ADJOURNED REGULAR MEETING
MAY 9, 1995
The City Council/Community Development Commission of the City of Downey
held an Adjourned Regular Meeting at 6:30 p.m., May 9, 1995, in the Council
Chamber of the Downey City Hall, Mayor /Chairman Barbara J. Riley presiding.
PRESENT: Council Members/Commissioners:

APPROVAL OF CLOSED SESSION MINUTES - APRIL 25, 1995
It was moved by Council Member /Commissioner Brazelton, seconded by Council
Member /Commissioner Lawrence, and carried by unanimous vote (4 -0) to approve
the Closed Session Minutes of April 25, 1995.
CLOSED SESSION
Mayor /Chairman Riley announced the Council /Commission is recessing to
Closed Session to discuss the following Sections of the Government Code:
A. SECTION 54957.6 - Conference with Labor Negotiator Lee Powell
regarding direction for labor negotiations with Downey Public Safety Auxiliary
Association.
B. SECTION 54957 - Public Employee Performance Evaluation - City
Attorney;
C. SECTION 54956.8 - Conference with Real Property Negotiator Gerald
Caton regarding property at 11500 Brookshire Avenue; negotiating party, Downey
Community Hospital Foundation; under negotiation, price and terms of payment.
D. SECTION 54956.9, Subdivision (c) - Conference with Legal Counsel -
regarding initiation of litigation - one matter.

E. SECTION 54956.8 - Conference with Real Property Negotiator Art Rangel
regarding property at 8206 Third Street; negotiating party, Kri kor i an Premiere
Theatres, Inc.; under negotiation, price and terms of payment.
The meeting reconvened in open session at 7:35 p.m. with Council Members/
Commissioners Lawrence, McCaughan, Brazelton, and Riley present; Council
Member /Commissioner Boggs absent. There were no Closed Session actions to
report.
Ms. Kane explained the previous announcements of actions taken by the
Council/Commission in Closed Session omitted the vote on each item announced
for the meetings of February 28, 1995, and March 28, 1995. The votes taken
were as follows:
February 28, 1995: Unanimous (5 -0 1 to secure fair market value appraisal
on property located at 8206 Third Street; and unanimous (5-.0) to
substitute State Labor Commission Attorney in the case of Wadsworth vs.
City of Downey.
March 28, 1995: Unanimous (4 -0) to approve the purchase of real property
at 12830 Woodruff Avenue for $100,000; and unanimous (4 -0) to approve
joining amicus brief - Deshetres vs. Sgt. Steen - U.S. Court of Appeals
(9th Ci rc . #94- 16912) .
The meeting recessed at 7:35 p.m.
ORAL COMMUNICATIONS
The meeting reconvened for Oral Communications at 8:05 p.m. with Council
Members /Commissioners Lawrence, McCaughan, Brazelton, and Riley present;
Council Member /Commissioner Boggs absent (see Oral Communications under Regular
City Council Meeting) , and recessed at 8:10 p.m.
The meeting reconvened at 8:12 p.m. with Council Members/Commissioners
Lawrence, McCaughan, Brazelton, and Riley present; Council Member /Commissioner
Boggs absent.
Mayor /Chairman Riley announced the meeting is recessing to Closed Session
(8:12 p.m.) to complete discussion of Items C, D and E.
Council Member /Commissioner McCaughan was not present during discussion of
Items C and D.
The meeting reconvened at 9:00 p.m. with Council Members/Commissioners
Lawrence, McCaughan, Brazelton, and Riley present; Council Member /Commissioner
Boggs absent. There were no Closed Session actions to report.
ADJOURNMENT: 9:00 p.m.
