ADJOURNED REGULAR MEETING
SEPTEMBER 8, 1992
The City Council /Community Development Commission of the City of Downey
held an adjourned regular meeting at 6:00 p.m., September 8, 1992, in the
Council Chamber of the Downey City Hall, Mayor /Chairman Diane P. Boggs
presiding. .

PRESENTATION
PRESENTATION BY PUBLIC SAFETY AUXILIARY AND CITY MANAGER FOR DETERMINATION
OF SALARY RANGE FOR PROPOSED CLASSIFICATION OF 'POLICE SERVICE AIDE II,'
AND DISCUSSION AND DETERMINATION BY CITY COUNCIL
Mayor /Chairman Boggs announced this is the time and place set for
presentation by the representative of the Public Safety Auxiliary and City
Manager concerning the impasse that has occurred with respect to the inability
to reach an agreement on the salary range for proposed classification of Police
Service Aide II which classification was ro osed from a Personnel Advisory

Board finding /recommendation. Written statements have been presented by the
Auxiliary representative and by the City Manager's Office. Pursuant to
provisions of Section 2761 of the Downey Municipal Code relating the Memoranda
of Understanding, now is the time for presenting any additional oral comments.
Mayor /Chairman Boggs asked if the representative of the Public Safety Auxiliary
would come forward and present any additional pertinent information regarding

this matter.
Ms. Robin Nahin, 3924 East 14th Street, Long Beach, representing the
Public Safety Auxiliary, explained the request for new classification was
brought about as the result of an employee grievance filed by Helen Moebus, who
has been functioning in the position of Police Aide. Ms. Moebus asked the
Auxiliary to represent her in achieving the proper classification and pay level
for the work she is doing. She pointed out that Police Aides are, by require-
ment, 18 -21 years of age, and that this job classification does not pay an
adult employee enough money on which to live. .
Council Member /Commissioner McCaughan arrived at the meeting at 6:06 p.m.

Ms. Nahin commented on the recommendations contained in the staff memo and
asked the Council to consider a compromise between her recommendation and that
of staff. She compared the salary ranges of the Police Aide and Police Clerk
classifications, pointing out this matter involves an adult employee being paid
at teenagers' wages yet performing most of the duties of her co- workers at 24
percent less money. She urged paying Ms. Moebus five percent more, wh is h
amounts to $75.00 a week, take her out of the Police Aide classification, and
P ace her the right classification. Ms. Nahin also mentioned that as a

, result of Personnel Advisory Board hearings, the Board felt Ms. Moebus was not
in the right job classification. She also urged that any pay classification
approved should be retroactive to the Personnel Board's recommendation.
Mr. Birch, Personnel Director, responded to the written statement filed by
Ms. Nahin on behalf of the Auxiliary and her comments this evening. He also
commented on the meet and confer process that took place during last negotia-
tions with employee organizations, noting the Auxiliary did propose a five
percent increase for the position in question. He pointed out there were no .
funds available for salary increases or salary adjustments, but that considera-
tion would be given to a five percent bonus for "out -of- class" pay. It was
subsequently determined the employee was not working out -of- class, which
resulted in a grievance on this matter.
Mr. Birch responded to questions of the Council, during which time
Mayor /Chairman Boggs asked if Ms. Moebus performs a majority of the duties of
the Police Clerk I position, with the exception of searching female

Moebus also does not provide incident data into the national and state computer
of crime statistics and does a more routine function of duties.
Mayor /Chairman Boggs declared the period for testimony closed. She stated
she does not feel limited to the four options offered by staff and asked the
Council Members /Commissioners if there are any other options they would like to
be considered.
Council Member /Commissioner McCaughan expressed concern about creating a
new classification for one position, but he wants to do what is fair for both
sides and feels Ms. Moebus is working out of classification. He suggested
granting the five percent but retaining her at the Police Aide classification.
Council Member /Commissioner Lawrence questioned the need to make a
decision at this time since the meet and confer process is scheduled for
October.
Council Member /Commissioner Brazelton concurred with letting this go
through the meet and confer process.
Mayor /Chairman Boggs also feels the employee is working out of class and
should be receiving 5.5 percent.
Mr. Thorson said if Council defers consideration of the salary for this
particular class until negotiations in October, then the appropriate action
would be to approve Option No. 3 and direct staff regarding the negotiating
posture it should take.

Further discussion ensued.
With concurrence of the Council, Ms. Nahin offered further comments,
saying the negotiations are scheduled for October 1993, not this year, and she
discussed the . pay gap that normally exists between positions that are
promotional. She reiterated the Personnel Board's decision that Ms. Moebus is
not doing all of the duties of Police Clerk but she is definitely working out
of class and needs to be paid commensurate with the duties she is performing.
Ms. Nahin also noted the Memorandum of Understanding provides that after 60
days of performing in a higher class, an employee shall be paid full pay of the
position being performed. She would be receptive to a proposal that pays the
position correctly.

In responding to the comments of Ms. Nahin, Mr. Birch said the acting pay
is for vacant positions, and there are no vacant positions. He also disputed
the pay differential referenced by Ms. Nahin.
After further discussion, it was moved by Council Member/Commissioner
McCaughan to pay the employee an additional amount for working out -of -class but
retain her at the Police Aide position. The motion died for lack of a second.
With the consensus of Council, Mayor /Chairman Boggs directed staff and the
Auxiliary to go back to the table immediately on this matter.
CLOSED SESSION
Mayor /Chairman Boggs announced the Council/Commission is recessing
to closed session (7:05 p.m.) to discuss the following Sections of the
Government Code:
Section 54956.8 - Real property negotiations:

Property owner: Community Development Commission
Section 54956.9 - one Subdivision (a) matter - pending litigation:
United States vs. Montrose Chemical Co., et. al.
(Potlatch /Simpson Claim No. 1074)
Section 54956.9 - two Subdivision (b) matters;
Section 54957 - one personnel matter.
The meeting reconvened in open session at 8:00 p.m. with all Council/
Commission Members present. There were no Closed Session actions to report.
The meeting recessed at 8:01 p.m.
ORAL COMMUNICATIONS
The meeting reconvened for Oral Communications at 8:41 p.m. with all
Council /Commission Members present (see Oral Communications under Regular City
Council Meeting) and recessed at 9:03 p.m.

The meeting reconvened at 9 :45 p.m. with all Council /Commission Members
present.
Mayor /Chairman Boggs announced the Council /Commission is recessing (9:45
p.m.) to Closed Session to complete discussion of items previously announced on
the Closed Session Statement.
The meeting reconvened at 10:28 p.m. with all Council /Commission Members
present. There were no Closed Session actions to report.
