HEARINGS Mayor McCaughan opened the public hearing on PROPOSED CODE AMENDMENT tELATING TO BUSINESS LICENSE FEES - SOLID WASTE DISPOSAL FACILITIES, which was continued from the meeting of September 12, 1995. Mr. Powell indicated the proposed ordinance has been revised and copies are available for public review. He discussed the changes made to the ordinance and recommended its introduction. No correspondence was received on this matter. Council Minutes 9/26/95 -1- Mayor McCaughan asked if there was anyone present who wished to speak in favor of the proposed Code Amendment, and no one approached the podium. A ORDINANCE OF THE CITY COUNCIL OF TFE CITY OF DOW NE Y, CALIFORNIA, MENDING SECTION 6251 OF THE DOWICEY MUNICIPAL CODE, RELATING TO BUSINESS LICENSE FEES FOR SOLID WASTE DISPOSAL SITES The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Brazel ton, and unanimously carried (4-0) to waive further reading and introduce. Mayor McCaughan opened the public hearing on ADOPTION OF FOUR CR DI NA NC ES GRANTING PE TR OLE Uul PRODUCTS PIPELINE FRANCHISES TO GOLDEN WEST REFINING COMPANY, MOBIL OIL CORPORATION, ATLANTIC RICHFIELD COMPANY, AND ARCO PIPE LINE COMPANY. Ms. McDonnell affirmed receipt of the proof of publication, which was so ordered received and filed. Mr. Brace explained the terms of the four Ordinances are identical , except that ARCO Pipe Line Company is entitled to a lower rate because it qualifies as a public utility. The new rates included in the proposed Ordinances are subject to annual adjustments based on the yearly consumer price index, and the proposed franchises grant the companies use of public rights-of-way in Downey for a period of ten years. No correspondence was received on this matter. As there was no one present wishing to speak in favor or opposition to the proposed Ordinances, it was moved by C o u n c i l Member Brazel ton , seconded by Council Member Lawrence , and so ordered to close the public hearing. ORDINANCE W. 1004 AN ORDINANCE OF TFE CITY COUNCIL OF TI-E CITY OF DOW ICE Y GRANTING A FRANCHISE TO GOLDEN WEST REFINING COMPANY The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried (4-0) to waive further reading and adopt. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOW NE Y APPROVING ZONE CHANGE NO. 95-37, REZONING PROPERTIES LOCATED AT 7100 -7170 FIRESTONE BOULEVARD AND 11530 RYERSON AVENUE, FROM M-1/PB (LIGHT MANUFACTURING/PARKING BLFFER ) TO C-M (CO*IERC IAL MANUFACTURING) AND THAT TEE OFFICIAL ZONING MAP OF THE CITY OF DOWNY BE AMENDED TO REFLECT THIS ZONE CHANGE AND APPROVING TI-E NEGATIVE DECLARATION (Introduced 8/22/95; continued from 9/12/95) Mr. Caton advised that a letter has been received from Ol so n & De Ti l 1 a Associates, representing Andrews Rancho Del Sur, requesting a two -week continuance of the case. After discussion, it was the consensus of Council to review setback concerns at this time, and also grant the two week continuance. It was m ov ed by Co unc i 1 Member Bo gg s , second ed by Co unc i 1 Member La wr enc e , and so ordered to continue proposed Zone Change No. . 95 -3 7 to 7:30 p.m., October 110, 1995, in the Downey City Council Chamber. Mr. Yoshiki summarized the staff report, specifically noting the setback requirements in the C -M Zone. He indicated there is no required rear yard setback in the C-M Zone; however, a height threshold requirement and Floor Area Ratio standard w i l l ensure privacy and improve land use efficiency. Council Member Boggs expressed concern with the setbacks in the C -M Zone that might adversely affect residential properties, and recommended the Planning Commission review this specific matter, if the applicant would not be adversely affected by the delay. Co unc i l Member Br a zel ton co nc ur r ed , s ugg e st i n g the different se tb ac k requirements for other commercial and manufacturing zones be considered when reviewing this issue. —' Mayor McCaughan mentioned that some uses allowed in the C -M Zone involve flammable materials, such as blueprinting services, and lack of a setback for such a business could create a safety hazard to abutting residential properties. After the applicant's representative stated there were no impending development pl ans that would be del ayed , Mayor McCaughan referred the issue of C-M setback requirements to the Planning Commission for further study and recommendation. Council Minutes 9/26/95 -4- ADMINISTRATIVE REPORTS COLLECTION OF GAS BILLS AT CITY HALL (Continued from 9/12/95) Mr. Williams explained that since the Southern California Gas Company has closed their local office, there is no location in Downey for payment of bills in person. Southern California Gas Company is interested in having City Hall become an authorized payment station, and would reimburse any costs involved for this sery ice. In addition, they will pay twenty -five cents per transaction, thus generating revenue for the City. It was moved by Council Member Boggs , seconded by Council Member Lawrence, and unanimously carried (4 -0) to authorize staff to enter into an agreement with the Southern California Gas Company that would establish City Hall as an authorized payment station for the Southern California Gas Company. REQUEST FOR TFEATRE FEE ADJUSTMENT FROM DOWNE Y CIVIC LIGHT OPERA ASSOCIATION (DCLOA) Mr. Caton explained he received a request from the DCLOA, asking for modification of certain fees regarding theatre usage. Staff is recommending a one -time grant of $5,000 be given to DCLOA, and that the Recreation and Community Services Commission review concerns and return with possible fee adj ustments Ms. Marsha Moode, 7903 2nd St., Public Relations Director, DCLOA, expressed appreciation for the grant, and emphasized the importance of modifying certain fees which she will discuss before the Commission when they review the matter. It was moved by Council Member Boggs and seconded by Mayor McCaughan to give a one -time grant of $5,000 to the DCLOA and direct the Recreation and Community Services Commission to review the concerns of DCLOA and return with possible fee adjustments. (Motion later withdrawn) . Council Member Br azel to n suggested receiving input from the Recreation and Community Services Commission regarding the proposed grant in addition to possible fee adjustments. In response to Council Member Lawrence's question, Ms . Moode indicated there is not an urgent need for the $5,000 grant at this time. Council Member Boggs withdrew her motion, with concurrence of the second. It was moved by Council Member Boggs , seconded by Council Member Lawrence, and unanimously carried (4 -0) to refer the $5,000 grant and possible fee adjustments to the Recreation and Community Services Commission for review and r ec amm end ati o n . OTHER BUSINESS - Council Members Council Member Lawrence noted a complaint received from a citizen regarding lack of response from the Mosquito Abatement agency.
