Paul presiding. PRESENT: Council Members: Roy L. Paul Mayor Barbara J. Hayden Mayor Pro Tem (arrived at 6 :35 p.m.) Diane P. Boggs Robert G. Cormack Robert S. Brazelton ALSO PRESENT: Gerald M. Caton, City Manager June Yotsuya, Assistant to the City Manager Judith McDonnell, City Clerk ORAL - COMMUNICATIONS: None At 6:02 p.m. with the consent of the Council, Mayor Paul recessed the meeting for relocating to the third floor conference room of the Council office. The City Clerk was asked to post the change in location accordingly. The meeting resumed in the third floor Council conference room at 6 :13 p.m. with Council Member Boggs, Brazelton, Cormack and Paul present (Council Member Hayden absent). CHARTER REVIEW STUDY SESSION At this time, the Council conducted a study of the City Charter and • y. the proposed amendments submitted by the Charter Review Committee. With the exception of the changes made at this meeting, the Council concurred with the recommendations of the Committee. Section 500. City Council. Terms. In sub-paragraph (b), the ears �� 198 �� � f. � �� �� �� y 8 and 1986 were changed to "1992" and 1994 , respectively. Council Member Cormack preferred returning the City's Election back to April when the majority of other cities conduct their election. Council Member Brazelton favored limiting the number of Council terms to two four -year terms. The remaining Council Members agreed there was no need to limit the number of terms since there is usually a new Council Member installed at each election; also, Downey traditionally does not have multi -term Council Members as do other cities. City Council /Charter Review 8/21/90 (Adj.) -1- • /e\, q,c Council Member Hayden arrived at 6:35 p.m. The Council discussed Section 502. Compensation, concurring with allowing the voters to decide on how the Council compensation should be set. Referring back to Section 501. Eligibility. ualifications, Council Member Hayden commented that a person shall have been domiciled in and a voter of such district of the City for at least "90" days prior to running for a Council office. This will be referred to the City Attorney for opinion Section n 503. Vacancies. The Council agreed with the minority opinion of the Charter Review Committee to conduct a separate election to recall a Council Member and to select his or her replacement. This section will be re- worded accordingly. Section 509. Quorum. Proceedings. In the last sentence of the first paragraph, the words "It shall establish rules..." were changed to "it may establish rules...". In the second sentence of the second paragraph, the words "the attendance of witnesses, to examine them under oath and to compel" were retained. Section 510. Public Participation. The third l i n e shall read "closed sessions as permitted by State law." The remainder of the sentence on the third and fourth lines was deleted. In the second sentence, the words "concerning any agenda item" were removed. Section 515. Ordinances. Violation. Penalty. The first sentence will be rewritten by the City Attorney to include ° infractions." Section 518. Contracts. Restrictions. In the second line, the words "following a public hearing" were removed. Section 519. Contracts. Execution. In the third paragraph, the word "may" on the first line was retained, the word "shall" was deleted; on the second line, the words "real or" were retained. Section 600. City Manager. I n the first paragraph, the last two Y 9 P 9 words "and experience" were removed. Section 601. Residence. It was decided to rewrite this section to make it "desirable" or "preferable" that the City Manager reside in the City. Section 607. Removal. This section will be rewritten by the City Attorney to shorten the language but retain the intent of the wording. Section 703. City Attorney. Powers and Duties. In the first paragraph, second line, after the words "State of California," a period was inserted and the remainder of the sentence was removed. The City Manager will review previous information on employing a full -time attorney. City Council/ Charter Review 8/21/90 (Adj.) -2- t. Article VIII - Board of Education. This section will state "Deleted per State Law." Section 900. In General. The names of the specific boards and commissions were removed, and the second sentence shall read "In addition, the Council may create by ordinance additional advisory boards or commissions... ". The remainder of the sentence was retained. Section 902. Appointments. Terms. This section will be rewritten so that the terms of boards and commissions coincide with the Council Member's term of office. r-, Section 904. Meetings. Chairman. In the second paragraph, first sentence, the words "The City Manager shall" were changed to 'the City Manager mi." - Section 1202. Budget. Submission to City Council. In the first sentence, the proposed "45 days" was left at "35 days ". In the third line, the words "by the public at the office of the City Clerk" were removed. The last sentence was changed to read, "Copies of the proposed budget shall be available for inspection." Section 1210. Revenue Bonds. This section will be reworded by the City Attorney for clarification. Section 1213. Claims and Demands. Presentation and Payment. It was noted the procedures for submitting claims should be as prescribed by State Law, and this section will be changed to incorporate that wording. Section 1214. Actions Against City. The last sentence will be reworded to include approving or rejecting a claim "in the time frame as prescribed by State Law." The meeting recessed at 8:15 p.m. and resumed at 8:20 p.m. with all Council Members present. Section 1303. Initiative, Referendum and Recall. This section w i l l be rewritten to coincide with Section 503. During discussion on Sections 1305 and 1306 concerning Council Districts, it was suggested establishing an advisory committee to begin studying this matter prior to waiting for the 1990 Census results. Section 1306. Amending District Boundaries. In the second line, the word "citizens" was removed. Referring to Section 500. City Council.
