The City Council of the City of Downey held a regular meeting at
7:50 p.m., January 11, 1994, in the Council Chamber of the Downey City Hall,

PRESENTATIONS
Mayor Brazelton presented a Proclamation declaring January 10 -16, 1994, �--,
as Downey Symphonic Society Week to Lo rive Parks, President of the Downey
Symphonic Society .
Mr. Rangel briefly commented on the video "Discovering Downey" which he
described as an important promotional tool that will be used to attract and
retain businesses in the City. The video emphasizes community assets that
create and maintain a dynamic business climate. He commented on input
received from City Departments and local businesses, specifically
acknowledging the assistance of Rockwell International. The video was shown
at this time.
HEARINGS
Mayor Brazelton announced that consideration will be given to the APPEAL
OF ZONE VARIANCE NO. 93-57 AND TENTATIVE PARCEL MAP NO. 23809 FOR PROPERTY
LOCATED AT 13032 BARLIN AVENUE. The public hearing on this case was conducted
at the Council Meeting of December 14, 1993, and is now closed.

Mr. Rangel summarized the staff report, noting this matter was continued
from the last Council meeting to allow time for the applicant to redesign his
site plans for the project that would address concerns expressed regarding the
proximity of the rear house to adjacent properties, and the shared use of the
access driveway. He narrated a brief slide presentation, showing the
applicant's redesign of the homes on the property, including modified ingress
and egress, and the development of a single story house in the rear. If
approved, a condition of a restrictive covenant would be included in the
Resolution to insure neighbor privacy adjacent to the rear house. An
alternate plan was also submitted that depicted a two-story house in the
rear. Staff recommends denial of the project based on the lack of findings
necessary for approval.
Following discussion, it was the consensus of Council to go forward with
approval of the Zone Variance and Tentative Parcel Map.
RESOLUTION NO. 5745
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING THE
APPEAL, AND APPROVING ZONE VARIANCE NO. 93-57 FOR PROPERTY LOCATED AT
13032 BARLIN AVENUE
The Resolution was read by title only. It was moved by Council Member
Riley and seconded by Council Member McCaughan to waive further reading and
adopt. (See motion to amend.)
Council Member Boggs noted that constructing a two -story house at the
rear of the property may be more consistent with his in, the surrounding

In response to Council Member Boggs' question, Mr. Thorson advised that
approval of this project would set a precedent regarding insufficient street
frontage for only those properties affected by the I -105 Freeway construction.
After discussion, it was the consensus of Council to give the applicant
''--` the choice of developing either one of the two site plans submitted.
It was moved by Council Member McCaughan, seconded by Council Member
Riley, and unanimously carried to amend the Resolution to include the
following language provided by the City Attorney: The development on the rear
lot (Lot 1) shall be limited to single story construction, or if two -story
construction, the development shall be limited to the area designated on the
map attached hereto as Exhibit B. Applicant shall place a deed restriction on
Lot 1 which restricts development as provided in this condition. This
restriction shall be in the form approved by the City Attorney."
Mayor Brazelton asked the applicant if he wished to address the Council
on this matter, and the applicant declined.
The motion to waive further reading and adopt the Resolution as amended
was unanimously carried,

RESOLUTION NO. 5746
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, DENYING THE
APPEAL AND APPROVING TENTATIVE PARCEL MAP NO. 23809 FOR THE
PROPERTY LOCATED AT 130 32 BARLIN AVENUE
It was moved by Council Member McCaughan, seconded by Council Member
Riley, and unanimously carried to waive further reading and adopt as amended,
with the inclusion of the above condition as stated by Mr. Thorson.
Mayor Bra z el ton opened the public hearing on PROPOSED CODE MENDMENT NO.
93-64 REGARDING OFF-STREET PARKING STANDARDS.
Ms. McDonnell affirmed receipt of the proof of publication. It was moved
by Council Member Boggs, seconded by Council Member Lawrence, and so ordered
to receive and file.
Mr. Rangel summarized the staff report, noting the primary objective of
the proposed Code Amendment is to update the City's commercial and industrial
parking standards. Parking regulations from the Urban Land Institute , the
Commercial Parking Industry, and Progressive Cities were used in establishing
the new standards. Some of the proposed changes include a universal parking
stall size for commercial and industrial uses, new methods for calculating the
required parking for public assembly -type land uses, and a "shared use"
parking ratio to regulate parking in shopping centers. Current regulations on
parking of recreational vehicles on residential lots will not be changed in
any way by this proposed Code Amendment.
No correspondence was received on this matter.
There being no one present who wished to speak in favor or opposition to
the proposed Code Amendment, it was moved by Council Member Boggs, seconded by
Council Member Lawrence, and so ordered to close the public hearing.

The Ordinance was read by title only. It was moved by Council Member
Riley, seconded by Council Member Boggs, and unanimously carried to waive
further reading and introduce.
Prior to the foregoing vote, Council Member McCaughan expressed his
desire to address the issue of commercial trucks in residential zones at a
later date.
Council Member Lawrence complimented staff on the informative and
understandable report, and agreed the updated parking standards are more
consistent and readable as proposed.

ORAL CCNMUNICATIONS
Mr. Gordon Strahan, 12359 Gneiss Ave., recommended distribution of lids
for DART barrels, and expressed the need to beautify ark improve Downey's main
streets, specifically Imperial Highway, through the use of municipal bonds.
He suggested maintaining the current level of City services, and commented on
the deteriorating condition of the railroad crossings.

ESTABLISHING WATER RATES FOR THE CITY OF DOW NEY AND

Mr. Powell summarized the staff report , explaining the proposed 3 percent
adjustment in water rates is necessary to support increasing costs for
supplying water to Downey customers, specifically, the increased pumping fee
to the Water Replenishment District. He referenced a chart in the staff
report listing past, current, and projected water production /consumption
statistics. This Water Advisory Board reviewed these figures, and unanimously
recomme nded approval of the ra te increase.
Council Member Boggs clarified for the public that the proposed increase
is a result of higher costs to supply water to Downey customers.
Discussion ensued regarding costs, support operations, and water
production /consumption figures as outlined in the staff report.
Council Member McCaughan questioned the need for a rate increase,
considering there has been a decrease in water usage and the projected 12
percent cost increase had been previously figured into the listed amounts.
Mr. Powell explained the 1993 -94 estimated numbers are lower. than the
budgeted figures because the estimates are based on the actual production of
water. The 1993 -94 budgeted amounts are based on the maximum water production
of 17,500 acre feet, which is considerably higher than the estimated water
production figure of 15,900 acre feet.
Further discussion ensued regarding operating expenses, the current rate
based on the pump tax, and the water fund reserve.
Council Member McCaughan reiterated his concern with increasing the wa to r
rates when consumption is lower than budgeted, and suggested reviewing
alternatives to this rate adjustment.

ADMINISTRATIVE REPORTS
FIXED ROUTE TRANSIT SYSTEM: AWARD CONTRACT TO MAYFLOWER CONTRACT
SERVICES, INC. (Continued from November 23, 1993)
Mr . Jarre tt summarized the sta ff report, noting the contract between
Mayflower and the City has now been finalized. Additional refinement of the
scope of work has been completed and is included in the report.
It was moved by Cou nc i l Member Riley, seconded by Cou nc i l Member
Lawrence, and carried by the following vote to award the Intra -City Fixed
Route Transportation contract to Mayflower Contract Services, Inc.:

NOES: 1 COUNCIL MEMBERS: McCaughan
Prior to the foregoing vote, discussion was held regarding ridership
evaluation, and a one -year trial system funded by transportation monies.
Council Member McCaughan noted his vote will reflect his consistent
desire to consider alternative uses for these funds.
Council Member Lawrence commented on the reduced operating hours during
specific holidays referenced in the scope of work, and the need to promote
ridership throughout the City.

ASSIGNMENT OF STO NBIOOD SHOPPING CENTER LOAN
Responding to quest ions from Council Member McCaughan, Mr. Thorson
explained this matter involves the assignment of the original Stonewood
Shopping Center loan from Welis Fargo & Company to Canadian Imperial Bank of
Commerce, and does not affect the ownership of the shopping center.

the change of loan assignment for Stonewood Shopping Center.

Prior to the foregiong vote, Council Member Lawrence discussed the
General Plan as it pertains to establishing safe sidewalks along school
routes.
Council Member Boggs questioned who w i l l be conducting the study, and vas
informed the study will be completed by City staff members, incorporating
input from different City Departments and the School District.
RESOLUTION M. 5748

APPROVING A CONSTRUCTION AND MAI NTENNIC E AGREEMENT WITH THE CITY
OF PARMOUNT FOR A TRAFFIC SIGNAL AT ROSEC RAMS AVENUE AND
CENTURY BOULEVARD
Council Member McCaughan spoke regarding the importance of the City of
Paramount assuming full responsibility for this traffic signal to mitigate
traffic impacts at this location, noting this neighboring City is progressing
with the development of a new major shopping center at this location.

Council Member Boggs inquired about the late distribution of warrants.
Council Member Boggs commented on the need for improvements on Imperial
Highway, and requested this matter be placed on a future agenda.
Council Member Boggs mentioned a recent shooting at the nightclub
adjacent to The Tahitian Village on Rosec ra ns Avenue, and requested a report

back on this matter.
Council Member Boggs reiterated the need to resolve the problem with
emergency vehicles being detained by train traffic near the Hospital.
Council Member McCaughan requested a status report on the progress of
developing a Community Center/Gymnasium/Police Center at Apollo Park, and was
informed the Subcommittee should meet and report their recommendations to
Council.
Council Member McCaughan mentioned the need to form a Neighborhood
Preservation Subcommittee to establish plans and goals for keeping Downey
clean and safe.
Council Member McCaughan discussed neighboring cities stringent curfew
regulations and inquired about enforcement of Ibwney's curfew laws pertaining
to young people.
Council Member McCaughan referenced a newspaper article regarding
development of a new multiplex movie theatre in Norwalk, and urged Downey to
move ahead with new plans for a movie theatre project.

Council Member McCaughan mentioned the need for improved shopping cart
re tr iev a l rye sp on se time by City crews and the shopping cart re tr iev a l service.
Council Member McCaughan complimented staff on the 'Discovering Downey'
video, noting the need to continue promoting the positive aspects of the City.
Mayor Brazelton expressed cautious optimism for the new year.
OTHER BUSINESS - Staff Members
Mr. Caton commented on the additional staff time necessary to review and
revise the contract with Iyflower Contract Services, Inc. for the Fixed Route
Transit System.
