The City Council of the City of Downey held a regular meeting at
7:46 p.m., September 27, 1994, in the Council Chamber of the Downey City Hall,
Mayor Barbara J. Riley presiding.

PRESENTATIONS
Mayor Riley presented a Proclamation declaring September 24 -30, 1994, as
Code Enforcement Week to Police Sergeant Mel Parks and Senior Code Enforcement
Officer Sid Lee.
Mayor Riley presented a Certificate of Appreciation to Shyen Holt -McCoy on
his attainment of Eagle Scout status.
HEARINGS
Mayor Riley opened the public hearing on APPEAL, ZONE VARIANCE NO. 94 -30
FOR PROPERTY LOCATED AT 7347 IMPERIAL HIGHWAY, which was continued from the
meeting of September 13, 1994.
Mr. Rangel advised that staff is in receipt of a letter from the
applicant, Mr. Oscar Garza, requesting withdrawal of the Zone Variance after
working with staff to modify his site plans to meet setback requirements, which
eliminates the need for a Variance.
It was moved by Council Member Lawrence, seconded by Council Member Boggs,
and unanimously carried to accept the written request from the applicant to
withdraw Zone Variance No. 94 -30 and terminate the proceedings.

CONSENT CALENDAR - ITEMS FOR REMOVAL
Council Member Lawrence requested removal from the Consent Calendar of
Agenda Item VI -E -3, SET DATE TO CONSIDER APPEAL, CONDITIONAL USE PERMIT NO. 94-
40 FOR PROPERTY LOCATED AT 12114 PARAMOUNT BOULEVARD.
CONSENT CALENDAR
It was moved by Council Member Boggs, seconded by Council Member
Brazel ton , and unanimously carried to waive further reading of the Resolution
and approve the remainder of the Consent Calendar as recommended:
COUNCIL MINUTES: ADJOURNED AND REGULAR MEETINGS, SEPTEMBER 13, 1994:
Approve.
CASH CONTRACT NO. 595 - TENNIS COURT RESURFACING AT FURMAN AND
INDEPENDENCE PARKS - Approve specifications and grant authority to advertise
for bids: Approve.
WARRANTS ISSUED: NO. 103562 - 103924, $1,358,380.46: Approve.
AGREEMENT WITH DOWNEY CHAMBER OF COMMERCE - 1994 -95 FISCAL YEAR, to
provide services at a cost of $15,000 to promote the welfare and growth of the
City: Approve.
LEASE AGREEMENT RENEWAL WITH DOWNEY CITY EMPLOYEES FEDERAL CREDIT UNION
through June 30, 1995 at a monthly rental rate of $360: Approve.
RESOLUTION NO. 5839 (ADOPT)

AMENDING THE CITY'S CONFLICT OF INTEREST CODE WHICH
INCORPORATES BY REFERENCE THE FAIR POLITICAL
PRACTICES COMMISSION'S STANDARD MODEL CONFLICT
OF INTEREST CODE AND RESCINDING RESOLUTION NO. 5584

APPEAL, CONDITIONAL USE PERMIT NO. 94 -40, 12114 PARAMOUNT BOULEVARD
(APPLICANT /APPELLANT, CURTIS JENKINS) - ESTABLISHMENT OF INFANT DAY CARE
FACILITY FOR THE MENTALLY CHALLENGED
Council Member Lawrence noted that she and Mayor Riley will be unable to
attend the Council Meeting of October 11, 1994, and requested the public
hearing on this matter be set for October 25, 1994, to allow the opportunity
for a full Council to hear the Appeal.
Mr. Rangel mentioned the applicant also wishes to have a full Council
consider the Appeal.
There being no objections, it was moved by Council Member Boggs, seconded
by Council Member Lawrence, and unanimously carried to set the public hearing
on this matter for 7:30 p.m., October 25, 1994, in the Downey City Council
Chamber.

ORDINANCES NOT SET FORTH ABOVE
ORDINANCE NO. 983
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTIONS 6401 AND 6404 OF THE DOWNEY MUNICIPAL
CODE RELATING TO PERMIT PROCEDURES AND APPEALS FROM THE
DENIAL OR REVOCATION OF, OR THE IMPOSITION OF
CONDITIONS ON, PERMITS
The Ordinance was read by title only. It was moved by Council Member
Boggs, seconded by Council Member Brazelton, and unanimously carried to waive
further reading and adopt.
ORDINANCE NO. 984
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING
SECTION 9130 OF THE DOWNEY MUNICIPAL CODE TO ADD A MATERIALS
RECOVERY FACILITY FOR WASTE SORTING AND TRANSFER AS A USE WHICH
MAY BE PERMITTED IN THE M -2 (GENERAL MANUFACTURING) ZONE
SUBJECT TO THE APPROVAL OF A CONDITIONAL USE PERMIT
The Ordinance was read by title only. It was moved by Council Member
Boggs, seconded by Council Member Brazelton, and unanimously carried to waive
further reading and adopt.
ORAL COMMUNICATIONS
Mr. Matthew Biwersi, 9321 Brookpark Rd., complimented the Council for
maintaining the current parking restriction policy on street sweeping days, and
recommended consideration of an ombudsman position to act as a liaison between
the City and the diverse public.
Mr. Caton offered to meet with Mr. Biwersi on this matter.
Ms. Esther Ashby, 9063 Suva St., mentioned receiving police assistance
with an ongoing problem involving a dispute with her neighbors, suggested
various options for generating City revenue, and concurred with the need for a
community ombudsman.
RESOLUTIONS NOT SET FORTH ABOVE: None.
ADMINISTRATIVE REPORTS: None.
OTHER BUSINESS - COUNCIL MEMBERS
Council Member McCaughan suggested a study session be conducted to
establish priorities in Code Enforcement once the new Program has been
established within the Police Department.
Council Member Lawrence recommended that each Council Member tour the City
with Code Enforcement personnel to prioritize community needs, as discussed in
the Program's development phases, prior to scheduling a study session on the
matter.

Council Member Lawrence requested that citizens contact their Council
person with regard to any questions or concerns they may have after reading
local newspaper articles about the City.
Council Member Boggs stated she missed the "monkey list."
Council Member Boggs requested a report regarding the impact on Downey
City Library as a result of the closure of neighboring libraries affected by
increased County taxes.
Council Member Boggs reiterated her request that a resolution be placed on
the next agenda opposing an issue on the November ballot proposed by the
tobacco industry, which would limit local control over smoking and anti-smoking
issues.
Council Member Boggs requested a report on the Golf Courtesy Play Policy
for Council's review, with a copy sent to the Golf Course location.
Council Member Brazelton commented on the successful Golf Course
Rededication Ceremony, lauding the remodeled facility and its amenities.
Mayor Riley expressed appreciation to Mr. Jarrett and the Community
Services staff for their efforts involving the renovated Golf Course, and
encouraged the public to visit the facility.
Mayor Riley announced that Mr. McOsker will be leaving to assume a
position in the Long Beach City Attorney's Office, and she wished him well in
his new endeavors.
OTHER BUSINESS -- Staff Members
Mr. Caton expressed staff's appreciation to Mr. McOsker for his years of
service with the City of Downey, and congratulated him on his new position with
the City of Long Beach.
Mr. Caton reported on his recent trip with Council Member Boggs to
Washington, D.C., where they met with various legislators concerning mandatory
flood insurance rates based on proposed Federal Emergency Management
Administration (FEMA) regulations.
Mr. Caton commented with pride on the grand reopening of the Golf Course,
which came in under budget, under schedule, and is a tremendous asset to the
community.
ADJOURNMENT: 8:25 p.m.
The meeting was adjourned to 6:30 p.m., October 11, 1994, in the Council
Chamber of the Downey City Hall.
