APRIL 23, 1996
The City Council of the City of Downey held a regular meeting at 8:15 p.m., April 23, 1996,
in the Council Chamber of the Downey City Hall, Mayor Gary P. McCaughan presiding.

PRESENTATIONS:
Ms. Victoria Jenkins, City Librarian, narrated a slide presentation of the volunteer program at
the Downey City Library entitled "Explore the Wonder - Volunteer." The slides depicted many of the
functions volunteers perform at the library, and she noted that 443 volunteers gave a total of 221,231
hours of service last year under the supervision of Volunteer Coordinator Claudia Dailey.
Mayor McCaughan presented to Summer Rivers and Steve Downes, Community Services
Department employees, a Proclamation declaring May 11, 1996 as Kidsday in Downey.
Ms. Rivers noted the Downey City Council has declared all Downey parks as drug and weapon
free zones and she stated Kidsday 1996 is proud to be highlighting the new signs being posted in all
City parks.

Mayor McCaughan presented to Chief Ron Irwin, a Proclamation declaring May 11, 1996
as Fire Service Recognition Day.

Mayor McCaughan presented to Rick Skofleld, representative of the Downey Elks Lodge, a
Proclamation declaring the week beginning May 1, 1996 as Youth Week.
Mr. Gordon Davis, General Manager of the Independent Cities Risk Management
Authority ( ICRMA), stated ICRMA has dedicated its first annual report to the original five member
cities, Downey, Arcadia, Huntington Park, Inglewood and Manhattan Beach, who established ICRMA
in 1980 as a long term solution to their liability insurance needs. To commemorate this event he
presented a plaque to the City of Downey in dedication to Downey as one of the original five cities.
Mayor McCaughan presented a Certificate of Commendation for Outstanding Community
Service to Arthurneen Miller, DowneyLINK driver. Ms. Judy Smith, Division Manager for
Mayflower Laidlaw, accepted the certificate for Ms. Miller and thanked the City on her behalf.
ORAL COMMUNICATIONS
John McDonald, 11028 Elmcroft Avenue, requested the City of Downey designate May as
Motorcycle Awareness Month. He mentioned having a proposed Proclamation faxed to City Hall
and asked if it had been received. Mayor McCaughan indicated he would check his correspondence
file. Mr. Caton advised Mr. McDonald this item would be placed on the next agenda.
HEARINGS
At this time, the Community Development Commission convened in joint session with the City
Council.
Mayor/Chairman McCaughan opened the joint public hearing between the Council and
Commission on the AMENDMENT TO THE DISPOSITION AND DEVELOPMENT
AGREEMENT BETWEEN THE COMMUNITY DEVELOPMENT COMMISSION AND
KRIKORIAN PREMIERE THEATRES, INC., APPROVED SEPTEMBER 12, 1995.
Ms. McDonnell affirmed the proof of publication.
It was moved by Council Member /Commissioner Riley, seconded by Council Member /
Commissioner Boggs, and so ordered to receive and file.
Mr. Rangel advised the Disposition and Development Agreement (DDA) approved last
September included a nine screen 1,700 seat theatre and a 6,500 square foot restaurant on the
property and provided for shared use parking between Mr. Krikorian and Mr. Cardono. The primary
goal project i
oal of this ro�ect is to encourage development in downtown Downey and the proposed amendments
presented are consistent with these goals. Mr. Krikorian has had difficulty finding a restaurant to fill

the 6,500 square foot pad as most of the quality restaurants require between 8,000 to 10,000 square
feet. The proposed amendment will replace the restaurant pad with another theater auditorium
containing 260 seats and also a 1,300 square foot cafe. The land sale price, shared use parking,
parking in lieu fee or other portions of the DDA are not affected by this proposed amendment. Also,
the total project size will not increase. Staff is asking that the scheduled performance dates in the
DDA be extended.
Mayor /Chairman McCaughan inquired if the City Clerk had received any correspondence, and
the response was no.
Mayor /Chairman McCaughan asked the applicant or his representative to come forward and
make a presentation at this time.
Mr. George Krikorian, President Krikorian Theatres, Redondo Beach, noted he did not have
anything to add to Mr. Rangel's report but would be happy to answer any questions.
Mayor /Chairman McCaughan asked if there was anyone present who wished to speak in favor
of the amendment and there was no response. He then asked if there was anyone present who wished
to speak in opposition.
Guy Sterner, 8145 Firestone Boulevard, had several questions and concerns regarding parking
spaces and the cost to purchase additional spaces. He commented on the three parking lots
purchased by the downtown property owners some years ago, noting the cost to the property owners
if additional parking spaces are needed, which should also apply to this project. He said the issue is
fairness and stated his understanding that even though the downtown property owners have already
bought this property, they will not receive credit for any changes or additions.
There being no one else wishing to speak, it was moved by Council Member /Commissioner
Boggs, seconded by Council Member /Commissioner Brazelton, and so ordered to close the hearing.
RESOLUTION NO. 5945

COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF DOWNEY
AND KRIKORIAN PREMIERE THEATRES, INC., A CALIFORNIA
CORPORATION, DATED APRIL 23, 1996" FOR THE REDEVELOPMENT OF
CERTAIN PROPERTY WITHIN THE DOWNEY REDEVELOPMENT
PROJECT AREA GENERALLY BOUNDED BY LA REINA AVENUE, THIRD
STREET, NEW STREET AND SECOND STREET

Prior to the vote, Mr. Rangel commented on the recommendation to change the following
dates in the schedule of performance in Exhibit 3: The Financing Commitment from on or before May
1 to on or before June 1; the Issuance of Building Permits from on or before May 1 to on or before
June 17; Conveyance of Title or Possessory Interest from on or before May 1 to on or before June 17;
Commencement of Construction from on or before May 22 to on or before June 20; and Completion
of Construction from on or before November 22 to on or before December 21, 1996.
Mr. Caton responded to Mr. Sterner's questions and comments by advising that the meeting
held with the downtown business owners was to determine if there was any interest as far as
purchasing additional parking spaces if they expand their business. Council must make a decision on __
whether to award a contract for a two level or four level parking structure based on interest among the
private parties and the Council will ultimately set the price of what it will be to purchase a parking
space in the new structure. He also suggested giving credit to businesses that have paid into the
downtown parking.
The Council Members /Commissioners expressed comments in favor of this matter. However,
Council Member /Commissioner Boggs voiced concern about changing the dates and said she will
approve the Resolution with the understanding there won't be more delays.

Commissioner Brazelton, and unanimously carried to waive further reading and adopt with
changes in the dates as noted.
Mayor /Chairman McCaughan recessed the Community Development Commission portion of
the meeting.
Mayor McCaughan declared a recess of the City Council Meeting from 9:13 p.m. to 9:23 p.m.
The meeting reconvened with all Council Members present.
Mayor McCaughan opened the public hearing on APPEAL, MODIFIED CONDITIONAL
USE PERMIT NO. 96 - 06, FOR PROPERTY LOCATED AT 9258 ORIZABA AVENUE.
Ms. McDonnell affirmed the proof of publication. It was moved by Council Member Boggs,
seconded by Council Member Lawrence and so ordered to receive and file.

Mr. Yoshiki explained this request involves the ability to establish a large family day care on
property located at 9258 Orizaba Avenue, which is zoned R1, single family residential. The Downey
Municipal Code was amended several years ago as a result of a State mandate that provides the ability
to take care of 7 to 12 children in a single family home. The City is required to comply with this
requirement and cannot deny it or attach conditions not normally imposed on residential properties.
The only areas open to local regulations are noise, traffic, parking, spacing and concentration. In
regard to the area of concentration, the DMC requires a separation of at least 1,000 feet.
Mr. Yoshiki stated when this case was heard at the Commission level it was felt by certain
members that they could not support the case which resulted in a denial. The applicant has filed an
application of appeal and the recommendation is for approval basically granting the appeal of the
applicant.
Mayor McCaughan inquired if the City Clerk had received any correspondence on this matter,
and Ms. McDonnell advised two letters of opposition were received, one from Mr. Dwelley on
Orizaba and one from the Doyles on Brock Avenue.
It was moved by Council Member Boggs, seconded by Council Member Brazelton, and so
ordered to receive and file.
Mayor McCaughan asked the applicant or her representative to come forward and present the
case.
Mr. Bill Kirsten, 3 Imperial Promenade, Suite 445, Santa Ana, representing the applicant, Ana
Nunez and her family, who reside on the subject property, offered a definition of day care; one is the
commercial day care center and the other is the family day care center. In 1983 the Family Day Care
Homes Act was passed which provided a mandate to all cities in California to allow residential day
care in as close to a home setting as possible. He noted a comment made at the Planning Commission
meetin g that there was not a fire life safety device in place and he noted the City Planning Commission
does not have authority to provide for further fire ordinances beyond what the State Fire Marshall
provides for in Health and Safety Code Section 1597.46. He advised the Fire Department visited this
p rop e rty today toda and found it to be in compliance with the code. Mrs. Nunez has provided day care for
26 children over the past eight years whose parents either live in Downey or work in Downey and
noted some of the parents were in the audience on behalf of Mrs. Nunez.
Mayor McCaughan asked if there was anyone present who wished to speak in favor of the
appeal and there was no response. He then asked if there was anyone present who wished to speak in
opposition.
Kathleen Anderson, 9234 Orizaba Avenue, felt the day care would increase traffic since the
street is narrow and voiced concern about adequate fire extinguishers, smoke detectors, carbon
monoxide detectors and adequate restroom facilities in this two story house.
William Wells, 9316 Birchbark Avenue, stated the street is narrow, there are no sidewalks and
it is an R -1 dwelling. He has lived there for 36 years and does not want to see children in a dangerous
situation where there are no sidewalks.

Mr. Hills, 9124 Brock Avenue, has lived there since 1950 and questioned why the City wants
to turn this quiet residential area into a commercial business area.

Mr. Paul Miller, 9231 La Reina Avenue, feels it will create more traffic problems on this
narrow street.
There being no one else to speak in opposition, Mayor McCaughan asked if the applicant or
her representative wished to speak in rebuttal.
Mr. Kirsten responded to the comment about increased traffic by saying there will only be
approximately five cars coming at different times to drop off children and the same in the evening
when they pick them up. He noted the Planning Report indicates there will be no traffic problem and
that this use is mandated by the State legislature.
It was moved by Council Member Boggs, seconded by Council Member Lawrence, and so
ordered to close the hearing.
Chief Irwin responded to questions of the Council regarding the ambient noise level for this
type of facility and the Fire Department's inspections of the property. When asked if there would be
more requirements if this business was in a business or commercial zone, he replied yes, there are
stricter requirements in a business environment.
During discussion Council Member Boggs asked how long Mrs. Nunez has been at her current
location and if there have been any noise complaints.
Mr. Kirsten responded Mrs. Nunez operated a day care facility at her previous residence in
Downey for six years and has lived in this neighborhood for about a year and a half.
Council Member Boggs asked staff to monitor the noise level to see if any problems develop.
She suggested residents know where their representatives are in Sacramento and should then write to .--
them if they are opposed to this mandate by the State.
Council Member Lawrence recommended returning the appeal fee since Mrs. Nunez was
acting in a lawful manner on this matter.
Mayor McCaughan asked if this use requires a business permit and the response was no. He
feels it is a business even though the State says it is not.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE APPEAL OF MODIFIED CONDITIONAL USE PERMIT
NO. 96-06 FOR THE ESTABLISHMENT OF A LARGE FAMILY DAY CARE
ON PROPERTY LOCATED AT 9258 ORIZABA AVENUE, ZONED R1

The Resolution was read by title only. It was moved by Council Member Lawrence, seconded

and return the applicant's appeal fee.

Mayor McCaughan stated he feels the state preemption is wrong and someone should
challenge it.
Council Member Brazelton asked staff if the noise level were to become excessive based on the
conditions, is the code written where there would be authority to revoke the permit. Mr. Yoshiki
replied yes.
Mayor McCaughan opened the public hearing on URBAN WATER MANAGEMENT
PLAN.
Ms. McDonnell affirmed the proof of publication.
It was moved by Council Member Riley, seconded by Council Member Brazelton, and so
ordered to receive and file.
Mr. Redmayne advised this plan is required by the Water Code of California every five years
and p rovides for conservation during a water shortage period. The Plan was presented to the Water
Advisory Board at its March 20 meeting and approved. The Plan takes into consideration population
and housing trends in the City, projected water use, water use planning, water conservation programs,
water shortage contingencies and recycled water opportunities. It would only be implemented during
a declared water shortage and would have to be implemented by the City Council. He noted this plan
is dated 1995 and advised this is because we received an extension.
Mayor McCaughan inquired if the City Clerk had received any correspondence, and the
response was no.
There being no one present to speak in favor or opposition, it was moved by Council Member
Riley, seconded by Council Member Boggs, and so ordered to close the hearing.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING AMENDMENT OF FACILITY LEASE IN CONNECTION WITH
REFINANCING OF 1986 CERTIFICATES OF PARTICIPATION RELATING
TO CIVIC CENTER PROJECT, AND APPROVING DOCUMENTS AND
ACTIONS RELATING TO SALE OF NOT TO EXCEED $14,000,000
REFUNDING CERTIFICATES OF PARTICIPATION
The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by
Council Member Lawrence, and unanimously carried to waive further reading and adopt.

OTHER BUSINESS - Council Members
Council Member Boggs discussed street lights, noting the City of Long Beach has begun to

change some of the lights to a higher wattage. She encouraged staff to look at Downey's street

lighting to see if there are areas that should have brighter lighting.
Council Member Boggs requested uested staff report on progress of removing advertising bus
q
benches in the City.
Council Member Boggs suggested working with the School District on a citywide
immunization program.
Mayor McCaughan reported on his attendance at the Environmental Awareness Day at
Furman Park which went very well. It was good exposure for Public Works and the Dart Program.
He also noted Police Officers have driven their cars up on Furman Park to patrol it and complimented
them for this action which has generated citizen response and compliments.

OTHER BUSINESS - Stag Members
Mr. Caton reported that the staff and Council are continuing to work closely with Rockwell to
try to save them as a major employer in the City. He, Mayor McCaughan, and Mr. Rangel will be
going to Houston on May 1st to meet with the head of Johnson Space Center to discuss releasing
some of the NASA property. The industrial vacancy rate in Downey is low at this time and there is a
good opportunity to get a brand new industrial development in since developers are very interested in
this property.

The meeting was adjourned in memory of Cora Belle Lovrien, wife of retired Fire
Engineer Glenn Lovrien, to 6:30 p.m., May 14, 1996, in the Council Chamber of Downey City Hall.
