The City Council of the City of Downey held a regular meeting at
7:40 p.m., August 10, 1993, in the Council Chamber of the Downey City Hall,
Mayor Robert S. Brazelton presiding.

PRESENTATIONS
Council Merrier McCaughan presented a Certificate of Appreciation to Brian
Gasdia for service on the Personnel Advisory Board, and presented him with a
Certificate of Re- appointment to the Planning Commission, District 3.
Mayor Brazelton presented a Proclamation declaring August 21, 1993 as
"Food For All" Day to Ethel Lover , Program Developer, Food For Al 1
Corporation.
HEARINGS
Mayor Brazelton opened the public hearing on DOWNEY MUNICIPAL CODE
AMENDMENT 93-44 REGARDING SENIOR HOUSING DEVELOPMENT STANDARDS.
Ms. Baker affirmed receipt of the proof of publication.
It was moved by Council Member Boggs, seconded by Council Member
Lawrence, and so ordered to receive and file.

Mr. Rangel summarized the staff report, noting the proposed Ordinance
would allow legal non-conforming senior housing units developed before 1992 to
be rebuilt in the case of natural or manmade disasters. The three most recent
developments affected are Regent Terrace, Brookshire Manor, and Aspen Place,
since they were approved by the City prior to the effective date of the Senior
Citizen Housing Standards in 1992.
No correspondence was received on this matter.
There being no one present wishing to speak in favor or opposition to the
proposed Code Amendment, it was moved by Council Member Lawrence, seconded by
Council Member Boggs, and so ordered to close the public hearing.
ORDINANCE NO.

AMENDING SECTION 9141 OF THE DOWNEY MUNICIPAL CODE
PERTAINING TO SENIOR HOUSING DEVELOPMENT STANDARDS, BY
MENDING SECTION 9141.18 APPLICABILITY OF OTHER
REGULATIONS AND PREVIOUS APPROVALS
The Ordinance was read by title only. It was moved by Council Member
Riley, seconded by Council Member Lawrence, and unanimously carried to waive
further reading and introduce.
CONSENT CALENDAR - ITEMS FOR REMOVAL:
Council Member Lawrence requested removal from the Consent Calendar of
AGENDA ITEM VI-E-1, PROPOSED ROSE FLOAT ASSOCIATION FACILITY AT WILDERNESS

It was moved by Council Member Riley, seconded by Council Member
Lawrence, and unanimously carried to waive further reading of the Resolutions
and approve the remainder of the Consent Calendar as recommended:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
MENDING ARTICLE IV, CHAPTER 6 OF THE DOWNEY MUNICIPAL
CODE BY ADDING SECTION 4601 THERETO PERTAINING TO FEES
AND THE USE OF POLICE SERVICES FOR SECOND RESPONSES AT
PARTIES OR GATHERINGS
Chief Caldwell explained the intent of this Ordinance is to authorize
charging a party giver for second or more police responses to loud, boisterous
parties. A suggested minimum fee of $50 is based on a per minute cost for
personnel involved, similiar to that imposed by surrounding cities.
Council Member Boggs clarified the fee would be assessed on the party
giver, and not the caller reporting a noisy party.
Council Member McCaughan questioned whether a lien could be placed on
property to collect the fee, and was informed that a property lien cannot be
imposed under the current State legislation.
Discussion ensued regarding fee collection, such as small claims court
and subsequent judgement actions.
The Ordinance was read by title only. It was moved by Council Member
Boggs, seconded by Council Member Riley, and unanimously carried to waive
further reading and introduce.

PROPOSED ROSE FLOAT ASSOCIATION FACILITY AT WILDERNESS PARK -
AUTHORIZATION TO NEGOTIATE A LEASE
Council Member Lawrence expressed the following concerns with the
Wilderness Park location: Need for neighborhood notification, landscaping
consistent with the surrounding area, potential loss of significant trees,
logistics as they pertain to area turnaround, guaranteed funding before
commencement of the p roject, size of location site, and lack of available
space for future Rose Float expansion needs.

Mr. Redmayne narrated a brief slide presentation of potential sites for
consideration. The Physical Services Division Yard parking lot had been
suggested as a possible location; however, use of this site would preclude
future plans to expand the Yard, and problems exist with insufficient turning
radius for Rose Float equipment. Mother site for consideration is a portion
of undeveloped land at Wilderness Park. The area meets the needs of the Rose
Float Association, and has been approved for this purpose by the Recreation
and Community Services Commission. Particulars dealing with size and exact
location can be negotiated in the lease. Compatible landscaping, including
minimal tree removal, will be addressed, and sufficient funding will be
required prior to building approval. Mr. Redmayne recommended that a public
informational meeting be held to receive input on the proposed use from the
surrounding Park residents.
In response to Council Member Riley's questions, Mr. Redmayne explained
that ample parking is available near the restroom area depicted in the Park
slides.
Discussion ensued regarding land ownership and appropriate use of the
area.
Council i l locations Member Boggs discussed the many locations that have been
considered in the past, and noted the Park property meets the needs of all
concerned. Security issues will have to be addressed by the Rose Float
Assoc iation.
It was moved by Council Member Boggs, seconded by Council Member
Lawrence, and unanimously carried to authorize the negotiation of a lease
agreement with the Downey Rose Float association for construction and use of a
building on a portion of Wilderness Park.
Prior to the foregoing vote, Mr. Redmayne advised the lease agreement
will be returned to Council for final approval.
Council Member McCaughan commented on the need to maintain open space in
the City, and mentioned the possibility of security problems in this secluded
portion of the Park.
Ms. Gloria Heer, 10257 Rives Ave., voiced concern with inadequate parking
facilities at the Park site. She commented on preserving wildlife in the Park
and open space in the City, and the need t o protect Downey's parks for p u b l i c
enjoyment.
Ms. Doris Patterson, 10524 Lesterford Ave., spoke regarding the adequacy
of the proposed Park site, noting the building could be used as an Emergency
Preparedness Center, if needed.
Mr. Joel Lubin, 7820 Allengrove St., agreed with the need to preserve
parks in Downey, and suggested an environmental impact report be conducted on
the proposed site to address concerns in this area.
Ms. Dee Ba cus , 10330 Downey Ave., mentioned the Rose Float Association is
requesting a very small amount of unused land at the Park, and discussed the
measures that will be taken for security and landscaping.

Mr. Lee Squire, 8804 Samo line St., commended Council Member McCaughan for
his recent vote against increasing the utility users tax.

APPROPRIATION OF FUNDS FOR SPECIAL MUNICIPAL ELECTION - NOVEMBER 2, 1993
Council Member McCaughan mentioned that the cost of $60,000 for the
Special Election in November deferred funds that could have been used for
public safety services.
It was moved by Council Member McCaughan, seconded by Council Member
Lawrence, and unanimously carried to authorize the transfer of $60,000 from
the General Fund Reserves to Account No. 104-1130.0700 (City Clerk Budget) to
cover costs for the Special Municipal Election to be held in the City of
Downey on November 2, 1993.
Prior to the foregoing vote, Joel Lubin, 7820 Al l e n g ro v e St., concurred
with Council Member McCaughan's comments, questioning whether money could have
been saved if the Charter Amendment ballot questions had been deferred to the
regularly scheduled election in June, 1994.
Ms. Baker mentioned that the City of Downey Special Municipal Election
will be consolidated with State and local school board elections, in an effort
to save costs.
Discussion ensued regarding the initiative process that required the
calling of a Special Municipal Election in November , 1993, and the
misconception that this Election would not cost the City any money.

CITY COUNCIL COMMITTEE ASSIGNMENTS
Mayor Brazelton corrected the list to reflect that Council Members
McCaughan and Riley serve in equal capacity on the Community Center Site
Selection Subcommittee.
It was moved by Council Member Boggs, seconded by Council Member
Lawrence, and unanimously
carried to receive ant file.
RESTRICTIONS REGARDING YARD SALES
Mr. Rangel summarized the staff report, explaining the regulations for
garage sales as outlined in the Downey Municipal Code.
Council Member McCaughan discussed the statistical average of permits
issued for ga rage sales, and cited abuses of the system, i .e . , sale of
commercial items, and frequent sales at the same location. Other problems
such as security and traffic need to be addressed. Two possible options
include restricting garage sales to one specific place in the City, or
reviewing the Downey Mun is i al Code for stricter rules and procedures, such as
imposing a significant penalty on violators.

Council Member Boggs favored enforcement of the current regulations.
Council Member Lawrence expressed concern with garage sale signs placed
throughout the City, and was informed that City employees can remove the signs
in the public right -of -way.
Council Member Riley also noted the problems with the sale of commercial
goods at garage sales, and urged continued enforcement of the current
requirements.
After further discussion, it was the consensus of Council to direct staff
to return at the next meeting with a report addressing the concerns discussed
tonight and enforcement options available.
Council Member Riley commended Police officer Richard Tuttle on his
recent handling of a loud party complaint at a 'Youth at Risk' gathering held
in a local park.
Council Member McCaughan requested consideration of a neighborhood tour
by City Council Members be placed on a future agenda to evaluate the needs of
the housing community, similar to the efforts of the BRAID Program for
businesses in the City.

longtime Downey resident and wife of Mr. Arch Morris , to 6:30 p.m., August
