HEARINGS Mayor Hayden opened the public hearing to discuss FINAL DRAFT OF 'THE CITY `S SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT. Ms. McDonnell affirmed the Proof of Publication which was so ordered to receive and file. Mr. Redmayne summarized the staff report, commenting on the Final Draft of the two elements which were prepared in compliance with the California Integrated Waste Management Act of 1989 (AB939). There was no correspondence received on this matter. Council Minutes 5/26/92 -1- 9505 There being no one present to speak in favor or opposition, it was moved by Council Member Riley, seconded by Council Member Braze lton, and so ordered to close the public hearing. RESOLUTION NO. 5557 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING THE SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT The Resolution was read by title only. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried by the Council Members present to waive further reading and adopt. Mayor Hayden recognized student council members from Gallatin Elementary School in the audience. Mayor Hayden opened the p u b l i c hearing on APPEAL, ZONE `VARIANCE NO. 92-14, A REQUEST TO PERMIT A PARKING SLAB IN REQUIRED LANDSCAPED AREA FOR PROPERTY LOCATED AT 7975 SECOND STREET (ZONED R1 -5000) . Ms. McDonnell affirmed the Proof of Publication which was so ordered to receive and file. Mayor Hayden indicated the applicant, Ms. Zenaida Guerra, telephoned the City Clerk today, requesting a continuation of this hearing to June 9, 1992 when all Council Members can be present. Ms. Guerra verbally confirmed her request to have the hearing continued until June 9, 1992. It was moved by Council Member Boggs, seconded by Council Member Riley, and unanimously carried by the Council Members present to continue the hearing to 7:30 p.m., June 9, 1992 in the Council Chamber of the Downey City Hall, 11111 Brookshire Avenue, Downey, California. OTHER BUSINESS: CONSENT CALENDAR - ITEMS FOR REMOVAL Council Member Boggs requested removal of Agenda Item VI-A-2, MINUTES OF REGULAR MEETING, APRIL 28, 1992; Agenda Item VI-E-1, AMENDMENT TO AGREEMENT FOR FE1NA CONSULTING SERVICES; and Agenda Item VI-E-3, DEFERRED COMPENSATION PROGRAM from the Consent Calendar. CONSENT CALENDAR It was moved by Council Member Brazelton, seconded by Council Member Riley, and unanimously carried by the Council Members present to approve the remainder of the Consent Calendar as recommended: MINUTES: ADJOURNED REGULAR MEETING, MAY 12, 1992: Approve. RESOLUTION NO. 5558 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT, A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS MISCELLANEOUS TRANSFER DRAIN NO. 1031 IN THE CITY OF DOWNEY FOR FUTURE OPERATION, MAINTENANCE AND REPAIR AND IMPROVEMENT, AND AUTHORIZE THE TRANSFER AND CONVEYANCE TH ER EO F (EMILY LANE FROM OLD RIVER SCHOOL ROAD TO QUILL DRIVE) RESOLUTION NO. 5559 (ADOFF) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF PARCEL MAP NO. 22194 (10923 -35 LITTLE LAKE ROAD N/0 HALCOURT AVENUE), APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTANCE OF A CASH DEPOSIT IN LIEU OF SURETY BONDS RESOLUTION NO. 5560 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING: ,CERTAIN . CITY EJIPLOYEES AS AGENTS TO SIGN APPLICATION TO THE STATE OF CALIFORNIA, OFFICE OF EMERGENCY SERVICES FOR DMAGES DUE TO CIVIL UNREST ORDINANCES NOT SET FORTH ABOVE: None RESOLUTIONS NOT SET FORTH ABOVE: None ADMINISTRATIVE REPORTS 1992-93 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS (CDBG) - ALLOCATION FOR RIO HONDO TEMPORARY HOME Mr. Rangel summarized the staff report, commenting on the annual operating costs of the Rio Hondo Temporary Home, which includes salaries for employees and mentioned volunteers also work at the f a c i l i t y . He noted Downey's contribution amounts to approximately three (3) percent, while 8.3 percent of the recipients originate from Downey. He also discussed the annual estimated operating costs for the PTA H.E.L.P.S. Program, noting all work is performed by volunteers. Council Members Boggs suggested reviewing the Community Services budget for possible funding of the PTA H.E.L.P.S. Program. After consideration of the percentage of Downey funds allocated to the Temporary Home and the Downey residents that use the facility, she expressed a strong desire to allocate the full $15,000 to the Home. Council Minutes 5/26/92 -3- r--r 950 It was moved by Council Member Boggs,. seconded by Counc=il Member Brazelton, and unaimously by carried b the Council Members present to continue allocating $15 ,000 in Community Development Block Grant Program Funds to the Rio Hondo Temporary Home and request that funding for PTA H.E.L.P.S. Program be reviewed during the budget study session. Prior to the foregoing vote, Council Member Riley recommended allocating monies from the General Fund for the PTA H.E.L.P.S. Program in the future. STUDY SESSION TO REVIEW THE PROPOSED 1992 -93 BUDGET It was the consensus of Council to set the Budget Study Session for 3:00 P .m., Dine 3, 1992 in the Downey City Council Chamber. Mr. Caton was asked to notify the newly - elected Council Members after the election and invite them to participate in the study session. OTHER BUSINESS: CONSENT CALENDAR - ITEMS REMOVED BY COUNCIL APPROVAL MINUTES: REGULAR MEETING, APRIL 28, 1992 Council Member Boggs referred to the comments of Mr. Joseph Lumsdaine contained in the first and last paragraphs on page 6 and mentioned that j j Mr. Lumsdaine said he was representing Downey Taxpayers United. She requested ::ivt staff review the tape meeting th t e of the meetin and insert this comment into the Minutes. It was moved by Council Member Boggs, seconded by Council Member Riley, and so ordered to approve the Minutes of the Regular Meeting of April 28, 1992 as amended. AMENDMENT TO AGREEMENT BETWEEN LACDA ALLIANCE AND FERG USO N COMPANY FOR FEMA CONSULTING SERVICES As requested by Council Member Boggs, Mr. Caton summarized a staff report on the City's involvement in the FEMA process and the alliance of cities that was formed to seek relief from the stringent mandatory flood plain regulations being imposed by the Federal Government. It was moved by Council Member Boggs, seconded by Council Member Riley, and unanimously carried by the Council Members present to approve the Amendment to the Agreement between LACDA Alliance and the Ferguson Company for consulting services and to authorize the allocation of $21,000 from the General Fund reserve for such service. DEFERRED COMPENSATION PROGRAM - GREAT WESTERN SAVINGS BANK AGREEMENT At the request of Council Member Boggs, Mr. Powell discussed the recommendation to add Great Western Savings Bank as an additional deferred compensation investment company for City employees. It was moved by Council Member Boggs, seconded by Council Member Riley, and unanimously carried by the Council Members present to approve an Agreement with Great Western Savings Bank to provide a deferred compensation program to the City of Downey employees. Council Minutes 5/ 26/92 -4- r • 950S OTHER BUSINESS: CITY COUNCIL MEMBERS Council Member Riley noted she received a request from Mrs. Jean Stohl to place on the next Agenda two presentations from the Gangs Out Of Downey (GOOD) Program. REAPPOINTMENT OF MR. ART AG U I LAR AS THE PRIVATE SECTOR REPRESENTATIVE TO THE PRIVATE INDUSTRY COUNCIL Council Member Boggs mentioned the Policy Board of the Private Industry Council has decided to allow each City the opportunity to approve the private sector representative on the Private Industry Council. It was moved by Council Member Boggs, seconded by Council Member Riley, y and unanimously carried by the Council Members present to approve the reappointment of Mr. Art Aguilar to the Private Industry Council. Council Member Boggs requested a report on receipt and disbursement of Police Department Forefeiture Funds. Council Member Boggs mentioned the large property tax increase being levied on small excess lots purchased by adjacent homeowners in the 1 -105 Freeway area and asked for staff assistance in contacting the County to see if the taxes can be reduced or held to a minimum. Referred to City Manager. Mayor Hayden submitted to the City Manager a wish list from the Downey Girls Ponytail Athletic Association. Mayor Hayden requested the next agenda include a proposal to name the Library Meeting Room in honor of Council Member Robert G. Cormack and his wife, Louise, for the many hours they have donated to the community and particularly to the Downey City Library. ORAL COMMUNICATIONS -% Mr. Norman Horney, 9102 Angell St., questioned the existence of permits for landscaping changes and other renovations taking place at the vacant Toyota dealership property on Firestone Boulevard and was informed all work requiring permits was stopped until those permits are issued. Mr. Lennie Whittington, 8542 Manatee St., spoke regarding the June 9, 1992 hearing on the Disposition and Development Agreement (DDA) between Penske and the Community Development Commission for operation of a Toyota dealership and questioned lease arrangements. Mr. Larry Squire, 9546 Metro St., thanked Council for the $200,000 allocation given to Downey Unified School District from the Community Development Block Grant funds. He reviewed questions he had about the Redevelopment Agency and requested a seminar be developed to educate the public on the purposes and issues of Redevelopment matters. Ms. Carol Wilford, 9159 Bays i nger St., questioned the possibility of using Redevelopment funds for Downey High School if this school is in the Redevelopment area, and requested she be included in any Redevelopment seminars in the fu to re . Council Minutes 5/26/92 -5- 9501 Ms. Joan Sma y, 13338 Ca sta na Ave., thanked Council for the $200,000 allocation to the schools from CDBG funds, questioned the use of Redevelopment funds, and requested she be included in any future Redevelopment seminars. Mr. Brian Ga sd is , 7830 4th St., spoke regarding offensive campaign material he has received at his home and mentioned he has contacted the Fair Political Practices Commission to review this matter. He read from the California Penal Code regarding consequences of such false statements and requested Council direct staff to adopt some type of election reform that would restrict anyone convicted of Election Code violations from serving on the Council now or in the future •�, Lawrence, 9627 Cheddar St., expressed Ms . Joyce La ressed opposition to deceptive p campaign ai n advertising she has received and lack of filing the proper form for late excessive expenditures or contributions by the group "Downey Taxpayers United." She noted she has also contacted the Fair Political Practices Act to investigate this matter.
