HEARINGS Mayor McCaughan opened the publ is hearing on the UNIF(M FIRE CODE - 1994 EDITION AND AMENDMENTS. Ms . McDonnell affirmed the Proof of Publ is ati o n . She al so indicated there was no correspondence received. Council Minutes 12/12/95 -1- 10254 Deputy Fire Marshal Rowe highlighted various changes proposed in ,the ffirre Code, which include renumbering the sections; a provision for allowing above ground storage tanks for dispensing fuel in limited quantities at approved locations for specified uses geared toward industrial areas of the City; and a requirement for sprinklers instead of a four -hour fire wall . There being no one present to speak to this matter, it was m ov ed by Council Member Lawrence, seconded by Council Member Brazel ton, and so ordered to close the hearing. Mayor McCaughan opened the hearing on PROPOSED CODE AMENDMENTS REGARDING UI LDING REGULATIONS. Ms . McDonnell affirmed the Proof of Publication. She al so indicated there was no correspondence received. Mr. Gallagher explained the State adopted the Uniform Building Codes as State codes, with the mandate that cities also adopt them as their building codes, except that they cannot make modifications unless for geological , topographical or climatic reasons. He then discussed his review of the City's Building Codes and recommended changes with regard to renumbering all the Chapters; deleting the acin in.i strative portion of each of the model codes and adopting a uniform administrative code; increasing the expiration date for building permits and plan checks to 180 days ; and deletions of various Code sections because they are contained in other codes. There being no one present to speak to this matter, it was roved by Council Member Boggs, seconded by Council Member Brazel ton, and so ordered to close the hearing. Mr. Rangel commented on creation of the general pl an designation of the C-M, Commercial Manufacturing, Zone , which should provide a property owner more flexibility when considering commercial or manufacturing, and this zone change would al low the subj ect property to bring the zon ing into conformance with the General P1 an designation. AN ORDINANCE OF TFE CITY COUNCIL OF TFE CITY OF DOW NE Y AMENDING SECTION 3185 OF TFE DOPEY MUNICIPAL CODE PERTAINING TO MISCELLANEOUS PARKING REGULATIONS Chief Caldwell rev iewed his previous request for Council's support in changing the Code regarding miscellaneous parking, which in part addressed Y Council Minutes 12/12/95 -4- i;2% 4 large vehicles, tractor - trailers, and trailers being parked on City streets. He said it has become more apparent that some Code modification is needed in order owners i n allowing owi n the temporary r ar parking ki n of large tractors ar to assist business a g t p y p g g and trailers on their property. The proposed Ordinance would allow the City Manager, without Council approval , to authorize a business owner to permit the parking or standing of vehicles up to 90 minutes in a 24 -hour period , and the authorization must be in writing. The Ordinance was read by title only. It was moved by Council Member Lawrence, seconded by Council Member Boggs, and so ordered to waive further reading and introduce. ORDINANCE NJ. 1011 --- AN ORDINANCE OF TIE CITY COUNCIL OF TIf CITY OF DOPEY Y APPROVING ZONE CHANGE #95 -37, REZONING PROPERTY LOCATED AT 7100 -7170 F IR ES TO['E BOULEVARD AND 11530 R YER SON AVENUE ZONED M -1 /PB (LIGHT MANUFACTURING AND PARKING BUFFER) TO C-M (CMCL-MANUFJCTtJRING) AND THAT TEE OFFICIAL ZONING MAP OF THE CITY OF DOPEY BE AMENDED TO REFLECT THIS ZO1'E CHANGE AND CERTIFYING TEE IEGATIVE DECLARATION Mr. Yoshiki mentioned the Ordinance was introduced at the public hearing; however, at the time it was presented for adoption, the Council discussed the C-M zone for possible an encln eats . The applicant then requested that second reading of this Ordinance be continued until the Council had resolved any issues with respect to changes in the C-M zone. The only change resulted in the addition of a soft drink manufacturing use , and the applicant has now requested that Council adopt the Ordinance approving the zone change. AN ORDINANCE OF TEE CITY COUNCIL OF THE CITY OF DOW IE Y APPROVING AN AMENDMENT TO THE LEASE AGREEMENT BETWEEN THE CITY OF DOW ICE Y AND TEE DOWNY ROSE FLOAT ASSOCIATION ALLOWING A MINOR CHANGE IN LOCATION OF TEE LEASE AREA AT WILDERNESS PARK IN TI-E CITY OF DOW I[ Y Mr. Recinayne reviewed the Council's previous approval for the Downey Rose Float Association to occupy a portion of Wilderness Park for constructing the Downey float each year. He noted it was later learned that the location selected made it cost prohibitive to construct a building on that site. Therefore, the Rose Float Association is requesting approval to rel ocate to a site that would allow for construction of the b u i l d i n g . He also p o i n t e d out that the adjacent residents would be notified and invited to provide input at the second reading of the Ordinance. He responded to questions regarding the proposed site for the building and location of the exit. Mr. Jarrett said the proposed location would not impact use of the park. Council Minutes 12/12/95 -5- • 10258 RESOLUTIONS: None ADMINISTRATIVE REPORTS RIO SAN GABRIEL PARK ATHLETIC FIELDS Mr. Recinayne cited some early history involving creation of the Rio San Gabriel Park, which was built on an old durnp site that was improperly com- pacted, and he emphasized the need to bring the playing field to a level condition for the safety and convenience of the athletic teams that use the --- facility. He submitted three options for Council consideration and recommended due to 1 imited General Funds, that consideration be given to the option of leveling the playing fields, reseeding, and raising the sprinkler heads on the existing irrigation system at a cost of $77,500. Mr. Caton al so pointed out the area is adj acent to a redevelopment area, so staff will be looking into the possibility of involving the Ci ty' s Redevelopment Agency. Mayor McCaughan commented on an athletic field in another city that was improved with redevelopment funds and asked if the work to be perfo at Rio San Gabriel Park would eliminate looking into the Park's anticipated needs in the future. Mr. Jarrett said the proposed repairs should last approximately 5 -7 years and there is a need to look at the entire site and make major improvements. It was moved by Council Member Lawrence, seconded by Council Member Brazel ton, and unanimously carried to authorize staff to proceed with the proposed work on Rio San Gabriel Park athletic fields using existing budgeted funds for parking lot repair and appropriate additional funds in the amount of $42,500 for use on this project. ORAL COMMUNICATIONS: None ADMINISTRATIVE REPORTS (Cont.) LICENSE AND AGREEMENT - CITIES OF MONTEBELLO, WHITTIER, AND DOWNE Y; AND JOINT AGREEMENT FOR MOBILE DATA TERMINAL SYSTEM Chief Irwin reported on the proposal to improve the existing mobile data terminal system through the construction of a new building to house the current communications equipment, with costs borne by the City of Montebello, on a site provided by the City of Whittier, who will be joining with the five cities in the joint communication system. Two agreements are submitted for approval , one between the cities of Montebello, Whittier, and Downey for construction of the new building, and the second between the cities of Montebello, Whittier, Compton, Lynwood, Santa Fe Springs and Downey to formally establish operational rules and procedures and components of the overall mobile data terminal system. He responded to questions of the Council.
