MAY 11, 1993
The City Council of the City of Downey held a regular meeting at
7:36 p.m., May 11, 1993, in the Council Chamber of the Downey City
Hall, Mayor Diane P. Boggs presiding.

PRESENTATIONS

Mayor Boggs presented a declaring y 16-22, 1993 as
,,..� "National Public Works Week" to Dick Redmayne, Director of Public Works.
Mayor Boggs presented a Proclamation declaring May, 1993 as "Water
Awareness Month" to Dick Redmayne, Director of Public Works
Mayor Boggs presented a Proclamation declaring June 7 -11, 1993 as
"National Management Week" to Bi 1ly, M. Wilkerson, President and Chairman of
the Board, Rockwell California Space Chapter, National Management Association.
HEARINGS
Mayor Boggs opened the public hearing on PROPOSED 1993 -94 COMMUNITY
DEVELO RI ENT BLOCK GRANT (CDBG) PROGRAMS AND FUMING ALLOCATIONS.
Ms. McDonnell affirmed receipt of the proof of publication, which was
received and filed.

Mr. Rangel summarized the staff report, noting that Community p g y Development
Block Grant monies are federal funds restricted to certain uses. He discussed
the procedure followed in obtaining funding requests from Downe y Unified
School District and the public, including community meetings held to ascertain
specific needs. Neighborhood preservation and business retention programs are
examples of qualified proposals for funding under Federal regulations.
Council Member McCaughan commented on the different amounts requested for
certain programs compared to the allocation they received last year.
Council Member Lawrence inquired into the categories and percentage

limitations governing the Adult Literacy Program, Farmer's Market, a Downtown
Specific Plan, and School District assistance.

increased amounts requested for specific programs.
It was clarified that the CDBG application must be submitted to the
Department of Housing and Urban Development by May 31, 1993 to receive funding
consideration.
Mayor Boggs requested staff compute the amount needed to assist the Adult
Literacy Program.
There was no correspondence received on this matter.
Mayor Boggs asked if there was anyone present who wished to speak
regarding the proposed 1993-94 Community Development Block Grant Programs and
Funding Allocations.
Mr. Donald La Plante, Downey Unified School Board Member, mentioned that
State reductions to local revenue have also affected the School District. Any
assistance the City can provide through the CDBG Program would be appreciated.
Mr. Lee Squire, 8804 Samoline St., and Mr. Larry Squire, 9546 Metro St.,
presented a recommended CDBG expenditure plan that included using 20% Set-
Aside
funds to free up Block Grant monies for programs such as handicapped
accessible drinking fountains, playground equipment at Brookshire Park,
fencing replacement at four elementary schools, and the Adult Literacy
Program.
Ms. Joan Smay, 13338 Castana Ave., commented on the public meeting at
Apollo Park with Mr. Velasco. She stressed the importance of assisting
schools, and mentioned work that could be contracted out to reduce costs.
Mr. Meredith Perkins, 12729 Smallwood Ave., narrated a brief slide
presentation that depicted the necessity for maintaining Code Enforcement
throughout the City. He requested additional General Fund monies be allocated
in this area, since the future of Downey is dependent on a successful Code
Enforcement Program.
There being no one else wishing to speak, it was moved by Council Member
Lawrence, seconded by Council Member Brazel ton , and so ordered to close the
public hearing.

Council Member Brazelton expressed support of the Code Enforcement
allocation, but noted he could not prioritize the requests presented by the
Squires without further information.
Mr. Caton mentioned having conversations with the School District
regarding a possible Section 108 Loan to assist with Downey High School
improvements.
Council Member McCaughan favored the recommended funding for Code
Enforcement; however, he requested additional information prior to making any
decisions on further CDBG funding. He suggested these monies be used for
innovative programs, and routine necessities be charged to the General Fund,
in case CDBG monies are not available in the future. Common needs and
interests should be explored with the School District.

Further discussion ensued regarding availabiliy of the 20% Set Aside
Funds, and other programs for funding consideration, such as child care, Keep
Downey Beautiful, and Adult Literacy.
After agreeing with staff in principle on their funding recommendations,
it was the consensus of C o u n c i l to refer the CDBG Proposed Program and Funding
Allocations back to staff to address the concerns and ideas expressed tonight,
and return the matter to Council at its next meeting for further considera-
tion.
ORAL COMMUNICATIONS
Ms. Myrtle Risley, 7938 Phlox St., suggested entry doors at Apollo Center
be wheelchair accessible, similar to the front doors of City Hall.
Mr. Larry Squire, 9546 Metro St., commended the Chamber of Co nine rce and
the volunteers involved in the successful Business Faire held recently at
Warren High School.
CONSENT CALENDAR
It was moved by Council Member Riley, seconded. by Council Member
Brazelton, and unanimously carried to waive further reading of the Resolutions

ADMINISTRATIVE REPORTS
CHARTER REVIEW STUDY SESSION
It was the consensus of Council to schedule the Charter Review Study
Session for 4:00 p.m., May 25, 1993 in the Downey City Council Chamber.
Counci 1 Member Brazel ton adv ised he wil 1 unable to attend the Study
Session and was asked to submit his questions or concerns regarding Charter
Amendments to staff.
MENDING AGREEMENT BETWEEN THE FERGUSON COMPANY AND THE CITY OF DOWNEY ON
BEHALF OF THE LACDA ALLIANCE
Mr. Caton discussed the purpose and successes of the Alliance, noting
their work has resulted in reduced impacts of FEMA regulations in the affected
communities. He stressed the importance of maintaining the Washington, D.C.
lobbyist, The Ferguson Company, to further the activites of the LACDA
Alliance.

It was moved by Council Merrier Brazelton, seconded by Council Member
Riley, and unanimously carried to authorize a one -year extension of the
agreement with The Ferguson Company, and allocate $14,700 from the General
Fund for these consulting services.
CONFIRMATION OF DECISION NOT TO MAIL OUT ON- STREET LANDSCAPING AND PUBLIC
FACILITIES LANDSCAPING PROPOSED ASSESSMENTS' NOTICES
Mr. Caton explained that clarification is needed regarding the consensus
of Council not to include proposed on- street landscaping and public facilities
landscaping assessments in notices mailed to the public.
Council Member McCaughan expressed his concern that a decision was made
through a consensus of Council at a Study Session not to include proposed
landscape assessments in public notices. He noted the Resolutions adopted at
a previous Council Meeting indicate this item would be considered at the
Council Meeting on July 13, 1993.
Mr. Thorson advised that the Council consensus 'not to include the
alternative o f proposed landscaping assessments was the proper action to stop
the process. At the time of the public hearing and the consideration for
adoption of the Resolution on July 13, 1993, a decision will be made on the
remainder of the .Assessment District. The adopted Resolution will then
indicate the formal action not to include the alternative o f proposed
landscaping assessments.
Council Member McCaughan reiterated his opinion that a formal procedure
should be followed to modify a previously adopted Resolution.
It was moved by Council Member Brazelton, seconded by Council Member
Riley, and carried by the following vote, to confirm and ratify the City
Manager's decision not to mail out notices concerning proposed on- street
landscaping and public facilities landscaping assessments:

APPROVING STATE OF CALIFORNIA, D EPARIM ENT OF TRANSPORTATION,
DISTRICT AGREEMENT NO. 415 0 FOR SUPERSEDED H IG I W AY RELINQUISHMENT
CONVENTIONAL ROUTE 105 - FIRESTONE BOULEVARD
Mr. Redmayne summarized the staff report, noting the State w i l l be
relinquishing control of Firestone Boulevard to the City when the I -105
Freeway is completed. They have agreed to pay $4,000,000 to upgrade the
condition of Firestone Boulevard prior to yielding the responsibility of the
highway to Downey.
The Resolution was read by title only. It was moved by Council Member
Brazelton, seconded by Council Member Riley, and unanimously carried to waive
further reading and adopt.

OTHER BUSINESS - COUNCIL MEMBERS
Mayor Boggs welcomed the new Chief of Police, Gregory Caldwell, to the
City, and wished him a successful future in Downey.
Council Member Riley congratulated Ward and u ld in Elementary Schools
for receiving the Distinguished School he rd s.
Council Member Riley commended the Fire Department for their efforts in
conducting successful Open Houses at fire stations on Fire Service Recognition
Day, Saturday, May 8, 1993.
Council Member Brazelton praised the Community Services Department,
Downey Unified School District, the parents and children involved in the
Kidsday Hall of Fame and celebration held at Apollo Park on Saturday, May 8,
1993.
Counc i 1 Member Lawrence commented on the exciting exhibits and
demonstrations at the fire stations during Fire Service Recognition Day.
Council Member Lawrence spoke regarding the successful Business Faire at
Warren High School and commended staff for the Business Retention Program
booth at the Faire.
Council Merrier McCaughan questioned the reason for withdrawing the Car
Wash U.S.A. Subordination Agreement on the Community Development Commission
Consent Calendar, and was informed staff needed additional time to work on
this matter.
Council Member Lawrence mentioned attending a recent meeting of the
League of California Cities regarding proactive solutions for solving the
State budget crisis, and assured the public that Council and staff are closely
monitoring the situation.
OTHER BUSINESS - STAFF MEMBERS
Mr. Caton recommended the public contact their State legislators about
the garnering of City revenues. He talked about the potential reduction of
25% of Los Angeles County services, including the possible closure of Rancho
Los Amigos Medical Center in Downey.
Mr. Caton c oume nd ed the City Clerk and her staff for their work on the
upcoming Special Municipal Election.
