Director /City Planner June Yotsuya, Assistant to the City Manager Cindi Lee, Executive Secretary PRESENTATIONS Mayor Riley presented a Proclamation declaring September 18 -24, 1994, as National Emblem Club Week to Ms. Nancy Watson, Vice - President, Downey Emblem Club No. 309. HEARINGS Mayor Riley opened the public hearing on LIGHTING MAINTENANCE DISTRICT A.D. 121 - ANNEXATION 94/03, KLONDIKE AVENUE BETWEEN ROOSEVELT AVENUE AND GOLDEN AVENUE, which was continued from August 23, 1994 for publication purposes. Ms. McDonnell affirmed receipt of the proof of publication. It was moved by Council Member Lawrence, seconded by Council Member Boggs, and so ordered to receive and file. Council Minutes 9/13/94 -1- f " # v i Mr. Redmayne summarized the staff report, noting the installation of street lights on this specific section of Klondike Avenue was requested by a majority of affected property owners in the area. He indicated that legal notices had been properly posted and mailed. Ms. McDonnell advised that no written protests or objections against the subject annexation have been received. There being no one wishing to speak in protest to the Lighting District Annexation, it was moved by Council Member Lawrence, seconded by Council Member --- Boggs, and so ordered to close the public hearing. RESOLUTION NO. 5835 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNE Y ORDERING ANNEXATION OF A CERTAIN AREA INTO LIGHTING MAINTENANCE DISTRICT A.D. 121 AND TO FURNISH AND MAINTAIN ELECTRICAL CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON STREETS AND PUBLIC PLACES WITHIN THOSE AREAS (ANNEXATION 94/03 - KLONDIKE AVENUE BETWEEN ROOSEVELT AND GOLDEN AVENUES) The Resolution was read by title only. It was moved by Council Member Boggs, seconded by Council Member Lawrence, and unanimously carried to waive further reading and adopt. Mayor Riley opened the public hearing on PROPOSED CODE AMENDMENT NO. 94- 32, REGARDING ESTABLISHING MATERIALS RECOVERY FACILITIES FOR WASTE SORTING AND TRANSFER IN THE M -2, GENERAL MANUFACTURING ZONE. Ms. McDonnell affirmed receipt of the proof of publication. It was moved by Council Member Lawrence, seconded by Council Member Brazel ton , and so ordered to receive and file. Mr. Rangel explained the Planning Commission has recommended a Code Amendment to allow Material Recovery Facilities (MRF's) as a permitted use in the M -2, General Manufacturing Zone, with Conditional Use Permit approval. The Code does not currently address MRF's, which are establishments where solid waste materials are sorted and processed for sale to users. As the amount of recycl abl es increase, MRF's offer a way for waste disposal and recycling companies to more easily process these commodities and ensure that cities receive their share of credit for local recycling programs. Council Member Lawrence noted her concerns regarding noise, odors, hazardous substances, etc., would be addressed by the Conditional Use Permit process. She suggested that creative landscaping be used to buffer such facilities from surrounding areas. Council Member Boggs preferred specifying certain M -2 zoned areas in the City where MRF's can be established. Council Minutes 9/13/94 -2- Discussion ensued regarding n possible e overl a zones to allow for this use 9 g P overlay in specific M -2 zones, the Conditional Use Permit process which would give discretionary approval of MRF locations to the City, and areas zoned M -2 where MRF's would categorically be denied due to nonconformity with the General Plan, Council Members Brazelton and McCaughan agreed the Conditional Use Permit process could be used to restrict MRF developments when necessary. Mayor Riley asked if there was anyone present who wished to speak in support of the proposed Code Amendment, and no one approached the podium. Mayor Riley asked if there was anyone present who wished to speak in opposition. Mr. Lennie Whittington, 8542 Manatee St., stated he was not necessarily against the proposed Code Amendment, but had similar concerns as those expressed by Council Member Lawrence regarding noise, odor, etc. He voiced his opposition to the taxpayers funding any portion of a proposed MRF. There being no one else to speak regarding this matter, it was moved by Council Member Lawrence, seconded by Council Member Brazelton, and so ordered to close the public hearing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 9130 OF THE DOWNEY MUNICIPAL CODE TO ADD A MATERIALS RECOVERY FACILITY FOR WASTE SORTING AND TRANSFER AS A USE WHICH MAY BE PERMITTED IN THE M -2 (GENERAL MANUFACTURING) ZONE SUBJECT TO THE APPROVAL OF A CONDITIONAL USE PERMIT The Ordinance was read by title only. It was moved by Council Member Lawrence, seconded by Council Member Brazelton, and unanimously carried to waive further reading and introduce. Mayor Riley opened the public hearing on APPEAL, ZONE VARIANCE NO. 94 -30 FOR PROPERTY LOCATED AT 7347 IMPERIAL HIGHWAY. Ms. McDonnell affirmed receipt of the proof of publication. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and so ordered to receive and file. Mr. Rangel discussed previous Planning Commission approval for a Conditional Use Permit establishing auto repair at this location, and a Zone Variance to reduce the rear yard setback to one foot. Mr. Rangel narrated a brief slide presentation, depicting the subject and surrounding areas. He commented on concerns expressed by the public at the Planning Commission hearing on this matter, and the applicant's subsequent rebuttal. No correspondence had been received regarding this issue. Council Minutes 9/13/94 -3- Mayor Riley sked the applicant to come forward and present his case. y y Mr. Oscar Garza, 712 S. Gretta, West Covina, spoke regarding the concerns expressed by those opposing the Zone Variance during the Planning Commission hearing on this matter. He questioned how his development would cause increased crime, noting the apartment's carports provide areas in which criminals can loiter. Commenting on blocked visibility, Mr. Garza explained the Downey Municipal Code allows for a 35 foot high building at this location which would definitely obstruct any visibility to Imperial Highway. --� There being no one else to speak in support of the applicant, Mayor Riley asked if there was anyone present who wished to speak in opposition to the applicant, including the appellant. Mr. Ron Kolar, 7914 7th St., advised he was speaking on behalf of Wynwood Apartments, located adjacent to the subject site. He noted the proposed wall would be 28 feet in height facing the apartment building, which would obstruct views from bedroom, kitchen, and dining room windows of homes. He also referenced slides which depicted garage doors on some of the carports, noting others are planned for the remainder of the carports, and weeds and trash located on the applicant's property. He stressed that a narrow alley or blind area would facilitate crime, which is already a problem and currently combatted with video cameras and lighting from the apartments. Ms. Susan Spann, Manager of Wynwood Apartments, commented that a 28 foot wall would obstruct light to the apartments, which are 20 feet in height. Mr. Bob Winningham, 8346 Lexington Rd., representing Mr. Todd Corrin, owner of Wynwood Apartments, read a letter from Mr. Corrin, stating his opposition to the Zone Variance based on the adverse impacts affecting the neighboring residential areas. There being no one else wishing to speak in opposition, Mayor Riley asked the applicant if he wished to speak in rebuttal. Mr. Garza reiterated the fact the property could be developed with a higher structure by current Code requirements that would also obstruct apartment views. He noted the 20 foot alley and 20 foot carport connection to the apartments provide 40 feet of available light, and disagreed that crime would increase because of his proposed development. Discussion ensued regarding different layouts of the proposed development on the site and the utility easements involved. There being no one else present wishing to speak regarding the matter, it was moved by Council Member Boggs, seconded by Council Member Lawrence, and so ordered to close the public hearing. RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DENYING THE APPEAL AND APPROVING ZONE VARIANCE NO. 94 -30 FOR THE PROPERTY LOCATED AT 7347 IMPERIAL HIGHWAY Council Minutes 9/13/94 -4- 1 `, The Resolution was read by title only. It was moved by Council Member Boggs and seconded by Council Member Lawrence to deny Zone Variance No. 94 -30 and approve the Appeal. Mr. McOsker clarified for the record that based on Council's intent, a resolution should be returned at the next meeting, approving the Appeal and denying the Zone Variance. Council Member Boggs noted the adjacent property owners have a right to expect surrounding properties to adhere to zoning regulations. Council Member Brazelton favored a different layout on the site for the development, in order to protect the residential integrity of the area. Council Member McCaughan expressed concern that a project might be hindered that could benefit the community if the Appeal is approved. He recommended an alternative solution be worked out with staff prior to denying the Zone Variance. Mr. Garza indicated he would be willing to modify his site plan if he were allowed two roll -up doors accessing the alley. Mr. Caton recommended the matter be continued to the next meeting to allow staff and the applicant time to further review the site plan. It was moved by Council Member Boggs, seconded by Council Member Lawrence, and so ordered to reopen the public hearing. It was moved by Council Member Boggs, seconded by Council Member Lawrence, and so ordered to withdraw the above motion to deny the Zone Variance and approve the Appeal. It was moved by Council Member Boggs, seconded by Council Member Brazelton, and hearing no objections, so ordered to continue the above subject Appeal to 7:30 p.m., September 27, 1994, in the Downey City Council Chamber. ORAL COMMUNICATIONS Ms. Myrtle Risley, 7938 Phlox St., expressed concern with day laborers loitering on Phlox Street near Paramount Boulevard, citing excessive trash and parking in the area, and people sleeping in cars and adjacent vacant structures. Ms. Esther Ashby, 9063 Suva St., read a letter outlining various problems she has experienced with City staff concerning her property, and requested Code Enforcement assistance regarding her neighbors placing their trash containers in front of her residence. Mr. Lennie Whittington, 8542 Manatee St., expressed his support of actions of the City Council, City Manager and City Attorney with regard to the a p p l i c a b i l i t y of the Brown Act to Board Meetings at Downey Community Hospital. Mr. Bill Walsh, 12738 Lakewood Blvd., commented on continual delays by Cal trans to finish construction of an additional 75 feet to the soundwall along the I -105 Freeway near his residence, and asked for assistance in expediting this matter. Council Minutes 9/13/94 -5- Council Member Boggs requested staff contact Cal trans officials with a list of incomplete items needing attention concerning the 1-105 Freeway development. Ms. Juanita Lewis, District Manager for The Gas Company, introduced herself as the representative serving the Downey area, and looked forward to working with the City in the future. TO 6:00 P.M., SUNDAY EXCEPT ON THE SOUTH SIDE OF HALL ROAD FROM COLDBROOK AVENUE EASTERLY 200 FEET RESOLUTION NO. 5838 (ADOPT) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE FINAL SUBDIVISION MAP OF PARCEL MAP NO. 21948, APPROVING AN AGREEMENT WITH THE SUBDIVIDER AND ACCEPTING A CASH DEPOSIT IN LIEU OF SURETY BONDS (7805 -11 COLE STREET) ____ Council Minutes 9/13/94 -6- 1 j y 3 T ORDINANCES NOT SET FORTH ABOVE ORDINANCE NO. 982 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3130.1 OF THE DOWNEY MUNICIPAL CODE RELATING TO ONE-WAY STREETS, BY ADDING SUBSECTION (E) - LAKEWOOD BOULEVARD FRONTAGE ROAD BETWEEN ADOREE STREET AND BORSON STREET The Ordinance was read by title only. It was moved by Council Member Boggs, seconded by Council Member Lawrence, and unanimously carried to waive further reading and adopt. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING ARTICLE III, CHAPTER 1, SECTION 3175 OF THE DOWNEY MUNICIPAL CODE BY REPEALING SUBSECTION (b) RELATING TO RESTRICTED PARKING AND THE IMPEDING OF STREET SWEEPING Chief Caldwell explained the current policy regarding parking restrictions related to street sweeping require that a violator actually interfere with the sweeping operation. This Ordinance would change the Code to restrict parking during the hours posted on street sweeping days. He mentioned if the law is properly followed, the amount of citations written will decrease, thereby reducing revenue. The proposed change would assist in preventing residential burglaries and insure equitable enforcement to all parties. The Ordinance was read by title only. It was moved by Council Member Boggs and seconded by Council Member McCaughan to waive further reading and adopt. (See later vote.) Ms. Eleanor Lindenfeld, 8856 Manzanar St., spoke against the proposed Ordinance as being unfair and unnecessarily restrictive, specifically as it would affect her livelihood as a real estate agent. Mr. Marvin Rosenow, 7542 2nd St., President of Downey Board of Realtors, concurred with Ms. Lindenfeld's comments. Mr. Emil Rasmussen, 10408 Newville, commented on the practicality of moving his second car to the street after the sweeper passes by. Council Member Boggs noted she has received several calls opposing the proposed Ordinance, and suggested other options be considered. Council Member Brazelton concurred, noting this would be an imposition of government restrictions on citizens that may not be necessary. Council Member McCaughan expressed concern with habitual offenders and perceived inequitable enforcement, and recommended adoption of the proposed Ordinance. Council Minutes 9/13/94 -7- 7 X •I Council Member Lawrence indicated she has also received many phone calls of protest from citizens who work for the betterment of Downey, citing the inconvenience of such a regulation. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 6401 AND 6404 OF THE DOWNEY MUNICIPAL CODE RELATING TO PERMIT PROCEDURES AND APPEALS FROM THE DENIAL OR REVOCATION OF, OR THE IMPOSITION OF CONDITIONS ON, PERMITS Chief Caldwell explained that based upon the recommendations of the City Attorney and City Prosecutor, staff has prepared the proposed Ordinance which would allow the City Manager or Police Chief to delegate specific duties regarding the permit process to other designated employees. The Ordinance was read by title only. It was moved by Council Member Brazelton, seconded by Council Member Boggs, and unanimously carried to waive further reading and introduce. RESOLUTIONS NOT SET FORTH ABOVE: None. ADMINISTRATIVE REPORTS MODIFICATION OF GOLF COURTESY PLAY POLICY AND GOLF COURSE PROMOTION PROGRAM Mr. Caton announced the reopening of the Rio Hondo Golf Course is scheduled for October 1, 1994, with the dedication ceremony set for September 23, 1994. To promote the new course and express appreciation for the support of Downey residents during the golf course closure, staff is recommending that 9 -holes free play be offered to all Downey residents on September 26, 27, and 28, 1994. He also recommended a change in the Golf Courtesy Play Policy to allow the City Manager or City Council to authorize courtesy play for purposes that will benefit the City. Council Member Boggs agreed the three days of free golf to Downey residents would be appropriate, but expressed concern with the potential abuses of the Golf Courtesy Play Policy in future years. Discussion ensued regarding the current Policy as it applies to designated individuals. Council Member Boggs suggested Council further review the Golf Courtesy Play Policy at a future meeting. It was moved by Council Member Brazelton, seconded by Council Member Lawrence, and unanimously carried to authorize free golf at Rio Hondo Golf Course to Downey residents on September 26, 27, and 28, 1994, and amend the Courtesy Play Policy. Ms. Jenkins explained the vendor and staff have agreed to certain modifications in the proposed agreement related to cancellation and length of service. Affiliates to provide "cost per copy /use" photocopiers, computer printers, microform reader printers and typewriters for the Downey City Library. Council Member Lawrence commented on the lack of street sweeping makeups on holidays, as this greatly affects the street sweeping schedules in south Downey. Council Member Lawrence inquired whether gas tax monies could be used to maintain the bus shelters throughout the City, specifically noting the poor conditions of the shelters at Lakewood and Firestone Boulevards, and Lakewood Boulevard and Imperial Highway. Council Member Lawrence referenced an article about the Downey McDonald's recently published in an Australian magazine. Council Member McCaughan mentioned the need to respond when possible to comments made by the public during Oral Communications, such as the concerns expressed regarding day laborers and unfinished soundwal l s . Council Member McCaughan expressed concern with alleys being used to dump unwanted furniture, mattresses, etc., specifically noting the alley between Western and La Reina Avenues. Council Member McCaughan commented on numerous abandoned shopping carts in the area of Rives Avenue and adjoining alleys. Council Member Lawrence mentioned the City of Montclair has two Code Enforcement officers attired in short pants and patrolling on bicycles. Council Member Boggs complimented the format of the Downey Communicator, including its size and color. Council Minutes 9/13/94 -9- 1 y Council Member Boggs requested the Traffic Committee be contacted regarding placement of a pedestrian crossing signal at either Iowa Street or Texas Street and Brookshire Avenue to accommodate foot traffic near the hospital. Council Member Boggs expressed concern with the impact of the closures of neighboring libraries on Downey City Library. Council Member Boggs requested a resolution be placed on the next agenda opposing an issue on the November ballot proposed by the tobacco industry. Council Member Boggs commented on alleys being used to dump furniture and other materials. Council Member Boggs indicated she missed the "monkey list." Mayor Riley noted the proliferation of vendors selling strawberries, ice cream, etc. near the area of Rio Hondo Elementary School and Furman Park. OTHER BUSINESS - Staff Members Mr. Caton indicated that staff reviews the comments of Council and the public on the day following the Council meeting to address any concerns. Mr. Caton noted that he and Council Member Boggs w i l l be representing LACDA in Washington, D.C. next week to meet with legislators regarding proposed flood insurance.
