The City Council of the City of Downey held a regular meeting at
7:50 p.m., November 22, 1994, in the Council Chamber of the Downey City Hall,
Mayor Barbara J. Riley presiding.

PRESENTATIONS
With the assistance of Mayor Riley, Police Chief Caldwell presented the
Distinguished Service Award to Downey Police Sergeant Phil Rego for his heroic
efforts in saving the life of a drowning child.
Mayor Riley assisted Mr. Norman Reese in presenting a Good Neighbor Award
to Mr. Gabriel Loya.
Mr. Redmayne noted with pride that Mr. Loya was an excellent employee with
the City of Downey Public Works Department prior to his retirement.
HEARINGS: None.

Council Member Boggs requested removal from the Consent Calendar of Agenda

It was moved by Council Member Brazelton, seconded by Council Member
Boggs, and unanimously carried to approve the remainder of the Consent Calendar
as recommended:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 4133 AND ADDING SECTION 4133.2 TO
CHAPTER 1 OF ARTICLE IV OF THE DOWNEY MUNICIPAL CODE
RELATING TO THE REGULATION OF SHOPPING CARTS
Ms. McDonnell noted correspondence had been received from the California
Grocers Association regarding various issues involving shopping cart
regulations.
It was moved by Council Member Lawrence, seconded by Council Member Boggs,
and so ordered to receive and file the correspondence.
The Ordinance was read by title only. It was moved by Council Member
Boggs, seconded by Council Member Lawrence, and unanimously carried to waive
further reading and adopt.
Prior to the foregoing vote, Council Member Lawrence commented on the
concern expressed by the California Grocers Association regarding current
Downe y Municipal requirements al Code uirements that duplicate signage for shopping carts.

Mr. Caton advised that staff would review this matter as a separate issue.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE, SECTION 3179(c)
RELATING TO TRUCK ROUTES ON PHLOX STREET AND DOWNEY AVENUE

Council Member Lawrence expressed her concerns that establishing this
portion of Downey Avenue as a truck route could adversely affect attempts to
revitalize the downtown area.
Council Member McCaughan questioned whether the railroad crossings on
Downey Avenue would be adequate in strength to accommodate large trucks.
Mr. Redmayne explained the current crossings are sufficient, and
rubberized crossings are planned for this area in the future.
It was moved by Council Member Boggs, seconded by Council Member
McCaughan, and carried by the following vote to waive further reading and
introduce:

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY REDEVELOPMENT PLAN, AS AMENDED, TO PROVIDE
FOR TIME LIMITATIONS ON ESTABLISHMENT OF INDEBTEDNESS, EFFECTIVENESS
OF THE REDEVELOPMENT PLAN, AND DURATION OF THE RECEIPT OF TAX INCREMENT
REVENUES, AS REQUIRED BY NEW STATE MANDATED LEGISLATION, HEALTH AND
SAFETY CODE SECTION 33333.6
The Ordinance was read by title only. It was moved by Council Member
McCaughan, seconded by Council Member Lawrence, and unanimously carried to
waive further reading and introduce.
Prior to the foregoing vote, Mayor Riley asked if there was anyone present
wishing to speak regarding the proposed Ordinance, and no one approached the
podium.
There was no correspondence received concerning this matter.

RESOLUTION NO. 5846
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE FINAL SUBDIVISION MAP OF TRACT MAP NO. 51856
(7339 -45 FLORENCE AVENUE WEST OF TECUM ROAD), APPROVING
AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTING AN IRREVOCABLE
STANDBY LETTER OF CREDIT IN LIEU OF SURETY BONDS
Council Member Boggs questioned the widths of the lots indicated on the
map, and Mr. Caton clarified the correct lot width measurements are located on
the perimeter of the map facing Tecum Road.
The Resolution was read by title only. It was moved by Council Member
Boggs, seconded by Council Member McCaughan, and unanimously carried to waive
further reading and adopt.
CONSIDER ABSORPTION OF CITY COSTS RELATED TO 1994 HOLIDAY LANE PARADE
Council Member Boggs mentioned she had requested this matter be considered
to provide financial relief to the Chamber of Commerce for this event. In the
past, expenses for Police and Public Works personnel working at the parade were
funded by the City. Currently, the City's budget allocates less money to the
Chamber than in previous years, and private contributions for the 1994 parade
have also decreased. Since the Chamber of Commerce provides an excellent
service for Downey, she recommended these costs be paid by the City.
Mr. Mike Prokop, 10444 Julius Ave., Chairman of the Parade Committee,
Downey Chamber of Commerce, commented that the additional expenses would cause
an undue burden on the Chamber, especially since donations have decreased.
Mr. Keith McCarthy, 13404 Barl i n St., President, Downey Chamber of
Commerce, noted that City funding of these services would be greatly
appreciated.
It was moved by Council Member Boggs, seconded by Council Member Lawrence,
and unanimously carried to approve absorbing City - incurred expenses related to
the 1994 Holiday Lane Parade at an estimated cost of $5,728, to provide
financial relief to the Downey Chamber of Commerce on a one year basis only.
ORAL COMMUNICATIONS
Mr. John Gonzalez, 15143 -45 Bellflower Blvd., Bellflower, commented on
problems he has encountered with the City, courts, and financial institutions
concerning his house located at 12350 Orizaba Ave., citing d i f f i c u l t i e s
involving permits and court orders which have hindered his ability to sell the
house.
Mr. Joseph Wol itski , 13040 Brookshire Ave., complained about a citation he
received for parking his vehicle on the street after the street sweeper had
swept the area.

Council Member Brazelton requested the Business Retention Assistance In
Downey (BRAID) Committee have the opportunity to review a draft of the Downey
Business Attraction Brochure, authorized by the Community Development
Commission.
Council Member McCaughan mentioned the appeal procedure available to
recipients of parking citations.
Council Member McCaughan referenced the recent gang statistics report,
wherein he was pleased to see the curfew laws are being enforced, specifically
at Independence Park.
OTHER BUSINESS - Staff Members
Mr. Caton wished everyone a happy Thanksgiving holiday.
Mr. Caton mentioned that today is the 31st anniversary of the
assassination of President John Kennedy.
