The City Council of the City of Downey held a regular meeting at 7:43 p.m.,
May 9, 1995, in the Council Chamber of the Downey City Hall, Mayor Barbara J.
Riley presiding.

PRESENTATIONS
Mayor Riley presented a Proclamation declaring May 13, 1995 as "Fire
Service Recognition Day" to Fire Chief Ron Irwin.
Mayor Riley presented a Proclamation declaring May 13, 1995 as "KIDSDAY" to
Jenny Lee and Steve Sharpe, KIDSDAY Spo kepersons .
Mayor Riley presented a Proclamation declaring May 21 -27, 1995 as "Public
Works Week" to Public Works Director Richard Redmayne.
Mayor Riley presented a Proclamation declaring the month of May, 1995 as
"Water Awareness Month" to Public Works Director Richard Redmayne.

Council Member Lawrence requested removal from the Consent Calendar of

CONSENT CALENDAR
It was moved by Council Member Brazel ton, seconded by Council Member
McCaughan, and unanimously carried to waive further reading of the Resolutions
and approve the remainder of the Consent Calendar as recommended:

RESURFACING: Approve plans and specifications and grant authority to

CARRY FORWARD OF 1993 -94 APPROPRIATIONS FOR 800 RADIO SYSTEM (City's
Emergency Communications Network) in the amount of $37,095 for the upgrade of

PROPOSED CONSOLIDATED PLAN AND PROPOSED USE OF CO *IUN ITY DEVELOPMENT BLOCK
GRANT (CDBG) AND HOME INVESTMENT PARTNERSHIP (HOME) PROGRAM FUNDS FOR 1995 -96:

AMEND STAFFING LEVEL - REPLACE POSITION OF JUNIOR CIVIL ENGINEER WITH

ORDINANCE NO. 1001
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNY
AMENDING DOWNY MUNICIPAL CODE SECTION 3185 - MISCELLANEOUS
PARKING REGULATIONS, SPECIFICALLY AS IT RELATES TO COMMERCIAL VEHICLES
Mr. Caton explained that certain 1 anguage has been modified for
clarification based on suggestions received from the public and Council .
Mayor Riley asked i f there was anyone present wishing to speak regarding
the proposed Ordinance.
Mr. Mauricio Sarmiento, 8512 Manatee St ., expressed concern with the
proposed Ordinance as it would affect his 1 ivl i hood, noting he works as an on-
cal 1 el ectrician and must park his oversi zed commercial vehicle at his house
every night .
Mr. Caton recommended Mr. Sarmiento meet with Chief Cal dwel 1 at the
conclusion of the Council Meeting to discuss the affects of the Ordinance on hi s
parti c ul ar situation.
Mr . Lennie Whittington , 8542 Manatee St . , indicated that Mr. Sarmiento is
his neighbor, and explained the subject commercial vehicle i s very 1 arge because
it is used to repair traffic lights.

The Ordinance was read by title only. It was moved by Council Member
McCaughan, seconded by Council Member Lawrence, and unanimously carried (4 -0) to
waive further reading and adopt.

RESOLUTION NO. 5874
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE ENGINEER TO PREPARE AND FILE A REPORT ON
PROPOSED CHANGES WITHIN LIGHTING MAINTENANCE DISTRICT
A. D, 121 FOR FISCAL YEAR 1995 -96
The Resolution was read by title only. It was moved by Council Member
Lawrence, seconded by Council Member Brazelton, and unanimously carried (4 -0) to
waive further reading and adopt.
ADMINISTRATIVE REPORTS: None.

Council Member Lawrence requested her comments on page 8 of the Minutes be
corrected to reflect that she had met with a local newspaper publisher, and
asked for specific instances of Council abuses of the Brown Act; however, this
has not occurred.
It was moved by Council Member Lawrence, seconded by Council Member
McCaughan, and unanimously carried (4 -0) to approve as corrected.
OTHER BUSINESS - COUNCIL MEMBERS
Council Member McCaughan requested an update on the dangerous situation of
vehicular traffic using Furman Park parking lot as a thoroughfare to bypass
ongoing construction on Rives Avenue.
Mayor Riley commented on the successful Gas Efficiency Expo held at the new
Energy Resource Center.
OTHER BUSINESS - Staff Members
Mr. Caton commended Mr. Rangel and his staff for their outstanding
representation of the City at the Gas Efficiency Expo, and urged everyone to
visit the Energy Resource Center,
Mr. Caton announced development plans for a new shopping center at Imperial
Highway and Clark Avenue, which will include an Albertson's Supermarket. Other
plans have been submitted for construction of an In -N -Out Burger at the north-
west corner of Firestone and Lakewood Boulevards.
Mr. Caton noted the Finance Department has indicated the City's population
is now 96,413.

ORAL COMMUNICATIONS
Mr. Lennie Whittington, 8542 Manatee St., thanked the City Attorney for
announcing the vote taken on prior Closed Session actions reported at previous
Council meetings, and presented statistical data on Closed Session meetings held
by the City Council from January 11, 1994 through May 9, 1995. He mentioned
problems he experienced at the last Council meeting with City Hall doors being
locked while the Council was still in session, noting the facility must be
accessible to the public at all times when Council is meeting. Finally, he
commented on the continuing problem of stray golf balls from the Rio Hondo Golf
Course damaging residential property and vehicles on adjacent streets.
Mayor Riley announced the meeting is recessing to Closed Session (8:12
p.m.) to complete discussion of Items C, D and E (see Minutes of Adjourned
Regular Meeting, May 9, 1995.)
Council Member McCaughan was not present during discussion of Items C and D.
The meeting reconvened at 9:00 p.m. with Council Members Lawrence,
McCaughan, Brazel ton , and Riley present; Council Member Boggs absent. There were
no Closed Session actions to report.
ADJOURNMENT: 9:00 p.m.
The meeting was adjourned in memory of Mr. Colin Johnson, brother of City
Employee Beverley Lauzon, to 6:30 p.m., May 23, 1995, in the Council Chamber of
Downey City Hal l .
