A representative from the Highway Patrol a l s o presented Officers Penrose and McCain with the "10851" Pin Award that can be worn on their uniforms at all times. Chief Mayes was presented with a Perpetual Plaque to the Police Department from the Automobile Club of Southern California. Mayor Hayden presented a Proclamation declaring the week of May 17 -23, 1992 as National Public Works Week to Mr. Richard Redmayne. HEARINGS Mayor Hayden opened the public hearing on NEGATIVE DECLARATION FOR CITY'S SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT. Council Minutes 5/12/92 -1- i ;\') o , Ms. McDonnell affirmed the proof of publication and it was so ordered to receive and file. Mr. Redmayne summarized the staff report, noting compliance with the law that requires staff to disclose any damage to the environment caused by the implementation of this program which is part of AB939, the Solid Waste Reduction Act. He explained there has been no damage to the environment at this time. There was no correspondence received on this matter. Mayor Hayden asked if there was anyone present who wished to speak in favor or opposition to the Negative Declaration for the City's Source Reduction and Recycling Element and Household Hazardous Waste Element. Mr. Richard Pridham, 10402 Beliman Ave., spoke regarding the various types of recyclable materials that can be collected. It was moved by Council Member Cormack, seconded by Council Member Riley, and so ordered to close the public hearing. RESOLUTION NO. 5553 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CERTIFYING THE NEGATIVE DECLARATION ON THE SOURCE REDUCTION AND RECYCLING EL E1M ENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT OF THE CITY OF DOW N EY It was moved by Council Member Boggs, seconded by Council Member Cormack and unanimously carried to waive further reading and adopt. Prior to the foregoing vote, Council Member Braze l ton questioned Alternative 29 - Policy on Scavenging on Page 1 -7 of the staff report and was informed this p o l i c y is already part of the City Municipal Code. Mayor Hayden opened the public hearing on 1992 -93 COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION. Ms. McDonnell affirmed the proof of publication which was so ordered to receive and file. Mr. Thorson advised that Council Member Riley can participate in this hearing even though she is a substitute teacher for the Downey Unified School District as she is receiving no income that qualifies as a conflict of interest. Mr. Rangel summarized the staff report, noting that community meetings were held during the past months where public comment was received regarding a variety of needs for these funds. He discussed staff's recommendations for use of these funds as a result of community input. Mr. Caton mentioned he has discussed a priority list of needs at school sites with Downey Unified School District Superintendent, Dr. Ed Sussman. He recommended the School Board increase development fees and he understands this is now under serious consideration. Council may wish to use Block Grant monies to aid the School District. Mr. Larry Squire, uire, 9546 Metro St., questioned whether the recommendation to remove asbestos from the Downeyt Theatre roof would benefit the low and moderate income family and suggested Redevelopment money be used for this project. He mentioned that staff's recommendations have changed since the J meetings were held with the community and noted the lack of important documents and Spanish- speaking interpretors at the public meetings. He suggested Council listen to the citizen's views on how this money should be sp ent and make an objective decision on the matter that would benefit all concerned. Ms. Joan Smay, 13338 Castana Ave., questioned the participation of citizens in spending the Block Grant money and expressed dismay that schools were not included in the recommended expenditure of funds. She asked specific questions regarding the Downey Theatre and how it was placed as a priority, the inability to use development fees for public school refurbishment, and lack of material for distribution at the community meetings. Mr. Andrew Kelley, 8916 Reydon St., stated the Federal government is borrowing 15 -20% of the money that is sent to the City, indicating a problem within the entire system. Ms. Margo Hoffer, 10329 Birchdale Ave., Member of the Downey Board of Education, recalled the District chose not to collect the full developer fees in deference to the City's concern for future development. She mentioned that housing values are largely dependent on the quality and appearance of the surrounding schools. Ms. Mary Tesserio, 9052 Raviller Dr., Member of the Downey Board of Education, stated the District has investigated and exhausted all revenue possibilities for school refurbishing. The schools are in a crisis situation and she requested any money the Council can afford to give them. Mr. Richard Pridham, 10402 Bellman Ave., agreed that something is wrong with the system. He spoke regarding the legal requirement to hold community meetings regarding Block Grant Funds, noting a communication problem. Dr. Bob Riley, 10317 Morning Ave., Member of the Downey Board of Education, mentioned difficult economic times and requested cooperation with the City in spending these community funds at the s c h o o l s . Mr. Lennie Whittington, 8542 Manatee St., questioned figures on the Block Grant application and was informed the money cited was carried -over from the previous year. He suggested that less money could be spent on the Adminis- trative portion of the Housing Division. Ms . Gail Tu , 12341 Glynn Ave., appealed to Council to make Federal funds a v a i l a b l e to the s c h o o l s . She spoke regarding the problems at Alameda Elementary School, citing deplorable conditions with bathrooms and drinking fountains. Ms. Irene Ortiz, 11934 Old River School Road, expressed support of transferring funds from the theatre project to needy schools. Council Minutes 5/12/92 -3- 9 ty Mr. Bill Bobbitt, 13208 Barlin Ave., asked if previous questions brought up tonight would be answered and was informed this would occur after all input was received from the audience. Ms. Brenda Warner, 12010 Morning Ave., stressed the importance of schools and the need to maintain them. There being no one else wishing to speak, it was moved by Council Member Cormack, seconded by Council Member Boggs, and unanimously carried to close the public hearing. Mr. Caton responded to questions raised by the audience. Council Member Cormack spoke regarding the need for cooperation between the School District and City and suggested the District implement the full amount of development fees to raise needed revenue. Council Member Boggs noted it is apparent the community wants some of the Block Grant money to fund schools in need. She suggested 20% of the funds be given to the District to be used as they deem necessary. Council Member Riley raised questions regarding the fire alarm requirements at the schools and what upgrading would entail. She expressed concern with school drinking fountain conditions, the flow of water, and handicapped access and was informed this problem would be handled, especially in the area of handicapped drinking fountains. Council Member Brazelton spoke regarding the constrained City budget as affected by the recent Los Angeles riot situation. He requested the City and District tighten their budgets where this can be done. He favored allocating funds for upgrading the fire alarm systems at the two specified elementary schools. Mayor Hayden concurred that both the City and District are facing difficult times and agreed that some of this money should be spent on the schools. Her first priority would be the fire alarm systems. She would also include the water fountains at all the elementary schools at an approximate total cost of $190,000. Mayor Hayden made recommendations in reducing appropriations for City programs to free this money. She suggested the contribution recommended for the Rio Hondo Temporary Home be given instead to p y 9 PTA - H. E. L. P. S. Program which serves Downey residents only. She mentioned letters of praise she has received regarding assistance given by the Housing Div is ion. Council Member Cormack stated that since the Downey Theatre is owned by the City, which includes the community, and if there is a dangerous situation with asbestos material, then this must be taken into consideration for the health and safety of all citizens, including children. Council Member Boggs questioned the figures on the theatre repair and was informed the final price has yet to go out to bid. She inquired about other sources of funds to handle this project. Mr. Caton stated the repair must be done, so money w i l l be found in another fund if this expenditure is not approved. Council Minutes 5/12/92 -4- - _ Council Member Boggs expressed support for giving some of the money to the schools but stressed the need to retain the $15,000 given to the Rio Hondo Tempora r y Home, which allows the City a place to refer homeless people in Downey. g . She agreed the PTA H.E.L.P.S. Program is also very important; perhaps this organization could be funded from some other source. Council Member Brazelton noted he would be against removing the theatre repair since money would have to be taken from some other constrained fund. He also voiced opposition to withdrawing the City's $15,000 donation to the Rio Hondo Temporary Home. Mayor Hayden suggested Golf Course funds be used for the theatre repair. Council Member Riley expressed further concern to improve the flow of water in drinking fountains at the schools and also noted the importance of installing a handicapped ramp at Alameda Elementary School. She favo red funding for fire alarms at the two specified elementary schools and also at Warren High School if the District can make up the difference in costs. Mr. Caton recommended the Council divert $200,000 to the schools for the two fire alarm systems at Gauldin and Gallatin Elementary Schools and upgrade all drinking fountains at every school. It was moved by Council Member Cormack, seconded by Council Member Boggs, and unanimously carried to allocate $200,000 to the Downey Unified School District from Community Development Block Grant funds. Prior to the foregoing vote, Mayor Hayden suggested splitting the $15,000 allocation between the Rio Hondo Temporary Home and the PTA H.E.L.P.S. Program. Mr. Caton stated that something could be done for all the schools if the drinking fountains were fixed; however, the $140,000 could be given toward the Warren High School fire alarm system. Downey School Board Member Tesserio was asked which priority requests she ,.� would like to see handled and she responded that the School District has the obligation of replacing the fire alarms. Personally, she favored the upgrading of water fountains in the District to benefit all schools. Mr. Caton mentioned that under the Block Grant Funding Program, limits are set on how money is to be spent. It was moved by Council Member Riley, seconded by Council Member Boggs, and unanimously carried to submit the 1992 -93 application and certifications required for $849,236 in Community Development Block Grant Funds; approve the activities and amounts recommended, excluding $15,000 for the Rio Hondo Temporary Home; approve necessary adjustments to accommodate funding of the $200,000 allocation to the School District for the repair of two fire alarms at Gauldin and Gallatin Elementary Schools in the amount of $60,000 and upgrade the drinking fountains to include increased water flow and ,handicapped access at a cost of $140,000; and authorise the City Manager to submit all documents and correspondence required by the Community Development Block Grant Program during fiscal year 1992 -93. Program. Council Member Brazelton expressed opposition to diverting any funding from the Rio Hondo Temporary Home as they have an excellent program and are also on a tight budget. Council Member Boggs reiterated the need for a place to take the homeless and feels it is important to have access to this type of facility. She discussed the excellent program available and opposed reducing the $15,000 by any amount. She suggested helping the PTA H.E.L.P.S. Program from another fund when the budget is discussed. Mayor Hayden requested information on the number of Downey residents served by the Rio Hondo Temporary Home and those served by PTA H.E.L.P.S. at the next meeting. She asked if there was a percentage requirement defined in the application and was informed there is a 15% cap on how much money can be used toward public service activity. Council Member Cormack also requested information on how much donated money would go toward administrative costs at the Rio Hondo Temporary Home. Ms. Joyce Lawrence, 9627 Cheddar St., referenced the community meetings held and the request of the people to increase, not decrease, funding to the Rio Hondo Temporary Home. Ms. Sally McFarland, 7415 Irwingrove Dr., stated that PTA H.E.L.P.S. is feeding an average of 45 families per month. The proposed $15,000 allocation to the Rio Hondo Temporary Home was continued to the next meeting. ORAL COMMUNICATIONS Mr. Ken Miller, 7336 Cleargrove Dr., mentioned that during his recent visit to the Library, a sign was posted stating there were no tax forms available and he suggested the Library purchase the book of tax forms from the Board of Equalization and let patrons make copies of the sheets they need. Mr. Lennie Whittington, 8542 Manatee St., expressed opposition to criticism of any particular person in the audience, specifically citing his comments on the Housing Division. He then spoke regarding the large apartment building on Clark Avenue and Imperial Highway which is a joint venture between Ca l tran s and the Housing and Urban Development Department. He questioned the lack of occupancy of this building and was informed all City approvals for occupancy have been given. Mr. Richard Pridham, 10402 Beliman Ave., thanked the Downey Police and Fire Departments for their protection during the recent Los Angeles riot situation. He discussed priorities of the budget, citing overabundance of manpower in the Public Works rks Department . Council Minutes 5/12/92 -6- 'f‘q€193 Mr. Joe Lumsdaine, 9926 Pangborn St., praised the work of the Police and Fire Departments during the Los Angeles riots. He expressed concern about government waste and referenced a recent request to the City Attorney on whether or not the Brown Act was violated as a result of certain city employee groups soliciting information from Council candidates. Mayor Hayden stated that Council will need to discuss this request 'and make a decision on direction to the City Attorney. Mr. Joel Lubin, 7820 Al l e n g ro v e St., stated that with regard to the Brown Act, there have been no statutes violated in the aforementioned case based on his 16 years of experience in interviewing, investigating, etc., candidates for office. He then discussed the need to care for streets in the City. • The meeting recessed at 9:30 p.m. and reconvened at 9:40 p.m. HEARINGS (Continued) Mayor Hayden opened the public hearing on APPEAL, CONDITIONAL USE PERMIT N0. 92 -10, 12160 DOWNEY AVENUE, A REQUEST TO PERMIT AN AUTO REPAIR BUSINESS IN C -2 (GENERAL COMMERCIAL) ZONE. Ms. McDonnell affirmed the proof of publication and it was so ordered to receive and file. Mayor Hayden advised a letter has been received from the applicant requesting the hearing be continued to June 23, 1992 and staff concurs with this request. It was moved by Council Member Cormack, seconded by Council Brazelton, and unanimously carried to continue the hearing to 7 :30 p.m., June 23, 1992 in the Downey City Council Chamber, 11111 Brookshire Ave., Downey, California. OTHER BUSINESS: CONSENT CALENDAR - ITEMS FOR REMOVAL Council Member Boggs requested removal of Agenda Item VI -A -1, MINUTES, ,r••r, ADJOURNED REGULAR MEETING, APRIL 20, 1992 and Agenda Item VI -A -2, MINUTES, ADJOURNED REGULAR MEETING, APRIL 28, 1992 from the Consent Calendar, Council Member Brazelton requested removal of Agenda Item VI -E -4, PROPOSED DOWNTOWN THEATRE PARKING /TRAFFIC STUDY CONTRACT from the Consent Calendar and advised he will be abstaining on this matter. Mayor Hayden requested removal of Agenda Item VI -E -2, RIO HOMO TEMPORARY HOME AGREEMENT FOR 1991-92, from the Consent Calendar. CONSENT CALENDAR It was moved by Council Member Cormack, seconded by Council Member Braze lton, and unanimously carried to waive further reading of the Resolutions and approve the remainder of the Consent Calendar as recommended: CASH CONTRACT NO. 433 CITYWIDE RESURFACING: Award construction contract to Bo ra l Resources at a total cost of $245,005.75: Approve. RESOLUTION NO. 5554 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOW N EY UPHOLDING THE DENIAL OF A MASSAGE PERMIT RESOLUTION NO. 5555 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING ACCESS TO SALES AND USE TAX RECORDS PURSUANT TO REVENUE AND TAXATION CODE SECTION 7056 ORDINANCES NOT SET FORTH ABOVE ORDINANCE NO. 944 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOW N EY AMENDING SECTION 6197 OF THE DOWNEY MUNICIPAL CODE LIMITING THE USE OF UTILITY USERS TAX REVENUES TO PUBLIC SAFETY SERVICES The Ordinance was read by title only. It was moved by Council Member Cormack, seconded By Council Member Riley, and unanimously carried to waive further reading. It was moved by Council Member Riley, seconded by Council Member Cormack, and carried by the f o l l o w i n g vote to adopt (see vote, page 10) . Council Member Boggs discussed the base public service budget to give more flexibility as the Ordinance appears to be too general in not specifying a minimum amount to cover Public Services. Mr. Caton agreed that funds from one Department budget could be appropriated to another area and still meet the criteria of this Ordinance. Mr. Ken Miller, 7336 Cleargrove Dr., mentioned the Ordinance refers to public safety services, yet the question to the voters contained in the proposed Resolution references public safety "purposes. He urged clarification of this issue. He commended the Police Department for their visibility and action in the recent Los Angeles riot situation. Discussion ensued regarding the need for clarification of the wording in the Ordinance and ballot question. Council Minutes 5/12/92 -8- 9501 Mr. Thorson agreed the word "services" should be used in both the Ordinance and Resolutions that contain the ballot question. Mr. Joel Lubin, 7820 Allengrove St., mentioned he faxed a letter to the Council recommending a base amount of $22 million budgeted for future police and fire services. Mr. Larry Squire, 9546 Metro St., raised various questions regarding the utility users tax, the budget for next year, and the possibility of monitoring funds should the ballot question be approved in November's election. Dr. Gary McCaughan, 7918 Eighth St., agreed with the intent being understood; however, there are no defined meanings in the language and a clear and concise plan should be followed. He commended the show of force of Police Officers during the recent unrest and questioned the money for funding additional officers. Council Member Boggs clarified that the result of the ballot question will not affect the tax amount as it would still be collected; the question on the ballot is basically a bookkeeping difference. Council Member Cormack stated the difference would be a limitation on use of the funds. It was moved by Council Member Riley to amend the motion to include the specific wording of "Police and Fire Departments." Motion died due to lack of second. The original motion was carried by the following vote: AYES: 3 COUNCIL MEMBERS: Cormack, Riley, Hayden NOES: 2 COUNCIL MEMBERS: Boggs, Brazelton RESOLUTIONS NOT SET FORTH ABOVE RESOLUTION NO. 5556 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING A MEASURE AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS The Resolution was read by title only. It was moved by Council Member Cormack, seconded by Council Member Riley, and unanimously carried to waive further reading. Mr. Thorson advised the wording on the ballot question should be changed from "purposes" to "services" on the last line to correspond with the adopted Ordinance. He also spoke regarding the question as to whether a Council Member must be on the Council at the time the argument in favor of the issue is written for submittal to the County in August. Under the Elections Code, the person must be a Council Member at the time the argument is due for placement on the November ballot which is August 7, 1992. Council Member Riley could be designated to write the argument in favor; however, if she is not re-elected, the new Council could amend this Resolution or if there is no one in favor, other voters could write the argument. Council Minutes 5/12/92 -9- { 95 I It was moved by Council Member Cormack, seconded by Council Member Riley, and carried by the following vote to designate Council Member Riley to write the argument in favor of the meaasure, Council Member Brazelton to write the argument against the measure, and to adopt the Resolution: AYES: 3 COUNCIL MEMBERS: Cormack, Riley, Hayden NOES: 2 COUNCIL MEMBERS: Boggs, Brazelton ADMINISTRATIVE REPORTS REPORT REGARDING EFFECTS OF RECENT RIOT SITUATION ON CITY OF DOWNEY - POLICE AND FIRE DEPARTMENTS Chief Mayes discussed execution of the mobilization plan followed by the Police Department during the recent Los Angeles riot situation, noting the deployment details of the Administrative, Detective, Motor and Patrol Divisions. He then summarized the statistics of the resulting problems in the Los Angeles area cities, including South Gate, Compton, and Lynwood. He commented on the cooperation of the community, noting that businesses called the Department to ask what they could do to ` help and civilians called to volunteer their services. Chief Irwin mentioned the City of Downey Fire Department dispatches for five cities - Montebello, Santa Fe Springs, Lynwood, Compton and Downey and the Fire Department's involvement in incidents in Lynwood and Compton. Additional Downey units were also dispatched to the City of Los Angeles. He briefly narrated slides that were taken the night of the riots, depicting fires, graffiti threats, damage sustained by a Downey firetruck, and scenes of the area after the riot. A tape recording was played of communications between the Fire Dispatch and engine companies on the the scene. OTHER BUSINESS: CONSENT CALENDAR - ITEMS REMOVED BY COIINCIL APPROVAL MINUTES; ADJOURNED REGULAR MEETINGS OF APRIL 20, 1992 AND APRIL 28, 1992 Council Member Boggs requested that the deadline for submitting the ballot measure to the County which was previously discussed be included on page 2 of the Minutes. It was noted this date was stated in the sixth paragraph on that page. She also mentioned the absence of the Minutes of the Regular Meeting of April 28, 1992 and was informed they were not completed at this time. It was moved by Council Member Boggs, seconded by Council Member Cormack, and unanimously carried to approve the Minutes of the Adjourned Regular Meetings of April 20, 1992 and April 28, 1992. RIO HOMO TEMPORARY HOME AGREEMENT FOR 1991 -92 Mayor Hayden requested this item be continued since more information will be returned at a subsequent meeting. Mr. Caton noted this Agreement is for the 1991 -92 fiscal year, so the funds have already been budgeted. The Council will consider the 1992 -93 fiscal year's allocation at its next meeting. Council Minutes 5/12/92 -10- 9502 It was moved by Mayor Hayden, seconded by Council Member Boggs, and so ordered City gg ' to approve the Agreement between the City of Downey and the Rio Hondo Temporary Home for the 1991 -92 fiscal year. PROPOSED DOWNTOWN THEATRE PARKING/TRAFFIC STUDY CONTRACT Council Member Braze lton noted he will be abstaining from this matter. It was moved by Council Member Cormack, seconded by Council Member Riley, and so ordered (Council Member Brazelton abstaining) to authorize a contract with the firm of Robert Bein, William Frost and Associates at a cost of not more than $19,100 for the parking /traffic study in this area. Prior to the foregoing vote, Council Member Boggs clarified this study will include the maximum impact and effects of what could potentially develop y p in the downtown area as a result of the theatre complex. It was noted this study will only serve as a data base that can provide important information on the downtown area, and the study is being paid for by the theatre developer. A Specific Plan is needed for Downtown which will rely y on information from this traffic study for future planning in the area. OTHER BUSINESS: CITY COUNCIL MEMBERS Council Member Riley reiterated her thanks to the Fire and Police Departments and all those involved in the recent crisis situation. Council Member Braze lton concurred with Council Member Riley's comments, noting the schools were able to stay open and function because of the safety provided in Downey. Council Member Boggs expressed her pleasure with the quality of service received by both the Fire and Police Departments. She also recommended staff consider modifying street sweeping policy during election day to allow voters to park on the streets. Referred to staff. ,,. Council Member Cormack praised the Police and Fire Departments for their outstanding fob. He asked that the problem with material being lagged to sidewalks be handled as soon as possible and Mayor Hayden requested this item be returned on the next agenda. Mayor Hayden mentioned phone calls she received from Ns. Cel Kimberly of the Rose Float Association in concern for their future home. She suggested possibly looking for alternative sites if the Caltrans area is too expensive. She also presented Mr. Caton with a wish list from the Downey Girls Ponytail Softball regarding their facilities at Independence Park. She spoke regarding a Farmers Market and the possibility of Smallwood Avenue and Imperial Highway being a viable location for the Market. OTHER BUSINESS: STAFF MEMBERS Mr. Caton concurred with the thanks given to the Police and Fire Department and commended all staff members for their efforts in the rioting situation, as they were also prepared and trained as a result of drills at the Emergency Operations Center.
