MAY 26, 1998
The City Council/Community Development Commission of the City of Downey held an
Adjourned Regular Meeting at 6:30 p.m., May 26, 1998, in the Council Chamber of the Downey City

CLOSED SESSION
Mayor /Chairman Riley announced the Council/Commissiori is recessin g to Closed Session
(6:31 p.m.) to discuss the following Sections of the Government Code:
A. SECTION 54956.9 - Subdivision (b)(1) - Conference with Legal Counsel - anticipated
litigation - exposure to litigation . potential cases

B. SECTION 54956.8 - Conference with Real Property Negotiator Gerald Caton; Property,

four parcels totaling approximately 27,000 square feet at 8117-8133 Third St.: Negotiating

Party, Advantage Realty; Under Negotiation, price and terms of payment.
The meeting reconvened in open session at 7:36 p.m. with Council Members /Commissioners
McCarthy, Lawrence, Brazelton, and Riley present; Council Member /Commissioner McCaughan was

absent. The City Attorney announced that the City Council voted unanimously (4-0) to direct the
City's special legal counsel to initiate the re aration of a Complaint for Declaratory p ec arato and Related

Relief to enforce the City's lease rights with the Downey Community Hospital Foundation. The City
of Downey intends to have further meetings with representatives of the Hospital Board in an effort to

resolve certain outstanding issues. If an acceptable resolution of these issues is not reached, the
special legal counsel has been directed to file the Complaint for Declaratory and Related Relief within

30 days.
The meeting recessed at 7:37 p. m.
ORAL COMMUNICATIONS
The meeting reconvened for Oral Communications at 8:06 p.m. with Council Members/ -
Commissioners McCarthy, Lawrence, Brazelton and Riley present; Council Member /Commissioner
McCaughan was absent (see Oral Communications under the Regular City Council Meeting) and
recessed at 8:49 p.m.
Council Member /Commissioner McCaughan arrived at 8:50 p.m.
The meeting reconvened at 9:25 p.m. with all Council Members /Commissioners present.
