM PRODUCTS PIPELINE IN THE CITY OF DOWNEY Council Minutes 9/11/90 -5- Mr. Thorson read the title of this Ordinance, noting i t i s identical g cal to the Ordinance read in full, except the name is changed in Sections 1, 2 and 10 to Four Corners Pipeline, and the following sentence is added to the end of the first paragraph in Section 6: "The grantee warrants and represents that it is a Public Utility within th of Public Utility Code y the meaning y o e Secti on 6231.5. The rate charged herein is the rate specified by Public Utilities Code Section 6231.5." It was moved by Council Member Boggs, seconded by Hayden, Council Member H and unanimously carried to adopt. ADMINISTRATIVE REPORTS RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY SUPPORTING PROPOSITION 138 AND OPPOSING PROPOSITION 130 Council Member Cormack voiced his support of this Resolution, commenting approach should be that a rational a PP a used in addressing the needs of the environment. The Resolution was read by title only. It was moved by Council Member Cormack and seconded by Council Member Hayden to waive further reading and adopt. (See motion to delay action). Council Member Boggs advised she will be abstaining from voting on this matter as she will be issuing g g a position on the ballot measures at a later date. Mayor Paul discussed his desire to avoid taking a stance on initiatives as there are many that would have to be considered. He advocated action on City- affected issues only. Council Member Cormack disagreed, noting this matter deals with lumber harvesting practices which could affect housing costs for the citizens of Downey. Council Member Brazelton indicated he would like to read the verbatim initiative prior to voting on this issue. It was moved by Council Member Cormack, seconded by Council Member Brazelton, and unanimously carried to delay action on this Resolution to the next Council meeting of September 25, 1990. Staff will provide a verbatim copy of the Proposition for Council consideration prior to the next meeting. OTHER BUSINESS - Items Removed from the Consent Calendar: MINUTES, ADJOURNED REGULAR MEETING, AUGUST 21, 1990 Council Member Boggs requested clarification on the disposition of the Charter Review Committee which was discussed at the end of the Study Session. Council Minutes 9/11/90 -6- Y► Mayor Paul stated he understood that Council recommendations and a letter of thanks would be sent to the Committee members, at which time their services would be completed. They would receive a special proclamation on behalf of their efforts. Council Member Boggs requested this be noted in the Minutes. Council Member Cormack recalled the great service the Committee has done for the City and encouraged a more elaborate display of gratitude than just a proclamation. Council Member Boggs concurred with Council Member Cormack's comments, noting the Committee's recognition should be a ceremonious occasion. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried to approve the Minutes of the Adjourned Regular Meeting, 9, August 21, 1990 with the additions discussed. VEHICLE TOWING AND SERVICE CONTRACT Mr. Robert Wade, 10473 Compton Blvd, Bellflower, representing Dales Toe, advised the fencing requirement would be met within 24 hours if Dales Toe is awarded the contract. Council Member Cormack noted this company had stated they would install fencing several years ago, at which time this should have been done. I t was moved by Council Member Cormack, seconded by Council Member Hayden, Y y en, and unanimously carried to award the vehicle towing and service contract to United Towing. ORAL CONM UN I CAT I ONS Mr. • . Lennie Whittington, 8542 Manatee St., expressed dismay at the procedure for recognizing citizens who have served the City. He specifically i f i ca 11 cited David P y and Judy Ray who served the City on various Boards and Commissions, but whose efforts were not recognized. He also advised of Judy Ray's recent death. OTHER BUSINESS - City Council Members: Council Member Hayden requested the issue of allowable colors on residential and commercial developments be addressed within the Building Code or at the Design Review Board level. Council Member Boggs announced the birth of her granddaughter Melissa Christine Boggs on September 10, 1990.
