Mayor Boggs presented a Certificate of Appreciation to the .March of Dimes Birth Defects Foundation. Mayor Boggs presented a Proclamation declaring April, 1993, as Keep America and Keep Downey Beautiful Month, to Ms. Doris Patterson, Chairman of Keep Downey Beauti ful Committee. Mayor Boggs presented a Proclamation recognizing the Sudden Infant Death S yrid ro aye (SIDS) Alliance on the Annual Second Red Nose Day U.S.A. , to Ms. Sandy Campbell , representing the SIDS Alliance. Council Minutes 3/23/93 -1 1 ' V r jj CONSENT CALENDAR: ITEMS REMOVED BY COUNCIL APPROVAL Council Member McCaughan requested removal from the Consent Calendar of Agenda Item VI-E-1, SELECTION OF CHIEF NEGOTIATOR - LIEBERT, CASSIDY AND FRIERSON. Mayor Boggs requested removal from the Consent Calendar of Agenda Item VI-E-2, FUNDS FROM CERRITOS COLLEGE FOR CITY'S CONSULTING PARTICIPATION IN LEARNING NETWORK CENTER. CONSENT CALENDAR It was moved by Council Member Lawrence, seconded by Council Member Riley, and unanimously carried to waive further reading of the Resolutions and approve the remainder of the Consent Ca le/tar as recommended. RESOLUTION NO. 5663 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPOINTING GERALD SILBY TO TRH E DOWNEY CIVIC CENTER CORPORATION FOR COUNCILMANIC DISTRICT 1110 RESOLUTION N0. 5664 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, SUPPORTING THE COOPERATIVE EFFORTS OF THE CITY OF ANAHEIM AND DISNEYLAND IN CREATING THE DISNEYLAND R ESOR T ORDINANCES NOT SET FORTH ABOVE ORDINANCE NO. 959 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 2434(a)(6) AND 2438, AND ADDING SECTION 2349 TO THE DOWNEY MUNICIPAL CODE RELATING TO THE IMPOSITION OF A CURFEW DURING A LOCAL EMERGENCY Mr. Thorson advised this Urgency Ordinance addresses concerns discussed in recent judicial court decisions, and clarifies the conditions of curfew in Downey. The regular Ordinance will also be considered for introduction at this meeting and adoption at the next meeting. The Urgency Ordinance was read in full by Mr. Thorson. It was moved by Council Member McCaughan, seconded by Council Member Brazelton, and unanimously carried to adopt. It was moved by Council Member Riley, seconded by Council Member Brazelton, and unanimously carried to waive further reading and introduce. RESOLUTIONS NOT SET FORTH ABOVE: None. ADMINISTRATIVE REPORTS LIGHTING MAINTENANCE DISTRICT A.D. 121: ASSESSMENT LEVY 1993-94 THROUGH 1996 -97 Mr. Redmayne summarized the staff report, noting new legislation requires additional advertising and public noticing. In order to avoid the increased costs, State requirements allow the agency to establish next year's rate and a maximum rate for a four -year period. Yearly rates would be set in the normal manner, including the usual notification and public hearing. Mr. Ken Miller, 7336 Cleargrove Dr., expressed concern regarding the increased rates in Zone III and the inequities existing in adopted legislation regarding property taxes. Mr. Richard Pridham, 10402 Bel l ma n Ave., suggested unscrewing half of the street lights in the City as a cost savings measure. RESOLUTION NO. 5665 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOW N EY ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT ON PROPOSED CHANGES IN THE RATE SCHEDULE WITHIN LIGHTING MAINTENANCE DISTRICT NO. A.D. 121 FOR FISCAL YEARS 1993-94 THROUGH 1996-97 It was moved by Council Member Lawrence, seconded by Council Member Riley, and unanimously carried to waive further reading and adopt. Prior to the foregoing vote, Council Member McCaughan asked that the Engineer's Report include information on the landscaping aspect of the Lighting and Landscaping Act of 1972, which was so ordered by the Mayor. Mayor Boggs requested a letter be sent to other cities that are also affected by property tax inequities, citing Mr. Miller's concerns and recommendations on the issue. ORAL COMMUNICATIONS Mr. Michael Daugherty, 7818 Dinwiddie St., commented on recent gang activity in Crawford Park, and suggested working with the Cities of Bell Gardens and South Gate to establish a safer neighborhood. Council Minutes 3/23/93 -3- Mr. Mike Perry, 7010 Dinwiddie St., expressed concern on behalf of himself and another Dinwiddie resident, Mr. Steven Hines, regarding gunfire at Crawford Park, and requested assistance in solving this problem. Mr. Ken Miller, 7336 Cleargrove Dr., recommended increasing the utility users tax as opposed to creating assessment districts to raise revenue for City services. OTHER BUSINESS: CONSENT CALENDAR - ITEMS REMOVED BY COUNCIL APPROVAL SELECTION OF CHIEF NEGOTIATOR: APPROVE CONTRACT WITH LI EBERT, CASSIDY AND FR I ERSON Council Member McCaughan recommended a staff person be designated as the Chief Negotiator for personnel matters in order to decrease costs. Mr. Caton mentioned the legal firm is needed for consulting purposes; however, Mr. Powell is extensively involved in negotiations and will continue being part of the process. It was moved by Council Member Riley, seconded by Council Member Brazelton, and unanimously carried to authorize the City Manager to execute an agreement for special services between the City and the law firm of Li ebert , Cassidy and Frierson. FUNS FROM CERRITOS COLLEGE FOR CITY'S CONSULTING PARTICIPATION IN LEARNING NETWORK CENTER Mayor Boggs requested a brief report. Ms . Kehoe discussed staff's recommendation to implement a Community Information Service as part of the Learning Network Consortium. It was moved by Council Member Riley, seconded by Council Member Lawrence, and unanimously carried to approve the agreement between the Cerritos Community College Learning Network Consortium and the City of Downey for consulting services, and accept and authorize the expenditure of $1,500 for said services. OTHER BUSINESS: CITY COUNCIL MEMBERS ESTABLISH COUNCIL SUBCOMMITTEE TO CONSIDER SITE ALTERNATIVES FOR CONSTRUCTION OF A COMMUNITY CENTER FACILITY Council Member McCaughan suggested establishment of a subcommittee to work with the School District in developing a community center. Council Members McCaughan and Riley vo lun tee red to serve on the subcommittee to consider site alternatives for the facility. Mr. Harry Hem, 7920 6th St., received clarification that the subcommittee will forward the recommended sites to Council for their consideration. Council Minutes 3/23/93 -4- • f113 77 ESTABLISH DATE FOR TOWN HALL MEETING ON 1993-94 BUDGET PRIORITIES Council Member Lawrence recommended a special meeting be held for the public and staff to address budget concerns in the next fiscal year. Mayor Boggs stated that ample time would be allowed during the budget adoption process for public input. Mr. Lee Squire, 8804 Samoline St., favored scheduling evening study sessions regarding the budget to foster increased public attendance and input. Council Member Riley questioned the status of improvements on Imperial Highway. Council Member Riley commended staff for their efforts in lessening traffic at the Texaco gas station on Firestone Boulevard and Rives Avenue, since the approaching driveway has been moved away from the busy intersection. Council Member Riley commended the Police Department for their recent visibility near an elementary school, which has promoted a safer environment. Council Member Riley recommended placing a crossing guard /security person at the tunnel under the Santa Ana Freeway in Downey where there has been a recent problem. Council Member McCaughan suggested utilizing services of the Parent- Teacher Association (PTA) in a joint effort to provide security near the tunnel area. Council Member McCaughan commented on the benefits of using an assessment district instead of increasing the utility users tax to generate revenue. Council Member McCaughan recommended the Council serve as the Hospital Commission and review the lease of Downey Community Hospital on a yearly basis. Mayor Boggs directed the City Manager to place this subject on a fu to re agenda. Council Member McCaughan requested a quick response to the problems at Crawford Park mentioned by residents tonight. Council Member McCaughan requested staff investigate a gang attire store located on Paramount Boulevard, north of Florence Avenue. Council Member McCaughan suggested public input on a Police { 9 99 Task Force P P composed of interested groups to establish future goals and priorities of the Department. Council Member McCaughan requested removal of four shopping carts at the corner of Myrtle and Third Streets. Mayor Boggs requested additional police patrol and graffiti removal on Elm Vista Street. Council Minutes 3/23/93 -5- b fi b 4 J OTHER BUSINESS - STAFF MEMBERS Mr. Caton commended Ms. Bonnie Kehoe, Recreation ttnager, on the outstanding service she provides to the community. Mayor Boggs announced the Council is recessing to Closed Session to complete discussion of items previously announced on the Closed Session Statement. The meeting reconvened at 10:10 p.m. with all Council Members present. There were no Closed Session actions to report.
