ORDINANCE NO. 1043
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
CALIFORNIA, APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE
CITY OF DOWNEY AND CALSAN, INC. RELATING TO THE DEVELOPMENT
OF A PHASED MATERIALS RECOVERY AND TRANSFER FACILITY AT ITS
PROPERTIES LOCATED AT 9821 DOWNEY - NORWALK ROAD AND 9770
WASHBURN ROAD
The Ordinance was read by title only. It was moved by Council Member McCaughan, seconded
by Council Member McCarthy, and unanimously carried (3 -0) to waive further reading and adopt.
ORDINANCE NO. 1044
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY
COUNCIL OF THE CITY OF DOWNEY AND THE BOARD OF
ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES'
RETIREMENT SYSTEM (PERS)
The Ordinance was read by title only. It was moved by Council Member McCaughan, seconded
by Council Member McCarthy, and unanimously carried (3 -0) to waive further reading and adopt.

ADMINISTRATIVE REPORTS
SOUTHEAST AREA ANIMAL CONTROL AUTHORITY - EXTENSION OF JOINT
POWERS AGREEMENT
Mr. Powell noted this agreement would extend the agreement currently in effect with the
Southeast Area Animal Control Authority ( SEAACA) for another ten years to June 30, 2007 and that the
City could withdraw in any given year. He mentioned this agreement makes two additional changes to the
agreement relating to cities being able to withdraw from SEAACA. The first change allows a withdrawing
city to participate in the distribution of assets should SEAACA ever be dissolved and liquidated in the
future. The second change concerns a city's ability to withdraw because it objects to a capital project
being proposed for the SEAACA budget in that it allows a City to withdraw and not incur any liability for
the capital project.
It was moved by Council Member McCaughan, seconded by Council Member McCarthy, and
unanimously carried (3 -0) to approve the extension of the joint powers agreement for the Southeast
Area Animal Control Authority.

Lennie Whittington, 8542 Manatee Street, commented on the vote for Senate Bill 413 Sen

Peace bill related to the sale of non - profit hospitals), stating it did not ass by four votes but di

reconsideration vote and will probably be brought back for a vote next Thursday. He noted the new ew bi11
was amended to repeal its provisions on January 1, 2003.

OTHER BUSINESS - Council Members
Council Member McCaughan clarified the language contained in the proposed Ordinance
defining front yards and parking in residential zones, which was discussed at the last meeting.

Council Member McCaughan mentioned that only two Council Members may attend Hospital

Board Meetings at one time and suggested to make it more official to treat it as a Council assignment.
Council Member McCarthy mentioned a suggestion made at the last Council Meetin g that a
Saturday route be approved for the DowneyLINK and he also suggested it be considered on a
gg test basis
to determine ridership.
Council Member McCarthy asked if a report was planned tonight on bus benches and the
response was no.
Council Member McCarthy noted demolition has begun on the new SavOns project g p , ect at
Paramount/Firestone Boulevards.
Council Member McCarthy suggested everyone look at the Public Works projects/Home __
Beautification Awards display outside the Council Chamber.
