AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING PORTIONS OF CHAPTER 5 OF THE DOWNEY MUNICIPAL CODE RELATING TO CHARITABLE SOLICITATIONS Mr. Thorson explained the revisions contained in this Ordinance were done to conform with State and Federal laws, simplify definitions arx1 registration materials. The most significant change will be solicitation hours from 9:00 a.m.-7:00 p .m . to 9:00 a.m.-9:00 p .m . based again on State and Federal law cases. He outlined a few changes to the text of Ordinance: Page 1 9 1, Section 4500 (a), l i n e three, should include the language "whether the solicitation is conducted door -to- door ",...in any place of business, etc; Page 2, Section 4504 (g) should include an ellipsis to denote there are no other - changes to the provisions of that Section; and Page 3, Section 4513(a) should include an ellipsis at the end for this same reason. The Ordinance was read by title only. It was moved by Council Member Brazelton, seconded by Council Member Riley, and unanimously carried to wive further reading and introduce. ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY REPEALING ORDINANCE NO. 944, RELATED 10 SECTION 6197 OF THE DOWNEY MUNICIPAL CODE AND THE USE OF UTILITY USERS TAX REVENUES FOR PUBLIC SAFETY SERVICES Mr. Caton summarized the staff report, noting the proper legal documents have been prepared which would rescind the prior Council's decision to place the utility users tax item on the November ballot. The Ordinance was read by title only. It was moved by Council Member Brazelton, seconded by Council Member Lawrence, and unanimously carried to waive further reading. Prior to the foregoing vote, Council Member Riley mentioned she w i l l be voting the way her constituents have asked her to vote, making sure this money is marked specifically for the Fire and Police Departments. Council Member Brazelton stated it is not warranted to go to the expense of placing this measure on the November, 1992 ballot; there is confidence in the current City Council to utilize the subject funds in the appropriate way. It was moved by Council Merrier Brazelton, seconded by Council Member Riley, and carried by the following vote to waive further reading and adopt: AYES: 4 COUNCIL MEMBERS: Braze lton, Lawrence, McCaughan, Boggs ' NOES 1 COUNCIL MEMBERS: Riley Prior to the foregoing vote, Council Member McCaughan suggested a review is needed of the recommended changes to the Charter as proposed by the Charter Review Committee and Council Member Lawrence, a former Committee member, concurred with this recommendation. RESOLUTION NO. The Resolution was read by title only. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING A CITY CHARTER MEASURE AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS ADMINISTRATIVE REPORTS DOWNEY MUSEUM OF ART WORK SCULPTURE PLACEMENT AT FURMAN PARK Mr. Jarrett summarized the staff's recommendation, requesting approval of the Art Museum to display a donated sculpture in an outdoor area adjacent to the Museum Building at Furman Park in accordance with Staff's recommendations. He discussed various concerns and needs staff and the Museum would address, such as proposed locations and responsibilities of the Museum and City should this matter be approved. He mentioned there were representatives from the Museum in the audience to answer any questions. Mr. Scott Ward, 10419 Rives Ave., talked about the sculptor and her art work around the world, indicating this is a special opportunity the Museum has been given. He answered Council questions regarding children and adult safety - measures, including angles and proposed locations. Ms. Faith Temple, 12249 Rives Ave., President of the Downey Museum of Art, reiterated the Museum would be receiving a gracious gift since the sculptor's works are so well known. After further discussion, it was the consensus of Council to accept the gift and let staff and the Museum work out details on safety position, location, and other necessary matters. It was moved by Council Member Lawrence, seconded by Council Member Riley, and unanimously carried to approve staff's recommendation as previously stated by Mri . Ja rre tt . Prior to the foregoing vote, Council Members Riley nd McCaughan y 9 volunteered to serve on a subcommittee that would work with staff in addressing the safety and location concerns expressed tonight. APPROPRIATION OF FUNDS FOR GREEN LINE LIGHT RAIL TA L S TIO N ENHANC EM ENTS Mr. Norman Horney, 9102 Angell St., spoke in favor of the City spending $75,000 to match Paramount's contribution for the art enhancement program of the light rail station on Lakewood Boulevard. He discussed the different funding sources available for this project. Ms. Johnette Stickel, 8731 McCallum St., indicated the need for restrooms at the stations prior to spending money on enhancement purposes and was informed by Mayor Boggs of the many unsuccessful discussion attempts to attain • station restrooms with the Los Angeles County Transportation Commission. Discussion ensued regarding what the art enhancements would include and costs involved. Council Minutes 7/14/92 -6- 9540 Mr. Caton discussed meetings he has had with representatives from the Transportation Commission and the City Manager of Paramount regarding placing the names of the cities served on the station in some way. It was agreed this could be done if Downey would contribute towards the $150,000 to enhance the artwork. Until the State completes their budget process which in turn would affect the City's money availability, staff's recommendation is to table this item. Mayor Boggs requested this item be continued to bring the new Council Members up -to -date on this project and it was the consensus of Council to continue action on the appropriation of funds for Green Line Light Rail Station Enhancements. (Continued to Budget Review following final approval of the State Budget) ` -42 ORAL. COMMUNICATIONS a s.. ,1 -e-e , e 47,7 Mr. Joel Lubin, 7820 Allengrove St., spoke regarding the unnecessary trucking ordinance to be considered before the Planning Commission in August and stated money should not be wasted on this matter. Mr. Lennie Whittington, 8542 Manatee St., discussed the continuing problem of property maintenance at the vacant homes on Manatee Street that were purchased by Downey Community Hospital, mentioning the Hospital never met with any of the people involved in the eviction situation that recently occurred. He suggested using housing funds to assist the people affected on Manatee Street and was informed that staff will follow -up on this issue. Ms. Johnette Stickel, 8731 M c C a l l u m St., expressed her support of the term limitation issue and was dismayed at Council's action to remove it from the November, 1992 ballot. Mr. Zach Morales, 11603 Adenmoor Ave., presented a petition to the City Clerk signed by residents in the area of Hall Road who are requesting a solution to traffic problems on Hall Road, citing the disturbing noise and safety concerns created by large commercial truck traffic on this street. Mr. Ken Milier, 7336 Cleargrove Dr., thanked the Council for their action in removing the issues of the Utility Users Tax and Term Limitations on the November, 1992 ballot. Mr. Lary Marks, 7808 Borson St., asked for maintenance of unlit street lights on Paramount Boulevard and other areas where street lights are not working. He also asked which newspaper publishes the City's legal notices and was informed that staff would respond to this question after the meeting. Mr. Pete Garo (unk. sp.) , 8522 Manatee St., requested assistance as his family still lives in a house in which they are being evicted on Manatee Street by Downey Community Hospital. This item was referred to staff. OTHER BUSINESS: CONSENT CALENDAR - ITEMS REMOVED BY COUNCIL APPROVAL COUNCIL MINUTES, REGULAR MEETING, JUNE 23, 1992 It was noted that Council Members McCaughan and Lawrence will be abstaining from voting on this matter as they were not Members of the City Council at that time. Council Minutes 7/14/92 -7- 115 It was moved by Council Member Riley, seconded by Council Member Brazelton, and carried by the following vote to approve: AYES: 3 COUNCIL MEMBERS: Brazelton, Riley, Boggs ABSTAIN: 2 COUNCIL MEMBERS: McCaughan, Lawrence WARRANTS ISSUED Council Member McCaughan requested a weekly copy of the warrants for the Council 's perusal. He discussed various warrants that were paid to companies and Mr. Powell informed him of the different costs involved. It was moved by Cou nc i l Member McCaughan, seconded by Council Member Lawrence, and unanimously carried to approve the warrants as issued. . OTHER BUSINESS: CITY COUNCIL MEMBERS CITY COUNCIL COMMITTEE ASSIGNMENTS Mayor Boggs noted one change on the Committee Assignments: Council Member Braze lton will be serving on the City - School Committee, r e p l a c i n g Mayor Boggs. It was moved by Council Member by McCaughan, seconded b Council Member g Brazelton , and so ordered to receive and file. Council Member McCaughan requested correspondence be sent to the School District to establish a first meeting with the new Council. Staff will send appropriate letter. Council Member McCaughan recommended the Public Address System inside the Council Chambers be looked into as it is very hard to hear in the audience most of the time. Council Member McCaughan suggested that one main telephone number connected to a City Hall receptionist remain after the new system is completely installed for those who cannot remember the various numbers. Council Member McCaughan spoke regarding his concern with the warrants and was informed staff will brief him on these expenditures. Council Member McCaughan questioned whether there is any information from the City Attorney on possible legal ramifications between the City, hospital lease agreement and lknatee Street eviction notifications and requested copies of any such information. Council Member Lawrence mentioned a constituent questioned the timeliness of graffiti removal on the inside of the freeway walls owned by Caltrans, specifically off the Dunrobin Bridge, and was informed all graffiti should be reported to our hotline, whether it is on City or Caltrans property. Council Member Lawrence reported a definite loss of working street lights in the area of Woodruff and Donrobin Avenues. Council Minutes 7/14/92 -8- • • .. • d Council Member Lawrence requested a report on the possibility of televising the Council Meetings on Cable television for those who cannot attend the meetings. Council Member Riley commented on the Independent Cities Risk Management Seminar she recently attended and issues discussed, including not taking money away from cities to balance the State budget. Mayor Boggs requested a staff report on the progress for the propo , Farmers Market. Mayor Boggs suggested possibly having more than one swimming session at the Community Pool. 99 Mayor Boggs noted she received a complaint about possible gang activity Y occurring on Spencer Williams Elementary School grounds at night, and requested staff look into this matter. 99 Mayor Boggs mentioned a constituent was concerned with the $1 million. Y liability requirement to work on City property. Mayor Boggs suggested establishing a priority list of Charter Amendments from the Charter Review Conuittee that Council could analyze. Mayor Boggs requested that in the future, each Council Member give a brief report during Council meetings to inform the public of Council's attendance at important meetings and events.
