Mayor Barb read a Proclamation recognizing June 14, 1990 as Flag Day. HEARINGS: Mayor Barb opened the PUBLIC HEARING ON APPEAL, ZONE VARIANCE NO. 687 FOR PROPERTY LOCATED AT 7069 DINWIDDIE STREET - REQUEST TO CONSTRUCT THREE SINGLE - FAMILY RESIDENCES ON PROPERTY ZONED R1 -5000 WITH LESS THAN 15,000 SNARE FEET WHICH WAS CONTINUED FROM THE MEETING OF MAY 22, 1990. Assistant City Manager Farfsing summarized the staff report, recommending denial of the Appeal. He narrated a slide presentation of the subject and surrounding properties. Council Minutes 6/12/90 -1- 9000 There was no further correspondence received on this matter. Mayor Barb asked the applicant /appellant to come forward and present any further information on his case. Mr. Jorge Negrete, 7069 Dinwiddie St. speaking through his interpreter, Ms. Yolanda Yola (unk. spl g.) , explained he had not made any preparations for the two additions on his property except installing electrical panels and sewer line connections. Also, in meeting a previous Planning Commission condition, many expenses were incurred through remodeling the front house. Owners of similar properties in the vicinity have been granted permission to build three units on their parcel; he is requesting the same privilege. There being no one else to speak in favor or opposition, it was moved by Council Member Hayden, seconded by Council Member Paul, and so ordered to close the public hearing. It was clarified that the reason for continuance of this matter was to ascertain if a vested interest exists in the property that would require a variance to complete the project. Council Member Hayden stated that after viewing the property, she could support a quality development that would not be detrimental to the neighborhood, noting the applicant is only 500 square feet short of the area requirements. Council Member Boggs stressed the need to follow minimum requirements in the Code and disapprove projects not meeting these standards. Council Member Paul expressed concern that the remodeled house depicted in the slides has been under construction for the past four years, causing him to question the quality of any further developments. RESOLUTION NO. 5301 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING THE APPEAL AND DENYING ZONE VARIANCE NO. 687 The Resolution was read by title only. It was moved by Council Members Cormack, seconded by Council Member Paul, and carried by the following vote to waive further reading and adopt: AYES: 4 Council Members: Paul, Cormack, Boggs, Barb NOES: 1 Council Member: Hayden Mayor Barb explained to the applicant the Appeal has been denied but one additional house can still be built on the property. Mayor Barb opened the PUBLIC HEARING ON APPEAL, CONDITIONAL USE PERMIT NO. 296 FOR PROPERTY LOCATED AT 9068 FIRESTONE BOULEVARD - REQUEST TO ESTABLISH CHURCH FACILITY ON C -2 LOT. Council Minutes 6/12/90 -2- 900 Mayor Barb advised the City has received a letter from Reverend George Stevenson representing the St. George Greek Orthodox Church, requesting continuance of this case to July 24, 1990. Hearing no objections, it was so ordered to continue the public hearing on Appeal, Conditional Use Permit No. 296 to 7:30 p.m., July 24, 1990 in the Council Chamber of the Downey City Hall. City Manager Caton noted that Reverend Stevenson informed him the church congregation had voted unanimously to accept the City's purchase offer and escrow should begin soon. Mayor Barb opened the PUBLIC HEARING ON ZONE CHANGE NO. 252 FOR PROPERTY r1 LOCATED ON ARRINGTON AVENUE BETWEEN TELEGRAPH ROAD AND I -5 FREEWAY, TO CHANGE ZONING FROM R1 -5000 TO R1 -6000 WITH THE SECOND UNIT DEVELOPMENT OVERLAY BEING RETAINED FOR PROPERTIES. City Clerk McDonnell affirmed the proof of publication. It was moved by Council Member Cormack and hearing no objections, so ordered to receive and file. Assistant City Manager Farfsing summarized the staff report, recommending an amendment to change the zoning of the residential properties on Arrington Avenue between Telegraph Road and the 1-5 Freeway from R1 -5000, Housing Factory Built, to R1 -6000 with the second unit development overlay zone. He distributed a clear copy of a map showing the affected area. Council Member Hayden clarified that the obvious halt of construction work on properties in this area is because of ongoing litigation. City Clerk McDonnell advised no correspondence had been received. Mayor Barb called for those in the audience who wished to speak in favor or opposition to the proposed Zone Change. There were none. It was moved by Council Member Cormack, seconded by Council Member Boggs, and so ordered to close the hearing, ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE OFFICIAL ZONING NAP ADOPTED BY SECTION 9106.06 OF THE DOWNEY MUNICIPAL CODE (ZONE CHANGE NO. 252) The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Cormack, and unanimously carried to waive further reading and introduce. Council Member Paul stated that this particular case reflects the desire of the majority of residents. However, he discouraged the habit of rezoning areas of the City in this manner as it would be detrimental to the General Plan. II Council Minutes 6/12/90 -3- ., . 9002 Mayor Barb opened the PUBLIC HEARING ON AMENDMENT TO DOWNEY MUNICIPAL CODE REGARDING PARKING STANDARDS FOR PRIVATE SCHOOLS AND COLLEGES. City Clerk McDonnell affirmed the proof of publication. It was moved by Council Member Paul and hearing no objections, so ordered to receive and file. Assistant City Manager Farfsing summarized the staff report, recommending separation of high school parking standards from college parking requirements and an increase in public and private college parking standards. Council Member Boggs discussed the comparison between the proposed and current parking requirements, expressing concern with the maximum number of students allowed per the square footage formula and the ratio of students to cars. Mr. Farfsing referred to the hypothetical example in the staff report in clarifying the proposed formula that would base parking on gross floor area. City Clerk McDonnell advised that no correspondence had been received. Mayor Barb called for those in the audience who wished to speak in favor or opposition to the proposed Ordinance. There were none. It was moved by Council Member Cormack and hearing no objections, so ordered to close the hearing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 915O.O5(t) AND ADDING SECTION 9150.06(x) TO THE DOWNEY MUNICIPAL CODE AS IT RELATES TO PUBLIC AND PRIVATE HIGH SCHOOL AND COLLEGE PARKING STANDARDS The Ordinance was read by title only. It was moved by Council Member Cormack and seconded by Council Member Hayden to waive further reading and introduce. Council Member Hayden expressed concern that the proposed formula would require more parking spaces than could possibly be needed by the number of i people in the budding. Mr. Farfsing explained that business colleges are often located in busy commercial areas that demand high parking. Also, students take classes concurrently and overlap at times, requiring more parking. Therefore, staff does not feel the proposed requirements are excessive. Council Member Boggs requested this item be continued for further clarification regarding the adequacy of high school parking requirements. Mr. Farfsing noted this Ordinance separates high school and college parking requirements and will not affect high schools. ADMINISTRATIVE REPORTS 0 S SETTLEMENT AGREEMENT - COUNTY AGRICULTURAL FACILITY LAWSUIT It was moved by Council Member Hayden and seconded by Council Member ac to approve. Cormack y Council Member Paul stated his strong opposition to the project, debating whether any type of compromise is acceptable. He noted, however, the settlement is probably the best legal protection the City can obtain at this stage, and as such, he will support it. The Council unanimously approved the settlement agreement. OTHER BUSINESS - Items Removed from the Consent Calendar: AUTHORIZATION FOR DISBURSEMENT OF ASSET FORFEITURE FUNDS /NEW POLICE COMMUNICATIONS CONSOLE.
