The City Council of the .City of Downey held a regular meeting at
7:45 p.m., January 26, 1993, in the Council Chamber of the Downey City
Hall, Mayor Diane P. Boggs presiding.

Council Member McCaughan presented Certificates of Appointment to the
following people representing District Three: Mr. Clay Anderson and Ms. Joan
Frey - Citizens Health and Environmental Sanitation Committee; Mr. Mark Gross
- Cable Television Citizen Advisory Committee; Ms. Gloria Heer - Recreation
and Community Services Comnission; Mr. William Hockinson, Traffic Committee;
Mr. William Hunt - Water Advisory Board; and Mr. Jon Lang - Emergency
Preparedness Committee.

It was moved by Council Member Riley, seconded by Council Member
Brazelton, and unanimously carried to naive further reading of the Resolutions

RESOLUTION NO. 5644
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ESTABLISHING WATER RATES FOR THE CITY OF DOWNEY NW
RESCINDING RESOLUTION NO. 5440
Mr. Powell summarized the staff report, recommending an adjustment in
water rates to meet rising costs in supplying water to customers, and special
rate provisions for those people who use reclaimed water.
Mayor Boggs noted that two Council Members serve on the Downey Cemetery
Board, which is currently discussing the option of using reclaimed water at

the Cemetery, and she questioned whether voting on this matter would be a
conflict of interest. She was informed by Mr. Thorson this would not
constitute a conflict of interest.
Council Member McCaughan noted his previous questions on this matter have,
been answered.
The Resolution was read by title only. It was moved by Council Member
Lawrence, seconded by Council Member Riley, and unanimously carried to waive
further reading and adopt.
Prior to the foregoing vote, Mayor Boggs noted this rate adjustment is a

p p that the City has incurred in supplying water to the
citizens of Downey.
ADMINISTRATIVE REPORTS
REFERENDUM PETITIONS AGAINST ORDINANCE NO. 952 (DOWNEY COURTHOUSE BLOCK
SPECIFIC PLAN 92 -1) AND ORDINANCE NO. 953 (DEVELOINENT A6 REEN ENT WITH
ICRIKORIAN PREMIERE THEATRES, INC.)
Council Members Brazelton and McCaughan abstained from considering this
matter and left their seats, accordingly.
Ms. McDonnell discussed the two referendum petitions submitted against
the Krikorian Theatre Project, noting the necessary amount of signatures have
been verified by the Registrar of Voters Office. Therefore, the two
Ordinances are now suspended. It is requested that Cou nc i l rati fy the
Certification of the City Clerk, stating the petitions have qualified and
conform with verification refluirements. After ratifying this Certification,
it would be appropriate to discuss the course of action Council wishes to
follow on this matter.
It was moved by Council Member Lawrence, seconded by Council Member
Riley, and carried by the following vote to ratify the Certification of the
City Clerk, stating the required number of signatures have been verified,
thereby declaring sufficient the two referendum petitions submitted against
Ordinance Nos. 952 and 953:

ABSTAIN: 2 COUNCIL MEMBERS: Brazelton, McCaughan
It was moved by Council Member Lawrence, seconded by Council Member
Riley, and carried by the following vote to declare intent to set a Special
Municipal Election for May 18, 1993 and authorize the City Clerk to bring back
the appropriate resolutions and request for transfer of funds to conduct said
election :

ABSTAIN: 2 COUNCIL MEMBERS: Brazelton, McCaughan
Prior to the foregoing vote, the following discussion took place:
Mr. Joel Lubin, 7820 Allengrove St., suggested the election be held in
such a manner that voters could mail in their ballot to one precinct as a
cost - savings effort for the City.

Mr. Lennie Whittington, 8542 Manatee St., spoke regarding possible
consolidation of the Special Municipal Election, retaining Martin & Chapman
Co. as election supplier and consultant for the Election, and questioned
whether Council Members Brazelton and McCaughan, although abstaining from t h i s
matter, could speak as private citizens regarding the Project.
Mr. Thorson advised that Council Members Brazelton and McCaughan can
speak as private citizens per the Fair Political Practices Commission
k regulations, should Council decide t o proceed w i t h an e l e c t i o n .
Discussion ensued regarding possible consolidation with upcoming
elections, i.e., Downey Unified School Board Election in November, 1993. It
was noted that certain geographical areas that vote within the Downey Unified
School District are not in the City of Downey and, therefore, would not �--,
participate in the City's election. Also, an election for Board of Education
members could be cancelled if the incumbents are not challenged.
Council Member Lawrence favored having the election as soon as possible
so that a decision can be made, and the City can move forward.
Council Member Riley noted the people are willing to spend the money to
have an election on this matter; therefore, the public should be afforded an
opportunity to express their opinion.
Mayor Boggs concurred, noting the democratic process is being followed
and the citizens shall have a voice in this matter as required by the
referendum procedure.
Council Members Brazelton and McCaughan returned to their seats at this
time.
REQUEST FOR COUNCIL SUBCOMMITTEE TO STUDY SOLID WASTE COLLECTION
ALTERNATIVES
Mr. Caton requested the formation of a Council Subcommittee to review the
various methods of solid waste collection which would enable the City to meet
the State's mandates outlined in AB 939. After completing this task, the
subcommittee will make recommendations to the full City Council on how to
proceed.
A subcommittee consisting of Mayor Boggs and Council Member Riley was
established.
. ORAL COMMUNICATIONS
Mr. Lennie Whittington, 8542 Manatee St., questioned the legality of a

wide, since required identifying information was omitted.

for other news ers

that have recently gone out of business. He expressed concern about the
difficult economic times facing newspapers today.
Mr. Andrew Harrod, 10229 Julius Ave., spoke regarding a recent burglary,
broken windows and auto thefts occurring at his residence and in his
neighborhood, and re requested more police ce protection.

OTHER BUSINESS: CITY COUNCIL MEMBERS
Mayor Boggs commented on her attendance at a recent DARE (Eug Abuse
Resistance Education) graduation held at Warren High School. She commended
the young people involved, the DARE program and its officers, and the
entertainment at the ceremony.
Mayor Boggs requested a joint meeting with the Charter Review Committee
in February to review Charter issues that need to be addressed.
Council Member McCaughan requested the City Manager contact the gentleman
on Julius Avenue who spoke tonight regarding problems in his neighborhood.
Council Member Mc Cau han complimented i mented staff on the comprehensive report

regarding abandoned shopping carts.
Council Member McCaughan noted perhaps Council could consider the Anti -
Gra ffi t i Ordinance in Whittier and the Anti-Loitering Ordinance in Monrovia at
some future time for De wn ey .
Council Member Lawrence discussed her trip with the Dowmey Sister Cities
Association to San Quintin, Mexico, to deliver needed supplies after recent
flooding in the area.
Council Member Lawrence voiced concern that when the lease with Nc1bnalds
Corporation expires this year on property located at 10207 Lakewood Boulevard,
McDonalds Corporation plans on vacating the property. The City Manager has
asked for more information from the Corporation on what the City and the
public can do to retain this landmark McDonalds site.

publication by 'Downey Taxpayers United", also noting the lack of
identification required for a newspaper.
Council Member Riley thanked the City Manager on his recent "State -of -the
,•-. City' Address to the Chamber of Commerce.
Mayor Boggs commended the Downey Rose Float Association and the City's
Float entry for winning the 'Founder's Day' Trophy at the 1993 Tournament of
Roses Parade in Pasadena.
Mayor Boggs discussed her meeting with staff and Congressman Steven Horn
regarding local issues affecting Downey, specifically problems with the
Federal Emergency Management Agency (FEMA).
OTHER BUSINESS - STAFF MEMBERS
Mr. Caton responded to an article in the "Downey Taxpayers lk ited"
publication by stating that he ordered the debugging sweep of the Police
Department, not the City Council as was misreported.
