CONSENT CALENDAR - ITEMS FOR REMOVAL Council Member Brazelton requested removal from the Consent Calendar of Agenda Item VI -E -1, PROPOSED AMENDMENTS TO COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FOR 1994 -95. CONSENT CALENDAR It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried (Council Members Lawrence and Riley absent) to approve the remainder of the Consent Calendar as recommended: COUNCIL MINUTES: SPECIAL CALLED MEETING, SEPTEMBER 23, 1994; ADJOURNED AND REGULAR MEETINGS, SEPTEMBER 27, 1994: Approve. UNSCHEDULED EQUIPMENT PURCHASE OF ELECTRIC GATE FOR SMALLWOOD TRANSIT YARD to provide a more secure working and vehicle storage area at a cost of $4,932 funded with Proposition A or C monies: Approve. ORDINANCES NOT SET FORTH ABOVE: ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING A LEASE BETWEEN THE CITY OF DOWNEY AND MASSEY CADILLAC, INC., MASSEY CHEVROLET -GEO , INC. FOR THE PROPERTY LOCATED AT 11190 FLORENCE AVENUE IN THE CITY OF DOWNEY Mr. Rangel summarized the staff report, noting the City had purchased the subject location in 1990 and subsequently leased the property to the adjacent Penske Cadillac and Honda dealerships in 1991. Approximately one year ago, Penske sold the dealership to Massey Co., who now wishes to enter into a lease agreement with the City for the site. The term of the lease is for five years with three additional five -year options, at a fair market value rate of $30,000 per year. Council Member Boggs noted the lease allows the lessee to have an office trailer on said property, and voiced concern with the need to abide by the City's regulations affecting such use. Mr. Rangel explained the trailer will be used temporarily until the Massey Co. completes development of a new showroom. Council Member Brazelton requested staff require evidence of the lease between the property owners to the west of the subject location, the Murata Family, and the Massey Co., as referenced in Section 2.6 of the lease. The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried (Council Members Lawrence and Riley absent) to waive further reading and introduce. RESOLUTIONS NOT SET FORTH ABOVE: None. ADMINISTRATIVE REPORTS RIO HONDO GOLF COURSE POLICY TO LIMIT COURTESY PLAY Mr. Jarrett explained that Council had requested modifications to the current Golf Course Policy to provide restrictions on courtesy play. The recommended change includes granting one courtesy play per quarter for certain individuals. Council Member Boggs concurred with staff's recommendation to limit the amount of free play to allow for inspections of the golf course on a quarterly basis. Council Minutes 10/11/94 -2- t f j ti J 7 It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried (Council Members Lawrence and Riley absent) to modify the present Courtesy Play Policy by limiting City Council Members, Recreation and Community Services Commissioners, the City Manager and Director of Community Services to one courtesy play and use of cart per quarter. DOWNEYLINK SPECIAL HOLIDAY SERVICE Mr. Jarrett discussed staff's recommendation to extend services for DowneyLINK users to provide Saturday service and extended weekday hours during the holiday season from November 26th through December 24, 1994. The current contract would be amended to include additional service hours at a cost of $12,628, funded through Proposition A and C monies. Council Member Boggs noted a request from Council Member Lawrence to reroute the DowneyLINK west on Firestone Boulevard, to include the areas of All American Home Center and Standard Brands for the holiday season. Mr. Caton noted staff w i l l review this requested modification of the northwest route. It was moved by Council Member Boggs and seconded by Council Member Brazelton to approve the proposed holiday schedule. (See later withdrawal of motion). Mayor Pro Tem McCaughan inquired as to the reason for this request, i.e., ridership data, etc., and Mr. Jarrett advised the recommendation is based on general comments received from passengers requesting Saturday service. Council Member Boggs suggested the matter be continued to the next meeting for consideration before a full Council and to review proposed modifications to the northwest route as discussed. Council Members Boggs and Brazelton withdrew their previous motion and second, accordingly. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried (Council Members Lawrence and Riley absent) to continue this matter to the next meeting, when consideration will be given to modifications of the northwest route of DowneyLINK. EXPANSION OF DOWNEYLINK WEEKDAY SERVICE Mr. Jarrett commented on the increased usage of DowneyLINK, which is transporting approximately 3,000 passengers per month. The most significant increase has consisted of school-age youth, particularly in the southeast portion of the City, where ridershp has exceeded the seating and standee capacity, resulting in students being late to school. The contractor has recommended that a "tripper ", or another bus, be added to assist the southeast route in transporting passengers in the mornings and afternoons. This bus would follow behind the regular bus, transporting overflow passengers, and would be discontinued when ridership decreases to a manageable number of passengers for the regular bus. It is recommended a pilot program be instituted to increase weekday hours of operation to accommodate the public demand for transportation, in addition to adding the "tripper" bus for overflow passengers. Council Minutes 10/11/94 -3- It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried (Council Members Lawrence and Riley absent) to approve instituting a two -month pilot program to increase weekday hours of DowneyLINK operation to accommodate the public demand for transportation mornings and afternoons and approve an operating change and additional funding in the contract with Mayflower Contract Services. Prior to the foregoing vote, Mayor Pro Tem McCaughan expressed hesitation with expanding the DowneyLINK service without recorded data to substantiate the necessity. Council Member Boggs noted she represents the southeast portion of the City which has a great need for transit services, and referenced statistics in the staff report that reflect an increase in passengers to warrant the additional bus. APROPRI AT ION ADJUSTMENTS - ENCUMBRANCES FOR FISCAL YEAR 1994-95: CARRY FORWARD BUDGET ITEMS Mr. Powell explained this report is completed annually and shows the encumbrances that remain as of June 30, 1994, which need to be carried over into the current fiscal year. These appropriations are for items ordered by the City but not received or paid for until after July 1, 1994. A budget adjustment is required to carry forward these budgeted items. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried (Council Members Lawrence and Riley absent) to approve the carry - forward budget items and the appropriation adjustments for Fiscal Year 1994 -95. COUNCIL CONSIDERATION OF MODIFYING THEATRE CUSTODIAL FEE AND DEPOSIT REQUIREMENT FOR DOWNEY CIVIC LIGHT OPERA ASSOCIATION AND DOWNEY SYMPHONIC SOCIETY Mr. Caton noted the Downey Civic Light Opera Association (DCLOA) has requested modifications to the theatre rental permit with the City, to include elimination of the Deposit Requirement for each of the DCLOA's three series performances, and elimination of the theatre custodial fee, which would save them $5,400 per season. Staff is in concurrence with these modifications which would apply to all "Downey non - profit performing arts organizations with at least five continuous years of theatre rental." The two organizations currently meeting this criteria are the DCLOA and the Downey Symphonic Society. This policy would affect all other organizations that meet the above criteria in the future. It was moved by Council Member Brazelton, seconded by Council Member Boggs, and unanimously carried (Council Members Lawrence and Riley absent) to eliminate the Theatre Custodial Fee and Deposit Requirement for the Downey Civic Light Opera Association and Downey Symphonic Society. OTHER BUSINESS - CONSENT CALENDAR: Items Removed by Council Approval PROPOSED AMENDMENTS TO COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM FOR 1994 -95 Council Minutes 10/11/94 -4- „s, ri i Council Member Brazelton questioned the specifics involving the referenced reallocation of CDBG funds in the staff report, and Mr. Caton suggested Council set the matter for public hearing, at which time further information would be made available. It was moved by Council Member Brazelton, seconded by Council Member Boggs, and unanimously carried (Council Members Lawrence and Riley absent) to set the public hearing to consider an amendment to the 1994 -95 CDBG Program for 7:30 p.m., October 25, 1994, in the Downey City Council Chamber. OTHER BUSINESS - COUNCIL MEMBERS RESOLUTION NO. 5840 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY IN OPPOSITION TO PROPOSITION 188 - THE SMOKING AND TOBACCO PRODUCTS STATEWIDE REGULATION INITIATIVE STATUTE Council Member Boggs noted this initiative, supported by the tobacco industry, would undermine local governmental control regarding smoking regulations, and urged Council action to oppose Proposition 188 on the November ballot. The Resolution was read by title only. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and unanimously carried (Council Members Lawrence and Riley absent) to waive further reading and adopt. Council Member Boggs commented on the forthcoming report from staff regarding the affect of the closure of neighboring libraries on Downey City Library, noting some of the communities are charging fees for use of their Library by non - residents. Council Member Boggs thanked staff for implementing the Council Assignment List. OTHER BUSINESS - Staff Members Mr. Caton welcomed new City Attorney Cheryl Kane to her first Council Meeting with the City of Downey. A visiting Political Science class from California State University, Long Beach, was recognized in the audience. ORAL COMMUNICATIONS Ms. Marsha Moode, 7903 Second St., speaking on behalf of the DCLOA and the Downey Symphonic Society, expressed her appreciation for the elimination of certain theatre fees affecting these organizations, and invited the public to attend the DCLOA production of "Evita.” Mr. Matthew Biwersi, 9321 Brookpark Rd., discussed the importance of gathering updated information regarding community demographics. Ms. Esther Ashby, 9063 Suva St., mentioned various issues concerning her neighborhood and discussions with City staff regarding Code Enforcement matters. Council Minutes 10/11/94 -5- z Ms. Lucy Squire, 9546 Metro St., commented on maintenance needs at Apollo Park and the Civic Center, i.e., mowing of overgrown grass and replacement of parking lot light.
