The City Council of the City of Downey held a regular meeting at
7:30 p.m., June 22, 1993, in the Council Chamber of the Downey City Hall,
Mayor Diane P. Boggs presiding.

PRESENTATIONS
Council Member Riley presented a Certificate of Appointment to Gary
Parks, Traffic Comittee, District 2.
Mayor Boggs and Chief Irwin presented Certificate of Merit Plaques to
Joseph Neales and Dave Bueller for their heroic efforts and dedication to the
safety of the City of Downey. Plaques were also awarded to Firefighters Scott
Jaeggi and Darren Mon, who were unable to be present.
HEARINGS
Mayor Boggs opened the public hearing on FISCAL YEAR 1993 -94 CITY BUDGET.
Ms. McDonnell affirmed receipt of proof of publication.
It was moved by Council Member Riley, seconded by Council Member
Lawrence, and so ordered to receive and file the proof.

Mr. Caton summarized the staff report, noting the importance of the
budget document as a f i n a n c i a l guideline for the next fiscal year. He
recalled that public input was received at the recent Budget Study Session
held on April 22, 1993, wherein staff was directed by a majority of Council to
reduce the budget and increase the utility users tax. He referred to a
handout available to the public which explains the many factors that resulted
in the current economic environment, specifically the combination of the
ongoing recession and State budget cutbacks. He discussed certain items that
are not indicated in the City's budget, such as possible costs associated with
prosecution of misdemeanor cases, and medical assistance for the paramedic
program. Proposals for generating revenue include consideration of selling ,^
the downtown courthouse site and Proposition A funds.
Ma yor Boggs reconvened the Community Development Conmission.
There was no correspondence received on this matter.
Council Member /Commissioner McCaughan discussed augmentation of Community
Development Block Grant funds for additional positions in the Code Enforcement
Division.
It was moved by Council Member /Commissioner McCaughan and seconded by
Council Member /Commissioner Riley to allocate a total of five Code Enforcement
officer positions to the manning table and reflect said modification in the
budget. (Action on this motion was deferred until after public -

Mr. Keith McCarthy, 13404 Barlin Ave., discussed comparative budget
figures, s a l e of Proposition A funds, and State government revenues.
Ms. Joann Barnes, 10446 Downey Ave., spoke regarding lack of money
available for employee pay increases, and urged reductions to balance the
budget.
Mr. Larry Squire, 9546 Metro St., speaking for himself and Ms. Joan Smay,
13338 Castana St., suggested an increased allotment of Community Development
Block Grant (CDBG) funds to the School District. He submitted petitions
signed by Downey residents in favor of allocating CDBG funds for School
District assistance, and read two letters into the record from Ms. Smay and

himself requesting same.
Mr. Joel Lubin, 7820 Allengrove St., recommended continuation of a drug
awareness program without using the official "DARE" title to reduce costs, and
expressed concern that local government is raisin taxes while the economy is
raising Y
worsening. Perhaps by showing the effects of budget reductions in public
services, Downey citizens will understand the need for increased taxes to
support City programs.
Mr. Allen Johnston, 10505 Brookshire Ave., cited recent tax increases he
has received in other areas, and noted the difficulty that high taxes impose
on elderly people with fixed incomes.

Mr. Lennie Whittington, 8542 Manatee St., commented on the proposed
budget, noting further reduction ideas in the areas of employee association
memberships, cellular phones in non - public safety departments, and employee
benefits. He suggested using Golf Course funds as a source of revenue.
Mr. Lee Squire, 8804 Samoline St., recommended partial loan repayments to
the General Fund from Redevelopment and Golf Course monies to al low for a
minimal increase in the utility users tax.
Mr. Kenneth Robarge, 9060 Priscilla St., spoke in favor of licensing cats
,...., within the City to assist in the costs currently paid by dog owners for animal
services, and suggested user - supported programs to offset expenses.
Ms. Neville Kilpatrick, 8117 5th St., concurred with licensing cats in
Downey, favored pay increases for Police Officers, and maintaining a drug
awareness education program.
There being no one else to speak regarding the proposed budget, it was
moved by Council Member /Commissioner McCaughan, seconded by Council Member/
Commissioner Lawrence, and so ordered to close the public hearing.
Mr. Caton mentioned '
o ed he asked for the Community Development opment Commission
budget to be removed from the Commission Consent Calendar so the public could
speak on the matter. He noted receipt of an amended budget request from the
Project Area Committee.
At this time, the Community Development Commission adopted Resolution No.
256, approving the fiscal year 1993 -94 Community Development Commission Budget
with implementing documents. (See Community Development Commission Minutes,
6/22/93).
The Community Development Commission recessed at 8:45 p.m.
RESOLUTION NO. 5686
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING THE FISCAL YEAR 1993-94 BUDGET WITH IM PL E]M ENTI NG DOCUMENTS
The Resolution was read by title only. It was moved by Council Member
Riley and seconded by Council Member Brazelton to waive further reading and
adopt.
Mayor Boggs expressed concern with the City's responsibility of
prosecuting misdemeanor cases, and was informed that further information on
this matter will be returned at the next regular Council meeting. She
recommended the Community Development Commission begin their loan repayment
to the General Fund by monies received from selling the downtown courthouse

It was moved by . Council Member McCaughan, seconded by Mayor Boggs, and
unanimously carried to amend the Resolution to include directing staff to
investigate the possibility of selling the downtown courthouse site to repay
the debt owed to the General Fund by the Redevelopment Agency.

Mayor Boggs clarified the potential sale of Proposition A funds would not
include monies needed for the City's fixed route transit system.
It was moved by Council Member McCaughan, seconded by Council Member
Brazelton, and unanimously carried to amend the Resolution to approve the
concept of selling excess Proposition A funds.
Discussion ensued regarding the potential costs for additional Code
Enforcement Officer positions.
It was moved by Council Member McCaughan, seconded by Council Member
Lawrence, and unanimously carried to amend the Resolution by allocating
$60,000 from the General Fund, in addition to $30,000 of CDBG money, to fund
two additional Code Enforcement Officer positions.
Responding to questions regarding the DARE Program, Chief Caldwell
strongly urged the continuation of drug awareness education under the
established "DARE" program, as it is a highly recognized, well-coordinated
effort. He mentioned requirements of the "DARE" Charter regarding personnel
for the Program.
Mayor Boggs commended the "DARE" Program as being a successful community
outreach in drug awareness education.
Council Member Lawrence concurred with Chief Caldwell on the necessity of
remaining with the official "DARE" Program.
After further discussion, it was moved by Council Member Brazelton,
seconded by Council Member Lawrence, and unanimously carried to amend the
Resolution by continuing the current "DARE" Program, until staff returns with
comparative alternatives at the next Regular Council meeting.
Mayor Boggs clarified staff's recommendation to charge rent to the Downey
City Employees' Federal Credit Union at the rate of 90 cents per square foot.
It was moved by Council Member Brazelton, seconded by Council Member
Riley, and unanimously carried to amend the Resolution by charging the Credit
Union rent at the rate of 90 cents per square foot for their occupancy at City
Hall.
Mayor Boggs recommended removal of the cat licensing option in the
budget, noting the additional enforcement expense associated with such a
program.
Mr. Caton agreed there would be costs associated with the program. The
idea of requiring cat licenses in Downey was suggested to offset the costs
currently paid by dog owners for animal services within the City.
It was moved by Council Member Lawrence, seconded by Mayor Boggs, and
carried by the following vote to amend the Resolution, removing the cat
licensing option from the Budget:

Council Member Brazelton questioned the financial impact of the Budget
modifications discussed tonight, and suggested the use of golf course funds to
offset the difference.
Mr. Powell expressed concern with funding ongoing programs from a one-
time transfer of Golf Course monies.
Council Member McCaughan clarified that the proposed budget includes a 2%
utility users tax increase. He favored further budget reductions instead of
increasing the utility users tax, noting the potential revenue available from
,._., the sale of Proposition A funds. He urged more volunteerism in the community
to assist the City in other ways.
Mayor Boggs expressed the need to preserve the quality of Downey, while
following a frugal spending plan. Public opinion as evidenced during the
budget hearing does not indicate an overwhelming objection to increasing the
utility users tax.
Council Merrier Brazelton concurred with Mayor Boggs' comments, noting the
utility users tax can be lowered or abolished when the economy has improved.
Council Member Riley expressed support of the proposed budget as amended.
Additional revenue must be generated if Downey is to remain a full service
City. She agreed with lowering the utility users tax when possible in the
future, and asked staff to review options for providing a salary increase for
public safety employees.
Council Member Lawrence commented on the services provided to the
community, and the quality of life enjoyed by Downey citizens. She noted that
revenue generated would replace funds taken by the State to balance its
budget.
Council Member McCaughan mentioned his suggested budget reductions would
not be detrimental to the qualify of life in Downey.
Mr. Lennie Whittington, 8542 Manatee St., expressed dismay that the
utility users tax increase is being voted on at this time. He understood the
utility users tax would be considered separately, and had withheld his
comments on the issue until the public hearing as outlined on the agenda.
Mayor Boggs noted the utility users tax increase was mentioned in staff's
report, and addressed indirectly by those persons who spoke regarding the
proposed budget. She mentioned for the record that Mr. Whittington is opposed
to the proposed tax increase, and informed him he could comment further when
the public hearing is held.
The Resolution to adopt the 1993 -94 City of Downey Budget as amended was
carried by the following vote:

ORAL COMMUNICATIONS
Mr. Joel Lubin, 7820 Allengrove St., commented on the plans of outgoing
Council Members in another City to attend the Ptayors' Conference in New York,
c onme nd ed Senator Ro b errt Beverly for quick notification to the City about the
State budget situation, expressed opposition to term limits, and mentioned a
refund received by General Telephone customers.
Mr. Lennie Whittington, 8542 Manatee St., expressed his opposition to
nepotism and requested the issue be addressed as a Charter Amendment on the
November ballot.

Ms. Neville Kilpatrick, 8117 5th St., voiced concern with the dilapidated
condition of apartment buildings in Downey, and noted the necessity of the
utility users tax for generating revenue.
The meeting recessed at 9:50 p.m. and reconvened at 10:00 p.m.

Mayor Boggs opened the public hearing on ESTABLISHING A UNIFORM SCHEDULE
OF FEES.
Ms. McDonnell affirmed receipt of the proof of publication.
It was moved by Cou nc i l Member Riley, seconded by Cou nc i l Member
Lawrence, and so ordered to receive and file the proof.
Mr. Powell summarized the staff report, noting that 67% of the fees are
unchanged, 13 new fees have been included, and 95 fees have been increased.
He mentioned the majority of new fees would offset the actual costs of use for
services and facilities, including a $2 parking fee at Wilderness Park. Staff
estimates the proposed fee changes w i l l increase revenues by $25,000.
There was no correspondence received on this matter.
In reply to questions from Council Member Lawrence, Mr. Jarrett advised
that the Recreation and Community Services Commission and Library Advisory

Board have not reviewed any of the proposed fees.
Council Merrier McCaughan questioned the method for paying a fee for
estimated costs, and was directed to that part of the Resolution that states
the actual deposit will be the higher of the two figures of a flat amount or
an estimated amount.
Responding to Mayor Boggs' concerns, Ms. Jenkins advised that groups
using the Library have mentioned the proposed facility use fee is still very
low compared to other areas.
Mayor Boggs questioned the fee for Concealed Weapon Background
Investigations, and was informed this charge applies to anyone requesting a
permit for such use, in accordance with State guidelines.

Mayor Boggs asked if there was anyone present to speak in favor of the
proposed Uniform Schedule of Fees.
Mr. Larry Squire, 9546 Metro St., expressed support of the fee proposal
as necessary in view of the rising costs of government services and reduction
of general revenues. He mentioned the goal of generating revenue would be
defeated if people do not take advantage of services with increased fees.
There being no one else to speak in favor of the proposed fees, Mayor
Boggs asked if there was anyone present to speak in opposition.
Mr. Joel Lubin, 7820 Allengrove St., spoke against rate increases, and
questioned the practicality of the Wilderness Park fee.
Mr. Jarrett explained the fee would recover staff costs for manning the
Park entrance and providing a secure parking area. The abundance of vehicles
in the lot and illegal parking have created a hazardous, disruptive situation
in the parking lot and adjacent streets.
There being no one else wishing to speak on this matter, it was moved by

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ESTABLISHING A UNIFORM SCHEDULE OF FEES
The Resolution was read by title only. It was moved by Council Member
Brazelton, seconded by Council Member Riley, and unanimously carried to waive
further reading and adopt.
Prior to the foregoing vote, Council Member Lawrence expressed concern
with the parking problems described at Wilderness Park, noting her wish to
have had the matter reviewed by the Recreation and Community Services
Commission prior to Council consideration.
Mayor Boggs opened the public hearing on PROPOSED CODE AMENDMENT
REGARDING UTILITY USERS TAX.
Ms. McDonnell affirmed the proof of publication. It was moved by Council
Member Brazelton, seconded by Council Member Riley, and so ordered to receive
and file.
Mr. Powell summarized the staff report, recommending a 2% increase in the
utility users tax for generating revenue to offset the local tax dollars
garnered by the State. Approximately $1.9 million per year will be collected,
via the tax applied to phone, gas and electric bills.
Ms. McDonnell advised correspondence had been received from Ms. Dolores
J. King, 7530 Quinn St., favoring the tax increase, and a pay raise for the
Police Department.

Brazelton, and so ordered to receive and file the correspondence.
Mayor Boggs asked if there was anyone present to speak regarding the
proposed Code Amendment.
Mr. Joel Lubin, 7820 Allengrove St., commented on the fairness of the
utility users tax to generate revenue for balancing the budget. He favored
imposing the tax on Cable television bills since this is not a neces for

MENDING SECTIONS 6182(A), 6184(A), AND 6185(A), OF THE
DOW N EY MUNICIPAL CODE RELATING TO THE UTILITY USERS TAX
The Ordinance was read by title only. It was moved by Cou nc i l Member
Riley, seconded by Council Member Brazelton, and carried by the following vote
to waive further reading and introduce:

Prior to the foregoing vote, Cou nc i l Member Brazelton questioned the
reasoning for not applying the utility users tax to water or cable television
bills.
Mr. Caton commented on staff's recommendation that water not be taxed
because of its essential nature, and noted the City already collects a 5%
franchise fee on cable television.

Mayor Boggs requested removal from the Consent Calendar of AGENDA ITEM
VI-E-2, APPROVE ADMINISTRATIVE REGULATION ESTABLISHING POLICIES REGARDING

Mr. Thorson requested removal from the Consent Calendar of AGENDA ITEM
VI -G -1, ORDINANCE APPROVING FORM AND AUTHORIZING EXECUTION OF FACILITY LEASE

AN ORDINANCE OF THE CITY COUNCIL OF THE CIFY OF DOWNEY
ADDING CHAPTER 10 TO ARTICLE IV OF THE DOWNEY MUNICIPAL CODE
REGULATING GRAFFITI WITHIN THE CITY
Ms. Yotsuya summarized the staff report, noting the procedures that other
communities have found successful in graffiti removal and awareness
education. The new Ordinance reflects the intent of the graffiti in -house
procedure removal, the anti - graffiti • award program, and restrictions on sale
of spray paint containers to minors.
Council Member Lawrence questioned the fairness of the abatement cost
recovery system as it affects the victim.
Council Merrier McCaughan noted recovery costs would be assessed at the
City Manager's discretion. He commended Ms. Yotsuya for her work in producing
this Ordinance.

Prior to the foregoing vote, Mr. Thorson mentioned the importance of the
abatement procedure in granting the City permission to remove graffiti from
property owned by an absentee landlord.

Mayor Boggs questioned project cost limitations that must be approved by
Council.
Mr. Caton explained this policy has been followed since 1982. The only
modification is regarding environmental to consultants

1993 LEASE REVENUE BOLDS, APPROVING THE FORMS OF A NOTICE INVITING BIDS,
A NOTICE OF INTENTION TO SELL AND AN INDENTURE AND THE PREPARATION
OF AN OFFICIAL STATEMENT AND OTHER MATERIALS RELATED THERETO
W. Larry Squire, 9546 Metro St., questioned the list of prospective
bidders, brokerage firms and banks mentioned in the staff report, the
estimated contingency and requested bond amounts, and the public availability
of all documents.
Mr. Powell explained the financial adviser will be responsible for
preparation and receipt of bids, which will be opened at a public forum and
awarded at that time. Jones, Hall, Hill and White was the bond counsel
selected after reviewing all Requests for Proposals received. He mentioned
the bond counsel's extensive experience in the financial area, and noted a
representative from the Firm is in the audience to answer any questions about
the documents. Contingency amounts cover unknown construction costs, such as
inferior soil conditions.

OTHER BU SI H ESS - Council Members
Council Member McCaughan referenced a letter he received from the Downey
Unified School District indicating a possible interest in using the old Rives
Avenue School site.
Mayor Boggs requested further information from staff on the potential
uses for this site, such as a community center or school.
Mr. Caton recommended the site subcommittee meet with the School District
to discuss this matter.
It was the consensus of Council to allow the site subcommittee to meet
with District representatives to discuss proposals for the old Rives Avenue
School Site.
Council Member McCaughan requested stricter enforcement of yard sale
regulations, noting the proliferation of commercial goods for sale. He
suggested the idea of establishing an area in the City designated exclusively
for public yard sales.
Council Member McCaughan expressed concern regarding the poor condition
of many apartment buildings in Downey, and questioned ioned the status of the

property maintenance ordinance.
Council Member Lawrence referenced a letter she received from Mu r i e l
Scheurman regarding establishment of a Bicycle Advisory Committee, and asked
that this matter be referred to the Recreation and Community Services
Commission.
Council Member Lawrence advised she will be unable to attend the Council
Reorganization I't eting, and thanked Mayor Boggs for her leadership and
assistance in the past year.
Council Member Riley commended Community Services staff for the recently
held successful middle school dance.
Council Member Riley congratulated "DARE" Officers Tousseing and! Gough
for receiving awards from the Downey Coordinating Council for their dedication
and service to the "DARE" Program.
Mayor Boggs mentioned she has received a request from a senior diver to
use the community swimming pool, and requested information regarding pool
regulations.
Mayor Boggs thanked Council for the opportunity to represent Downey as
Mayor this past year.

OTHER BUSINESS - Staff Members .
Mr. Caton thanked all Council Members for their dedicated service on
subconmittes, especially the difficult work done on the budget subcommittee
composed of Mayor Boggs and Council Member McCaughan.
Mr. Caton commended Mr. Pbwe l l for his diligent work on the budget
document.
Mayor Boggs invited the public to attend the Mayoral Transition Ceremony
on Tuesday, June 29, 1993 at 7:00 p.m.
