ORDINANCE NO. 967 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOW N EY AMENDING ARTICLE IV, CHAPTER 6 OF THE DOWNEY MUNICIPAL CODE BY ADDING SECTION 46 01 THERETO PERTAINING 10 FEES AND THE USE OF POLICE SERVICES FOR SECOND RESPONSES AT PARTIES OR GATHERINGS The Ord ina nce was read by t it le on l y. Council Minutes 8/24/ 93 -2- 4~ # - ADMINI STRATI VE REPORTS YARD SALES AND CODE ENFORCEMENT WORK PROGRK4 Rangel summarized the staff report, noting the importance of continued enforcement of yard sale regulations, especially �' Ra n g in residential neighborhoods. Fines could be determined for certain violations if a proposed Charter 'Amendment is passed in the November election, which would allow for certain Code violations to be classified as "infractions." Other potential violations by i handled b the infraction process could include tall grass and excessive paving in front yards, and construction work done without weeds, p g permits. Organizational 9 Or anizational chan es proposed for Code Enforcement Division will promote efficiency and proactive enforcement. Two new Code Enforcement P y officers will work alternative schedules, including weekends, and be responsible for enforcing all Code violations defined as infractions. Code p 9 regulations and sales have been interpreted to apply to individual 9u concerning g y properties. Council Member McCaughan recommended staff enforce the Ordinance as written while changes are being implemented, and suggested ambiguous language be modified in the Code to clearly reference one property as Mr. Rangel discussed. He requested monthly updates on yard sale statistics. Council Member Riley agreed with the necessity of enforcement, and mentioned the large number of yard sales on Rives Avenue this past weekend. Council Member Boggs noted staff has addressed the concerns, and urged enforcing the current regulations. • i received regarding rd n Council Member La wre nc e referenced letters she receive g g the proliferation feration of yard sale signs throughout the City, and recommended a brochure be printed for the public, outlining yard sale regulations. Mayor Brazelton concurred with previous comments, suggesting that a public information brochure also address property maintenance requirements. Ms. Myrtle Risley, 7938 Phlox St., expressed dissatisfaction with telephone answering machines in City Departments, and reported graffiti on the southeast corner of Paramount and Firestone Boulevards. She asked that neighbors not be required to give their name when reporting a violation in their area, as this would cause disharmony among neighbors. Mr . La rr Squire , 9546 Metro St . , commended staff and Council 1 for r y proposing a proactive Code Enforcement Program, and agreed that neighbors should not be placed in a position of reporting each other's violations. Ms. Marcella Bright, 10354 Hasty Ave., requested designated hours of operation be imposed on garage sales, especially during morning hours, so that neighbors will not be adversely affected by noise, traffic, etc. It was moved by Council Member McCaughan, seconded by Council Member Boggs, and unanimously carried to receive and file. Mr. Redmayne advised that earlier information indicated leaks in the underground tanks. The proposed study by the recommended consultant, Th ,will include an investigation � � e Mark Group, nvestigation of the City's underground storage tanks, tank replacement and remediation of contaminated soils. It was moved by Council Meer McCaughan, seconded by Council l ,and unanimously y c Member Riley, us y carried to approve the consultant agreement with The Mark Group, Engineers and Geologists, Inc. to complete to a study o f ' round storage � y the City's s unde n'g ge tanks, and authorize the consultant to proceed with Phase I (Investigation) in the amount of $88,900. GRANDPARENTS AND BOOKS PARTNERSHIP AGREEMENT WITH FHP HEALTH SERVICES Council Member Lawrence commended the Library Partnership with RP Health Services as an excellent example of public and private sector cooperation. It was moved by Council Member Lawrence, seconded b y Council Member Riley, and unanimously carried to approve the Partnership Agreement with FHP Health Care for the Library's P A r� 9 nary s Grandparents and Books Program. ORAL COMMUNICATIONS Mr. George Butcher, 13115 Verdura St., requested assistance in handling problems he is experiencing in with his probl P g unemployment and illness resulting in his destitute condition, and was referred to Community Services Division. OTHER BUSINESS - Council Members Council Member Lawrence mentioned that applications are available for those people wishing to participate in imprinting tiles for artwork at the Metro Green Line Station on Lakewood Boulevard. Council Member Lawrence, noting her recent appointment to the Southeast Area Animal Control Authority Board, commented on the high number of animals euthanized at SEAACA in the past year due to overpopulation, and encouraged responsible pet ownership and adoption. Council Member Lawrence mentioned receiving many anonymous letters on different issues, and asked that people identify themselves so that concerns can be addressed appropriately and thoroughly. Council Member Boggs reiterated her request that staff return obsolete Ordinances to Council for repeal and removal from the Downey Municipal Code. Council Member McCaughan requested Council review possible modifications to the Shopping Cart Ordinance at the next Council meeting. Council Member McCaughan recommended scheduling a date to discuss funding d9 sources and future plans for a community center. Council Member McCaughan requested Council consider dates at the next meeting for touring City neighborhoods to assess housing needs. Council Member McCaughan referenced letters he received regarding excessive weeds at the vacant Nissan dealership on Firestone Boulevard, and the need for tree trimming on Florence Avenue. Council Member Boggs noted the vacant lot on the northwest corner of Firestone and Lakewood Boulevards needs to be cleaned of debris. Mayor Brazelton mentioned the unsightly appearance of the vacant Paramount Chevrolet lot on the southeast corner of Firestone and Paramount Boulevards. OTHER BUSINESS - Staff Members: None .
