The City Council of the City of Downey held a regular meeting at 8:10 p.m., January 25, 2000,
in the Council Chamber of the Downey City Hall, Mayor Keith McCarthy presiding.

HEARINGS
Mayor McCarthy opened the public hearing on PROPOSED DOWNEY MUNICIPAL
CODE AMENDMENT TO REMOVE AMBULANCE SERVICES AS A PERMITTED USE IN
THE H -M (HOSPITAL MEDICAL -ARTS) AND C-2 (GENERAL COMMERCIAL) ZONES;
AND ADDING AMBULANCE SERVICES AS A USE SUBJECT TO A CONDITIONAL USE
PERMIT IN THE H -M, C -2 AND M -1 (LIGHT MANUFACTURING) ZONES.

Ms. McDonnell affirmed receipt of the Proof of Publication. It was moved by Council
Member Lawrence, seconded by Council Member Winningham, and so ordered to receive and file.
Mr. Yoshiki mentioned this item was originally heard at the November 9, 1999, Council
Meeting, and was precipitated by a property owner in the industrial zone who requested adding the
ability to operate ambulance services in that zone. The Council raised a number of concerns and felt
the use should best be considered by a public hearing through the conditional use permit process. He
reviewed concerns raised by the Council, such as additional traffic, noise, and the number of
ambulance units allowed on a particular piece of property, noting the matter was returned to the
Planning Commission for further consideration. Staff also reexamined the Downey Municipal Code,
which allowed ambulance services as a use permitted by right in the Hospital Medical Art zones (H-
M), and General Commercial (C -2) zones and felt the concerns identified by the Council were valid.
The proposed Ordinance amends the H -M, C -2 and the M -1 zones, by adding ambulance services as a
permitted use through the conditional use permit process and no longer as a use permitted by right.
Mayor McCarthy inquired if the original applicant, James Crawford, still planned to use the site
for ambulance services and was informed he was no longer interested.
There was no correspondence received regarding this matter.
Mayor McCarthy asked if there was anyone present to speak in favor of Code Amendment No.
99 -64.
Lennie Whittington, 8542 Manatee Street, commended staff for placing regulations on
ambulance services, especially in the H -M (Hospital Medical) zones where there are residential
properties.
Mayor McCarthy asked if there was anyone present to speak in opposition of the Code
Amendment.
David Bowers, 10620 Dolan Avenue, commented on the applicant's decision to withdraw his
application.
There being no one else to speak, it was moved by Council Member Lawrence, seconded by
Council Member McCaughan, and so ordered to close the hearing.

The Ordinance was read by title only. It was moved by Council Member Winningham,
seconded by Council Member McCaughan, and unanimously carried to waiver further reading
and introduce.
Prior to the vote, Council Member Lawrence stated the Planning Commission report
indicates the C -3 zone was discussed and should be included, noting it is not, and was informed
that when a use requires a conditional use permit in the C -2 zone, it is automatically required in
the C -3 zone. She mentioned helping to initiate this change, noting areas where these uses abut
residential properties. She referred to the applicant's decision not to go forward with his request
and felt the integrity of the residential neighborhood is the important issue in this situation.
CONSENT CALENDAR - ITEMS FOR REMOVAL

ORDINANCES
EXTENSION OF SOUTHEAST AREA ANIMAL CONTROL AUTHORITY
( SEAACA) JOINT POWERS AGREEMENT (JPA)
Ms. Yotsuya explained that animal control services in the City are provided by the Southeast
Area Animal Control Authority where Downey is a member agency along with the cities of Bell
Gardens, Montebello, Norwalk, Paramount, Pico Rivera, Santa Fe Springs and South El Monte. Each
city provides an elected official to serve on the Authority Commission, as well as a city staff member
to serve on the Administrative Committee. The .Authority Commission, through the Administrative
Committee, has been working for several years to finalize the design and budgetary considerations for
renovation of the present animal control facility, with the project being undertaken to meet State
Mandates to address the problems of an aging facility and to meet the growing needs of animal control
services in the cities served. Several months ago the Commission authorized extending the JPA to the
year 2020 to accommodate financing requirements for the renovation project and directed staff to
submit amended documents to each member city for approval. The cities of Montebello, Pico Rivera,
and South El Monte approved the extension; Downey and the City of Santa Fe Springs are
considering the extension tonight; and the cities of Norwalk and Paramount will consider the extension
at their next Council Meetings. The current agreement expires June 30, 2007; and the amended
agreement will extend the JPA to June 3 0, 2020. All other terms of contract remain the same.
ORDINANCE NO.

CALIFORNIA, APPROVING AN AMENDMENT TO THE JOINT EXERCISE
OF POWERS AGREEMENT BETWEEN THE CITIES OF BELL GARDENS,
DOWNEY, MONTEBELLO, NORWALK, PARAMOUNT, PICO RIVERA,
SANTA FE SPRINGS AND SOUTH EL MONTE EXTENDING THE TERM
OF THE SOUTHEAST AREA ANIMAL CONTROL AUTHORITY
The Ordinance was read by title only. 1t was moved by Council Member McCaughan,
seconded by Council Member Perkins, and unanimously carried to waive further reading and
introduce.
Council Member Perkins, who serves as Chairman of SEAACA, explained the remodeling
program will be brought back to the Council at a later date for additional financing, noting the
amount, approximately $2.6 million, will be divided among the member cities according to
population. He mentioned other cities serviced by SEAACA under contracts, such as Vernon and
Bellflower, have also been requested to buy into the program and to extend their contracts for
longer periods of time. He explained that part of the need for expanding the facility was brought
about by a bill passed in Sacramento, whereby shelters must keep animals longer, noting the
present SEAACA facility was built a number of years ago and is in need of updating. The
remodeling project has been in progress for about five years and it is hoped ground will be broken
in the Year 2000.
Mr. Caton noted, even though the term is being extended, there is an out position in any
given year, if that were the direction of a future Council.

RESOLUTIONS: None
ORAL COMMUNICATIONS:
Lennie Whittington, 8542 Manatee Street, submitted documents and expressed his complaint
that the public would no longer be able to obtain certified copies of documents from the City Clerk's
Office unless the documents are "official documents" as defined by the City Attorney. He felt this was
a policy change made without Council approval and submitted a list of cities he polled that do provide
certified copies of documents to the public.
David Bowers, 10620 Dolan Avenue, commented on a recent Council action to appoint a sub-
committee to review front yard setback restrictions and urged the subcommittee to take careful
consideration when approaching this issue. He also stated he felt providing certified copies of
documents should be a policy decision.
Mr. Vose advised he became aware the City Clerk had been certifying certain documents,
some of which were not City generated documents, and that he directed her, for the interim period,
not to certify documents, other than official records of the City, and that he would provide additional
direction. He noted the City Charter states the City Clerk shall certify Ordinances and Resolutions,
advising that official documents of the City are different than memorandums or reports not generated
by the City. He indicated he would submit a report to the Council outlining the issue and requesting
direction with respect to a policy.
ADMINISTRATIVE REPORTS
NEIGHBORHOOD PRESERVATION FENCE REPLACEMENT PROGRAM
Mark Galvan, Neighborhood Preservation Officer, explained the program, whereby the
Council is being requested to approve a one -year pilot program to replace dilapidated fences as part of
the neighborhood preservation effort; approve the expenditure of $25,000 of unallocated Community
Development Block Grant Funds (CDBG); authorize staff to initiate an amendment to the CDBG
application; and to set a public hearing for the March 14, 2000, Council Meeting. The fence
replacement program will be implemented in the Golden Park neighborhood, which is single - family
residential with a high ratio of low and very low income households and a large concentration of front
yard fences, many of which are in need of repair or replacement. He felt this would improve the
streetscape in this area and it is hoped the program will be successful and can be expanded in a year or
so to other areas. One hundred and thirty fences were identified in need of improvement or
replacement, with preliminary estimates that cost will be $20 to $30 per linear foot, for heavy gauge
PVC decorative fence with concrete mold strip and rolling gates. A typical property will average
$985, with the cost to be split between the property owner and the City at a 75 -25 percent ratio, with
the City paying the 75 percent, about $740. He narrated slides depicting program guidelines, noting
the program will only replace dilapidated fences and will not place fences where none exist; it will
legalize fence height restrictions, and there will be one contractor who will install fences of one
particular design approved by the City. The owner will be responsible for maintenance of the fence.
He presented before and after shots taken in the City of Paramount, where this program is in effect.
He responded to comments from the Council.

Council Member McCaughan mentioned cities who have taken the direction to expend funds
back into their neighborhoods and felt it was time Downey did the same and this would be a good
start. He stated neighborhood preservation runs a parallel line with decreasing the criminal element in
town and hoped future budget refinements would reflect the City's commitment to neighborhood
preservation.
It was moved by Council Member McCaughan, seconded by Council Member Winningham,
and unanimously carried to approve a one -year pilot Fence Replacement Program to alleviate
blight through the replacement of dilapidated fences as part of the Neighborhood Preservation
effort; approve the expenditure of $25,000 of unallocated Community Development Block
Grant (CDBG) funds for the program; and authorize staff' to initiate an amendment of the
CDBG application, including setting a public hearing for the March 14, 2000, City Council
Meeting.
Council Member McCaughan suggested data be kept as to what the buy -in rate is, the kind of
peripheral effects there are in terms of other neighbors or these property owners improving their
houses, and the reduction in service calls to that particular area.
PARTICIPATION IN CLEAN CITIES PROGRAM
Ms. Yotsuya mentioned Mayor McCarthy requested Council consideration to participate in the
"Clean Cities Program," a voluntary, local -based government/industry partnership sponsored by the
United States Department of Energy (DOE) to help mobilize local stakeholders in the effort to
accelerate the deployment of alternative fuel vehicles and to build alternate fuel vehicle refueling
infrastructure. The Southern California Association of Governments (SCAG) has been designated as a
member of the Clean Cities Program and by approving the Memorandum of Understanding (MOU)
between SCAG and the City, Downey will join a coalition of public and private sector entities who
have pledged to work together to advance the objectives of the 1990 Clean Air Act Amendments and
promote the use of alternative fuels. She reviewed requirements of the MOU, and noted the Clean
Cities designation would make the City eligible to apply for Federal funds designated for such
purposes. The MOU would be for a period of five years, become eligible for renewal and may be
amended or terminated by mutual agreement. If approved, staff will return at a future meeting with a
Resolution for adoption.
Mayor McCarthy urged Council consideration to adopt the MOU and referred to supplemental
information he submitted today. He mentioned other cities participating in the program, noting he
contacted several cities and conveyed the benefits mentioned to him.
Marcie Lamontia, member of Southern California Gas Company's Natural Gas Vehicle Team,
congratulated the City for giving consideration to the Clean Cities Program, and named the seven
clean cities coalitions in Southern California.
Steve Dixon of R. F. Dixon Company, explained his company is working with staff and looks
forward to having their street sweepers run on compressed natural gas for clean air. He has contacted
other fleets in Downey and surrounding cities and R. F. Dixon wants to become one of the first fleets
in the nation. He requested the City to take the lead in becoming a coalition city with SCAG.

Council Member Lawrence asked Mr. Dixon if he received letters of intent from other agencies
and he replied letters were received from the Downey Unified School District, Bellflower Unified
School District, the City of Bellflower, Express Shuttle, Calsan and R. F. Dixon
When asked about the Air Quality Management District (AQMD) ruling, Ms. Yotsuya
explained Rule 1190 will require public and airport fleet operators with 15 or more vehicles to
purchase alternative fuel vehicles when adding or replacing vehicles in an existing fleet or when
creating a new fleet. It is still in the comment stage and has not been approved.
Mr. Alvarez noted if it becomes a regulation, the City will be subject, when replacing any of its
fleet vehicles, to replacing them with alternate fuel vehicles.
Council Member McCaughan inquired if there was a timeline in approving this program.
Mr. Dixon explained he received two weeks notice that all the grant information must be in,
and must be turned in to SCAG by tomorrow and then issued to the Department Of Energy to be
eligible for grants.
It was moved by Mayor McCarthy, seconded by Council Member Perkins, and unanimously
carried to approve the Memorandum of Understanding with Southern California Association of
Governments.
Prior to the vote, Council Member McCaughan noted he was in favor of alternate fuels but felt
several issues should be considered. He inquired about financial impacts.
Mr. Alvarez indicated the City would be financially impacted, if the regulation were adopted,
because the acquisition of alternate fuel vehicles is more expensive than traditional fuel vehicles. He
clarified that the MOU is not binding but Rule 1190 would be.
Council Member McCaughan inquired if other cities have found strings attached to the federal
funds and was informed the City would have to evaluate the grants carefully at the time of application.
Council Member Lawrence noted she was the City's representative to the League of California
Cities' Clean Fuels Committee and has seen new technology and how government and private
businesses were working together to make it happen sooner. While she felt the Clean Cities idea is
good, she was concerned that some things would be mandatory and not voluntary.
Council Member Winningham asked if the MOU can be terminated by mutual agreement and
was informed it did not have to be mutual but by either party.
David Bowers, 10620 Dolan Avenue, concurred with comments and concerns of the Council
and felt the MOU does not lock the City into any contract or alternative fuel source, noting better
technology may come up in the next several years.
Lennie Whittington, 8542 Manatee Street, raised concerns about mandatory compliance if it
becomes law and what it would cost the taxpayers.
Mayor McCarthy responded that the regulation referred to by Mr. Whittington is different than

the MOU before the Council tonight. If the regulation must be faced, the MOU places the City in a
position to receive funds provided by the Federal government.
OTHER BUSINESS - Consent Calendar - Items removed by Council Approval
CASH CONTRACT NO. 618 — LAKEWOOD BOULEVARD WATER
TRANSMISSION MAIN IMPROVEMENTS FROM THE I -5 FREEWAY TO
ROSECRANS AVENUE (ACCOUNT NO. 5148646)
Council Member Winningham inquired as to whether staff foresees any problems with the
Water Replenishment District's $1.8 million grant program and was informed the money has already
been given to the City.
It was moved by Council Member Winningham, seconded by Council Member Lawrence, and
unanimously carried to approve Plans and Specifications and grant authority to advertise for
bids on Cash Contract No. 618 — Lakewood Boulevard Water Transmission Main
Improvements.
ORDINANCE NO. 1075
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE LAKEWOOD/FIRE STONE SPECIFIC PLAN 91 -2 (SP- 91 -2A) AND
DENYING THE APPEAL
Mr. \Nose explained this matter was a noticed public hearing, the public hearing was closed;
and the only issue that can be discussed at this point is whether or not the Ordinance reflects the
direction of the City Council at the last meeting. The substinative issues with respect to the public
hearing cannot be discussed without a new notice of public hearing to afford all property owners the
opportunity to speak.
Frank Weiser, 3460 Wilshire Boulevard, Suite 903, Los Angeles, attorney for the appellant
Arvin Parekh, noted documents he referred to at the public hearing that he would like to place into the
record, which were submitted to the City Clerk. He also commented on remarks made at the hearing
and noted his client has a Fourteenth Amendment Right under the due process clause to not have
government interfere with his business.
Arvin Parekh, 11102 Lakewood Boulevard, submitted additional documents and stated he was
against the plan.

OTHER BUSINESS - Council Members
Council Member Perkins commented on attending the DARE Program at Warren High
School, which was well attended.
Council Member Perkins complimented the "Rumors" play, which was held in the Downey
Theatre last Friday and Saturday nights, and included the City Clerk and Planning Commissioner Gafin
as actors.
Council Member Perkins mentioned attending the grand opening of Heritage Court (senior —
housing project), which he felt would be a great improvement to the downtown area.
Council Member Perkins acknowledged meeting Miss Downey and Miss Teen Downey and
their courts, noting where they attend school and that four of them reside in Council District 2.
Council Member McCaughan thanked the Community Services Department for working on
the concept of bringing middle schools to the gymnasium to play their basketball games indoors.
Council Member McCaughan asked that the shopping cart service be reviewed, since it
appears the contractor is not picking up carts as quickly.
Council Member McCaughan commented on a Police checkpoint held this month in the City,
noting statistics on the number of vehicles impounded, drivers cited for suspended licenses, no proof
of insurance, etc., stating it is a great program and should always be continued.
Council Member Lawrence also noted Building Official Haines acted in the Rumors play and
thanked all staff members who participated in the event.
Council Member Lawrence mentioned a crude incident that occurred at a recent Water
Replenishment District meeting (WRD), in which she was an unwilling participant. She suggested
moving forward focusing on the blatant procedural and administrative problems that exist in the WRD.
Council Member Lawrence commented that Senate Bill 1316, Senator Mountjoy's Bill,
passed out of the Senate Local Government Committee today, which requires more frequent audits
and financial reports of the WRD.
Council Member Winningham complimented the celebration honoring retiring Police Chief
Caldwell.
Council Member Winningham welcomed new Police Chief Finch for stepping in to run the
City's public safety in the new millennium.
Council Member Winningham requested a staff report on Air Quality Management District
Regulation 1190 regarding Alternate Fuel Vehicles with a recommendation on the City's position.
He referred to Mr. Whittington's concern about costs and felt the City should keep a watchful eye on
this Regulation.

Council Member Winningham thanked the City Attorney for responding to the clarification of
official records and looked forward to the forthcoming report.
Mayor McCarthy commented on being quoted in the Whittier Daily News regarding the Water
Replenishment District (WRD) issue. He praised WRD Board Members Leo Van derLans and
Albert Robles for their vote (minority on a 3-2 vote) against the action of the majority of the WRD
Board.
Mayor McCarthy mentioned a letter received by Police Chief Finch from a liquor store owner
commending Officer Boggs for taking the time to stop and make sure everything was okay when he
did not see anyone at the counter.
Mayor McCarthy read correspondence from Southern California Incident Command Team 2 to
Fire Chief Irwin commending Downey's participation in the recent fires in the Arcadia area.
Mayor McCarthy mentioned the Resolution adopted on the Consent Calendar approving the
agreement with the Downey Police Officers' Association for the next three years.

City Manager Caton acknowledged the presence of a Los Angeles Times reporter.
