The City Council of the City of Downey held a regular meeting at
8:00 p.m., March 9, 1993, in the Council Chamber of the Downey City

PRESENTATIONS
The March of Dimes Presentation was continued to the Council meeting of
Ma rch 23, 1993.
Mayor Boggs accepted the 1993 Downey Rose Float Portrait and Founder's
Trophy from Mr. Del Beckhart, President of the Pasadena Tournament of Roses
Association.
Mayor Ioggs presented a Certificate of Appreciation to Dee Bacus,
President of the Downey AD se Float Association.
Members of the Downey Rose Float Association we re recognized in the
audience.
HEARINGS
Mayor Boggs opened the p u b l i c hearing of protests on LIGHTING MAINTENANCE
DISTRICT A. D. 121, ANNEXATION 93/01, BROOKPARK ROM, WEST OF SMN.L.WOOD AVENUE
TO EAST OF NEEDY LANE.

Ms. McDonnell affirmed the affidavit of posting of notice and proof of
publication.
It was moved by Council Member Lawrence, seconded by Council Member
Braze l ton , and so ordered to receive and file. Cfit37
Mr. Redmayne summarized the staff report, noting the property owners in
this area have requested annexation into the Lighting Maintenance District.
There were no written protests or objections received against the subject
annexation.
There being no one present in the audience to speak regarding the
proposed annexation, it was moved by Council Member Lawrence, seconded by
Council Member Riley, and so ordered to close the public hearing.

Mayor Boggs opened the public hearing on STREET VACATION ND. 167 - EAST
SIDE OF BARLIN AVENUE, NORTH OF I - 105 FREEWAY.
Ms. McDonnell affirmed the affidavit of posting and proof of publication.
It was moved by Council Member Lawrence, seconded by Mayor Boggs, and so
ordered to receive and file.
Mr. Redmayne summarized the staff report, noting approval of this
vacation would fulfill a City commitment to property owners on the east side
of Barl i n Avenue who have requested the City vacate this portion of land in
front of their properties.
There was no correspondence received on this matter.
There being no one present in the audience to speak regarding the
proposed vacation, it was moved by Council Member Lawrence, seconded by

ADMINISTRATIVE REPORTS

SET DATE FOR JOINT MEETING OF CITY COUNCIL AND PLANNING COMMISSION
Mr. Caton explained the joint meeting will be held to discuss future
goals and direction for the community.
j It was the consensus of Council to schedule a joint meeting with the
Planning Commission for 6:30 p.m., April 20, 1993 in the Downey City Council
Chamber.

DISTRICT R EGIFtD ING REQUIREMENTS OF LOCAL GOVERNMENTS UNDER THE AIR QUALITY

Mr. Rangel discussed a recent Supreme Court decision involving the
Federal Clean Air Act and subsequent enforcement of new regulations for
Southern C a l i f o r n i a in 1993. He introduced two representatives from the Air
Quality Management District (NMD), W. Doug Kim and W. Bob Kne i sel , who were
present to discuss this matter.
Mr. Kim conniended staff's efforts on air quality issues in the past
years, and briefed the Council on air pollution statistics and regulations
currently facing this region. He narrated a slide and overhead presentation,
mentioning policies such as the Air Quality Management Plan and the "Backstop"
Rule used by the AQMD to impose control measures on those cities that do not
meet certain targets. He discussed upcoming deadlines to meet Fed a ra l
requirements on air quality issues.
Mr. Bob Kneisel spoke regarding funding resources available to aid cities
in meeting government requirements regarding air quality management. ent. He
noted, for example, car registration monies can be used to fund programs to
reduce vehicle pollution.
Mayor Boggs referred to her list of questions from the City regarding
this matter, which she will .send to the AQM D for written responses.
Council Member McCaughan discussed personnel time necessary to work on
these measures, how the "Backstops Rule will affect Downey, and funding ma jo r
projects in the City.
Council Member Brazelton commented on the unreasonable deadlines imposed,
considering how the recessionary times have impacted. businesses. These types
of measures would discourage companies from locating in Downey. He asked that
the AQM D persuade the Federal Government to extend these deadlines, in view of
the economic climate.
Mayor Boggs requested copies of information received by the AQMD from the
State regarding government requirements, , notin the regulations appear to be

Mr. Lennie Whittington, 8542 Manatee St., read a letter for the ubli

record regarding freedom of information, citing the unavailabilit of it

billing statements submitted by the City Attorney. He questioned whether a
conflict of interest exists since the City Attorney renders legal ad

the City that could result in litigation, and then ultimately represents the

City in that litigation.
Mr. Michael Hoag, 8120 4th St., suggested consideration gg s eration of funding
projects such as Farmer's Market, graffiti eradication and communication

upcoming speaking events at Downey City Library regarding landscaping.

Council Member Brazelton clarified the month -to -month tenancy term in th e
rental agreement.
It was moved by Council Member Brazelton, seconded by Council Member
Lawrence, and unanimously carried to approve venting office space at the

Problems, Inc., and authorize execution of the City's standard Rental
Agreement.
MATER WELL TELEMETRY: MINOR I ZE SOLICITATION OF PROPOSALS 10 PROVIDE A
TURN -KEY TELEMETRY (SCRA) SYSTEM FOR WATER/SANITATION DIVISION
Cou nc i l Member McCaughan questioned the cost for this system and was
informed the final price will be approximately $300,000, which has been
budgeted for implementation o f this project.
It was moved by Council Member McCaughan, seconded by Council Member
Lawrence, and unanimously carried to authorize the Director of Public Works to
solicit proposals for a Turn -key Telemetry (SCIOA) System in the Water/
Sanitation Division.

Council !timber Brazelton commented on the costs involved if Oewney's
services are extensively requested by neighboring cities.
Mr. Caton explained the Federal Government will reimburse costs in an
emergency situation, such as civil unrest.

Council Member Riley noted that her suggestions for this program, such as
dances or games, will provide entertainment for young people, especially
during summer months.
This matter was referred to the Recreation and Com■u n i ty Services
Commission and the City /School Coordinating Committee for expeditious con-

Council Member Brazelton spoke regarding a recent request by Downey POP
Varner Football to place an athletic equipment storage container at Rio San
Gabriel Park. After viewing the site, he noted the container is located in an
inconspicuous place that does not interfere with public use, and - recommended
removal of the old trailer previously used for this purpose.
Staff advised this matter could be placed on a future agenda for
consideration.
Council Member Lawrence thanked staff and those who attended the first
meeting of the BRAID Committee (Business Re me nt ion and Assistance in Downey).

Council Member Lawrence mentioned she attended a recent conference held
by the Local Government Commission and referred to topics discussed, i.e.,
land use strategies, transportation, and air quality.
Council Member Lawrence cone nted on speaking at a local chinch about
civic ov a rn me n t and community n i t information .

Council Member Lawrence stated that she is the contact person for those
persons interested in circulating a petition to preserve the It Donald's
Restaurant on Lakewood Boulevard.
Council Member McCaughan requested the status on staff's development of a
graffiti ord imance.
Council Member It Cau g ha n referenced articles in the Orange County
Register regard ing successful curfew law enforcement, and requested
information on Downey's current curfew laws.
Council Member tCaughan suggested placing on the next agenda the issue
of contacting Downey Unified School District regarding a possible property
swap to establish a comnunity center, and consider potential sites for the
facility.
Mayor Boggs requested staff look into re-lining the street next to the
Downey Municipal Cou rthou se to provide for additional parking.

Mr. Caton advised that a proposed Fire Management Ag ency with the Cit y of
Santa Fe Springs will not be established.
Mr. Caton mentioned "Specialty Vehicle, Inc.', a business in Downey that
manufactures low emission buses. !
Mr. Caton informed Council the five finalists for the Police Chief
{ position will be interviewed next week.
