The City Council of the City of Downey held a regular meeting at
7:55 p.m., August 25, 1992, in the Council Chamber of the Downey City Hall,

PRESENTATIONS
.--. Mayor Boggs introduced Mr. Art Aguilar, representative from the Private
Industry Council, and presented Proclamations declaring the week of August 25
through September 2, 1992 as 'National JTPA Alumni Week' and honoring the
achievements of Harry Boeckel and Chu Vu.
Council Member Riley presented a Certificate of Appointment to District
Two appointee Ns. Bobbie Samperi , Recreation and Community Services
Commission.
Council Member Lawrence presented a Certificate of Appointment to
District Five appointee Mr. Guy Sterner, Parking Place Comaission.
HEARINGS
Mayor Boggs opened the public hearing on DOWNEY COMPREHENSIVE GENERAL
PLAN UPDATE; GENERAL PLAN AMENDMENT #91 -141, DESIGN CHAPTER ; 191 -142, ECONOMIC
DEVELOPMENT CHAPTER ; 191-145, LAND USE CHAPTER ; 191-146, CIRCULATION CHAPTER;
AND CONSISTENCY CLEAN UP FOR GENERAL PLAN AMENDMENT #92-05, HOUSING CHAPTER;
#92-06, CONSERVATION CHAPTER; 192-07, SAFETY CHAPTER; #92 -08, NOISE CHAPTER;
AND 192 -09, OPEN SPACE AND RECREATION CHAPTER which was continued from the
meeting of August 11, 1992.

Mr. Thorson advised that Council Members Brazelton and McCaughan
individually own a small interest in office buildings in the downtown area and
will not be participating in any consideration or voting on the e proposed
General Plan in this area. He recommended the first portion of the hearing be
limited to convents on all areas of the General P l a n other than the Downtown
vicinity and the second portion of the hearing be devoted to comments
addressing the Downtown area.
Mr. Rangel reiterated some of the public input that occurred at the last
meeting regarding the proposed General Plan changes, including residents that
would work with the City using the Specific Plan tool, zoning in other
specified areas, and concern with the Economic Development and Design r—
Chapters. He referenced some letters received regarding citizen opinions on
specific areas and distributed a map which showed draft changes to the Downey

Land -Use Diagram 2010 which included staff's recommendations.
There was no further correspondence received on this matter.
Mayor Boggs asked if there was anyone present who wished to speak
regarding the ro o s ed General Plan, requesting e s t i n that comments made at the last

meeting not be repeated as they are already part of the public record. She
asked that those people wishing to speak on the Downtown area hold their
comments until the second portion of the hearing.
Mr. Chris Sandoval , 13441 Verdura St., expressed opposition to the
Specific Plan in the Golden Park area.
Mr. Sherman Grizelle, 10932 Hasty Ave., representing his daughter, Alice
Grizelle, mentioned he was a past Planning Director for the City of Downey and
emphasized the importance of residential . neighborhoods in the City.

Mr. Paul Jajan, 500 Citadel Dr., Commerce, representing business people
in Downey, noted the proposed Zone Change of Neighborhood Commercial affecting
the northwest corner of Rosecrans Avenue and Lakewood Boulevard will not
accommodate this area and create many non - conforming uses.
Mayor Boggs requested the Chapters on Economic Development and Design be "
continued at the request of the Downey Chamber of Commerce for more time to
study this matter.
There being no one wishing to speak regarding the Downtown area that had
not been addressed, it was moved by Council Member Brazelton, seconded by
Council Member Riley, and unanimously carried to continue the public hearing
on the Design and Economic Development Chapters to 7:30 p.m., September 22,
1992 in the Downey City Council Chamber, and close the public hearing on the
remainder of the General Plan Aare nd me nt Chapters.
RESOLUTION NO. 5600
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CERTIFYING
AND AD0 PTI NG THE FINAL EN VI RONN ENTAL IN PAC T REPORT FROM THE
DOWNEY COMPREHENSIVE GENERAL PLAN UPDATE
The Resolution was read by title only. It was moved by Council Member
Lawrence and seconded by Council Member Brazelton to naive further reading and
adopt.

Mr. Thorson indicated this Resolution excludes the Design and Economic
Development Chapters, which were continued to the September 22nd meeting.
Also, this Resolution will contain a statement that Council Members Brazelton
and McCaughan did not participate in any consideration of the Downtown area.
Following Council discussion regarding their approval of the General Plan
Amendment recommendations, the vote on adoption of the Resolution was
unanimous.
RESOLUTION NO. 5601

The Resolution was read by title only. It was moved by Council Member
Lawrence, seconded by Council Member Brazelton, and unanimously carried to
waive further reading and adopt.
Mr. Thorson advised that this Resolution will contain a statement that
Council Members Brazelton and McCaughan did not participate in any
consideration of the Downtown area.

TO THE DOWNEY GENERAL PLAN RELATING TO THE HOUSING, CONSERVATION,
SAFETY, NOISE, AND OPEN SPACE/RECREATION CHAPTERS
The Resolution was read by title only. It was moved by Council Member
Lawrence, seconded by Council Member Brazelton, and unanimously carried to
waive further reading and adopt.
Mr. Thorson advised that this Resolution will contain a statement that
Council Members Brazelton and McCaughan did not participate in any
consideration of the Downtown area.
ORAL COMMUNICATIONS
Mr. John Gonzalez, 12350 Or i z a b a Ave., complimented the Police and Fire
Departments in their work with the Downey Unified School District regarding
the soccer stadium and other problems at Downey schools.
Mr. Jim Shade, 2110 Mesita Ave, West Covina, retired Downey Police
Captain, distributed and read a letter regarding the City's health insurance
coverage for retirees and requested consideration of amending the current Man
by increasing the deductible to decrease the annual premium currently paid.
Mr. Javier Velez, Chairman of the Project Area Committee, complained
about lack of staff assistance at their meetings and requested Community
Development Coamission Agendas be mailed to him when they are provided to the
public pursuant to provisions of Redevelopment Plan No. 4.

Mr. Gordon Strahan, 12331 Gneiss Ave., reiterated his complaint of blight

along Imperial Highway and suggested redevelopment in this area.
Mr. Larry Squire, 9546 Metro St., praised the Fire Department for the
method of maintaining their records. He suggested a format change in oral
communications on the agenda to allow time for response to previous questions
asked by the public. He requested that staff reports provide the name of the
actual employee who prepared the report in addition to the Department Head
submitting the report, and asked about the status of the Police Department
Efficiency Study.
Mr. Lee Squire, 8804 Samoline St., complimented the Fire Chief and Fire
Marshal for assisting him with inquiries regarding fire alarm problem at the
Downey schools, and discussed the use of Block Grant Funds for needed sc hoo l
improvements. He read into the record copies of two documents he received
from the Fire Department files and submitted a list of questions to staff
regarding funding, Redevelopment, and Downey schools.

FOR PROPERTY LOCATED AT 8855 ROSECRANS AVENUE which was continued from the
meetings of July 28, 1992 and August 11, 1992.
Mr. Rangel summarized the staff report, discussing the pertinent
testimony of citizens at the last meeting regarding their opposition to this
Appeal.
There was no correspondence received on this matter.
Mayor Boggs requested the applicant to come forward and present the case.
Mr. John Carmella, 371 Lexington St., Upland, Professional Planner
representing the applicant, mentioned that Council may not be able to approve
the subject Zone Change as it may be inconsistent with the General Plan
changes that were previously adopted this evening. He discussed problems with
the new Plan designation of Neighborhood Commercial for this area, noting
there are commercial uses in manufacturing zones throughout the City. He
mentioned his clients are willing to work together with staff if Council
wishes to continue this matter.
Mayor Boggs asked if there was anyone in the audience who wished to speak
in favor of the Appeal.
Mr. Paul Jajan, 500 Citadel Dr., Commerce, representing the applicant,
spoke regarding the negative element surrounding the apartments adjacent to
the night club. He mentioned his client has an interest in improving the
situation, including limited street parking, talking to the neighbors about
more lighting and installing a block wall along the westerly side of the
property to reduce noise. He requested Council direct staff to work with the
club owners and neighbors to find a resolution to the many problems in the
area.

Ms. Irma Ramirez, 13250 Pepperwood Ave., Bellflower, stated she
appreciated having a club where she and her hispanic friends can have a decent
time in a nice place.
There being no one present wishing to speak in opposition to the Appeal,
it was moved by Council Member McCaughan, seconded by Council Member
Brazelton, and so ordered to close the hearing.
RESOLUTION NO. 5603
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING ME
REQUEST TO CHANGE THE ZONE FOR PROPERTY LOCATED AT THE NORTHWEST
CORNER OF LAKEWOOD BOULEVARD AND ROSECRANS AVENUE FROM R1 -5000
(SINGLE FAMILY RESIDENTIAL) AND N-1 (LIGHT MANUFACTURING) TO
C -2 (GENERAL COMMERCIAL)
The Resolution as read by title only. It was moved by Council Member
Brazelton, seconded by Council Member McCaughan, and unanimously carried to
waive further reading and adopt.
Prior to the foregoing vote, Mr. Thorson advised that Paragraph C of
Section 2 would be changed to remove the words, "now pending before the
Council."
Council ;ember Lawrence questioned Council's ability to change the zone
after prior adoption cf the General Plan Amendments and was informed by Mr.
Thorson y
o son that the requested change of zone to General Commercial l would be
inconsistent with the new General Plan.
Council Member McCaughan advised this case originally
wra s brought before
the Planning Commission because the applicant did not obtain building p ermits
when a back patio was converted into a room that included additional square
footage. He expressed concern that a precedent might p p g be set that work done
without permits would be legitimized if the Zone were changed.
Mayor Boggs noted her decision on this matter is based on her desire to
protect the quality of residential living in the City.
Mayor Boggs opened the public hearing on DOWNEY MUNICIPAL CODE AMENDMENT
REGARDING DENSITY BONUS - ESTABLISHING THAT MULTIPLE FMILY RESIDENTIAL
HOUSING DEVELOPMENTS OF FIVE UNITS OR MORE AND MULTIPLE FMILY CONVERSIONS MAY
INCLUDE DENSITY BONUS AND /OR OTHER INCENTIVE.
Ms. McDonnell affirmed the proof of publication which was so ordered to
receive and file.
Mr. Rangel summarized the staff report, advising State law requires this
issue be addressed by granting a density bonus of 25% and providing one
develoment incentive to developers that provide housing for lower income, very
low income individuals or senior citizens for at least 30 years. He discussed
the various incentives that could be offered in this plan and the requirements
that must be met by the developer. The developer would have to find a way to
subsidize the bonus units for 30 years.

Council Member McCaughan clarified that a Conditional Use Permit would be
the tool used in obtaining the bonus. At that point, the Planning Commission
could establish certain requirements but would not affect the state mandated
density bonus.
Council Member Lawrence questioned how the City's Housing Division is
going to monitor occupancies and vacancies and if residents qualify under the
requirements and was informed the City would use Conditions, Covenants and
Restrictions (C.C. &R.'s) and close tracking.
Discussion ensued regarding apartment conversions, allowable charges for
enforcement, rent subsidizing for 30 years, and the City's rights within a r,
property's C.C. &R.'s.
There was no correspondence received on this matter.
There being no one to speak in favor or opposition of the Code Amendment,
it was moved by Council Member Lawrence, seconded by Council Member Braze lton,
and so ordered to close the hearing.

The Ordinance was read by title only. It was moved by Council Member
Brazelton, seconded by Council Member Riley, and unanimously approved to wive

Prior to the following vote, Council Member McCaughan asked if this
Ordinance could be extended to other public areas, i.e. parks, schools, etc.
and was informed that specific ordinances could address the hours of operation
at the
parks. The schools are regulated by s to to laws and are fenced around
the perimeters to thwart tresspassing.

CONTRACT RENEWAL WITH FAIR HOUSING FOUNDATION OF LONG BEACH
Mr. Rangel explained renewal of this contract would allow for continuing
professional counseling and educational services on housing discrimination and
landlord /tenant matters during the fiscal year 1992 -93. This contract also
satisfies the Community Development Block Grant (CDBG) Program requirement to
further fair housing as one of the conditions for receiving CDBG funds.
Discussion ensued regarding the billing procedure and prorating costs
over the year.
It was moved by Council Member Lawrence, seconded by Council Member
Brazelton, and unanimously carried to approve the contract renewal with Fair
Housing Foundation of Long Beach for a Fair Housing Program in the amount of
$11,142.00 fiscal year 1992 -93.

Mr. Redmayne summarized the staff report, notin the street improvements

completed in Assessment District No. 10 contain the subject property ert of which

a portion is landlocked from the street. The original intent was to deed back
that portion back to the property owner; however, the deed was subsequently
lost after being delivered to the owner.
It was moved by Council member Brazelton, seconded by Council Member
Riley, and unanimously carried to authorize the Director of Public Works to
execute and deliver a deed conveying street frontage to an otherwise
landlocked property located at 13222 Lau re ldale Avenue.

Council Member Lawrence stated for the record that a seminar expense
reimbursement to Diane Boggs for $364.35 on page 2 of the

August 13, 1992 actually includes the costs for three Council Members'
transportation and meals at the recent League of California Cities'
conference.
It was moved by Council Member Lawrence, seconded by Council Member
Riley, and unanimously carried to approve the Warrants.

APPROPRIATION FOR PART -TINE CODE ENFORCE TENT OFFICER
Mayor Boggs questioned whether the number of hours currently allotted to
Code Enforcement would be reduced and was informed there would be no change in
the hours budgeted for this year.
It was moved by Mayor Boggs, seconded by Council Member Lawrence, and
unanimously carried to appropriate $16,900 for part -time work in the Code
Enforcement Program.
RESOLUTION OPPOSING PROPOSITION 167 - TAX REVENUE INITIATIVE
Council Member Brazelton requested a copy of the Proposition to consider,
prior to voting on the initiative.
It was the consensus of Council to continue this matter to a future
meeting.

APPROVAL OF LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE RESOLUTIONS FOR
DIVISION SPONSORSHIP
Council Member Lawrence requested Council input on these Resolutions
prior rior to her voting on them as the City's delegate to the League of California
Cities.
It was moved by Council Member Brazelton, seconded by Council Member
Riley and unanimously carried to recommend approval of the subject Resolutions
(Council Member McCaughan abstaining on Resolution Numbers 5 and 6.)
Prior to the foregoing vote, Council Member McCaughan noted he would need

Council Member Brazelton requested staff look into providing a more
definitive procedure for responding to questions asked by the public or
Council.
Council Member Riley mentioned her attendance with Mayor Boggs at a
recent charitable event on the grounds of Rancho Los Amigos Hospital that was
poorly attended. She expressed hope that the Chili Cook -Off to be held at
Apollo Park will have a better response in attendance.
Council Member Ri ley reiterated the need for attention to the
construction on the corner of Paramount Boulevard and De Palma Street with an
empty t trailer upon the site and requested this matter be handled prior to the
opening of school.
Council Member Lawrence discussed her recent trip aboard an ocean vessel
in San Pedro belonging to Los Angeles County Sanitation District, and
explained what she learned regarding the purpose of testing the affects of
sewage outfall on marine life.
Council Member McCaughan questioned why warrants are not reported in
consecutive order and was informed the City Manager will return with an answer
on this item.

Council Member McCaughan inquired into the status of the Public Address
System in the Council Chamber and was informed staff's recommendation will be
returned at the next meeting.
Council Member McCaughan requested an update on the enforcement of garage
sale permits and was informed thirteen notices of violation had been given out
by Code Enforcement on the previous Saturday.
Regarding Council Member Mc Cau ghan's request for an Ordinance to address
street vendors in the City, Mr. Thorson advised this Ordinance will be placed
on the next Agenda.
Council Member McCaughan suggested possibly computerizing complaints,
correspondence, and other communications with the public as a way to address
problems regarding the public's questions and answers.
Council Member McCaughan requested a small tape recorder for dication
purposes when he works in his Council office after hours and was informed one
will be obtained for his use.
Council Member McCaughan requested a follow -up report on retired Police
Captain Jim Shade's request for change of insurance deductible and premiu■ for
retirees.
Council Member McCaughan discussed problems of parking and code
enforcement at Wilderness Park and suggested charging parking fees, etc. if
possible.
Chief Mayes noted the Special Enforcement Team has been concentrating on
this area and will continue to do so. He also discussed the details of the
recent robbery at Welis Fargo Bank.
Ms. Duke explained the Recreation and Community Services Commission has
looked into the Wilderness Park situation to try and resolve problems that
currently exist in this area.
Council Member McCaughan requested a report on the lack of a Canine unit
in the Police Department and was informed the City Manager will review options
with the Police Chief.
Council Member McCaughan requested a report regarding a possible fire
assessment district if Fire Station No. 3 is affected through budget cuts, and
Mayor Boggs asked that this information be included in the budget studies.
Council Member McCaughan requested a fu to re joint meeting with the
Planning Commission to discuss pertinent issues such as Redevelopment,
strategy and direction.
Council Member Lawrence requested a report back regarding the possibility
of televising Council meetings.
Mayor Boggs suggested issuing warnings and subsequent citations for
parking on lawns to retain community values.
Mayor Boggs reiterated the need for Code Enforcement at two ro erties in

Mr. Caton thanked Council for adjourning the last meeting of August 11,
1992 in honor of his newborn son, John Caton.
Mayor Boggs announced the meeting is recessing (10:25 p.m.) to Closed
Session to complete discussion of items previously announced on the Closed
Session Statement.
The meeting reconvened at 11:55 p.m. with all Council Members p resent.
There were no Closed Session actions to report.

The meeting was adjourned in memory of Ms. Rosa Lubin, mother of Downey
resident Joel Lubin to 6:00 p.m.., September 8, 1992 in the Council Chamber of
