HEARINGS: Mayor Barb opened the PUBLIC HEARING ON APPEAL, ZONE VARIANCE NO. 687 FOR PROPERTY LOCATED AT 7069 DINWI DOI E STREET - REQUEST TO CONSTRUCT THREE SINGLE- FAMILY RESIDENCES ON PROPERTY ZONED R1-5000 WITH LESS THAN 15,000 SQUARE FEET. Assistant City Manager Farfsing summarized the staff report, recommending denial of the Appeal. He narrated a slide presentation of the subject and surrounding properties. Discussion ensued regarding similar applications in the area and square footage of buildings currently on the subject site. Council Minutes 5/22/90 -1- 8988 City Clerk McDonnell advised the only correspondence received was a letter of opposition from Debrajane Masidonio, which was received and filed at the meeting of May 8, 1990. Mayor Barb asked the applicant /appellant to come forward and present his case. Mr. Jorge'Negrete, 7069 Dinwiddie St. speaking through his interpreter, Ms. Yolanda Yola (unk. spl g.) , explained he did not understand the comments made by his opposition at the Planning Commission meeting of May 4, 1990, and thus, could not rebut them. He had received a Zone Variance (No. 432) approximately three years ago to build three single family houses on his property with conditions which have all been met, including remodeling the fl existing house. Three electric boxes and the sewer line have been installed for use by the additional houses. In response to opposition, he explained the population density created by his proposed project would not be any different than those properties in the same block with similar dimensions. There being no one else to speak in favor or opposition, it was moved by Council Member Paul, seconded by Council Member Boggs, and so ordered to close the public hearing. Responding to questions, Mr. Farfsing explained that a Zone Variance was approved three years ago to construct three units on the property. The permits obtained in 1987 expired in 1989, thus the property owner needs another variance to build additional units. Council Member Hayden questioned whether the installation of utilities would constitute a vested interest in the project under the previous Zone Variance. Mr. Farfsing advised that to the best of his knowledge, no utilities have been installed since the existing garage would have to be demolished to accommodate the utility lines. City Attorney Thorson advised a "vested interest" would include a valid building permit and substantial construction in reliance on that permit. The courts have held that radi n and preliminary nar work on the site does not 9 9 p y constitute vesting. In his opinion, utility lines would not give the applicant a legal vested interest; however, the Council can make that decision as a matter of policy. Mr. Farfsing recommended staff view the property and return with their findings at the next meeting. He was then asked whether a utility permit would have been obtained from the City and inspected if these utilities had been installed, and he stated permits could have been received from the gas or electric company, in which case City inspection would not have been required. I t was moved by Council Member Cormack, seconded by Council Member Paul, and so ordered to reopen the public hearing and continue the Appeal on Zone Variance No. 687 to June 12, 1990 at 7 :30 p.m. in the Downey City Council Chamber. Mayor Barb directed staff to inspect the property for any improvements that have been done and return with this information at the next meeting. Council Minutes 5/22/90 -2- 8989 Mayor Barb opened the PUBLIC HEARING ON APPEAL, CONDITIONAL USE PERMIT NO. 296 FOR PROPERTY LOCATED AT 9068 FIRESTONE BOULEVARD - REQUEST TO ESTABLISH CHURCH FACILITY ON C -2 LOT. City Clerk McDonnell affirmed the proof of publication. It was moved by Council Member Paul and hearing no objections, so ordered to receive and file. Mayor Barb advised the City has received a letter from Anthony Canzoneri, attorney representing the St. George Greek Orthodox Church, requesting continuance of this case to June 12, 1990 at 7 :30 p.m. Hearing no objections, it was so ordered to continue the public hearing on Appeal, Conditional Use Permit No. 296 to June 12, 1990 at 7:30 p.m. in the Council Chamber of the � - � Downey City Hall. Mayor Barb opened the PUBLIC HEARING ON EXTENSION OF MORATORIUM PROHIBITING ISSUANCE OF LAND USE ENTITLEMENTS FOR CERTAIN COMMERCIAL PROPERTIES ON FIRESTONE AND LAKEWOOD BOULEVARDS: URGENCY ORDINANCE. City Clerk McDonnell affirmed the proof of publication. It was moved by Council Member Paul and hearing no objections, so ordered to receive and file. Assistant City Manager Farfsing summarized the staff report, recommending extension of the moratorium and narrating a brief slide presentation of the areas affected. He advised a letter was received from Dorothy Tatti, property owner at 9262 Firestone Boulevard, requesting relief from the moratorium. City Manager Caton noted that a letter of opposition had also been received from Mr. Anthony Canzoneri, attorney representing the St. George Greek Orthodox Church. Mayor Barb called for those in the audience who wished to speak in opposition to the Ordinance. Mr. Milton Schoof, leaseholder on 9262 Firestone Blvd., explained he was not in opposition to the proposed Ordinance, but is seeking relief from the moratorium. The specific property at 9262 Firestone Boulevard is strictly a •-•.‘ single purpose business property designed for a new or used auto dealership. !� He requested that Section 2, Paragraph A of the Ordinance be modified to include used automobile dealerships. A new franchise would necessitate a Motor Vehicle Board Hearing that could take from 90 days to two years, creating a hardship on the owner. He further explained there is a used auto dealer who will immediately apply for a new car franchise if allowed to currently operate his business at this location, City Manager Caton advised that staff would support a used auto dealership but prefers the control afforded by the Conditional Use Permit process which could specify conditions to ensure compatibility with surrounding developments. Mr. Schoof noted that a Conditional Use Permit applied for immediately may not be heard until July at the Planning Commission level. Mr. Lennie Whittington, 8542 Manatee St., questioned whether a traffic study had been done prior to the recent upgrading of the area. If so, then staff's request of $5,000.00 for another traffic study should not be granted. Council Minutes 5/22/90 -3- 89 _90 Mayor Barb called for those in the audience who wished to speak in favor of the Ordinance. There were none. It was moved b y Council Member Paul, seconded by Council Member Cormack, and so ordered to close the public hearing. Discussion ensued regarding adopting an ordinance that would impose certain requirements (i.e. landscaping, block walls, etc.) on specific uses. Current standards pertaining to auto dealerships in the C -2 Zoning Code are minimal. Council Member Hayden explained this unique situation could be handled through the Conditional Use Permit process. The fact that the property owner has unsuccessfully attempted to lease his property during the moratorium would constitute a hardship. Council Member Paul supported using the Conditional Use Permit process to address this problem, but expressed concern over time delays that may result. Council Member Boggs requested expeditious handling of a Conditional Use Permit if filed by this property owner. Mr. Farfsing advised of the legally required 21 day noticing period. Should the application be filed immediately, the case could be heard before the Planning Commission within 30 days. ORDINANCE NO. 902 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXTENDING A MORATORIUM PROHIBITING THE ISSUANCE OF LAND USE ENTITLEMENTS FOR CERTAIN COMMERCIAL PROPERTIES ON FIRESTONE BOULEVARD AND LAKEWOOD BOULEVARD WITHIN THE CITY OF DOWNEY The Ordinance was read in full by City Clerk McDonnell and City Attorney Thorson. City Attorney Thorson noted a typographical error on the second line of Section 6: "Section 65856" should read "Section 65858 ". It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried to adopt. Mr. Don Paulin, member of the Board of Directors of Human Services in Bell Gardens, presented a plaque to the City of Downey in appreciation for supporting senior citizen services in the community. He suggested using the Conditional Use Permit process to address building deterioration within the City. The meeting recessed at 8:46 p.m. and reconvened at 9:00 p.m. ORDINANCES NOT SET FORTH ABOVE: None RESOLUTIONS NOT SET FORTH ABOVE: None (See Consent Calendar) ADMINISTRATIVE REPORTS BUDGET STUDY SESSION SCHEDULE Discussion ensued regarding establishing Budget Study Session dates. It was decided to schedule these Sessions for June 13, 1990 at 3:30 p.m. and June 19, 1990 at 3:30 p.m. Mayor Barb requested one potential litigation matter be continued from Closed Session to the Budget Study Session on June 13, 1990 at 3:30 p.m. INTRA - CITY TRANSPORTATION REPORT Community Services Director Jarrett summarized the staff report, recommending authorization to solicit professional services to conduct a transit needs assessment. Council Member Boggs noted that comfort and feasibility should be considered when deciding on the transportation mode. Although the trolley is attractive, it may not be the most practical vehicle to use in this program. She encouraged the transit study compare the costs of contracting for vehicles and purchasing vehicles. Council Member Cormack advised he received complaints from citizens using the "Dial -A -Ride" Program, specifically problems in reserving their rides. Mr. Jarrett will look into this matter. Council Member Paul voiced his support of increased transportation within the community, noting the requested transit study will save money in the future. Council Member Hayden voiced her support of the program, concurring with Council Member Boggs that a leasing option should be considered prior to purchasing any vehicles. Proposition A monies could fund the program instead of ridership fees, allowing this service to be free to the public. Mayor Barb encouraged support of a system that would serve the needs of Downey citizens as opposed to regional transportation program requirements. It was moved by Council Member Boggs, seconded by Council Member Paul, and unanimously carried to solicit professional services to conduct a transit needs assessment, including a comparison between city- owned vehicles and contracted vehicles, and recommend a transportation implementation program. Council Minutes 5/22/90 - 8 9 9 REWARD PROGRAMS FOR INFORMATION ON GRAFFITI VANDALS Assistant City Manager Farfsing summarized the staff report, explaining that a reward program can be an effective public relation tool in raising community awareness of the graffiti problem. It was moved by Council Member Paul and seconded by Council Member Hayden to direct staff to proceed with establishing this program, setting the reward amount at $100. Council Member Hayden discussed the reward value and basing the reward on the amount of property damage. It was moved by Council Member Boggs and seconded by Mayor Barb to amend the motion to increase the reward amount up to $500 for information leading to the arrest or conviction of the violator, with the reward to be based on the amount of property damage. Discussion ensued regarding the possibility of having two rewards, one for arrest and another for an arrest leading to a conviction; and the procedure for determining the amount of property damage. Council Member Boggs withdrew the portion of her amendment that based the reward on property damage. Police Chief Mayes expressed his support of a graffiti reward program as a definite deterrent to the crime. He suggested connecting the reward to the arrest and conviction of the violator, since the witness's testimony would probably be required for a conviction. Council Member Paul withdrew his original motion. It was moved by Council Member Cormack, seconded by Council Member Paul, and unanimously carried to set the reward amount at $500 for arrest and conviction of a violator, and ask the Court to seek restitution. Mayor Barb directed staff to return with a resolution incorporating the ideas discussed by Council. OTHER BUSINESS - Items Removed from the Consent Calendar: PROPOSED EASEMENT - PARKING LOT #10 /UNDERGROUND UTILITY DISTRICT #15 (8129 -33 -41 FIRESTONE BOULEVARD) Public Works Director Ralph summarized the staff report, recommending no action be taken on the proposed easement over City -owned property. Council Member Boggs noted this was the only downtown district in which an easement was not ranted to the utility company by the property owner for 9 P y y P P Y y service to his properties. Council Member Paul encouraged Council's support in persuading a utility company to restore property to its original condition after their work is completed. Council Minutes 5/22/90 -8- • w t a 89 Council Member Boggs questioned whether an easement was ever granted to the utility company. Mr. Robert Maniaci, 8572 Cherokee St., advised that no easement was granted, and thanked the Council for their consideration. Council Member Boggs voiced her opposition to reconsideration of granting an easement over city property to supply utility service to private property. A precedent would be set that could be detrimental to the City in the future. Council Member Hayden concurred, expeditious co cu ed, requesting exped�t�ous handling of further work on this property. Council Member Paul urged the City to consider a policy to protect property owners from poor quality workmanship by a contractor. Council Member Cormack questioned the permit p rocedure and was advised that permits need not be obtained through City departments when a utility company is involved. i . Mayor Barb advised there is not a majority to reconsider the easement issue but directed staff to review work done on private property by utility companies. OTHER BUSINESS - Council Members: Council Member Boggs received calls regarding a Shoe City parking lot sale held over the past weekend that overflowed into the Federal pa Coast , ederal Savings parking lot. She questioned whether code enforcement officers could be scheduled to work during the weekend when many violations occur. Assistant City Manager Farfsing explained that currently there is a code 9 9 p Y enforcement officer working on the weekends.
