REMOVING JOSE TRUJILLO AS A MEMBER OF THE RECREATION &
COMMUNITY SERVICES COMMISSION FOR COUNCILMANIC DISTRICT

Council Member McCarthy advised he appointed Mr. Trujillo with the good faith that he

shared his interest in the community, explaining that the role of an appointed commissioner is to act as
a conduit to the community and commission and to represent the interest of the appointer. He felt,
over the last year, that Mr. Trujillo's behavior has been contradictory to his views, noting he was not
consulted prior to Mr. Trujillo's actions and would remove any commissioner who conducted himself
in this manner. He thanked Mr. Trujillo for the services he provided.

Jose Trujillo, 13212 Stanbridge Avenue, thanked Councilman McCarthy and the Recreation
and Community Services Commission for allowing him to voice his concerns on issues that pertain to
the citizens of District 1, as well as the rest of the City. He felt his conduct as a City commissioner
was excellent and that he promoted the City, mentioning a trip he took to Sacramento where he met
with Senate and State representatives on issues pertaining to Downey's Parks & Recreation. He stood
by his previous accusation regarding names directed at the Golden Park area, and expressed

disappointment regarding the decision to remove him from the commission, stating he would join
other committees without having a conflict of interest, and thanked Council Member McCarthy for
allowing him to serve.
Diane Boggs, 8629 Meadow Road, commended Councilman McCarthy for appointing his
opponent to serve on the Recreation and Community Services Commission. She noted the Council is
elected by the public and has the responsibility of appointing members to the City's boards and
commissions and that those members should respect their appointers.

Council Member Brazelton supported Council Member McCarthy's recommendation and

suggested Mr. Trujillo stay involved in a positive way in the community.
Council Member Lawrence noted she will be supporting the Resolution. She stated she
serves the City large, at- lar which means she was elected by the whole City, and she took offense to
Mr. Trujillo's remarks and felt they were derogatory towards the Council.
Council Member McCaughan stated he supported Council Member McCarthy's request,

noting he has the right to appoint and the right to ask someone to step down. The Council must have
confidence in the people they appoint and he will leave it up to Council Member McCarthy to make
this judgement.

Mayor Riley stated she would also support the recommendation.

ORDINANCES
FILMING PERMIT ORDINANCE
Mr. Caton advised that staff requests continuing this matter to the Council Meeting of May 26,
1998; however, one member of the public, Mr. Whittington, who will not be able to attend the next
Council Meeting, has requested permission to give his comments tonight, with Council's permission.
Lennie Whittington, 8542 Manatee Street, advised he is very familiar with movie and television
production-and is concerned with disruptions to residential neighborhoods. He felt that staff should .-�.
build restrictions into the agreement to monitor hours of operation of equipment, unless agreements
are signed by residents. He stated there are no restraints on this at the present time.

OTHER BUSINESS - Council Members
Council Member Brazelton commented on results of the two ballot issues voted on
May Tuesday, Ma 5, 1998; 8 5% for Charter Amendment 11, and 83.5% for Charter Amendment 12,

stating this was a strong expression of the community to retain City fire services and hoped the
Firefighters would be cooperative and work together in the future regarding fire protection.
Council Member Lawrence requested an item be placed on the Agenda for the May 26th
meetin g relating relatin to Assembly Bill 146 (the Havice Bill - open meetings), to review Council's
support of any amendments that might be proposed.
Council Member McCarthy mentioned he went to the Krikorian Theatre last Friday night and
was happy to have to park on the third level. He noted some of the lights are in need of repair but it
was nice to see the structure and theatre active.
Council Member McCarthy expressed his appreciation to the people who voted last week

and who worked the polls.
Council Member McCarthy commended the Parks & Recreation staff for the Kidsday
Programs, both on Wednesday night and Saturday, May 9th, which is a wonderful opportunity to
promote kids and get them involved in community activities.
Council Member McCaughan noted his agreement with Council Member Lawrence in that the

City should monitor Assembly Bill 146.
Council Member McCaughan noted his agreement with Council Member Brazelton and
encouraged open constructive dialogue on fire services that will lead the City into the new century.
Council Member McCaughan mentioned his concern about the number of commercial
vehicles parked in residential neighborhoods, stating this is proliferating the area with vehicles. He
requested copies of the regulations regarding these vehicles and asked whose duty it is to enforce the
codes from 5:00 p.m. to 7:00 a.m. weekdays and weekends.

Council Member McCaughan mentioned contacting the FEMA hotline and speaking to
people who were unable to answer his questions. He suggested the "Feds" need to be prepared with
proper information that will enable people to purchase flood insurance at the appropriate time.
Council Member McCaughan mentioned problems he experienced with his Cable TV service
during the last two weeks and asked to see the report from the Cable TV Advisory Committee about
the Cable TV service being provided to the community. He stated even though they have a franchise,
Cable TV is providing a public service.
Council Member McCaughan complimented the Kidsday Program, suggesting giving a new
twist to the Kidsday Hall of Fame. The City needs to continue to recognize kids that are doing the
positive things in the community.
Mayor Riley commented that Kidsday was wonderful and the recognition of the kids was
great. She noted that the presence of the police officers on horses gave confidence to the public that
they were safe and protected. She complimented the Public Works staff for the services they
provided and mentioned that buses transported people to and from Fire Station 1, where many
demonstrations were held in honor of Fire Service Recognition Day. The whole City was involved
and it was a great day.
OTHER MISINESS - Staff Members
Mr. Caton congratulated the Public Works Department in recognition of Public Works Week,
stating this department went through some very tough times in the early 1990's when the City had to
make some tough budget decisions. He mentioned how well the City's drains work and asked
everyone to take a look at the City's streets compared to surrounding cities.
Mr. Caton mentioned the Street Faire on May 2nd, stating it is one of the most outstanding
events that occur in Southeast Los Angeles County. Everyone involved, particularly the Chamber of
Commerce, should be very happy with the success of this event.
Mr. Caton advised that the City Managers of member cities in Southeast Los Angeles County
(SELAC), are attempting to change its name to the more appropriate "Gateway Cities."
Mr. Caton explained that Assembly Bill 1776 is coming up on the November ballot, which
would eliminate vehicle license fees and mean the City of Downey will lose $3.9 million or 10% of its
budget. He discussed how this loss would negatively impact the City's budget.
Mr. Caton advised that July 6th is the date the City will be put in the Floodplain and will mean
$131 million a year in mandatory insurance for the ten cities affected. He noted the City is working
very hard in Congress to have this date delayed and, more importantly, to get the flood control project
completed. Proper funding, $50 to $60 million a year, could complete the project within three years;
however, the President keeps recommending $11 million a year, which will take the project ten years
to complete.

Mr. Caton commented that the City is starting to see more quality jobs coming in and noted
redevelopment of the Boeing property. The City is working very hard to bring jobs back to the City.
Mr. Caton indicated that Building Official Linda Haines, Council Member McCarthy, and he
will attend the Citizens For Downey meeting tomorrow morning at 7:00 a.m.
ORAL COMMUNICATIONS
Mitch King, 8136 Second Street, developer of six homes at 9713 -9723 Stewart & Gray Road,
said he is waiting for final approval of a tract map, which will be presented to the Council at a future
meeting. He requested preliminary approval tonight to allow him to commence with the project and
was informed by the City Attorney that the Council cannot take action on a matter that was not on the

Agenda. Mr. King asked if the City would approve pulling the permits prior to the final approval of
I I the tract map, if he and his company takes full responsibility and holds the City harmless. Mr. Vose
advised that he would discuss this with City staff on Thursday.
Jose Trujillo, 13212 Stanbridge Avenue, expressed his views regarding the turnout at the
Special Municipal Election held on May 5th. He mentioned he was not invited to speak at a forum
scheduled regarding the election issues, which he felt was discrimination. He expressed concern about
the passage and effect of Charter Amendment No. 12 and mentioned that one of the reasons he
supported the Fire Department is because he is a union member and will help any union in the City that
requests help.
Mayor Riley advised Mr. Trujillo that the City Council had nothing to do with the forum
scheduled by the League of Women's Voters and suggested any concerns be directed to the League.
Jim Derry, 7845 Fourth Street, advised the Mayor that the League of Women's Voters asked
the Downey Firemen's Association and the Save Downey Fire Department committee to participate in
a forum to discuss issues regarding the May 5th Special Municipal Election, which the Firemen's
Association declined to attend. He felt that Mr. Trujillo should have been invited to attend by the
Firemens' Association, as this is who he represents. The issue was given to the electorate, who
decided they want local control. He commended the Save Downey Fire Department committee for

the part it played in informing the electorate of the issue and noted a last minute campaign by the
opposition attempting to confuse the electorate into thinking it was an election on term limits rather
than on local control. The Save Downey Fire Department committee will be filing a formal complaint
with the State to find out who hired the telemarketing firm used to make these calls.
Joe Polselli, 9330 Gallatin Road, asked staff to look at ways to alleviate the water problems
that occur on Gallatin Road during heavy rains and was informed the Director of Public Works
will investigate this matter.
