The City Council of the City of Downey held a regular meeting at
7:30 p.m., July 13, 1993, in the Council Chamber of the Downey City Hall,

PR ESENTATIONS
Ms . Lee Emerson was unable to be present to accept her Certificate of
Appreciation for service on the Personnel Advisory Board.
HEARINGS
Mayor Brazelton opened the public hearing again on PROPOSED UTILITY USERS
TAX INCREASE.
Mr. Caton summarized the staff report, explaining the proposed 2% utility
users tax increase on electric, gas and telephone bills will provide $1.9
million annually to help offset State revenue reductions. He discussed budget
reductions implemented by Council at previous meetings, noting that all
Departments have reduced their budgets, with the exception of the Police and
Fire Department budgets, which have increased. The monies received from the
current Utility Users tax of 3% has enabled the Fire Department to be
maintained at nearly full strength. To retain competent employees, he
recommended consideration be given to a modest salary increase for Police and
Fire personnel.

In response to Council Member Boggs' questions, Mr. Caton noted the
latest information from the State indicates they will not be taking as much
property tax monies as previously expected.
There was no correspondence received on this matter.
Mayor Brazelton asked if there was anyone present to speak regarding the
proposed Utility Users Tax increase.
Johnette Stickel, 8731 McCallum St., opposed any increase in taxes,

and suggested that money saved from suspension of golf course maintenance
services during closure should be considered as a revenue source.
Mr. E d Di L o reto , 7333 Rio Flora P1 . , read a letter of opposition to the
proposed utility users tax, and submitted same into the public record. He
referenced a recent article regarding a private firm that avoided bankruptcy
with the help of employee concessions.
Ms. JoAnn Warner, Executive Director, Downey Chamber of Commerce, 11131
Brookshire Ave., spoke regarding the detrimental effect of the proposed tax
increase on businesses which will defeat the goal of business retention and
attraction.
Mr. Richard Jennings, 7435 Stewart & Gray Rd., expressed support for the
utility users tax as the fairest way to increase taxes, since people can
monitor their consumption. He indicated the importance of correct accounting
procedures to ensure that monies collected from the tax are received by the
appropriate City.
Mr. Bob Collins, (address unk.) , voiced opposition to the utility users
tax increase, citing the necessity of utility use in a household.
Ms. Susan Taylor, 8628 Donovan St., spoke against the proposed tax,
mentioning various increases on her other utility bills. She questioned the
result of a previous commitment to hire additional police officers with funds
provided by the current utility users tax.

additional burden to the citizens of Downey, and suggested balancing the
budget by reducing salaries of civil service employees.
Norman Horney, 9102 Angell St., noted the voters elected Council
Members to preserve the services of the City, including implementing utility
users tax to generate necessary revenue. He advocated salary increases for
all employee groups.
Ms. Neville Kilpatrick, 8117 5th St., urged support of the proposed tax
increase and continuation of the DARE Program in the Police Department.
Ms. Lisa Rapp, 7823 Baysinger St., spoke regarding the excellent City
services received in the past years, and favored the utility users tax as a
fair and effective way to deal with the economic problem.
Ms. Joan Smay, 13338 Castana St., mentioned that people will pay the
increased tax if necessary to retain the City's fine Police Department.

Mr. Dan Kragen, Facilities Manager, Rockwell International Corporation,
25 08 22nd St., Santa Monica, expressed opposition to the increased tax as it
would penalize labor- intensive businesses.
Ms. Terry Lambros, 9715 Brookshire Ave., noted her dismay with the great
amount of taxes imposed on citizens, and recommended creative expenditure
limitations.
Mr. Joseph Lumsdaine, 9926 Pangborn St., spoke in favor of a unanimous
decision to increase the utility users tax, noting that all possible budget
reductions have been considered by Council.
Council Member McCaughan mentioned the need for innovative spending
instead of higher taxes. The Council works together as a team, although
opinions differ at times.
Mr. Lennie Whittington, 8542 Manatee St., discussed public distrust of
previous claims to hire additional police officers. He suggested the use of
golf course surplus funds to balance the budget.

expressed opposition to the

Mr. Richard Pridham, 10402 Bel lman St., referenced notifications he
receieved of other tax increases from public utility companies and opposed any
further tax increase.
Mayor Brazelton recognized approximately 25 people in the audience
expressing opposition to the proposed utility users tax, and approximately 15
people indicating approval of the tax.
Mr. Joel Lubin, 7820 Allengrove St., spoke against a tax increase without
a vote of the people, noting further cutbacks that could be realized in the
budget, such as association dues for City employees.
Ms. Gloria Heer, 10257 Rives Ave., explained the amount of the utility
users tax can be adjusted by prudent living styles. She supported continued
Code Enforcement throughout the City as a necessity to quality life in Downey.
Ms. Margaret Fillet, 9904 Birchdale St., mentioned that prior tax money
was not used to fund the hiring of additional police officers, and questioned
the disposition of the money collected by the proposed tax increase.
Mr. Caton discussed the services expected by the citizens that
necessitate the proposed tax.
Ms. Glenna Hall, 10615 Stamps Rd., indicated she cannot afford to pay any
increase in her utility bills, and will be moving out of California because of
the high cost of living.
Mr. Ralph Dulac, 8901 Arrington Rd., questioned the comparison of
salaries of neighboring cities' public safety employees, and was informed that
Downey employees are paid below the average surveyed. He recommended
development of the riverbed property near the 6 05 Freeway to generate revenue.

Mr. Brad Van Ert, President, Downey Firemen's Association, mentioned the
effects of difficult economic times on Fire Department personnel, including
reductions in training and equipment, and the loss of valuable employees to
other cities. Revenue must be generated to preserve the quality of Fire
service depended upon by the community.

commented on the importance of competitiveness in maintaining a profficient
police department. Downey Police Officers are the lowest paid personnel when
compared to a survey of 13 surrounding cities with similar services.

ORDINANCE NO. 965
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
MENDING SECTIONS 6182(A), 6184(A), MD 6185(A), OF THE
DOW NEY MUNICIPAL CODE RELATING TO THE UTILITY USERS TAX
The Ordinance was read by title only. It was moved by Cou nc i 1 Member
Boggs, seconded by Council Member Lawrence, to naive further reading and
adopt. (Motion split into two motions, and voted on separately - see Page 5).
Council Member McCaughan reiterated his desire to further review the
budget for reductions that would not affect the quality of life in Downey.
He discussed subsidized services, fees, and the benefits of utilizing
assessment districts.
Council Member Riley mentioned that public comments indicate a desire for
continued quality service from the City. She favored the utility users tax as
the fairest means to generate revenue for these services, noting the waiver
provision of the tax for hardship cases.
Council Member Lawrence encouraged the public to voice their anger about
the budget problem to their State representative. She explained the benefits
associated with organization membership, such as as networking and receipt of
updated information, and mentioned the existence of employee volunteer
efforts.
Council Member Boggs expressed support of the utility users tax method as
the fairest way to generate necessary revenue for preserving City services.
She requested establishment of a limitation on the proposed tax related to
large businesses, and asked that a system be employed to prosecute misdemeanor
cases that may not be handled by the District Attorney in the future. She
stressed the need for innovative ideas to generate revenue.
Mayor Brazelton voiced concern that an assessment district would
essentially free up monies in other Departments. Further budget reductions
will serverely impair the services the public has come to expect.
Mr. McOsker advised that waiver of further reading of the Ordinace
requires a unanimous vote of Council.

Mr. Lennie Whittington, 8542 Manatee St., voiced concern with the closure
of the paramedic base station at Downey Community Hospital, citing possible
injuries or delays. Since service has been reduced to the community,. he
questioned whether the lease agreement has been violated.

Ms . Glenna Ha 11, 10615 Stamps Rd . , expressed concern with Downey
Community Hospital's attempts to save money through closure of the paramedic
base station while simultaneously mailing out various flyers soliciting her
attendance at their functions.
Mr. Joel Lubin, 7820 Al l e ng ro v e St , commended Council for the service
they give to the community.
Mr. Lennie Whittington, 8542 Manatee St., mentioned overhearing that
Downey Community Hospital is strongly considering becoming a HMO facility,
possibly violating their lease agreement.
Ms. Susan Taylor, 8628 Donovan St., questioned what effect the paramedic
base station closure at Downey Community Hospital would have on the community.
Chief Irwin explained there w i l l be no changes with the service currently
provided by the paramedics. Medical direction received by the paramedics will
be coming from another base hospital; however, Downey Community Hospital will
remain a receiving hospital for treatment.
Ms. Gloria Heer, 10527 Rives Ave., suggested the City save money by
increasing the thermostat in the Council Chamber.
Mr. Lennie Whittington, 8542 Nbnatee St., expressed concern regarding the
amount of information relayed to the receiving hospital from the paramedic
base station at another hospital.
Mr. Dennis Groat, Downey Fire Marshall, addressed the concers of people
speaking about the paramedic base station closure by explaining that base
stations are in direct contact with the receiving hospital so that all
information is known about a patient when they are admitted to the hospital.

Mayor Brazelton opened the public hearing on LIGHTING MAINTENANCE
DISTRICT A. D. 121 - 1993-94 ASSESSMENT LEVY/MAXIMUM ASSESSMENT THROUGH 1996-
97.
Ms. McDonnell affirmed receipt of the affidavit of posting and mailing of
notice and proof of publication.
It was moved b y Council Member Lawrence, seconded by Council Member
Boggs, and so ordered to receive and file the affidavit and proof.
Mr. Redmayne summarized the staff report, explaining that increased rates
are necessary because of the State using property tax monies that previously
funded lighting district maintenance. In accordance with SB 1977, a four year
maximum fee structure is proposed to save costs on advertising. The specific
rate will be establish by Council each year.
Ms. McDonnell advised she has received 36 written protest letters.

Boggs, and so ordered to receive and file the protests.
Mayor Brazelton asked if there was anyone present who wished to speak in
protest to the proposed assessments.
Mr. Lennie Whittington, 8542 Manatee St., expressed concern that Downey
Community Hospital is not paying any lighting assessments for the parcel on
which the hospital building is located, because the land is leased to them by
the City. However, terms of the lease indicate a possible change of ownership
to the Hospital, wherein lighting assessments would apply.
Ms. Susan Taylor, 8628 Donovan St., noted she received two notices of
. . . . . information this hearing, with conflicting information on her residence.
Staff was directed to contact Ms. Taylor regarding this problem.
Mr. Richard Pridham, 10402 Beliman St., suggested contacting the Edison
Company regarding the amount of unlit street lights in the City, and favored
unscrewing one half of the light bulbs to save money.
Mr. Ralph Dulac, 8901 Arrington Ave., expressed dismay that lots with
developments set back from the street do not derive the same benefit from
street lights as other properties. He recommended removal of street lighting
poles, as they often attract graffiti.
Ms. Lisa Rapp, 7820 Baysinger St., commented on the sound, fiscal policy
of lighting assessments that equally distribute costs for operation and
maintenance of street lighting.

There being no one else wishing to speak regarding this matter, it was
moved by Council Member McCaughan, seconded by Council Member Boggs, and so

Prior to the foregoing vote, Council Member McCaughan noted the potential
liability involved with unscrewing street light bulbs, and the actual low
percentage of unlit street lights throughout the City.

AUTHORIZING A S I D EL ETTER AGREEMENT BETWEEN THE CITY OF
DOWNEY AND THE DOW N EY FI R EN EN ' S ASSOCIATION, WHICH
ESTABLISHES A SPECIAL FIRE ASSIGNMENT BONUS

ORDINANCE NO. 964
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADDING CHAPTER 10 TO ARTICLE IV OF THE DOW N EY MUNICIPAL CODE
REGULATING GRAFFITI WITHIN THE CITY
The Ordinance was read by title only. It was moved by Council Member
Boggs, seconded by Council Member McCaughan, and unanimously carried to waive
further reading and adopt.
Prior to the foregoing vote, Council Member Lawrence expressed her
opposition to p e n a l i z i n g property owners that may be victimized by graffiti.

AUTHORIZING A WAIVER OF REQUIRED PARKING SPACES AND SETTING
OF FEES AT $2,500 PER SPACE (11032 DOWNEY AVENUE)
Mr. Red may ne summarized the staff report, noting the property owner plans
to expand the area of his restaurant known as the Cowboy Ca fe . The proposed
expansion would require additional parking which is not available. Staff is
recommending waiver of the parking spaces and application of the minimum fee
of $2,500 per space as specified in the Downey Municipal Code.
Discussion ensued regarding the applicant's plans to expand the
restaurant without increasing the seating capacity.
It was moved by Council Member McCaughan, seconded by Council Member
Lawrence, and unanimously carried to request the City Attorney to rye to rn with
findings waiving the required parking spaces, ant reducing the minimum fee to
$0.00 per space, contingent on the seating capacity remaining at its current
level.
Mr. Joel Lubin, 7820 Allengrove St., concurred with Council's comments,
noting excessive regulations are counter - productive.
ADMINISTRATIVE REPORTS
COMMUNITY ECONOMIC PROFILE: REPORT OF BRAID PROGRM AND BR COMMITTEE
Mr. Rangel summarized the staff report, noting the outreach and
assistance aspects of the Program. The Profile consists of Downey's economic
base information, recommendations of BRAID Committee Members, and planned
activities under the BRAID Program.

It was moved by Council Member Riley, seconded by Council Member
Lawrence, and unanimously carried to receive and file the report.
AGREEMENT FOR WATER /SANITATION DIVISION TELEMETRY SYSTEM
Mr. Redmayne spoke regarding the de l ap ida ted condition of the existing
telemetry system used by the Water Division, citing dysfunctional pressure
sensors and t i mec l ocks . He introduced Mr. Paul Johnson, Advanced Telemetry
Systems International, Inc. (ATSI) in the audience to answer any questions.
Mr. Johnson explained the updated data a v a i l a b l e with the proposed
system, i .e . reservoir level , pressure controls , failure of equipment
indicators, etc.
It was moved by Council Member Riley, seconded by Council Member
McCaughan, and unanimously carried to authorize the Mayor to execute an
agreement with ATSI to provide a Supervisory Control and Data kquisition
Telemetry (SCADA) System for the Water /Sanitation Division.
STAFFING FOR DARE PROGRM - 1993 -94 BUDGET
Chief Caldwell summarized the staff report, discussing the necessity of
using a sworn officer in the DARE Program as indicated by DARE America
regulations. Staff recommends continuing the Program this year, with
consideration of other staffing options in the future if economic times remain
di fficult.
Discussion ensued regarding the importance of the DARE Program in the
community.
It was moved by Council Member Riley, seconded by Council Member Boggs

and unanimously carried to approve continued funding of the DARE Program as
currently outlined in the 1992 -93 budget.
REVISED FINAL. FIXED ROUTE TRANSIT PLAN: AUTHORIZATION TO SOLICIT SERVICE
PROVIDER PROPOSALS
Ms. Duke summarized the staff report, noting the transit routes have been
modified to address Council 's earlier concerns of service to certain areas of
the City.
Discussion ensued regarding the use of new or existing transit vehicles.
Buffy Ellis and Heather Henninger, ANrtA consultants, explained the
changes made to the transit routes, including additional areas of service that
concentrate on intra -city transportation. Ms. Henninger commented on the
importance of viewing this program as a demonstration or provisional service
based on future success.
Council Member Boggs requested further time to study the revised
proposal. She favored starting the Program with a minimal amount of
investment, until its success can be measured.

Council Member Lawrence noted that Proposition A and C monies were voted
upon by the public to be used for transportation services. She stressed that
ridership could increase with promotional activities, and recommended the
project be implemented.
Council Member Riley questioned the permanence of the route in southwest
Downey.
Ms. Duke noted Council approval was needed to send the ro 'ec t to the

p ty for any modifications. After their review, the
transit plan would return to Council for further consideration.
Cou nc i l Member McCaughan reiterated the need for bidirectional service,
and discussed cost vs. benefits of the program.
Mayor Brazelton concurred, expressing concern with proposed ridership

figures and the cancellation policy of the contract.
Ms. Menn finger explained the estimated figures a r are based on the hourly

costs commonly seen in other systems.
It was moved by Council Member Boggs, seconded by Council Member
McCaughan, and unanimously carried to continue consideration of this ratter to
the next Council Meeting of July 27, 1993.

RESOLUTIONS, AND A6 EN D I ZE FOR JULY 27, 1993
Cou nc i l Member Boggs requested continuing this item to allow a ow time for a
careful review. She suggested the necessary paperwork be prepared for the
next meeting and asked staff to provide an alternative term limit proposal to
initiative nitiative submitted .

Discussion ensued regarding possible language for an alternative term
limit proposal.
Mr. Joel Lubin, 7820 Allengrove, recommended the following language be
considered as an alternative amendment: "Prior service as a Member of the
Downey City Council shall not be used in any test of qualification to file for
office of the Downey City Council". He discussed common practices of other
cities, and the unfair policy of penalizing someone for previous service on
the City Council.

After further discussion, staff was directed to prepare the necessary - � ' ; �
paperwork for the Council meeting of July 27, 1993 regarding this matter, and 6
draft an alternative term limitation Charter amendment similar to the language
proposed by Mr. Lubin.

Council Member Boggs asked about the records proposed for destruction.
Mr. Caton advised the records are tape recordings of Design Review Board

and Planning Commission meetings from 1980 through 1987. The tapes will be
erased and reused by the secretary at future meetings.

RESOLUTION NO. 5701
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
IM PL E]M ENTI NG AN EARLY RETIREMENT PROGRAM FOR ALL
FULL -TIME EMPLOYEES
Council Member Boggs requested the s ide let ter agreements associated with
this program be changed to reflect the effective retirement date between
September 1 and November 30, 1993, instead of October 30, 1993.
The Resolution was read by title only. It was moved by Council Member
Boggs, seconded by Council Member Lawrence, and unanimously carried to waive
further reading and adopt, with the modification fication to the sideletter agreements

extending the retirement date period to November 30, 1993.

REQUEST TO SUPPORT SB 778 (DILLS) REGARDING SERVICE DUPLICATION
Council Member Boggs explained this Bill would allow the Sanitation
Districts to use their own reclaimed water to irrigate the L a Puente L a n d f i l l .
It was moved by Council Member Boggs, seconded by Cou nc i l Member
Lawrence, and unanimously carried to authorize the Mayor to send a letter to
the City's elected representatives supporting SB 778.

Council Member Lawrence favored the use of a sworn police officer as the
Community Relations Officer and asked that this modification be returned as an
agenda item for consideration.
Council Member Boggs requested staff look into a new Air Quality
Management District bill that is anti- business.

Council Member Boggs noted receipt of a letter from D. Nark lbrris ,
Downey Unified School Board, regarding lack of resources for establishment of
a community center.
Council Member Boggs commented on her attendance at a recent Independent
Cities Association meeting that urged Cities to find additional sources of
revenue, such as the sale of services, which has been previously discussed by
Mr . Caton .
Council Member Boggs recommended placement of one or two outdated
ordinances on future agendas to be considered for removal.
C o u n c i l Member Riley recommended continued efforts in locating a site for
a commu n ity center.
Council Member McCaughan re iterated his concern with safety and
commerciality of yard sales.
Council Member McCaughan requested the status of the property maintenance
ord inance.
Council Member McCaughan also acknowledged receipt of a letter from
Downey Unified School District, indicating they are unable to assist in the
development of a community center at this time.
Council Member McCaughan questioned potential City liability resulting
from an abundance of signs in liquor store windows that block visibility into
the store.
Council Member McCaughan requested the agenlla rules procedure be
considerned at the next meeting for possible revisions to facilitate placement
of items on the agenda by Council Members.
