HomeMy WebLinkAboutResolution No. 12-7372 RESOLUTION NO. 12 -7372 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACTS AND CHANGING THE GENERAL PLAN LAND USE DESIGNATION FROM GENERAL COMMERCIAL TO MEDIUM DENSITY RESIDENTIAL FOR PROPERTY LOCATED AT 8605 GALLATIN ROAD WHEREAS, on April 16, 2012, the applicant submitted an application requesting to construct 46 units on the subject; and q g WHEREAS, a Notice of Intent to adopt a Negative Declaration was recorded with the Los Angeles County Recorder's office on July 25, 2012. Furthermore, the ro osed Negative p p g Declaration was circulated for public comment from July 25, 2012 to August 15, 2012; and WHEREAS, the Planning Commission conducted a duly noticed public hearin g on August 15, 2012, at the conclusion of which the Planning Commission adopted P.C. Resolution No. 12 -2780, thereby recommending the City Council approved the General Plan Amendment; and WHEREAS, on August 30, 2012, notice of the pending public hearing was published in the Downey Patriot and mailed to all property owners within 500' of the subject site; and WHEREAS, the City Council held a duly noticed public hearing on September 11, 2012, and after fully considering all oral and written testimony and facts and opinions offered at the —.6. aforesaid public hearing adopted this resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council finds, determines and declares that after preparing an Initial Study in compliance with the requirements of the California Environmental Quality Act, which found that there would be no significant environmental impacts created by the proposed project, a Negative Declaration was prepared. Based on its own independent judgment that the facts stated in the initial study are true, the City Council herby finds that the approval of the project (PLN-12-OO100) will not have any potential negative environmental impacts. SECTION 2. Having considered all of the oral and written evidence presented to it at said public hearing, the City Council further finds, determines and declares that: 1. The proposed General Plan Amendment is consistent with all other goals, policies, programs, and land uses of applicable elements of the General Plan. The proposed General Plan amendment is to support the construction of 46 units on the site. In an overall review of the General Plan, the proposed 46 unit development (including all related applications) is consistent with all of the policies, programs, and goals. More specifically, it is a goal of the General Plan (1.3) to, "Address changes in land use and zoning trends." The subject site is a former automotive sales, repair, and storage facility. Due to the ongoing fiscal crisis, it is doubtful the City will see the reestablishment of the automotive uses �- on the site. This change in land use trends supports the applicants request to all residential uses on the site, thus making it consistent with the aforementioned goal. Furthermore, it is an objective of the City's Housing Element (Program 5) RESOLUTION NO. 12 -7372 PAGE 2 to increase the overall housing stock within the City. This includes providing sufficient housing to meet the City's share of the Regional Housing Needs Assessment (RHNA). By allowing the change to the Land Use Designation, the propose project will be allowed, thus increasing the housing inventory by 46 units. For these reasons, approval of the General Plan Amendment is consistent with all other goals, policies, programs, and land uses of applicable elements of the General Plan. 2. The proposed General Plan Amendment will not adversely affect surrounding properties or the surrounding environment. The proposed General Plan amendment is to support the construction of 46 units on the site, which will take access from Gallatin Road. Surrounding properties include apartments and various retail uses. As part of the review of the proposed project, an Initial Study of Environmental Impacts was completed, in which it was found the proposed project will not have a significant affect on the environment nor surrounding area. Furthermore, improving the site, which is mostly vacant and covered with ac paving, will serve to improve the aesthetics of the area giving a better environment for the residents on the surrounding properties 3. The proposed General Plan Amendment promotes the public health, safety, and general welfare and serves the goals and purposes of the zoning code. Currently, the subject site is zoned for and improved with a former automotive sales, repair, and storage facility; while the adjoining properties are improved with apartments. By approving the General Plan Amendment the site will be allowed to be rezoned to accommodate residential developments, thus eliminating the incompatible adjoining uses. Furthermore, this project will result in an aesthetically pleasing streetscape (in lieu of the storage of vehicles). This development will promote the public health, safety, and welfare of those who work or reside in the area 4. The proposed General Plan Amendment will not conflict with provisions of the Zoning Code, including the City's subdivision ordinance. According to the Land Use Element of the General Plan, the Medium Density Residential Land Use Designation should be implemented by the R -3 zone. As part of this request, the applicant is proposing to rezone the property to R -3 and combine construct a 46 unit townhouse development. Since the construction is consistent with the R -3 zone approval of the General Plan Amendment will not create a conflict with the Zoning Code.. SECTION 3. The City Council hereby amends the General Plan Land Use Designation of the following properties from General Commercial to Medium Density Residential. Properties: AIN 6363- 001 -021 — 8605 Gallatin Rd; AIN 6363- 001 -028 — 8613 Gallatin Rd; AIN 6363- 001 -029 — No Address Assigned; AIN 6363- 001 -052 — 9207 & 9219 Lakewood Blvd. RESOLUTION NO. 12 -7372 -�-- PAGE 3 SECTION 4.
