Council Member Cormack presented a Certificate of Appreciation to Austin Kane, past member of Emergency Preparedness Committee. HEARINGS: Mayor Barb opened the PUBLIC HEARING ON FISCAL YEAR 1990 -91 CITY BUDGET, City Clerk McDonnell affirmed the proof of publication. It was moved by Council Member Paul and so ordered to receive and file. Council Minutes 6/26/90 -1- 943f Assistant City Manager Powell summarized • 9 the staff report, recommending approval of the proposed budget and amending the Public Works budget to fund median landscaping along Lakewood and Firestone Boulevards. There was no correspondence received on this matter. Mayor Barb called for those in the audience who wished to speak in favor or opposition to the proposed budget. Mr. Lennie Whittington, 8542 Manatee St., - 9 t., requested there be a designated time for public input at budget study sessions i n the future, uture, and encouraged budget restraint. It was moved by Council Member Paul and so ordered to close the hearing. ear� ng. Mayor Barb commented that while budget study sessions are held during 9 Y ur ng the day when many people cannot attend, the actual budget hearing is held during hours to provide de a convenient g evening p nven�ent time for public input. Council Member Boggs requested a budget review every six months, with December being the next review date. She uestioned the`Communit S budget change. q y Services City Manager Caton noted there was a miscalculation on funding the librarian positions which resulted in additional money. The amended budget reflects this correction. Council Member Boggs requested support for litter fines and enforcement of current litter ordinances, noting the new medians on Lakewood Boulevard have already been affected. She commented the child care program will not be negatively affected by the budget cuts which reflect the absence of a second site for child care. Finally, during the six month review, she requested that new positions filled within those last six months also be analyzed. Mayor Barb questioned the difference between the total amount of funds held by the City at the end of the year in relation to the beginning of the year. He also expressed concern with incorporating Code Enforcement into the _ Building Division, encouraging them to remain separate entities. Assistant City Manager Powell commented on some of the major projects under the Capital Improvement Program, including a water master plan, street projects, etc. Discussion ensued regarding funding for future water needs and the child care program. Council Member Boggs advised that her action on the budget w i l l be contingent on the discussion of the City Fee Schedule. Council Minutes 6/26/90 -2- RESOLUTION NO. 5307 9 0 ‘: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING THE FISCAL YEAR 1990 -91 BUDGET WITH IMPLEMENTING DOCUMENTS The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Hayden, and unanimously carried to waive further reading and adopt. Mayor Barb opened the PUBLIC HEARING ON UNIFORM SCHEDULE OF FEES. City Clerk McDonnell affirmed the proof of publication. It was moved by Council Member Hayden and so ordered to receive and file. Assistant City Manager Powell summarized the staff report, recommending approval of the proposed fee schedule. Council Member Paul questioned the street sweeping parking permit fee for construction vehicles, noting that small jobs should not require such a fee. Public Works Director Ralph explained the permit fee is designed for construction companies that have large trucks parked for long periods of time in a neighborhood. City Clerk McDonnell advised no correspondence had been received on this matter. Council Member Boggs expressed concern over some of the fees, specifically noting the large increase in Fire Department and Planning Division fees. She encouraged a thorough review of the proposed increases prior to deciding on the fee schedule. Mayor Barb called for those in the audience who wished to speak in favor or opposition to the proposed Uniform Schedule of Fees. Mr. Lennie Whittington, 8542 Manatee St., read many of the current and proposed fees from the staff report. He requested fees be reviewed more frequently to prevent such large increases at one time. It was moved by Council Member Hayden, seconded by Council Member Paul, and so ordered to close the hearing. Council Member Boggs discussed the theory of user fees, noting the entire community benefits from the work of one property owner. She requested this item be returned after an extensive review of the proposed fees. Council Member Paul referred to the fee survey of 22 cities, expressing concern with a few of the proposed fees, specifically the Design Review Board fee. He requested certain fees be reviewed to encourage reputable development throughout the City. Council Minutes 6/26/90 -3 Council Member Hayden commented the Design Review Board is now composed of professional members and should be paid accordingly. She suggested gg establishing a separate fee for owner occupied, single family dwellings. Council concurred and City Attorney Thorson advised the language on a e 7 page of the Uniform Schedule of Fees under Design Review Board will separate out owner occupied, single family application fees and all other application fees. Council Member Boggs noted for the record she concurs with the change made but there still are many proposed fee increases that she cannot support. She requested in the future, the fee schedule be considered during the annual budget review. RESOLUTION NO. 5308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY { ESTABLISHING A UNIFORM SCHEDULE OF FEES The Resolution was read by title only. ORAL COMMUNICATIONS 7 Mr. Lennie Whittington, tt ngton, 8542 Manatee St., referred to a recent newspaper article that discussed the population of District One and perhaps the need for more representation. Council Member Boggs requested staff review this situation. Ms. Gloria Pasmant, 8833 Arrington Ave., spoke regarding the recent 9 9 shooting of Fullerton Police Officer De La Rosa that occurred in her neighborhood. She requested a meeting with City officials and residents to discuss possible solutions for problems in the area. She encouraged all contributions be sent to the family of the slain officer in Fullerton. She distributed pictures that were taken the day of the shooting. Mayor Barb advised Ms. Pasmant that her previous complaints about the neighborhood has resulted in the issuance of an arrest warrant for the ro ert P P Y owner of the house at which the shooting took place. He thanked Ms. Pasmant for her efforts and continual involvement in her community. City Clerk McDonnell affirmed the affidavit of posting and proof of publication. It was moved by Council Member Hayden and so ordered to receive and file. e City Clerk McDonnell advised no written rotests had been received. ved. Mayor Barb called for those in the audience who wished to speak in favor or opposition to the proposed annexation. There were none. In response to a concern expressed by Council Member Paul, City Attorney Thorson advised that unless a Council Member owns property in the area affected P Y to by the annexation, there is no conflict of interest. Also, the asssessment levy discussed in the next hearing is City -wide, and thus there is no conflict of interest. It was moved by Council Member Boggs, seconded by Council Member Hayden, and so ordered to close the hearing. RESOLUTION NO. 5310 A RESOLUTION OF THE CITY OF DOWNEY ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO MAINTAIN AND FURNISH ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS (ANNEXATIONS 90/02 THROUGH 90/45) The Resolution was read by title only. It was moved by Council Member ember Cormack, seconded by Council Member Paul, and unanimously carried to waive further reading and adopt. Council Member Paul expressed support for Option I and appreciation for the new information returned at this time. There was no correspondence received on this matter. Council Member Cormack commented that some inequity may result if Option I I were adopted; therefore, he supports Option I. Council Member Hayden expressed support for Option II. RESOLUTION NO. 5311 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE 1990 -91 FISCAL YEAR ASSSESSNENT FOR LIGHTING MAINTENANCE DISTRICT A.D. 121 The Resolution was read by title only. It was moved by Council Member Cormack and seconded by Council Member Boggs to waive further reading and adopt the Resolution with Option II. Further discussion ensued regarding clarification of the different methodology of assessment offerred in all options and the costs involved. ADMINISTRATIVE REPORTS CASH CONTRACT NO. 575 - DRILLING WELL NO. 4: RESOLUTION NO. 5314 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CERTIFYING THE NEGATIVE DECLARATION FOR DRILLING AND COMPLETING A WATER WELL ON THE WEST SIDE OF PARAMOUNT BOULEVARD AND NORTH OF GALLATIN ROAD The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Boggs, and unanimously carried to waive further reading and adopt. Council Member Cormack requested Council be given a copy of the drilling log when available. OTHER BUSINESS - Items Removed from the Consent Calendar: CORRESPONDENCE FROM DOWNEY JAYCEES REGARDING ANNUAL CARNIVAL /FIREWORK SHOW Council Member Boggs questioned whether this matter should be considered as an action item. She encouraged waiver of fees to this organization that provides such an outstanding patriotic event for the community. Mayor Barb cautioned waiving fees when they are not outlined. Council Minutes 6/26/90 -8- { 9 01 ”, Council Member Hayden expressed support for the program but could not waive fees when an amount had not been determined. She suggested establishing an upper limit to the fee waiver. Council Member Paul voiced support of a fee waiver for this organization. It was moved by Council Member Boggs and seconded by Council Member Cormack to waive fees as requested by the Downey JAYCEES. (See amended motion.) Mayor Barb expressed concern that the professionals who operate the show will make a profit from the City but not be required to pay any fees. With the consent of the second, Council Member Boggs amended her previous motion to waive all fees except those required by the professional operator who will be presenting the fireworks show and the carnival owner. Council Member Hayden requested that Council be given a list of the fees at the next meeting. The motion was carried by the following vote: AYES: 3 COUNCIL MEMBERS: Paul, Cormack, Boggs NOES: 2 COUNCIL MEMBERS: Hayden, Barb WATER RIGHTS, TRANSFER TO LOS ANGELES COUNTY PER AGREEMENT Council Member Cormack requested further explanation regarding the agreement. Public Works Director Ralph explained the original agreement with the County stated that should the Rancho development use less than 100 acre feet of water, the difference will be leased back to the County. Since the development did not use any of this water last year, staff is requesting authorization to return the water rights to the County. I t was moved by Council Member Paul, seconded by Council Member Cormack, and unanimously carried to approve the agreement. TESTIMONY SUPPORTIN SENATE SUPPORTING TE BILL 2500 RELATING TO BILLBOARD ABATEMENT Council Member Boggs expressed concern regarding lack of reimbursement to the billboard owner. Mayor Barb commented the amortization period addresses the issue of cost as it affords the owners time for removal. Bar•, Ma y or Council Minutes 6/26/90 -10- 4 e. 9C— ADDENDUM TO MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY JUNE 26, 1990 On page 4, under HEARINGS - UNIFORM SCHEDULE OF FEES, first paragraph, Council Member Hayden requested the first sentence be replaced with the � following: "Council Member Hayden commented the Design Review Board is now composed of professional members and is paid accordingly."
