The businesses of California Business Service, Downey Escrow Company, Tabbert's Television Company, and Adept Prosthetics were also acknowledged. Council Member Lawrence presented a Certificate of Appreciation to Carol Rowland for her service on the Recreation and Community Services Commission, and offered congratulations on her new City position as Keep Downey Beautiful Coordinator. HEARINGS Mayor Brazelton opened the public hearing on ZONE CHANGE NO. 94-4, FOR PROPERTY LOCATED AT 9117, 9121, 9131, 9191, 9201, 9215, 9227, 9245 FLORENCE AVENUE AND 10035 HALEDON AVENUE - REQUEST FOR ZONE CHANGE FROM R1- 10,000 (SINGLE - FAMILY RESIDENTIAL) TO R -3 -0 (MULTI - FAMILY RESIDENTIAL, OWNERSHIP). Council Minutes 6/28/94 -1- � A.r Z.18 Ms. McDonnell affirmed receipt of the proof of publication, which was so ordered to receive and file. Mr. Yoshiki summarized the staff report, narrating a brief slide presentation of the subject and surrounding areas: He noted the single-family Avenue y residence at 9201 Florence A v ue i s situated between two existing ng condomi n � um developments. The applicant and owner of t thi s site, Mr. Tony Uva, initiated a Zone Change request to allow construction of a condominium at the location, and the Planning Commission expanded' the area to include the additional subject properties. Approval of this Zone Change will be consistent with the zoning ,_.., designated on the General. Plan and *with the existing developments, which are multi-family units permitted by old 'Zone Exception cases. Certain Zone Exceptions will be retained to avoid nonconforming p o conforms ng status for properties in the future. Regarding residents' concerns with increased traffic on Arrington Avenue, the City's Traffic Committee has requested the area be closely monitored by the Downey Police Department for enforcement of speed restrictions. No correspondence was received regarding this matter. Mayor Brazelton asked the applicant or his representative to come forward and present the case; however, no one approached the podium. As there was no one to speak in favor or opposition to the proposed Zone Change, it was moved by Council Member Lawrence, seconded by Council Member Boggs, and so ordered to close the public hearing. ORDINANCE NO. AN ORDINANCE OF THE :CITY COUNCIL OF THE CITY OF DOWNEY CHANGING THE ZONE OF PROPERTIES LOCATED AT 9117, 9121, 9125, 9131, 9191, 9201, 9215, 9227 €,, 9245 FLORENCE AVENUE AND 10035 HALEDON AVENUE, DOWNEY, FROM R1- 10,000 (SINGLE- FAMILY RESIDENTIAL) TO R -3 -0 (MULTI - FAMILY RESIDENTIAL, OWNERSHIP) AND AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF DOWNEY TO REFLECT SUCH CHANGE OF ZONE (ZONE CHANGE NO. 94 -4) The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Lawrence,' and unanimously carried to waive further reading and introduce. Mayor Brazelton opened the public hearing on APPEAL OF A CONDITION OF APPROVAL FOR CONDITIONAL USE PERMIT NO. 94 -13, A REQUEST TO EXPAND AN EXISTING COMBINED SERVICE STATION /CONVENIENCE MARKET ON PROPERTY LOCATED AT 10808 LAKE - WOOD BOULEVARD. Ms. McDonnell affirmed the proof of publication. Mayor Brazelton read a letter received by staff from the applicant, requesting a continuance of the public hearing to July 26, 1994, as the applicant is unable to attend the meeting tonight. It was moved by Council Member Boggs and seconded by Council Member Lawrence to approve the applicant's request for continuance of the hearing. Council Minutes 6/28/94 -2- r M (' 1 • Mayor Brazelton asked if there was anyone present who wished to speak regarding this matter, since the public hearing was advertised for this date. The motion to approve the applicant's request for continuance was withdrawn, with the concurrence of the second. Mr. Lennie Whittington, 8542 Manatee St., indicated he would be unable to attend the July 26th meeting. He then distributed via the City Clerk copies of a gas station survey he conducted in 1985 relating to public restrooms, air and water provided to consumers at Downey gas stations, and noted that two Thrifty Oil Gas Stations did not have restrooms open to the public at that time, nor did they provide air and water. He mentioned problems he experienced while attempting to access the one public restroom at the subject gas station, and stressed the need for compliance of all gas stations with City and State regulations. There being no one else wishing to speak, it was moved by Council Member Boggs, seconded by Council Member Lawrence, and unanimously carried to continue the hearing on Appeal of Conditional Use Permit No. 94 -13 to 7:30 p.m., July 26, 1994, in the Council Chamber of the Downey City Hall. Mayor Brazelton opened the public hearing for the CITY OF DOWNEY PROPOSED BUDGET FOR FISCAL YEAR 1994 -95. Ms. McDonnell affirmed the proof of publication. Mr. Powell summarized the staff report, noting the City Charter requires the budget be adopted by June 30, 1994. The proposed budget includes a $90,000 allocation for sidewalks and school repairs as requested by Council at the Budget Study Session. He referenced other information for Council 's review co.ncerni,ng potential budget costs to fund a Public Information Officer position, publication of additional issues of the City's newsletter, and cablecasting City Council Meetings. Council Member Lawrence expressed support of the Public Information Officer position as an effective means of communicating with constituents regarding ongoing property maintenance and neighborhood preservation issues, etc. She noted that dissemination of information to the public can also be accomplished by publishing the "Downey Communicator" on a more frequent basis, and clarified that money is available in the Cable TV Fund to finance cablecasting expenses related to Council Meetings. She favored a $15,000 allotment to the Chamber of Commerce, and advocated community support for its many worthy activities. She referenced a letter from the Chamber, expressing her dismay at its indication that she, as the Council liaison, could not further assist the Chamber. She requested that $2,500 be appropriated to both the Downey Symphonic Society and the Downey Art Museum, respectively. Ms. Joan Warner, Executive Director of the Downey Chamber of Commerce, 11131 Brookshire Ave., publicly apologized on behalf of the Chamber for the letter received by Council Member Lawrence, noting she has performed her duties as Council liaison to the Chamber in an exemplary fashion. She mentioned that more people should have attended the informative budget study session that was previously conducted by the Council, to learn about the City's government. Council Minutes -3- 6/28/94 - 3 ".-/ 0 Mr. Lennie Whittington, 8542 Manatee St., favored additional street sweeping enforcement positions. He questioned the need for an appropriation to fund a Washington D.C. lobbyist for assisting the City in retaining Rockwell International as a major employer; the funding of a consultant position to aid in implementing revised Redevelopment Law (AB1290); and the excessive cost to develop a Downey Redevelopment brochure. He agreed the City has adequate money y in franchise fees to fund cabl ecasti ng of Council Meetings. Council Member McCaughan discussed interfund transfers involving the General Fund, Cable TV Fund and Capital Project Fund. He clarified that General Fund revenues exceeding expenditures could be appropriated to any area, and questioned the actual benefit received from cabl ecasti ng Council Meetings based on viewer audience versus the large financial investment. He supported the concept of retaining a Public Information Officer position and the frequent distribution st ibution of the Downey Communicator," noting the need to organize information and services in one area. He agreed with appropriating to $15,000 the Chamber of Commerce, and mentioned the f l e x i b i l i t y of the budget in the coming year. Council Member Riley concurred with the need to keep the public informed; however, she also questioned the size of the viewing audience if Council Meetings were televised. She agreed with Council Member Lawrence's suggestion to subsidize the Downey Symphonic Society and Downey Art Museum, and recommended the Chamber of Comerce receive a designated amount to support its important activities. Council Member Boggs concurred with the $15,000 allotment to the Chamber of Commerce, recommending the funds be used in the areas of "Shop in Downey" promotion, Chamber publications, Chamber services information, and Small Business u Development Center, and requested these four items be outlined i with q in a contract with the Chamber if one is established. She agreed there is a communication gap between the City and the public, but could not support approval of a Public Information Officer position without studying and prioritizing all vacant positions within the City. She suggested that staff ask Continental Cabl evi si on if they would televise a Council Meeting using only 9 9 y one camera, similar to the way other community events are covered by this Cable Company, prior to the City investing a large amount of money is this area. She doubted whether increased frequency of City publications ' q y y p would expand public interest, and expressed support of comunity assistance and volunteerism to help the Downey Symphonic Society and Downey Art Museum, noting her caution of setting a precedent by subsidizing community organizations. Mayor Brazelton commented on the limited City budget, and suggested 9 99 publishing a summary of Council agendas in the local newspaper as a means of communication with the public. He concurred with Council Member Boggs' remarks concerning the need to study all vacant City positions prior to approving a specific one at this time, and favored allocating $15,000 to the Chamber of Commerce. It was moved by Council Member Boggs, seconded by Council Member Lawrence, and so ordered to close the public hearing. Council Member McCaughan expressed support for the newsletter concept, but could not approve additional issues at this time based on unknown specifics, including costs. Staff was directed to contact Continental Cablevision regarding televising a City Council meeting with one camera. McCaughan, Riley, Lawrence NOES: 2 COUNCIL MEMBERS: Boggs, Brazelton RESOLUTION NO. 5806 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING THE FISCAL YEAR 1994 -95 BUDGET WITH IMPLEMENTING DOCUMENTS The Resolution was read by title only. It was moved by Council Member McCaughan, seconded by Council Member Riley, and unanimously carried to waive further reading and adopt as amended. ORAL COMMUNICATIONS Mr. Lennie Whittington, 8542 Manatee St., cited figures regarding cable television franchise fees, discussed public lack of interest in the "Downey Communicator ", and recommended reduced City spending in the future. He inquired about the applicability of the Brown Act with regard to Downey Community Hospital Board Meetings, noting the Council serves as ex-officio members of the Board. Ms. Myrtle Risley, 7938 Phlox St., referenced problems caused by the recent breakdown of the Southern Pacific Railroad in Downey, specifically the unsupervised, dangerous situation created when young students attempted to bypass the stalled train at Paramount Boulevard on their way to school. Council Minutes 6/28/94 -5- • Council Member Riley noted that after being contacted by Mrs. Risley regarding the matter, she called the Police Department, who responded immediately to the area. She reiterated the importance of working with Railroad officials to alleviate problems related to train traffic in Downey. Council Member Brazelton requested a letter be sent to Railroad officials concerning this episode and related liability issues. The meeting recessed at 9:25 p.m. and reconvened at 9:30 p.m. ,...� HEARINGS (Continued) Mayor Brazelton opened the public hearing on ESTABLISHING A UNIFORM SCHEDULE OF FEES. Ms. McDonnell affirmed the proof of publication. It was moved by Council Member Lawrence, seconded by Council Member Boggs, and so ordered to receive and file. Mr. Powell summarized the staff report, noting the recommendation to increase 161 fees from three to six percent. Three new fees are proposed for Administrative Appeals and Code Interpretations related to Planning issues, and a Public Works fee for curb painting. He commented on the proposed elimination of the Library fee for reserving books since the new computer system allows patrons to reserve their own materials via computer terminal. The City Parking Place Commission has recommended a discount be given for purchase of a block of ten or more parking permits. A new rate structure has been proposed for Rio Hondo Golf Course fees, based on the higher standards of the redeveloped golf course and a survey of similar golf course rates. Although the proposed fee adjustments will increase the service fee revenue in the General Fund by $20,000, fee revenue has gradually decreased over the past five years because many fees are related to building development, which has declined. He referenced a letter received from the Downey Civic Light Opera (DCLO) Association, expressing concern about high theatre rates, and Mr. Jarrett's response memo. Council Member Boggs questioned the necessity for the Planning Code Interpretation Fee. Mr. Yoshiki explained the Downey Municipal Code does not list every permitted use in a specific zone, so there are times when a citizen requests a particular use which is not outlined in the Code. The proposed fee w i l l cover staff expenses related to researching materials and preparing reports for Planning Commission consideration to decide whether to permit the use in that particular zone. Council Member Boggs requested a discounted fee be offered to Downey organizations for theatre use, and discussed issues related to theatre overhead, maintenance, and revenue generation from DCLO events. Mr. Caton suggested that Council consider allocating a specific amount to the theatre, noting the City currently subsidizes the theatre at a rate of $180,000 per year. Council Member Boggs preferred maintaining a fair rate schedule for theatre use by Downey organizations. Council Minutes 6/28/94 -6- r Mayor Brazelton asked if there was anyone present who wished to speak regarding the proposed schedule of fees. Ms. Marsha Moode, 7903 Second St., Public Relations Director, Downey Civic Light Opera (DCLO), discussed increased theatre rates approved in recent years which have adversely affected the DCLO, causing elimination of the annual Christmas, Show, reduction i n show performances, and rehearsal time. She requested the fee schedule. ; reflect reasonable , rates, including overtime charges, to which the DCLO can adjust. There being no one else wishing to speak regarding this matter, it was moved by Council Member Boggs, seconded by Council Member Lawrence, and so ordered to close the public hearing. RESOLUTION NO. 5807 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING A UNIFORM SCHEDULE OF FEES The Resolution was read by title only. It was moved by Council Member Boggs and seconded by Council Member Lawrence, to waive further reading and adopt, deleting the Planning Code Interpretion Fee, and establishing a policy of offering discounted theatre use rates to Downey organizations. (See motion withdrawn.) Council Member McCaughan expressed concern with the financial impact on the budget of the proposed fee amendments, and supported the Planning fee for Code Interpretations, noting the work that must be done to address a matter not found in the Code. With concurrence of the second, Council Member Boggs withdrew her motion. It was moved by Council Member Boggs, seconded by Council Member Lawrence, and failed by the following vote to waive further reading and adopt, with the exception of the Planning Code Interpretation Fee of $100: AYES: 2 COUNCIL MEMBERS: Boggs, Lawrence NOES: 3 COUNCIL MEMBERS: McCaughan, Riley, Brazelton It was moved by Council Member Boggs, seconded by Council Member Lawrence, and unanimously carried tok waive further reading and adopt as amended: with the exception of the rate schedules related to use of the Downey Theatre, and direct staff to return with a proposed rate discount for theatre use by Downey organizations, and the financial impact of said modification. TO MOTOR VEHICLE REPAIR IN THE R -1 (SINGLE - FAMILY RESIDENTIAL) AND R -2 (TWO- FAMILY RESIDENTIAL) ZONES The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Lawrence, and carried by the following vote to waive further reading and adopt: AYES: 4 COUNCIL MEMBERS: Riley, Boggs, Lawrence, Brazelton ABSTAIN: 1 COUNCIL MEMBERS: McCaughan Prior to the foregoing vote, Mr. Joe Romero, 9003 Stoakes Ave., expressed support of regulating motor vehicle repair in residential areas, citing a specific problem in his neighborhood regarding continual repair work being done on cars at a residence. Mr. Lennie Whittington, 8542 Manatee St., favored the proposed Ordinance, and suggested there be further restrictions on the amount of registered automobiles allowed for repair at a specific residence. He mentioned the irritating large vapor floodlights that facilitate car repair during evening hours. Council Minutes 6/28/94 -10- 3 RESOLUTIONS NOT SET FORTH ABOVE: None. ADMINISTRATIVE REPORTS ISSUANCE OF CONTRACT WITH CALIFORNIA LANDSCAPE SERVICE TO PROVIDE LANDSCAPE MAINTENANCE SERVICE Mr. Powell explained the requested contract with California Landscape Service w i l l provide landscape maintenance services for street medians, water well sites, along freeway soundwal l s , street parkways, irrigation systems, and trimming of trees located in street medians. This change would free existing City employees from these tasks, who will then be transferred to the Water Yard to utilize their services in a more efficient manner. Bids were submitted for this service, and the low bid of $64,604 is considerably less than the City's current budget for landscape maintenance, at a savings of approximately $122,922. Council Member McCaughan reiterated the need for maintaining areas near City Entry Signs, and at the on -ramp and off-ramp locations serving the Santa Ana Freeway from Paramount Boulevard. Council Member Lawrence clarified the clean -up of stamped concrete is not specifically mentioned in the contract, but debris removal is outlined as part of the services provided. It was by Council Member McCaughan, seconded by Council Member Riley, and unanimously carried to approve the contract with California Landscape Service to rovide landscape maintenance services to specific areas as outlined, in the P P amount of $64,604.
