The City Council of the City of Downey held a regular meeting at
7:44 p.m., January 25, 1994, in the Council Chamber of the Downey City Hall,

PRESENTATIONS
Mayor Brazelton presented a Plaque of Appreciation to Ms. Melinda
Zachary , Di rector of Public Affairs , Kaiser A Permanente Foundation , for
Kaiser's donation of funds to Independent Cities Association (ICA) Youth
Summit Conference and Symposium.
Manhattan Beach City Councilman Steve Barnes, President of Independent
Cities Association, presented a Plaque of Appreciation to Ms. Melinda Zachary,
Kaiser Permanente Foundation, for support of the ICA Youth Summit
Conference. He expressed his thanks to Council Member Riley for her efforts
in raising funds for the Conference.
Fernando de la Torre , In sp ec to r /Fi re Education , Downey Fi re Department,
briefly discussed the Emergency Preparedness in the Community (EPIC) Program.
Mayor Brazelton accepted a community service grant of $15,000 on behalf
of the City for use in the EPIC Program presented by Ms. Sue Ha jek , Medical
Group Administrator, Kaiser Permanente Foundation.

Council Member Riley thanked Kaiser Permanente for their continued
assistance to Downe y schools and service in the Downey Council P.T.A. HELPS
Program.
Chief Caldwell introduced Downey Police Department's new Police Captain,
Mr. John Finch.
Cap acknowledged parents Finch acknowled ed his arents and wife in the audience, and
expressed his appreciation to all who have supported him during his tenure
with the City of Downey.
Council Member McCaughan presented a Certificate of Appointment to Mr.
Joel Lubin, Personnel Advisory Board, District 3.

Mr. Redmayne summarized the staff report, explaining the alley north of
Foster Road between Bellflower Boulevard and Corrigan Avenue is being used to
bypass traffic on a regular basis. At the request of the majority of property
owners in the area, and concurrence of Public Safety staff, it is recommended
this alley be restricted to eastbound one -way traffic.
The Ordinance was read by title only. It was moved b y Council Member
Boggs, seconded by Council Member Lawrence, and unanimously carried to waive
further reading and introduce.
ORDINANCE NO.. 972
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING
CODE AMENDMENT NO. 93-64, MENDING SECTION 9104, DEFINITIONS;
SECTION 915 0, OFF - STREET PARKING AND LOAD ING ; AND
SECTION 9152, LANDSCAPING, LIGHTING AND WALLS, OF THE
DOWNEY MUNICIPAL CODE (CHAPTER 1, ARTICLE IX) AS SAID
SECTIONS PERTAIN TO OFF - STREET PARKING STANDARDS
The Ordinance was read by title only. It - was moved by Council Member

Boggs, seconded by Council Member Lawrence, and unanimously carried to waive
further reading and adopt.

ADMINISTRATIVE REPORTS
CONSIDERATION OF CHARTER AMENDMENT CHANGING THE DATE OF THE CITY'S
GENERAL MUNICIPAL ELECTION
Ms. McDonnell summarized the staff report, explaining the effect of
recent legislation on the City's Municipal Election in 1996, which will change

the election date from June to March, in order to consolidate with the
Statewide Primary Election. If subsequent legislation permanently moves the
Statewide Primary Election to March but does not change the Primary in the
remaining even-numbered years, the City may have to conduct alternating
elections in June and March. The suggested that because of this legislation,
the Council may want to consider a Charter Amendment that changes the e l e c t i o n
date to a date that is not likely to change, such as Noverrter of even - numbered
years.
Council Member Boggs agreed with proposing an election date in November,
noting impacts of the legislation such as expense and voter turnout are
important aspects that must be considered.
Council Member McCaughan concurred with proposing a November election
date, commenting on the importance of a large voter turnout and the most
economical option available that would coincide with the new legislation. He
expressed concern with Downey issues being displaced from the ballot if there
is an abundance of State and County measures.
Mr. Joel Lubin, 7820 Al1engrove St., voiced support of changing the
election date to November of even - numbered years.
It was moved by Council Member McCaughan, seconded by Council Member
Riley, and unanimously carried to direct the City Attorney to prepare language
for the Charter hne ndme nt and ballot questions relating to changing the
election date to November of even- numbered years, and authorize the City Clerk
to bring back the appropriate Resolutions placing the mea su re on the June 7,
1994, ballot.
APPEAL OF ADMINISTRATIVE DECISION OF PLANNING COMMISSION REGARDING DENIAL
OF TIME EXTENSION OF NON - CONFORMING USES IN C -1 ZRNE (THE DOG'S HYDRANT, 11943
FARM OU NT 'BOULEVARD)
Mr. Yoshiki summarized the staff report, noting the applicant is
requesting a time extension for the non-conforming use of dog grooming in the

C-1, Neighborhood Commercial Zone. He outlined the chronological history of
the City's dealings with the subject property, wherein two time extensions
were granted by the Planning Commission for the non- conforming use. The
applicant's recent request for a third time extension was denied by the
Planning Commission at its meeting of October 20, 1993. The Appeal of this
decision is now before Council for consideration.
Mr. Rod So, owner of The Dog's Hydrant, 11943 Paramount Blvd., explained
he is negotiating a lease with CB Realty for another location to conduct the
dog grooming activity. Completion of the lease should occur within the next
two weeks; however, a four month extension is requested to allow for a smooth
transition to the new location. ..
Council Member Boggs asked the applicant if he is boarding animals at the
current location, and he replied that he is not boarding any animals that are
not being sold in his store.

Noting the precedent - setting nature of this case Council Member
Boggs
requested her comments on page 2, fifth paragraph, be modified to reflect t that
the proposed house would be c o n s i s t e n t w i t h the home behind and adjacent to
the rear of the property.
It was moved by Council Member Boggs, seconded by Council Member
Lawrence, and unanimously carried to approve the Council Minutes of Januar y
11, 1994, as corrected.
SELECTION OF ATTORNEY FIRM FOR PERSONNEL /LABOR RELATIONS ISSUES
Cou nc i l Member McCaughan questioned who would work on personnel matters,
and was informed that City staff would handle the majority of personnel work.
It was moved by Council Member McCaughan, seconded by Council Member
Lawrence, and unanimously carried to authorize the City Manager to execute an
agreement for special services between the City and the law firm of Hebert,
Ca ss idy and Frierson.
ORAL COMMUNICATIONS
Mayor Bra z e l t on recognized former Ikyor /Cou nc i 1 Member Robert Co rma ck at
the podium.
Mr. Robert Cormack, 9632 La Reina Ave., expressed concern with the lack
of a strong smoking ordinance in Downey, and asked for Council assistance in
removing pornography racks within the City, as they are detrimental to the
moral fiber of the community.
Mr. Larry Young, President, Downey Seniors Recreation Club, 8622 5th St.,
requested the City consider establishing a Senior Center in Downey, where
senior citizens can visit and fraternize with each other on a daily basis. He
noted his club meets once a week at Apollo Center, and mentioned the
deteriorating condition of the buildings. Referencing newspaper articles
regarding the new senior center in the City of Cerritos, he reiterated his
request for a Senior Center in Downey.
Mr. Richard Pridham, 10402 Bellman St., concurred with Mr. Cormack's
remarks and commented on the continuing problem of unlit street lights along
major streets of Downey.

Mali is a non-smoking f a c i l i t y , and he suggested no smoking signs be posted at
Stonewaod Shopping Center as an :initial step in creating a smoke -free
environment inside the Mall.
Mr. Lennie Whittington, 8542 1 Manatee St., spoke 'regarding the need to
offer a fair pay increase to all City employees, in addition to the recent
salary increase given to Police and Fire personnel.
Ms. Terr y Felix, 10911 Brookshire Ave., non -sworn City employee and
representing Police Dispatchers, outlined the important duties involved in

police dispatching, and requested a fair pay City
employees.
Mr. Dennis Dollarhide, 10911 Brookshire Ave., Downey Police Officer,
explained that Police Officers rely heavily on Dispatchers in the course of
the day, and requested Council consider giving other City employees a fair pay
ra is e .
Mr. Dan Newcomb, 10911 Brookshire Ave., Police Dispatcher, discussed
concerns that fellow employees have expressed in the wake of the recent six
percent pay increase granted to sworn personnel. The majority of City
employees have joined together in the spirit of cooperation for the past four
years; however., it is time for serious consideration of a pay raise for
remaining City employees.

He commented on the vital role played by non-sworn personnel, and a sk ed for
Council consideration of a fair pay raise for all employees.

personnel for their quick response time in assisting an elderly friend who had
fallen down and suffered injuries. He mentioned the difficult decisions that
face Council, and expressed hope for a comprOmise in employee negotiations.
OTHER BUSINESS - Council Members
Council Member McCaughan suggested some' type_ of staff follow --up 1 the
Edison Company's audit of unlit street lights.

Council Member McCaughan expressed appreciation for all City employees
and asked for patience during the negotiation process.
Council Member Riley commented on City parking lot lights that appear to
go on anal off intermittently.
Council Member Boggs mentioned the health conference recently attended by

Council Member Boggs noted the health risks of smoking are well-proven,
and perhaps volunteerism could be a start in implementing a smoke -free
environment at Stonewood Shopping Center.
Council Member Boggs concurred with Mr. Robert Cormack's comments on the
need to rid the City of pornography racks and suggested staff explore some
kind of legal solution to this problem.
Council Member Boggs expressed understanding of City employee concerns
mentioned tonight.
Council Member Lawrence noted her recent attendance at the "Health ,---, y
Cities Project", which focused on quality of life issues determined by
a individual communities. She advised that she will report further on this
conference at a future meeting.
Council Me rrt e r Lawrence concurred with the need for a gymnasium in
Downey, and expressed support of efforts to find a funding source for . this
project.
Council Merrier Lawrence voiced her appreciation for all City employees.
Mayor Brazelton acknowledged City employee requests for a salary
increase, noting his appreciation for their dedicated service.

Mr. Caton mentioned that Fire Captain /Inspector Dennis Lockard has taken
a position with another City.-
Mr. Caton responded to concerns expressed by City employees, asking them
to have faith in the negotiation process.
Ms. McDonnell requested Council select a date for an adjourned meeting to
consider adoption of a Resolution establishing regulations for candidates in
the June 7, 1994 election.
It was the consensus of Council to schedule an adjourned meeting for 5:30
p.m., Tuesday, February 1, 1994, in the Downey City Council Chamber.
CLOSED SESSION
Mayor Brazelton announced the Council is recessing to Closed Session to
complete discuss ion on items previously sta ted in the Closed Session
Statement.
The meeting reconvened at 10:00 p.m. with all Council Members present.

The City Council /Community Development Commission of the City of Downey
held an Adjourned Regular Meeting at 5:30 p.m., February 1, 1994, in the

of the Voting Rights Act that was amended in 1992 requiring that voting
materials be made available for language minority groups. She discussed
printing and translation charges as they will affect Downey City Council and
candidates, noting the population make -up of the Congressional District in
which Downey is represented may dictate the need for additional translations.
Discussion ensued regarding ballot translations and printing costs.
The Resolution was read by title only. It was moved by Council Member/
Commissioner Riley, seconded by Council Member /Commissioner Lawrence, and
unanimously carried by the Members /Commissioners present to waive further
reading and adopt (Council Member /Commissioner Boggs absent.)
