The City Council of the City of Downey held a regular meeting at
7:38 p.m., December 13, 1994, in the Council Chamber of the Downey City Hall,

PRESENTATIONS
With the assistance of Mayor Riley, Police Chief Caldwell presented the
Distinguished Citizen Service Award to Mr. Walter Lane for his brave efforts in
detaining a suspect for arrest by police officers.
Mayor Riley presented a Proclamation honoring Henry Spears on his
retirement as Superintendent of the Downey Cemetery District.
Mayor Riley presented a Proclamation declaring December, 1994, as National
Drunk and Drugged Driving Prevention Month to Carol Davidson, Assistant
Manager, Automobile Club of Southern California in Downey.
HEARINGS
Mayor Riley opened the public hearing on UNIFORM FIRE CODE, 1991 EDITION
AND AMENDMENTS.
Ms. McDonnell affirmed receipt of the proof of publication. It was moved
by Council Member Boggs, seconded by Council Member Brazelton, and so ordered
to receive and file.

There was no correspondence received on this matter.
Mayor Riley noted staff is recommending the hearing be continued to the
next meeting; however, since the hearing was advertised for this date, public
testimony will be heard at this time.
As there were no one present wishing to speak concerning the proposed
Uniform Fire Code, it was moved by Council Member Lawrence, seconded by Council
Member McCaughan, and unanimously carried to continue the public hearing on
proposed amendments to the Uniform Fire Code, 1991 Edition, to 7:30 p.m.,
January 10, 1995 in the Downey City Council Chamber.
Mayor Riley opened the public hearing on ZONE CHANGE NO. 94 -35, A REQUEST
TO CHANGE THE ZONE FROM R -1 (SINGLE - FAMILY RESIDENTIAL) TO R -3 (MULTIPLE - FAMILY
RESIDENTIAL) FOR PROPERTIES AT 7829, 7841, 7845 AND 7871 STEWART & GRAY ROAD.
Ms. McDonnell affirmed receipt of the proof of publication. It was moved
by Council Member Boggs, seconded by Council Member Brazelton, and so ordered
to receive and file.
Mr. Rangel explained the proposed Zone Change will bring the properties
involved into conformity with the General Plan designation for this area and
the current land uses. He narrated a brief slide presentation of the subject
properties, which included one single family residence and three apartment
complexes previously approved by Zone Exception.
Mayor Riley advised that after conferring with the City Attorney, she w i l l
abstain from voting on this matter, due to a potential conflict of interest
involving the proximity of her residence to the subject location. She left the
di as after turning the meeting over to Mayor Pro Tem McCaughan.
There was no correspondence received concerning this matter.
Mayor Pro Tem McCaughan asked the applicant to come forward and present
his case.
Mr. James McCollum, 7829 Stewart & Gray Rd., explained he is experiencing
problems in selling his house due to the R -1 zoning of his property. The
irregular lot pattern, adjacent apartments, and busy street are more conducive
to multi - family development.
As there was no one present wishing to speak in opposition, it was moved
by Council Member Lawrence, seconded by Council Member Boggs, and carried by
the following vote to close the public hearing:

The Ordinance was read by title only. It was moved by Council Member
Lawrence and seconded by Council Member Boggs to waive further reading and
introduce. (Motion and second later withdrawn) .
Council Member Boggs remarked on the lack of opposition to the proposed
Zone Change, and understood the applicant's difficulty in selling the single
family residence zoned for R -1 development.
Council Member Brazelton expressed concern with changing the zoning on the
properties to R -3 in view of the close proximity to single family residences
west of the subject location.
Council Member Lawrence recalled that in 1963, the General Plan designated
R -3 zoning to accommodate growing industry and corresponding housing needs
throughout the City. Although times have changed, the applicant's property
should be afforded the same opportunities given to lots of similar size.
Mayor Pro Tem McCaughan discussed the issue of individual versus
neighborhood rights. He suggested a solution be worked out that would be
beneficial to both the applicant and the neighboring residents.
Discussion ensued regarding rebuilding rights on the subject properties if
either the Zone Change was granted or the current zoning remained.
Mr. Caton voiced concern that the proposed Zone Change may actually be
downzoning the sites approved by Zone Exceptions in the City's effort to be 1
consistent with the General Plan designation for this area. He requested the
matter be continued to the next meeting for further staff review, including
possible options for the single family residence property other than rezoning.
The motion and second to waive further reading and introduce were
withdrawn.
It was moved by Council Member Brazelton, seconded by Council Member
Boggs, and carried by the following vote, to reopen the public hearing and
continue the matter to 7:30 p.m., January 10, 1995 in the Council Chamber of
the Downey City Hall:

Mayor Riley opened the public hearing on CONSOLIDATED PLAN FOR THE
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) COMMUNITY PLANNING AND
DEVELOPMENT PROGRAMS.

ordered to receive and file.
Mr. Rangel summarized the staff report, explaining that HUD has enacted
regulations concerning the preparation of a new Consolidated Plan as a
prerequisite to receiving certain Federal housing funds.

Mr. Velasco narrated a slide presentation that outlined funding areas
affected by the new regulations, including Community Development Block Grant,
HOME Investment Partnership Program, Emergency Shelter Grant, and Housing
Opportunities for Persons with Aids. The Consolidated Plan will serve as a
planning document for HUD grant programs, a working plan to be followed in
carrying out HUD Programs, and an action plan to assess the City's performance
in carrying out its programs. The Plan must be submitted to HUD by May 15,
1995, and requires two public hearings to receive community input on the City's
housing and non - housing needs, and then to consider public comment on the
adoption of the draft Consolidated Plan in April, 1995.
No correspondence had been received concerning this matter.
As there was no one present wishing to speak regarding the proposed
Consolidated Plan, it was moved by Council Member Lawrence, seconded by Council
Member Boggs, and so ordered to close the public hearing.
Discussion ensued regarding the need to address potential barriers to
affordable housing, and catering to those families with special needs.
Mayor Riley advised this hearing concludes the first step toward
compliance with new HUD regulations, and no action of the Council is required
at this time.

Council Member McCaughan requested removal from the Consent Calendar of

ADMINISTRATIVE REPORTS
DOWNEY FIRE PARAMEDIC IN -HOUSE EDUCATION AND QUALITY ASSURANCE/
IMPROVEMENT PROGRAM
Prior to staff's report, Mayor Riley stated for the record that she is not
related to Ms. Evelyn Riley, R.N.
Assistant Chief Robinson commented on the many changes in Emergency
Medical Services that have necessitated more education and quality assurance
for Fire Department personnel.
Captain Dave Simmons explained that Beverly Hospital currently serves as
the paramedic base facility for Downey, and will begin charging fees for the
its services provided to Downey paramedics. He noted the economic feasibility
in establishing an in-house education and quality assurance /improvement
program.
Council Member McCaughan clarified specific costs involved in the proposed
Agreement with Ms. Riley, who would provide the in -house training.
It was moved by Council Member McCaughan, seconded by Council Member
Brazelton, and unanimously carried to authorize the Downey Fire Department to
enter into an Agreement with Ms. Evelyn (Lyn) Riley, R.N. (M.I.C.N.) to provide
in -house continuing education and develop a Quality Assurance /Improvement
Program for Downey Firefighter/Paramedics, and provide for EMT recertification
instruction for all Downey Fire personnel at a total annual cost of $10,800.
RESIDENTIAL FRANCHISE AGREEMENT BETWEEN CITY AND CALSAN, INC.
Mr. Redmayne summarized the staff report, noting that necessary changes in
the City's Residential Franchise Agreement with Calsan, Inc. have been made to
comply with the goals of AB939 to divert 25% of sold waste going into landfills
by 1995, and 50% by the year 2000. The modifications include Citywide separate
pickup of residential refuse, yard waste, and recycl abl es. Based on the rate
study conducted by the City's consultant, service rates for single family
residences will increase from $10.02 to $13.82 per month, and costs for
multiple dwelling unit rates will increase from $8.69 to $12.05 per month.
Implementation of the new residential waste collection is scheduled to begin
the week of January 9, 1995. Contractor fees could be adjusted with Council
approval if, for example, hauler costs should increase at landfills.

Council Member Brazelton recommended the Agreement indicate the Consumer
Price Index for this area.
Discussion ensued regarding the different Calsan rates in other cities
based on the type of collection method already in place, such as automated
pickup systems.
Mayor Riley asked if there was anyone present who wished to speak
regarding this matter.
Mr. Paul Richardson, 7507 Noren St., spoke in opposition to the proposed
rate increase, as he compared Calsan charges to other cities with comparable
service also provided by Calsan. He suggested the contract be placed out to
bid for competitive rates.
Mr. Guy Sterner, 10303 Downey Ave., recommended the contract include
incentives to attract residents' compliance with the new requirements.
Mr. Mike Adnoff, Vice President, Calsan, Inc., 9821 Downey - Norwalk Road,
noted there are various services provided to other cities which would explain
the difference in rates, and expressed enthusiasm with starting the new program
in Downey. He responded to questions regarding different collection systems in
neighboring cities, including the affects of a commercial franchise on
residential rate costs.
Mr. Caton noted the issue of a commercial franchise involving all
interested haulers would be presented for Council consideration at the next
meeting.
Council Member McCaughan stressed the importance of voluntary compliance
in making this Program successful, in addition to incentives and enforcement.
It was moved by Council Member McCaughan, seconded by Council Member
Lawrence, and unanimously carried to approve the revised Residential Franchise
Agreement between the City and Calsan, Inc., reflecting the changes necessary
for the mandatory DART and Yard Waste Programs.
RESOLUTION NO. 5849
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE
CITY OF DOWNEY AND THE DOWNEY POLICE OFFICERS' ASSOCIATION
Mr. Caton explained the proposed contract with the Downey Police Officers'
Association covers a two year period from July 1, 1994 through June 30, 1996,
and grants a salary adjustment of 8% effective July 1, 1994, and a 2% salary
adjustment effective July 3, 1995.
The Resolution was read by title only. It was moved by Council Member
Lawrence, seconded by Council Member McCaughan, and unanimously carried to
waive further reading and adopt.
Prior to the foregoing vote, Council discussed the importance of public
safety personnel, and expressed satisfaction with the proposed contract.

OTHER BUSINESS - CONSENT CALENDAR: Items Removed by Council Approval
CASH CONTRACT NO. S.S. 465 - PHASE I, HANDICAPPED RAMPS AND PEDESTRIAN
IMPROVEMENTS
Council Member McCaughan questioned whether the sidewalks could be
repaired under this Cash Contract in the area south of Imperial Highway,
between Rancho Los Amigos Hospital and Paramount Boulevard, specifically on
Consuelo Street.
Mr. Redmayne noted that funds may be available for this purpose, depending
.--� on the bids received.
Mr. Caton suggested approval of the Cash Contract, with a possible Change
Order in the future to address the concern expressed.
It was moved by Council Member McCaughan, seconded by Council Member
Lawrence, and unanimously carried to approve Plans and Specifications and grant
authority to advertise for bids on Cash Contract No. S.S. 465, Handicapped
Ramps and Pedestrian Improvements, (Account Nos. 25 -13936 and 26- 16465), at an
approximate cost of $88,000.
ADDENDUM TO AREA "E" MUTUAL AID AGREEMENT
Council Member McCaughan questioned the presence of La Habra Heights as
part of this Agreement, since it is located a distance away from the other
cities included in the Agreement.
Assistant Chief Robinson discussed the extensive past involvement of the
La Habra Heights Fire Department with Downey Fire Department, including
cooperative drills, strike teams, and other work done in conjunction with
Downey personnel. Since La Habra Heights has been an informal member of Area
"E" for many years, this action would formalize its participation in the
Agreement.
It was moved by Council Member McCaughan, seconded by Council Member
Lawrence, and unanimously carried to approve the First Addendum to the Area "E"
Mutual Aid Agreement.
OTHER BUSINESS - COUNCIL MEMBERS
Council Member Boggs mentioned the recent financial crisis in Orange
County, and requested a report on the City of Downey's investment policy.
Mr. Williams discussed in detail the conservative investment policy
followed by the City, and expressed his assurance the City's money is not at
risk.
Council Member Lawrence wished everyone a happy holiday season.

involving animal and kennel care, office assistance, etc., and encouraged the
public to participate in these worthy programs.
Mayor Riley thanked City staff for their service to the public, including
many volunteer hours in the community.

Mayor Riley commended the Community Services Department on its successful
Christmas Lighting Awards Ceremony, which reflects the neighborhood pride that
Downey residents display throughout the year.
OTHER BUSINESS - Staff Members
Mr. Caton reported that he and Council Member Boggs will be meeting with
FEMA representatives in Washington, D.C. next week regarding the floodplain
issue, and noted that Downey residents save approximately $400,000 each month
the issuance of the floodplain map is delayed. He expressed appreciation for
the outstanding support given by Congressman Steven Horn in this endeavor.
Mr. Caton credited the City Council with steadfastly following a
conservative approach with the City's budget during difficult economic times.
Mr. Caton P raised the City Employees for their excellent service to the
community during the past year.
Mr. Caton thanked the City Council for approving the amendment to his
employment contract, and expressed appreciation for the opportunity to work for
the City.
