The City Council of the City of Downey held a regular meeting at
7:44 p.m., November 24, 1992, in the Council Chamber of the Downey City Hall,
Mayor Diane P. Boggs presiding.

PRESENTATIONS
Council Member Lawrence presented a Certificate of Appointment to
District 1 appointee Grace Horney - Personnel Advisory Board.
HEARINGS
Mayor Boggs opened the public hearing on PROPOSED DOWNEY MUNICIPAL CODE
AMENDMENT REGARDING FAMILY DAY CARE HOMES AND CHILD CARE STANDARDS.
Ms. McDonnell affirmed the proof of publication which was so ordered to
receive and file.
Mr. Rangel summarized the staff report, noting the changes proposed by
staff are in conjunction with State regulations on family day care homes. He
discussed several concerns voiced by Council when they reviewed these
standards approximately two years ago, and how these issues are affected by
State law.
No correspondence was received on this matter.

was moved by Council Member McCaughan, seconded by Council Member Lawrence,
and so ordered to close the public hearing.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING
SECTIONS 9104.76, 9110.08(C), 9122.06(D), 9124.06(1) AND 9150.06(1)
OF THE DOWNEY MUNICIPAL CODE (CHAPTER 1, ARTICLE IX) AS SAID SECTIONS
PERTAIN TO FAMILY DAY CARE HOMES AND CHILD CARE STANDARDS
The Ordinance was read by title only. It was moved by Council Member
Lawrence, seconded by y
y Council Member Brazelton, and unanimously carried to
waive further reading and introduce.
Prior to the foregoing vote, Council Member Lawrence expressed '
continued
concerns with crowding, infrequency of inspections and other related issues
that are controlled by State law. However, due to the importance of
establishing child care standards, she favored passage of the Ordinance.
Council Member McCaughan mentioned the density problem involving y da care
homes, noting the d i f f i c u l t y with lack of local control .
Council Member Riley voiced the need for modifications in State re 9 ula-
tions on this matter.
Council Member Brazelton concurred with the comments stated by Council.
Mayor Boggs indicated she will be voting in favor of this matter, but
that work needs to be done at the State level to change legislation to insure
better child care standards that include open space requirements.

It was moved by Council Member Riley, seconded by Council Member
Brazelton, and unanimously carried to approve the remainder of the Consent
Calendar as recommended.

abstaining from voting on the following Ordinances related to Specific Plan
924 and the Krikorian Premiere Theatres, Inc. Council Members Brazelton and
McCaughan vacated their seats, accordingly.
ORDINANCE NO. 952
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING THE COURTHOUSE BLOCK , SPECIFIC PLAN (SP 92 -1) FOR THE
PROPERTY BOUNDED BY LA REINA AVENUE, THIRD STREET, NEW STREET
AND SECOND STREET, INCLUDING ALL OF SECOND STREET BETWEEN
LA REINA AVENUE AND NEW STREET AND MENDING THE OFFICIAL
ZO NI NG MAP OF THE CITY OF DOWNEY TO REFLECT ADOPTION OF SAID PLAN
The Ordinance was read by title only. It was moved by Council Member
Riley, seconded by Council Merrier Lawrence, and carried by the following vote
to waive further reading and adopt:

Prior to the foregoing vote, it was noted that the date under Section 1,
C. should be November 10, 1992. Mr. McOsker advised this is a clerical

ORDINANCE NO. 953

APPROVING THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF DOWNEY
AND KRIKOR IAN PREMIERE THEATRES, INC.
The Ordinance was read by title only. It was moved by Council Member
Lawrence, seconded by Council Member Riley, and carried by the following vote
to waive further reading and adopt:

The Ordinance was read by title only. It was moved by Council Member
Brazelton, seconded by Council Member Riley, and unanimously carried to waive
further reading and adopt.
Prior to the foregoing vote, Mayor Boggs urged the public to continue the
practice of water conservation as California's drought is in its seventh year.

ADMINISTRATIVE REPORTS
ESTABLISH DATE FOR JOINT CITY COUNCIL AND RECREATION & COMMUNITY SERVICES
CAMISSION MEETING TO DISCUSS DEVELOPMENT OF RIO HONDO GOLF COURSE
Mr. Caton explained that staff has been reviewing proposals regarding a
master plan and improvements for the Rio Hondo Golf Course. A joint meeting
is requested between the Cou nc i l and Commission to review the matter.
It was the consensus of Council and staff to set the Joint City Council
and Recreation & Community Services Commission meeting for 4:00 p.m., December 8,
1992, in the Downey City Council Chamber.
CASH CONTRACT NO. 555, CITYWIDE STREET SWEEPING: EXTENSION OF C ONTR AC T
WITH R.F. DICKSON CO., INC.
Mr. Redmayne summarized the staff report, recommending a five year
extension of the contract with R. F. Dickson Co., Inc. based on the good
relations and lack of problems staff has experienced with this Company. He
mentioned that Mr. Steve Dickson is in the audience to answer any questions.
Council Member McCaughan discussed the charges based on different weeks
of service and the current competitive costs.
In response to Council Member Brazelton's concerns, Mr. Caton explained
the options available in the current contract, including termination and
various times of service.
It was moved by Council Member Lawrence , second ed by Council Member •-•
Riley, and unanimously carried to approve a five year extension of the
Citywide street sweeping contract with R. F. Dickson Co., Inc . of Downey,
including operating and scheduling amendments previously implemented.
OTHER BUSINESS: ITEMS REMOVED FROM CONSENT CALENDAR
COUNCIL MINUTES - REGULAR MEETING, NOVEMBER 10, 1992
Ms. McDonnell advised the Minutes are being amended as follows:
On page 1 of 1, Table of Minute Actions, the date in the heading should
read November 10, 1992.
On page 6, the seventh paragraph w i l l be changed to read:
"Mr. Lennie Whittington, 8542 Manatee St., referred to the Planning
Commission Minutes of September 16, 1992, wherein the Commission held a
public hearing on this matter, and he objected to the brevity of those
Minutes since they only listed the speakers for or against but did not

reflect what each person said. He expressed his objection to letters of
support received from the Downey Chamber of Commerce and Downey School
Board. Mr. Whittington distributed pictures of the vacant lot of a
proposed Kr ikoria n Theatre project in Pasadena which showed lack of
maintenance on the property, submitted an excerpt from "Box Office"
magazine taken from a previous redevelopment staff report and submitted a
petition containing 34 signatures opposed to this project. He also
challenged two letters of support received from the Downey Council PTA '

nd an anonymous citizen, since they were not signed by an individual.

He submitted to the City Clerk and read into the record a letter of
opposition from Mr. Kenton Krogstad.
On page 8, third paragraph, the last sentence will be deleted.
It was moved by Council Member Lawrence, seconded by Council Member
Brazelton and unanimously carried to approve the Minutes as amended.
RESOLUTION NO. 5628
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
RESCINDING RESOLUTION NO. 5366 AND ESTABLISHING A
POLICY FOR DESTRUCTION OF CERTAIN OBSOLETE RECORDS
Council Member Lawrence questioned repossessions referenced in the
Ordinance and mentioned that upcoming changes may warrant retaining records at
this time.
Council Member McCaughan and Mr. McOsker discussed how the time frames
for destruction of certain records would affect the filing of claims.
Chief Mayes explained the need for destroying specific records that may
expose the City to liability, as advised by the City Attorney. He a l s o
mentioned that a computer print -out stores all the calls received, response
times, and other important information.
Mayor Boggs questioned the destruction of gun sales reports which are
over two years old and was informed that gun sales are entered into the State
computer system and may be retrieved from this source.
Council Member Braze lton clarified that no records would be destroyed
that are required to be retained by State law.

Lawrence, seconded by Council Member Brazelton, and unanimously carried to
waive further reading and adopt.
ORAL COMMUNICATIONS
Mr. Dieter Oltersdorf, 9542 Tweedy Lane, read a letter regarding noise
problems created by delivery and dumpster trucks conducting business at two
nearby schools during the night and early morning hours. He also commented on
a notification letter he received from the City citing a violation of City
Code regarding visible trash cans.
Mayor Boggs directed staff to look into this matter.

Mayor Boggs requested he submit his questions to the City Clerk for
appropriate staff response.

RESOLUTION NO. 5629
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING
THE APPLICATION FOR PEDESTRIAN FUNDS S FOR FISCAL YEAR 1992-93
AUTHORIZED U IUD ER SENATE BILL NO. 821
Council Member McCaughan questioned the use of these funds and was
informed of other specific projects that could be funded with this money. He
discussed the possibility of providing sidewalks for heavily traveled school
routes.
Mr. Redmayne noted other funds could be used for installing sidewalks and
mentioned that receipt of Pedestrian funds would be delayed if Council wishes
to further study this matter.
The Resolution was read by title only. It was moved by Council Member
Braz elton , seconded by Council Member Riley, and unanimously approved to waive
further reading and adopt.
Prior to the foregoing vote, the request was made to place sidewalk
construction for school routes as a funded project under this Senate Bill for
next year.
Mayor Boggs stressed the importance of accessibility for handicapped
people and agreed that sidewalk school routes should also be addressed.

Council Member McCaughan mentioned he has been in contact with
Mr. Oltersdorf and Mr. Redmayne and hopefully the problems will be resolved 7
soon.
Mayor Boggs mentioned the neon purple lights at the Tahitian Village on
Rosecrans Avenue.
