Director of Community Dev. /City Planner Mark Dryer, Police Captain John Michicoff, Assistant Finance Director Ed Velasco, Manager of Housing June Yotsuya, Assistant to the City Manager Shirley Conte, Executive Secretary PRESENTATIONS Mayor McCarthy presented a plaque to Scott and Faith Temple in honor of their service to the community. Mr. Temple was a member of Downey's first City Council in 1956, which helped incorporate the City, and he and Mrs. Temple both served on various City boards and commissions. A going away party was held at the Community /Senior Center last week for the Temples, who are relocating to Texas. Scott and Faith each thanked the City, stating Downey will always be their home and urged everyone to keep up the good work for the community. Mayor McCarthy presented Proclamations to Tim and Dawny Frize, Dale and Brenda Warner, and Bob and Mimi Warren, in recognition of their selection as 2000 Parents of the Year in conjunction with National Parents Day, celebrated on the 4th Sunday of July. (Nick and Joy Karavedas were not in attendance to receive their Proclamation.) Council Minutes 7/25/00 -1- 1 ` y k t tfI OE13536 Connie Sziebl, representing Congressman Steven Horn's office, congratulated the parents and read a letter from the Congressman. She thanked Katrine McCarthy for her efforts on behalf of the Parents of the Year program. Katrine McCarthy thanked the Mayor and City Council, noting this is the fifth year Downey has recognized outstanding parents. She thanked those family members present, reporters Arnold Adler and John Adams for publishing the event, and Connie Sziebl and Congressman Horn for their support. She noted local restaurants, La Cabana, La Barca, Mimi's, and Tokyo Gardens, donated complimentary dinners for the parents and the Downey Civic Theatre donated tickets to their next performance in October. Fire Chief Sauter recognized the students selected as scholarship recipients by the Downey Police and Fire Foundation. He expressed appreciation to family members in attendance and to Council Members and City Staff who gave of their time to serve on the Foundation's board. He noted the Downey Police and Fire Foundation was formed in 1990, with one of its goals being to offer scholarships to the children, wives, and family members of police and firemen. Council Member Riley commented on taking part in the interview process for these young people and felt they held a bright future for both Downey and the Country. Mayor McCarthy recognized former Mayor and Council Member Ken Miller. Mayor McCarthy mentioned receiving a request to move Agenda Item X- B -1 -a, PROPOSED CITY CHARTER AMENDMENT RELATING TO CITY COUNCIL TERM LIMITATIONS, forward on the Agenda and requested input from the Council. Council Member McCaughan, who had submitted this item, requested it be continued to the meeting of August 8, 2000, when the full Council would be in attendance. There were no objections. HEARINGS Mayor McCarthy opened the public hearing on PROPOSED DOWNEY MUNICIPAL CODE AMENDMENT RELATING TO THE COMMERCIAL MANUFACTURING ZONE, ADDING SELF - STORAGE/MINI- WAREHOUSE FACILITIES AND CARETAKER'S DWELLING, SUBJECT TO CONDITIONAL USE PERMITS. Ms. McDonnell affirmed receipt of the Proof of Publication. It was moved by Council Member Riley, seconded by Council Member Perkins, and so ordered to receive and file. Mr. Yoshiki explained this text amendment to the Zoning Code of the City of Downey, involving the addition of another use to the City's newly established Commercial Manufacturing Zone. He advised that the Planning Commission reviewed this request and felt self - storage mini /storage was different from the warehousing typically found in the General Manufacturing Zones and is requesting staff consider an amendment to the Commercial Manufacturing zone to add this type of storage use, subject to a Conditional Use Permit (CUP). He noted the use would include caretaker type quarters under the same discretionary action. He responded to comments from the Council. There was no correspondence received regarding this matter. Council Minutes 7/25/00 -2- o153? Mayor McCarthy asked if there was anyone present to speak in favor of Code Amendment No. 00 -39. Dorothy Palermo, 7600 Sarabeth Street, owner of property at 9607 Imperial Highway, approved of the change and felt it was for the betterment of the street. Craig Lyons, applicant, congratulated staff and the Planning Commission for wording the amendment in the best possible light for his and the City's use, stating there is flexibility and control with the requirement of the CUP. There being no one else to speak in favor and no one to speak in opposition, it was moved by Council Member Perkins, seconded by Council Member McCaughan, and unanimously carried (4 -0) to close the hearing. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY TO AMEND SECTION 9127 OF THE DOWNEY MUNICIPAL CODE, RELATING TO THE COMMERCIAL MANUFACTURING ZONE, ADDING SELF - STORAGE/MINI- WAREHOUSE FACILITIES AND CARETAKER'S DWELLING, SUBJECT TO CONDITIONAL USE PERMITS AND ADOPT A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT (CODE AMENDMENT NO. 00 -39) The Ordinance was read by title only. It was moved by Council Member McCaughan, seconded by Council Member Perkins, and unanimously carried (4 -0) to waive further reading and introduce. Mayor McCarthy opened the public hearing on ZONE CHANGE 00 -41 FOR PROPERTY LOCATED AT 12432 -12530 BELLFLOWER BOULEVARD AND 9501 -9641 IMPERIAL HIGHWAY. Ms. McDonnell affirmed receipt of the Proof of Publication. It was moved by Council Member Perkins, seconded by Council Member Riley and so ordered to receive and file. Mr. Yoshiki noted this is a cleanup action, referring to the June 13th Council Meeting where an amendment was approved to the City's General Plan involving these six properties. He narrated a slide presentation of where the new zoning will occur, noting it is consistent with the General Plan and provides the greatest development opportunities on the north side of Imperial Highway. He responded to comments from the Council. There was no correspondence received on this matter. Council Minutes 7/25/00 -3- 013538 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY TO RE -ZONE SIX (6) PARCELS TO THE C -M, COMMERCIAL MANUFACTURING, ZONE ON PROPERTIES LOCATED AT 12432 -12530 BELLFLOWER BOULEVARD, AND 9501 -45, 9557 -61, 9607, 9623, 9637, AND 9641 IMPERIAL HIGHWAY AND ZONED LIGHT MANUFACTURING (M -1), GENERAL MANUFACTURING (M -2), AND PARKING- BUFFER (P -B), AND ADOPT A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT (ZONE CHANGE NO. 00 -41) The Ordinance was read by title only. It was moved by Council Member Perkins, seconded by Council Member Riley and unanimously carried (4 -0) to waive further reading and introduce. Prior to the vote, Council Member McCaughan mentioned receiving phone calls regarding future self - storage facilities in commercial districts and stated he would draw the line and oppose additional projects. Mayor McCarthy echoed Council Member McCaughan's remarks, stating he hoped to see Imperial Highway improve in terms of land value over the next few years, due to improvements at the NASA site and the underground wiring project along Imperial Highway. Mayor McCarthy opened the public hearing to CONSIDER APPROVING THE ISSUANCE OF MULTIFAMILY HOUSING REVENUE BONDS BY THE CALIFORNIA STATEWIDE COMMUNITIES DEVELOPMENT AUTHORITY. Ms. McDonnell affirmed receipt of the Proof of Publication. It was moved by Council Member Perkins, seconded by Council Member Riley, and so ordered to receive and file. Mr. Velasco explained this item involves the issuance of multifamily housing revenue bonds for the acquisition of the subject property and to provide funding for property improvements. He narrated a visual program of the site located at 8525 Paramount Boulevard and noted the California Statewide Community Development Authority (CSCDA) is the issuer of the bonds and must receive the City's approval to proceed, stating the adoption of the proposed Resolution would satisfy that requirement. This hearing is being held to receive public input on the nature of the transaction and location of the project. He noted the transaction does not involve any financing or investment by the City, and there would be no City responsibility or obligation to pay back the bonds, if so issued. Council Member Perkins inquired if approval would insure that the project would be affordable to lower and moderate income families for 55 years and the response was yes. There was no correspondence received regarding this matter. Mayor McCarthy asked if there was anyone present who wished to speak in favor or in opposition to the issuance of multifamily housing revenue bonds. Council Minutes 7/25/00 -4- OtSK. David Bowers, 10620 Dolan Avenue, inquired if these units would count towards the City's housing requirements with the State and the response was no, since they are existing units. There being no one else to speak, it was moved by Council Member Perkins, seconded by Council Member Riley, and so ordered to close the hearing. RESOLUTION NO. 6385 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY —' APPROVING THE ISSUANCE OF MULTIFAMILY HOUSING REVENUE BONDS BY THE CALIFORNIA STATEWIDE COMMUNITIES DEVELOPMENT AUTHORITY The Resolution was read by title only. It was moved by Council Member Perkins, seconded by Council Member Riley, and unanimously carried (4 -0) to waive further reading and adopt. Prior to the vote and in response to comments from the Council, Don Field, of Orrick, Herrington, Sutcliffe, LLP, bond counsel to the California Statewide Communities Development Authority, explained the bonds will be secured by revenue from the housing project. There will be a mortgage against the property and a regulatory agreement will be recorded against the property, with these conditions remaining on the property if it is ever sold. The buyer is solely responsible for the repayment of the bonds but there is credit enhancement to support the bonds if the borrower defaults. He noted Birchcrest Preservation Limited will be the owner of record for the financing and the project, with TOPA Management Company remaining the property manager. In response to Council Member McCaughan's concern regarding the 55 year term, p Ralph Orrick, bond counsel of the California Statewide Communities Development Authority, referred to a commitment letter from Washington mutual that states the bond term is 30 years. Mr. Velasco noted the 55 years is what is in the application and is a term consistent with these affordable projects. He noted the senior housing project on Third Street also has a 55 -year term. Gary Clopp, TOPA Management Company, advised the original deal was a 40 -year mortgage a e with a 20 -y ear use restriction and 20 y ear prepayment o t -out provision. He noted opt-out chose to keep the property as an affordable housing property, as this is the business they are in, which will insure the ro ert remains affordable for 5 5 years. p p y y Mayor McCarthy opened the public hearing to HEAR PROTESTS ON THE LOT CLEANING AND NUISANCE ABATEMENT PROGRAM. Ms. McDonnell affirmed receipt of the Proof of Publication and Affidavit of Mailing. It was moved by Council Member Perkins, seconded by Council Member Riley, and so ordered to receive and file. Council Minutes 7/25/00 -5- 013540 Mr. Alvarez commented on this program to maintain properties throughout the City, noting the Downey Municipal Code provides for notification to be sent to property owners whose fall into a state of disrepair. When the owner fails to follow -up on the notice, the Code properties P provides for the City to take whatever action is necessary to abate the condition. During Fiscal Year 1999 -2000, 55 property owners were notified, and 10 failed to take action. The City took appropriate action to abate the nuisance conditions and the owners were assessed for the costs involved through a lien placed on their property tax bill. The public hearing is conducted to hear any protests and to affirm the assessments on the properties involved. The City Clerk advised there were no written protests received. There being no one present to speak, it was moved by Council Member McCaughan, seconded by Council Member Riley, and so ordered to close the hearing. It was moved by Council Member McCaughan, seconded by Council Member Riley, and unanimously carried (4 -0) to deny any protests and affirm the assessments. Council Member Perkins advised he had requested at last year's hearing on this issue that owners be notified by certified mail and was informed that notifications were sent via regular mail. He expressed concern and requested certified mail be utilized with a return receipt verifying notification was received. He inquired if notification was sent to those properties boarded up prior to board up and the response was no, that these properties required immediate action. Mayor McCarthy inquired if there is a follow up system in place regarding the 30 day time period to pay the assessment and the response was no. He stated he felt this was something to be considered. ORAL COMMUNICATIONS Ed Di Loreto, 7333 Rio Flora Place, suggested Oral Communications be the first item on the Agenda, referring to Section 510 of the City Charter, which states the public is entitled to speak on every subject on the Agenda. He expressed concern about the Council term limits issue and requested it be withdrawn. David Bowers, 10620 Dolan Avenue, commented on the term limits issue, noting he will not be at the next Council Meeting and had concern that postponing the issue to August 8th was cutting it too close to the election. He referred to the City's agreement with Downey Regional Medical Center announced at the Special Called Meeting of the Council on July 18th, noting it appears the Hospital made some poor decisions in judgement. He had hoped the Council would have retained more of a position on the Hospital Board or on the smaller board that seems to control the Hospital Foundation's money. Joseph Di Loreto, 8607 Imperial Highway, expressed dismay that Council term limits was placed on the Agenda again by a Council Member and stated he felt it was an abuse of power. He noted the people have spoken and the Council has a responsibility to their electorate. Council Minutes 7/25/00 -6- 013541 Lennie Whittington, 8542 Manatee Street, complained about the time limit imposed on speakers at the July 18th meeting regarding the Hospital agreement; he referred to the notifications for lot cleaning and nuisance abatement, pointing out the Council had requested notifications be sent by certified letter last year, which was not done; and referred to his rior request p g to have the Council honor retired Parking Enforcement Officer, Johnnie Kelley, with a certificate for her years of service, which did not happen. Bob Collins, 9037 Gaymont Avenue, felt it was not right to bring the term limit issue back again. He suggested everyone stop by the third floor of City Hall to see the pictures of the original City Council. --- Council Member Perkins expressed pride in serving on the Police and Fire Foundation and seeing the young people and their families here tonight to receive their scholarships. Council Member Perkins referred to the recently adopted City Fee Resolution, requesting a review of the Golf Course starting times for senior citizens. He suggested changing the noon start time to 11:00 a.m. during the winter to allow seniors to play 18 holes before dark. Council Member McCaughan mentioned requesting a meeting with the pertinent departments about the Theatre parking structure and the need for posting signs to prohibit skateboarding and loitering. Council Member McCaughan referred to the comments made regarding the term limitations issue and noted, if he feels something needs to be changed, he has the right as a Council Member to place an issue on the Agenda. He pointed out the City of Long Beach is reconsidering its Ordinance, which does not have the total lifetime ban that Downey has. He explained why he felt that Downey's term limits is hurting the City and its impact on the City in its many inter - council agencies, wherein it takes approximately six years to ever get elected to any position in those organizations and many of these organizations bring funding to the City. He noted 95 percent of the cities do not have term limits and Downey is "saddled" with unfair term limits. The citizens should be given the opportunity to make their opinion on whether or not they want to alter it. —' OTHER BUSINESS - Staff Members: None ADJOURNMENT: 9:05 p.m. The meeting was adjourned in memory of John Apodaca, who was active in the Sister Cities Association, to 6:30 p.m., August 8, 2000, in the Council Chamber of Downey City Hall.
