Council Member McCaughan presented Certificates of Appointment to Dr. George Davis on his appointment to the Emergency Preparedness Committee - District 3 and to Linda Davis on her appointment to the Personnel Advisory Board - District 3. Comic Sziebel of Congressman Steven Horn's office who introduced Congressman Horn's new Chief of Staff, David Bartel, and Eric Swedlaiid, who deal with LACDA issues, the Alameda corridor, the ports etc. Council Minutes 1/28/97 -1- 4 s HEARINGS Mayor Lawrence opened the public hearing on the 1997 - 98 FEDERAL COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND HOME INVESTMENT PARTNERSHIP PROGRAMS. Mr. McDonnell affirmed receipt of the Proof of Publication. It was moved by Council Member McCaughan, seconded by Council Member Riley, and so ordered to receive and d file. Mr. Rangel explained the Consolidated Plan process established by HUD in 1995 -96 where Y e e the City was required to prepare a 5 -Year Consolidated Plan, an Annual Action Plan n a d develop a Public Participation Plan. He advised that this evening's meeting begins the process required . g g p q under the public participation requirement of the Consolidated Plan and noted the key areas in which p ublic comments are needed. He mentioned the dates of three public meetings scheduled with the last ublic hearing a ing to be held by the Council on April 22. Staff recommends Council receive ublic comments ents concerning the development of the City's 1997 -98 Annual Action Plan for CDBG and HOME funds. There was no correspondence received regarding this m matter. Mayor Lawrence asked if there was anyone present who wished to speak regarding the 1997 - P g g 98 Federal Community Development Block Grant and Horne Investment Partnershi p Programs. rams. Guy Sterner, 10303 Downey Avenue, stated the Project Area Committee ttee (PAC) would like the Council to strongly consider the factor that home ownership is the most important factor p p o that makes this community unique and stated the significant amount of single family residents that are becoming . . g y ecoming substandard rental units. He mentioned the Rental Rehabilitation Assistance Program and suggested ggested a more significant expenditure of these funds would be a distribution that would enable one family in each Council District to become a home owner. He mentioned programs undertaken in other .. ., p g communities such as Hawaiian Gardens and Paramount and felt the City needs to create programs that y p g will result home ownership. He mentioned the Senior Fixup Program and felt there should lt i h hi p g be more flexibility in this program to meet the subsequent needs of seniors instead ' q ead of being a one -time request. i Miguel Lopez, owner of Tijera Salon at 863 5 Firestone ' . � stone Boulevard and a Project Area Committee member, concurred with Mr. Sterner's comments to help in any way possible to beautify p Y Y p fY the City. Richard B. Pridham, 10402 Beliman, noted attending meetings held at 6.3 0 g g p.m. where he observed the maximum public participation was six individuals. He felt this time frame limits the participation of citizens and su ested setting meetings at a later hour. gg g g He also mentioned the problem of garage conversions and feels they distract from what Downey has been as a community. ty. Lennie Whittington, 8542 Manatee, referenced the lack of housing g assistance programs in Contra Costa County and remarked on assistance programs that are available in two cities in that county. Council Minutes 1/28/97 -2- _ 4 � ;.1 There being no one else wishing to speak, it was moved by Council Member McCarthy, seconded by Council Member Brazelton, and so ordered to close the hearing. Council Member McCarthy concurred with the suggestion about the time of the meetings and suggested moving the time back one half hour. He also mentioned the comments about home ownership and felt the investment in the community is much greater with home ownership. Council Member Brazelton agreed with Council Member McCarthy on both points. Council Member McCaughan referred to Page 2, Fiscal Impact, and asked if the $1,794,000 includes the loans for the gymnasium and community center. He was informed the net amount anticipated to be received during the next fiscal year is exclusive of the gym and community center. Council Member McCaughan then agreed with home ownership but noted different types of housing must also be addressed. The Section 8 program is needed but must be monitored through code enforcement. He asked for definitions on how this money could be used for public facilities, senior centers, recreational facilities and childcare facilities the next time this is considered and also asked for the definition of public services and infrastructure. He asked to see the requirements of the CDBG system to enable approaching things in a different manner. He mentioned the City's position on garage conversions over the last several years has been more proactive. If the City has knowledge of an illegal conversion, due diligence has been given to enforcement. Mayor Lawrence noted during the last fiscal year approximately 196 complaints have been investigated. She mentioned reading an article on a project undertaken in Boulder, Colorado, similar to the sweat equity program mentioned by Mr. Whittington and passed this article on for review. Council Member McCarthy asked if the cutouts for wheelchair ramps comes out of this funding and was advised money was provided to Public Works for this purpose. He mentioned several other programs funded through CDBG funds. It was moved by Council Member McCarthy, seconded by Council Member McCaughan, and so ordered to receive and file the report. CONSENT CALENDAR - ITEMS FOR REMOVAL Agenda Items VI - - INVESTMENT POLICY - 1997, and VI - - JANITORIAL MAINTENANCE CONTRACTS, were requested by Mr. Caton to be withdrawn until the next Council Meeting. Mr. Caton also requested Item VI -F -4, ADOPTION OF MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CITY OF DOWNEY AND THE DOWNEY POLICE OFFICERS' ASSOCIATION, be removed and moved to other business to explain in detail some changes to the MOU. Agenda Items VI -F -3, DOWNEY AVENUE AT SECOND STREET, RESOLUTION TO REMOVE STOP SIGNS, and VI - - FEE RESOLUTION FOR WATER, SEWER, AND AB 939, were removed at the request of Council Member McCaughan. Agenda Item VI - - SET PUBLIC HEARING FOR CODE AMENDMENT 96 - 95 RELATING TO ADULT BUSINESSES, was removed at the request of Council Member McCarthy. Council Minutes 1/28/97 -3- 4 K Council Member McCarthy expressed a request to remove Agenda Item VI - - SET PUBLIC HEARING FOR CODE AMENDMENT 96 -95 RELATING TO ADULT BUSINESSES, for the purpose of addressing some concerns regarding ardin this matter. He was informed g g d by Mr. McOsker that if there are questions, it would be best to defer complete responses to the p ublic hearing so that the audience would have the right to due process to hear the answers to the questions and to respond. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY F O DOWNEY ADDING SECTION 3186(V) OF THE DOWNEY MUNICIPAL CODE, DESIGNATING A PRIMA -FACIE SPEED LIMIT OF 30 MILES PER HOUR ON PATTON ROAD BETWEEN FIRESTONE BOULEVARD AND STEWART & GRAY ROAD Mr. Redmayne advised staff has received complaints about speeding on P p p g Patton Road, and as a result a traffic engineering study was performed along the entire length of Patton Road between Firestone Boulevard and Meadow Road, which determined in the area between Firestone Boulevard and Stewart & Gray Road that 85 percent of the motorists were drivin g at or below 38 MPH. Staff is recommending 30 mph as the proper speed limit for this location- -the remainder of Patton Road down to Meadow Road was found to be adequate as it stands. Lennie Whittington, 8542 Manatee, mentioned his concern that the speed limit has been 25 mph and people have been driving at speeds of 35-40 mph, which he hoped their speed would not p p p increase with the new speed limit of 30 mph. The Ordinance was read by title only. It was moved y y by Council Member McCarthy, seconded by Council Member Brazelton, and unanimously carried to waive further readin g and introduce. ORDINANCE NO. 1036 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, PROTECTING PUBLIC HEALTH AND SAFETY AND CITY PROPERTY WITH RESPECT TO CONTROL OF DISCHARGES AND POLLUTANTS, AND THE PROHIBITION OF ILLICIT DISCHARGES AND ILLICIT CONNECTIONS TO THE MUNICIPAL SEPARATE STORM SEWER SYSTEM, BY AMENDING ARTICLE V OF THE DOWNEY MUNICIPAL CODE BY ADDING NEW CHAPTER 7, "STORM WATER AND URBAN RUNOFF POLLUTION CONTROL" The Ordinance was read by title only. None Council Minutes 1/28/97 -6- ADMINISTRATIVE REPORTS PROPOSED NEIGHBORHOOD PRESERVATION AREAS Ms. Christina Garcia, Neighborhood Preservation Coordinator, described the goals and objectives of the neighborhood preservation program to coordinate resources for attacking crime, blight and other existing problems in target areas of the City. She mentioned meeting with City Y g Y personnel, members of the City Council, and members of the community to obtain information on services, resources and input for determining the neighborhoods in need of preservation assistance and whether they met the required criteria. Ms. Garcia noted neighborhood preservation efforts are eligible for funding through CDBG funds if the efforts are concentrated in CDBG eligible areas. The following areas were recommended for first -year neighborhood p reservation: Adco/Neo, Golden Park neighborhood and the Dinwiddie/Pellet neighborhood. She requested Council approval to move forward with the work plan presented. Council Member McCarthy commented on the significantly higher number of calls to the Police Department from the Adco /Neo neighborhood and noted he was happy to see the Golden Park area selected. It was moved by Council Member McCaughan, seconded by Council Member Riley, and unanimously carried to approve the first -year list of targeted neighborhoods and the accompanying strategy for neighborhood preservation and enhancement. Council Member McCaughan expressed his feeling that this dividends in a ro ram would pay p g p. the long run and mentioned this will be the City's test to the metal with the CDBG funds in future years as problems are addressed now. He felt the report showed a lot of interesting data. It was indicated by Ms. Garcia that she would be attending the public meetings scheduled. Mayor Lawrence looked forward to hearing back from people contacted in these neighborhoods as their perspectives may be different. Lennie Whittington, 8542 Manatee, commended the report by Ms. Garcia, and stated he would like to see active participation from the people in the neighborhoods. Council Member Riley concurred with Mr. Whittington and mentioned an apartment owner on Adco Street who was very interested in forming an apartment owners association. She felt these people would be necessary for the preservation program. Council Member Brazelton noted he was in favor of this p g ro ram, but had not been in favor of funding for the program due to budget constraints. He cited the need to establish leaders in the designated areas and the development of a program that would attract participants. Council Minutes 1/28/97 -7- o DROUGHT PROOF 2000 FOR THE CITY OF DOWNEY AND DESIGNATION OF A COMMUNITY GROUP TO PROMOTE THE PROGRAM Mr. Redmayne advised the Central Basin Municipal Water District (CBMWD) has developed (CBMWD) p a plan, Drought Proof 2000, to assist the City in its water conservation efforts. He noted ' d a lateral line is planned from the existing mainline to feed recycled water to Rio Hondo Elementary School ry cool and Furman Park. Another component of the plan is the distribution/rebate program to distribute , l , p g ute 1, 000 Ultra- Low -Flush (ULF) toilets to residents in exchange for their old toilets at no cost. The e Central Basin is looking for a community based non - profit organization to distribute the toilets and is willing to pay $15 for each new unit distributed with collection of the old unit for recycling. He mentioned the criteria an organization must meet and indicated the Downey High School baseball team an Y g and boosters have requested they be named as the sole group to promote this program on behalf of p p p g o the CBMWD. Staff recommends approval of the Drought Proof 2000 lan and designation of the p g Downey High School baseball organization as distributor of the program. Gary Morris, 13202 Rutgers Avenue, advised the City is under fire from the Federal ederal and State governments in the area of urban water planning and management. The City's water agency is y g y attempting to reducing the quantity of water used without negatively impacting the quality of life. He g y p g q Y noted recycled water projects have been introduced, including ULF toilets, etc. to accomplish this, and Drought Proof 2000 was implemented in 1995 with the goal of gettin g all 25 cities under the certification by the year 2000. He encouraged the program and noted with the advent of Proposition 204 p there will be grant funding for infrastructure improvements- -this program will help ac p g p uire some q of those grants. Council Member McCarthy asked if various community groups were solicited to act as the distributor for the program and was informed it was felt that schools were a good approach to put g pp p conservation ethics into this group. It was moved by Council Member Brazelton, seconded by Council Member Riley, and unanimously carried to approve Drought-Proof 2000 for the City of Downey and i g y y designation of a community group to promote the program. Council Member McCaughan advised that the recycled water system is only for • " y y y o irrigation purposes and will not be used for drinking water. He also noted the Downey baseball team contacted him about two and a half years ago on this and he felt that it was fair to assign the project to them g p J as they are the ones who have worked for it. ORAL COMMUNICATIONS Frank Perez, 9104 Gainford Street, commented on questions relative to Downey Community y Hospital and its affiliates. He asked about the time -frame imposed for responses from the hospital. Mr. Caton replied that about twenty letters were received, mostly anonymous, but containing hundreds of questions. He will go through the letters and sort out duplicate q uestions and those that do not apply. Council Minutes 1/28/97 -8- 1 y Jose Trujillo, 13212 Stanbridge Avenue, explained he represented a small group of concerned parents of Downey High School girls basketball teams. He noted the gymnasium floor has very extensive water damage and that repair work is scheduled to be performed during the summer. This will eliminate training for various teams who would normally use the gymnasium. He mentioned the recent school bond approved by citizens of Downey for school repairs and urged the Council to request the board of education to begin these repairs. Mr. Trujillo also complained about the trash service provided by Calsan stating if something is out of the container they will not pick it up. He mentioned the wheels came off the trash can during the last pickup and felt he was paying more money for service but was not receiving the same quality of service. He asked the Council to contact this company regarding their service. OTHER BUSINESS - Consent Calendar - Items removed b Council Al royal RESOLUTION NO. 6015 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DESIGNATING DOWNEY AVENUE A THROUGH STREET AT ITS INTERSECTION WITH SECOND STREET Council Member McCaughan expressed concern that in the future this intersection could be a pedestrian walkway when the parking structure and theater project are completed and if the stop signs are eliminated, it could increase speeds from Firestone Boulevard to Third Street. He was informed it has been found that too many vehicles are not stopping at this stop sign and it was felt p edestrians would take more care to watch before crossing. It was also noted that Third Street is expected to be the walkway used by most theater goers. Second Street will no long er have a marked crosswalk but it is still legal to cross at any corner, marked or unmarked. The Resolution was read by title only. It was moved by Council Member McCarthy, seconded by Council Member Brazelton, and unanimously carried to waive further reading and adopt. RESOLUTION NO. 6016 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF DOWNEY AND THE DOWNEY POLICE OFFICERS' ASSOCIATION Mr. Powell noted the Police Officers' Association completed the balloting process and approved the MOU. After approval the wording was reviewed and six changes were requested to g q which staff agreed. He explained the language changes in the MOU. The Resolution was read by title only. It was moved by Council Member Brazelton, seconded by Council Member McCaughan, and unanimously carried to waive further reading and adopt as g p amended. Council Minutes 1/28/97 -9- RESOLUTION NO. 6018 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING WATER, SEWER, AND AB 939 RATES FOR THE CITY OF DOWNEY AND RESCINDING RESOLUTION NO. 5871 Council Member McCaughan asked for clarification regarding paragraph two of the staff report. Mr. McOsker explained this is an ongoing debate that will probably be resolved by the courts on whether a water commodity fee is covered by Proposition 218. The paragraph in question indicates that in fact water is covered. There are a series of requirements for increasing fees, only one of which is the voter requirement, and there is an exception for water, sewer and trash fees. Mr. McOsker noted if there was not a problem with the fees as structured or if there is a necessity for further procedures in the future for increases or modifications, then the City would be dealing with just this resolution and not the larger resolution with all of the other fees. The Resolution was read by title only. It was moved by Council Member McCaughan, seconded by Council Member Riley, and unanimously carried to waive further reading and adopt. OTHER BUSINESS - Council Members STUDY SESSION - POLICE FACILITY AND POLICE COMPUTER UPGRADES Council Member McCaughan noted he requested a study session to review the police facility upgrade and police computer upgrades and requested including the idea of joint dispatch concept as he feels this is inter - related and needs to be synchronized. It was moved by Council Member McCaughan, seconded by Mayor Lawrence, and unanimously carried to set the study session for February 11, 1997, at 5 :00 p.m., in the Council Chamber of the Downey City Hall. Council Member Brazelton noted there is a question of what the added operating costs would be after this was installed, and he requested this information be brought to the study session. Council Member McCaughan commented on the tour he took of the child care facility at Imperial School and the Gymnasium and Community Center at Apollo Park. He expressed his p p strong support of the three projects and feels the City needs to pursue future infrastructure improvements such as these. Council Member McCarthy referenced need for weed abatement on property at Paramount and Firestone Boulevards and has been assured there is a court date pending on this matter. Council Member McCarthy mentioned the Hal Roach concert at the Downe y Theater Saturday evening and encouraged everyone to attend. Council Minutes 1/28/97 - Council Member McCarthy mentioned a letter he received commending the police g p department for their assistance with a vehicle problem on the I -5 Freeway. Y Mayor Lawrence commented on a trip that she and Council Members Riley nd McCarthy Y made to Sacramento for a Contract Cities Legislative Seminar, the goal of which was to allow elected local officials to meet their State Legislators and gather information. Responding to Mr. Trujillo's concern regarding Calsan, Mayor Lawrence indicated they are supposed to repair broken trash barrels or trade them for a new one. She also noted there are times when citizens can call for additional pickups if needed. OTHER BUSINESS - Staff Members Mr. Caton acknowledged that Mayor Lawrence is serving as an alternate to the Metropolitan Transit Authority Board representing 26 cities in the Southeast Los . Angeles County. Y Mr. Caton mentioned Mr. Whittington's assistance in setting up a meeting with the Regional g g Vice President of Coca Cola to discuss their plans to develop the 13-acre site they have acquired. Y q Mr. Caton discussed the status of the Krikorian Theater and mentioned an article in the Downey Eagle. The City's part of this project, the parking structure, is moving ahead very well and should be completed shortly. Mr. Caton commented on discussions he and Mr. Rangel have had with the Boeing Company to make sure they will stay here in the City.
